Introduzione Nel corso degli ultimi cinquant'anni l'UE si è dotata di un considerevole corpus legislativo (il cosiddetto acquis ) per rispondere alle esigenze dei cittadini, delle imprese e dei pubblici poteri. Ha conferito nuovi diritti ai cittadini, ha aperto mercati alle imprese, ha rafforzato i pubblici interessi e ha contribuito in tal modo a incrementare la crescita e il benessere. Tuttavia, la legislazione può anche comportare costi. La sfida consiste nel trovare il giusto equilibrio, anche con il passare del tempo e in circostanze diverse. All'inizio del suo mandato, l'attuale Commissione si è perciò impegnata fermamente a rivedere l' acquis e a garantirne la pertinenza, l'efficacia e la proporzionalità della legislazione in vigore[1]. Insieme con il programma parallelo per la riduzione degli oneri amministrativi, la strategia per la semplificazione del contesto normativo[2] ha definito un programma ambizioso per aggiornare, modernizzare e semplificare il quadro normativo dell'UE. Quattro anni dopo essa può vantare risultati convincenti. Costituita inizialmente da una serie di misure sparse, l'azione di semplificazione si è sviluppata diventando parte integrante di ogni revisione delle politiche in vigore, in tutti i settori. L'analisi dell' acquis , i cui risultati sono pubblicati con la presente relazione, illustra chiaramente quest'evoluzione. Questa terza relazione sullo stato d'avanzamento della strategia per la semplificazione del contesto normativo completa il terzo esame strategico del programma per legiferare meglio nell'Unione europea[3] e il documento di lavoro della Commissione sulla riduzione degli oneri amministrativi. Essa passa in rassegna i notevoli progressi compiuti da quando la strategia è stata adottata, mette in evidenza i principali risultati ottenuti e precisa i settori ai quali si estenderà l'azione di semplificazione in futuro. 2. Situazione attuale Grazie a numerosi meccanismi di consultazione, la Commissione raccoglie ed esamina costantemente i suggerimenti dei cittadini, delle parti interessate e degli Stati membri per rendere la normativa comunitaria più chiara, semplice ed efficace. Sulla base di questi contributi, la Commissione ha elaborato un "programma modulato di semplificazione" che prevedeva inizialmente 100 iniziative di semplificazione per il periodo 2005-2008. Il programma utilizza un insieme di strumenti identificati nella strategia di semplificazione, che comprendono tecniche legislative come l'abrogazione, la codificazione e la rifusione, nonché altri mezzi di modernizzazione dell'acquis, come il maggior ricorso a soluzioni informatiche. Dal 2007 il programma di semplificazione è integrato nel programma legislativo e di lavoro della Commissione. Esso è stato esteso ogni anno con nuove iniziative e copre ora tutti i settori politici. Attualmente contiene 185 iniziative, di cui 132 sono già state adottate dalla Commissione, con un tasso di realizzazione che si aggira attorno all'80% nel 2007 e 2008. Ciò dimostra la determinazione della Commissione a superare tutti gli ostacoli e a fornire tempestivamente i vantaggi di questo esercizio prioritario. Più della metà delle iniziative adottate hanno ora completato il ciclo legislativo e hanno acquisito forza di legge dopo la pubblicazione nella Gazzetta ufficiale. La Commissione ha già proposto la modifica o l'abrogazione di circa 800 atti legislativi nell'ambito del programma di semplificazione 2005-2009. Con la loro adozione l'acquis sarà ridotto di circa 600 atti legislativi, corrispondenti a circa 6500 pagine della Gazzetta ufficiale. Ma la semplificazione va oltre ed è diventata parte integrante della revisione di tutte le politiche. Parallelamente, la Commissione ha anche continuato a codificare l'acquis al fine di renderlo più compatto e leggibile, garantendone la certezza giuridica. Finora ha già completato la codificazione di 229 atti, di cui 142 sono già stati adottati dal colegislatore e hanno sostituito 729 atti precedenti, corrispondenti a circa 1300 pagine della Gazzetta ufficiale. In totale dall'ottobre 2005 la Commissione ha adottato misure che ridurranno l'acquis quasi del 10%, vale a dire circa 1300 atti legislativi e 7800 pagine della Gazzetta ufficiale. 3. risultati Finora 75 delle 132 iniziative di semplificazione sopramenzionate hanno completato il processo legislativo, 36 sotto forma di atti autonomi della Commissione (allegato 4) e 39 sotto forma di atti adottati dal legislatore (allegato 5). I vantaggi di queste e altre misure di semplificazione stanno diventando sempre più tangibili per le imprese, i cittadini e le autorità pubbliche. I seguenti paragrafi presentano una serie di esempi, che illustrano diversi approcci complementari alla semplificazione. 