REGOLAMENTO (UE) 2019/220 DELLA COMMISSIONE
del 6 febbraio 2019
che modifica il regolamento (CE) n. 865/2006 recante modalità di applicazione del regolamento (CE) n. 338/97 del Consiglio relativo alla protezione di specie della flora e della fauna selvatiche mediante il controllo del loro commercio
LA COMMISSIONE EUROPEA,
visto il trattato sul funzionamento dell'Unione europea,
visto il regolamento (CE) n. 338/97 del Consiglio, del 9 dicembre 1996, relativo alla protezione di specie della flora e della fauna selvatiche mediante il controllo del loro commercio (1), in particolare l'articolo 19, paragrafo 4,
considerando quanto segue:

Scopo del regolamento (CE) n. 865/2006 della Commissione (2) è l'attuazione del regolamento (CE) n. 338/97 nel pieno rispetto delle disposizioni della convenzione sul commercio internazionale delle specie di flora e di fauna selvatiche minacciate di estinzione (CITES, di seguito «la convenzione»). |

Nella settima riunione della conferenza delle parti della convenzione sono state decise alcune modifiche della risoluzione Conf. 11.20 (Rev. CoP17) relative al commercio di elefanti e rinoceronti vivi. Nella stessa riunione è stato ristrutturato e aggiornato l'elenco delle opere di riferimento per la nomenclatura allegato alla risoluzione Conf. 12.11 (Rev. CoP17), che serve per indicare i nomi scientifici delle specie nelle licenze e nei certificati. |

Il comitato permanente della convenzione, nella 67a riunione, ha adottato orientamenti riveduti per la presentazione delle relazioni annuali. Gli orientamenti comprendono i codici riveduti che devono essere inclusi nella descrizione degli esemplari e delle unità di misura da usare nelle licenze e nei certificati. |

Le modifiche delle risoluzioni Conf. 11.20 e Conf. 12.11 e la revisione dei codici e delle unità di misura devono essere riportate nel regolamento (CE) n. 865/2006. |

È quindi opportuno modificare di conseguenza il regolamento (CE) n. 865/2006. |

Le misure di cui al presente regolamento sono conformi al parere del comitato per il commercio della flora e della fauna selvatiche, |
HA ADOTTATO IL PRESENTE REGOLAMENTO:
Articolo 1
Il regolamento (CE) n. 865/2006 è così modificato:

È inserito il seguente articolo 5 ter: «Articolo 5 ter Contenuto specifico delle licenze e dei certificati relativi ai rinoceronti vivi e agli elefanti vivi Le licenze e i certificati, rilasciati a norma dell'articolo 4 o dell'articolo 5 del regolamento (CE) n. 338/97, per l'importazione e la riesportazione di rinoceronti vivi o di elefanti vivi provenienti da popolazioni inserite nell'allegato B del suddetto regolamento contengono l'indicazione della condizione che corno e avorio di tali animali e della loro discendenza non possono essere oggetto di scambi né di attività commerciali all'interno dell'Unione. Inoltre, i rinoceronti vivi e gli elefanti vivi provenienti da dette popolazioni non sono oggetto di caccia da trofeo al di fuori delle rispettive aree storiche di distribuzione.»; |

il testo degli allegati VII e VIII è sostituito dal testo figurante nell'allegato del presente regolamento. |
Articolo 2
Il presente regolamento entra in vigore il ventesimo giorno successivo alla pubblicazione nella Gazzetta ufficiale dell'Unione europea.
Il presente regolamento è obbligatorio in tutti i suoi elementi e direttamente applicabile in ciascuno degli Stati membri.
