KOMISIJOS ĮGYVENDINIMO SPRENDIMAS (ES) 2022/522

kuriuo iš dalies keičiamas Įgyvendinimo sprendimo (ES) 2021/641 dėl neatidėliotinų priemonių, susijusių su labai patogeniško paukščių gripo protrūkiais tam tikrose valstybėse narėse, priedas

EUROPOS KOMISIJA,

atsižvelgdama į Sutartį dėl Europos Sąjungos veikimo,

atsižvelgdama į 2016 m. kovo 9 d. Europos Parlamento ir Tarybos reglamentą (ES) 2016/429 dėl užkrečiamųjų gyvūnų ligų, kuriuo iš dalies keičiami ir panaikinami tam tikri gyvūnų sveikatos srities aktai („Gyvūnų sveikatos teisės aktas“) (1), visų pirma į jo 259 straipsnio 1 dalies c punktą,

kadangi:

labai patogeniškas paukščių gripas (toliau – LPPG) yra užkrečiamoji paukščių liga, kuri gali turėti didelį poveikį paukštininkystės pelningumui ir dėl kurios gali sutrikti Sąjungos vidaus prekyba ir eksportas į trečiąsias šalis. LPPG virusais gali užsikrėsti migruojantys paukščiai, kurie juos gali išplatinti dideliais atstumais rudens ir pavasario migracijos metu. Todėl LPPG virusai laukiniuose paukščiuose kelia nuolatinę tiesioginio ir netiesioginio šių virusų patekimo į ūkius, kuriuose auginami naminiai ar nelaisvėje laikomi paukščiai, grėsmę. Kilus LPPG protrūkiui atsiranda pavojus, kad ligos sukėlėjas gali išplisti į kitus ūkius, kuriuose auginami naminiai ar nelaisvėje laikomi paukščiai;

Reglamentu (ES) 2016/429 nustatyta nauja ligų, kurios perduodamos gyvūnams arba žmonėms, prevencijos ir kontrolės teisės aktų sistema. LPPG patenka į tame reglamente pateiktą į sąrašą įtrauktos ligos apibrėžtį ir jam taikomos tame reglamente nustatytos ligų prevencijos ir kontrolės taisyklės. Be to, Komisijos deleguotuoju reglamentu (ES) 2020/687 (2) dėl tam tikrų į sąrašą įtrauktų ligų prevencijos ir kontrolės taisyklių, įskaitant LPPG atveju taikomas ligos kontrolės priemones, papildomas Reglamentas (ES) 2016/429;

Komisijos įgyvendinimo sprendimas (ES) 2021/641 (3) buvo priimtas pagal Reglamentą (ES) 2016/429 ir jame nustatytos ligos kontrolės priemonės, susijusios su LPPG protrūkiais;

tiksliau Įgyvendinimo sprendime (ES) 2021/641 nustatyta, kad apsaugos ir priežiūros zonos, kurias valstybės narės pagal Deleguotąjį reglamentą (ES) 2020/687 nustatė po LPPG protrūkių, turi apimti bent tas teritorijas, kurios to įgyvendinimo sprendimo priede yra išvardytos kaip apsaugos ir priežiūros zonos;

Įgyvendinimo sprendimo (ES) 2021/641 priedas neseniai iš dalies pakeistas Įgyvendinimo sprendimu (ES) 2022/454 (4) po LPPG protrūkių tarp naminių arba nelaisvėje laikomų paukščių Čekijoje, Vokietijoje, Ispanijoje, Prancūzijoje, Nyderlanduose ir Lenkijoje, į kuriuos reikėjo atsižvelgti tame priede;

po Įgyvendinimo sprendimo (ES) 2022/454 priėmimo dienos Vokietija, Ispanija, Prancūzija, Italija ir Portugalija pranešė Komisijai apie naujus LPPG protrūkius to įgyvendinimo sprendimo priede nurodytų teritorijų ribose arba už tų ribų esančiuose ūkiuose, kuriuose auginami naminiai ar nelaisvėje laikomi paukščiai;

Rumunija taip pat pranešė Komisijai apie vieną H5N1 potipio LPPG protrūkį tos valstybės narės Džurdžu apskrityje esančiame ūkyje, kuriame auginami naminiai ar nelaisvėje laikomi paukščiai;

Vokietijos, Ispanijos, Prancūzijos, Italijos, Portugalijos ir Rumunijos kompetentingos institucijos ėmėsi būtinų ligos kontrolės priemonių, kurių reikalaujama pagal Deleguotąjį reglamentą (ES) 2020/687, be kita ko, aplink šių protrūkių vietas nustatydamos apsaugos ir priežiūros zonas;

be to, protrūkiai Portugalijoje ir Rumunijoje patvirtinti labai netoli nuo sienų su atitinkamai Ispanija ir Bulgarija. Kadangi priežiūros zonų dalis yra atitinkamai Ispanijos ir Bulgarijos teritorijose, tų valstybių narių kompetentingos institucijos deramai bendradarbiavo pagal Deleguotąjį reglamentą (ES) 2020/687 nustatant reikiamas priežiūros zonas;

bendradarbiaudama su Vokietija, Ispanija, Prancūzija, Italija, Portugalija ir Rumunija Komisija išnagrinėjo ligos kontrolės priemones, kurių ėmėsi tos valstybės narės, ir įsitikino, kad susijusių valstybių narių kompetentingų institucijų nustatytų apsaugos ir priežiūros zonų Vokietijoje, Ispanijoje, Prancūzijoje, Italijoje, Portugalijoje ir Rumunijoje, ir priežiūros zonos Bulgarijoje ribos yra pakankamai toli nuo ūkių, kuriuose patvirtinti nauji LPPG protrūkiai;