3.1. Un quadro regolamentativo snellito La legislazione prende forma con il tempo, via via che si aggiungono nuovi elementi agli atti giuridici fondamentali. Per far sì che siano compatibili e formino un quadro coerente, la Commissione rivede costantemente la legislazione in vigore, alla ricerca di soluzioni legislative più efficienti ed efficaci. - Il nuovo regolamento generale d'esenzione per categoria permette agli Stati membri di approvare una serie di misure d'aiuto senza notificarle prima alla Commissione e consente un trattamento più rapido dei casi. Il regolamento, destinato a promuovere la creazione di posti di lavoro e la competitività, copre gli aiuti per le PMI, la ricerca, l'innovazione, lo sviluppo regionale, la formazione, l'occupazione e il capitale di rischio. Le imprese possono, ad esempio, beneficiare di aiuti per la ricerca fondamentale (fino al 100%), la ricerca industriale (fino al 50/70%) e per lo sviluppo sperimentale (25/45%). Inoltre, il regolamento armonizza e consolida in un solo testo cinque atti legislativi. - Le nuove regole concernenti i controlli dei pagamenti diretti agli agricoltori offrono un quadro più semplice ed efficace per la selezione del campione di controllo, il calendario dei controlli e le procedure di verifica sul posto[4]. - Il nuovo regolamento relativo alle statistiche strutturali sulle imprese riduce il numero di informazioni richieste e prevede raccolte annuali di dati invece di raccolte effettuate varie volte all'anno. Contemporaneamente è stata introdotta una nuova classificazione statistica delle attività economiche nella Comunità europea. Queste disposizioni dovrebbero portare a una riduzione netta del 17,5% dei dati da dichiarare. - La legislazione quadro nei settori coperti dalle strategie tematiche sull'inquinamento atmosferico e la prevenzione e il riciclaggio dei rifiuti è stata snellita, chiarita e semplificata. La nuova direttiva sulla qualità dell'aria ambiente risulta dalla fusione di 5 direttive distinte e la nuova direttiva quadro sui rifiuti integra le direttive, precedentemente separate, sui rifiuti pericolosi e sugli oli usati. - La nuova direttiva quadro sull'acqua offre un quadro politico coerente e unico per la pianificazione, l'esecuzione e la notifica al fine di proteggere e purificare l'acqua in Europa, e riduce da 18 a 10 il numero di direttive nel settore dell'acqua. - Una nuova direttiva sulla salute e sicurezza sul lavoro semplifica e razionalizza le relazioni degli Stati membri sull'attuazione pratica della direttiva quadro e delle direttive specifiche. D'ora innanzi gli Stati membri saranno tenuti a presentare solo una relazione ogni cinque anni. 3.2. Miglioramento dei metodi di lavoro e semplificazione delle procedure La Commissione promuove attivamente l'utilizzazione più vasta delle TI come mezzo per migliorare le procedure di lavoro. - Il nuovo vocabolario comune per gli appalti pubblici (una descrizione comunitaria tipo dei prodotti) facilita l'identificazione degli appalti pubblici in tutta l'UE, indipendentemente dalla lingua del paese dell'appalto. I moduli utilizzati dalle autorità pubbliche per la pubblicazione degli avvisi nella Gazzetta ufficiale dell'UE sono stati standardizzati e informatizzati, in modo da ridurre il tempo di pubblicazione da 12 a 5 giorni. Entrambi i provvedimenti aumenteranno la trasparenza in materia di appalti pubblici. Sul sito Internet dell'UE Tenders Electronic Daily (TED) appaiono ogni giorno opportunità commerciali del settore pubblico per un valore di più di 1 miliardo di euro. - La semplificazione del codice doganale comunitario mira a modernizzare la legislazione doganale dell'UE e a ridurre l'uso dei documenti cartacei da parte delle autorità doganali e degli operatori commerciali. La registrazione elettronica delle dichiarazioni doganali e dei documenti di accompagnamento diventerà la regola. Gli operatori autorizzati potranno dichiarare le merci elettronicamente e pagare i dazi nello Stato membro in cui hanno sede, indipendentemente dal luogo in cui le merci sono entrate o uscite dal territorio doganale dell'UE o dal luogo di consumo. Quando questo sistema integrato sarà totalmente operativo, dovrebbe comportare vantaggi stimati in circa 2,5 miliardi di euro per gli operatori. - La modifica dell'articolo 55 del regolamento generale per la politica di coesione ha semplificato le regole per i piccoli progetti che generano proventi. La disposizione sulla proporzionalità nel monitoraggio di operazioni di modesta entità (con un costo totale è inferiore a 200 000 euro) è stata sostituita da un'esenzione dall'applicazione di tale articolo alle operazioni cofinanziate dal Fondo sociale europeo e dal Fondo europeo di sviluppo regionale o dal Fondo di coesione quando il loro costo complessivo è inferiore a 1 milione di euro. 3.3. Un mercato interno che funziona bene Il mercato interno è stato e rimane una forza motrice per la semplificazione nell'UE, permettendo la concentrazione di numerose leggi nazionali in un unico atto legislativo. - Le norme comuni per la prestazione dei servizi aerei nella Comunità costituiscono una