šiuo metu Įgyvendinimo sprendimo (ES) 2021/641 priede nėra išvardytų Rumunijos apsaugos ir priežiūros zonų ir Bulgarijos priežiūros zonų;

(12)

kad būtų išvengta bet kokių nereikalingų Sąjungos vidaus prekybos sutrikdymų ir trečiųjų šalių sudaromų nepagrįstų prekybos kliūčių, būtina bendradarbiaujant su Vokietija, Ispanija, Prancūzija, Italija, Portugalija ir Rumunija skubiai Sąjungos lygmeniu apibrėžti pagal Deleguotąjį reglamentą (ES) 2020/687 šių valstybių narių nustatytas apsaugos ir priežiūros zonas ir Bulgarijos nustatytą priežiūros zoną;

todėl Įgyvendinimo sprendimo (ES) 2021/641 priede išvardytos Vokietijos, Ispanijos, Prancūzijos, Italijos ir Portugalijos teritorijos turėtų būti iš dalies pakeistos;

be to, į Įgyvendinimo sprendimo (ES) 2021/641 priedą turėtų būti įtrauktos Rumunijos apsaugos ir priežiūros zonos ir Bulgarijos priežiūros zona;

taigi Įgyvendinimo sprendimo (ES) 2021/641 priedas turėtų būti iš dalies pakeistas, kad būtų atnaujintas Sąjungos lygmeniu nustatomas skirstymas į regionus ir atsižvelgta į Vokietijos, Ispanijos, Prancūzijos, Italijos, Portugalijos ir Rumunijos apsaugos ir priežiūros zonas, ir Bulgarijos priežiūros zoną, kurias tų valstybių narių kompetentingos institucijos tinkamai nustatė pagal Deleguotąjį reglamentą (ES) 2020/687, bei jose taikytinų priemonių trukmę;

todėl Įgyvendinimo sprendimas (ES) 2021/641 turėtų būti atitinkamai iš dalies pakeistas;

(17)

atsižvelgiant į tai, kad į epizootinę situaciją Sąjungoje dėl LPPG plitimo reikia reaguoti skubiai, svarbu, kad Įgyvendinimo sprendimo (ES) 2021/641 pakeitimai, kurie turi būti padaryti šiuo sprendimu, įsigaliotų kuo greičiau;

šiame sprendime nustatytos priemonės atitinka Augalų, gyvūnų, maisto ir pašarų nuolatinio komiteto nuomonę,

Der Küstenstraße folgend über Mederns entlang der K87 Richtung Hohenkirchen, in Hohenkirchen über die Bahnhofstraße (L 809) bis Altgarmssiel, Richtung Oesterdeich. Entlang Oesterdeich über Groß und Klein Münchhausen bis zur Kreisgrenze des Landkreises Wittmund.

Die Schutzzone verläuft im südlichen Bereich kommend aus der Gemeinde Wangerland (Landkreis Friesland) vom Berdumer Altendeich in nördliche Richtung bis Enno-Ludwigsgroden. Westlich bis zur B 461, dann in nördliche Richtung, entlang an Neufunnixsiel Richtung Carolinensiel. Vor Carolinensiel im Kreisverkehr der Umgehungsstraße Richtung Harlesiel in dessen Verlauf weiter bis zur Nordsee.

Dem Feldweg folgend bis Wischenstraße. Der Wischenstraße (K 142) in nördlicher Richtung folgend bis zur Straße Rüsseldorf. Dieser folgend bis Scharreler Damm (K 141). Die Überwachungszone beginnt bei Schillighafen entlang der Schafhauser Leide Richtung Schillighörn, dann in südlicher Richtung der Jadestraße (K325) bis Horumersiel. In Horumersiel über die Goldstraße Richtung Wiardergroden über St. Joostergroden in den Feineburger Weg bis Altebrücke. Von dort in südlicher Richtung auf die L 810, vor Hooksiel auf die L 812 über Waddewarden bis Jever, dort auf die B 210. Die B210 in westlicher Richtung folgend bis zur Kreisgrenze Friesland/Wittmund. Der B 210 bis Wittmund folgend auf die B 461, anschließend auf die L10 Richtung Burhafe. Vor Stedesdorf über die Hauptstraße (K6) nach Thunum, weiter entlang der K6 auf Margens (L 6), in nördlicher Richtung bis Neuharlingersiel (Addenhausen) ent-lang dem Badestrand mündend in die Nordsee.

Die Schutzzone befindet sich in der Gemeinde Wangerland und beginnt am nördlichen Küstenstreifen bei Elisabethgroden, in südlicher Richtung entlang der Tengshauser Leide durch Friederikensiel. Der Küstenstraße folgend über Mederns entlang der K87 Richtung Hohenkirchen, in Hohenkirchen über die Bahnhofstraße (L 809) bis Altgarmssiel, Richtung Oesterdeich.