revisione del cosiddetto "terzo pacchetto" di liberalizzazione del trasporto aereo. Dovrebbero contribuire ad allargare la scelta per i consumatori, ad abbassare le tariffe e ad aumentare la concorrenza. Prescrizioni più severe e una migliore supervisione delle nuove compagnie aeree ridurranno anche il rischio di fallimento e le conseguenze negative per i passeggeri. Il costo medio annuale dei fallimenti per i passeggeri, comprese le spese di rimpatrio e la perdita di prenotazioni, è stimato in circa 15,6 milioni di euro. Una diminuzione del 50% del numero di fallimenti di compagnie aeree aventi fino a due anni di attività permetterebbe ai consumatori di risparmiare in media 2,4 milioni di euro all'anno. - La direttiva riveduta sull'interoperabilità del sistema ferroviario all'interno della Comunità modernizza le regole sulla certificazione dei veicoli. I risparmi realizzati dalle imprese ferroviarie e dai fabbricanti di materiale ferroviario sui costi di certificazione sono stati stimati in 200-280 milioni di euro nei prossimi 15 anni. - Il nuovo regolamento relativo ai livelli massimi dei residui (LMR) di pesticidi negli alimenti e nei mangimi sostituisce circa 500 000 LMR nazionali con 100 000 LMR comunitari e aiuta gli operatori, che non devono più presentare varie domande in diversi Stati membri. - Il " pacchetto IVA " introduce nuove norme per i servizi, in base alle quali i servizi prestati da imprese ad altre imprese saranno tassati nello Stato membro del cliente. Questa disposizione dovrebbe incentivare le imprese a fornire i loro servizi in tutta la Comunità. Il pacchetto comprende anche un minisportello unico per i servizi di telecomunicazione, radiotelevisivi e di commercio elettronico per le imprese con sede nell'UE e una nuova procedura per la richiesta di rimborso dell'IVA per le imprese che non hanno sede nello Stato membro in cui l'IVA è stata applicata. - Nel settore del diritto societario , la direttiva adottata con procedura accelerata nel 2007 sulle fusioni e le scissioni sveltisce le fusioni transfrontaliere, permettendo così alle società per azioni di risparmiare 17 milioni di euro. 4. ALTRI RISULTATI PREVISTI: PROPOSTE IN ATTESA DI ESSERE ESAMINATE E ASPETTI INTERISTITUZIONALI Il numero delle misure di semplificazione adottate dal Consiglio e dal Parlamento europeo è aumentato da 16 nel gennaio 2008 a 39 nel gennaio 2009. Tuttavia, 50 proposte di semplificazione sono ancora in attesa di essere esaminate dal Consiglio e dal Parlamento europeo (allegato 3). È importante che le istituzioni avanzino con l'esame di queste proposte in modo che le imprese, i cittadini e le amministrazioni pubbliche possano beneficiare di maggiori vantaggi. - La nuova direttiva europea sui fondi d'investimento, detti " OICVM " (organismi di investimento collettivo in valori mobiliari), offrirà ai consumatori la possibilità di accedere a prezzi abbordabili a investimenti gestiti con criteri professionali, consentirà ai gestori degli OICVM di sviluppare le loro attività transfrontaliere, di consolidare i risparmi e di realizzare economie di scala, darà agli investitori una maggior scelta di fondi di investimento con minori spese di gestione e proteggerà i piccoli investitori garantendo che ricevano informazioni chiare, facilmente comprensibili e pertinenti quando investono in OICVM. Questa direttiva sostituirà le dieci direttive esistenti con un unico testo. - Varie proposte importanti sono state presentate nel settore del diritto societario allo scopo di semplificare l'esercizio delle attività commerciali nell'UE e realizzare consistenti risparmi. Fra queste misure figurano la proposta di regolamento del Consiglio relativa a uno statuto della società privata europea, la proposta di ridurre gli obblighi di traduzione e di pubblicazione delle società, che comporterebbe un risparmio stimato in 600 milioni di euro, e una proposta sugli obblighi in materia di relazioni e documentazioni in caso di fusioni e scissioni . - Il nuovo regolamento sui cosmetici sostituirà oltre 3500 pagine di testi legislativi. Mantenendo lo stesso livello elevato di norme di sicurezza, la proposta riduce i costi per le imprese almeno del 50%. Le procedure di valutazione della sicurezza dei prodotti sono chiarite e le norme sulla notifica per i prodotti cosmetici sono semplificate. Gli effetti saranno significativi, poiché il mercato europeo dei cosmetici vale 65 miliardi di euro e crea, direttamente e indirettamente, più di 350 000 posti di lavoro. - In campo farmaceutico la revisione dei regolamenti sulle "variazioni" armonizzerà i criteri di valutazione delle variazioni e i termini previsti per l'esame e l'approvazione. I dati disponibili indicano che un'impresa tipica di medicinali generici deve effettuare ogni anno più di 1500 modifiche di medicinali, mentre una grande impresa farmaceutica deve gestirne più di 12 000. La proposta rafforzerà la competitività delle imprese riducendo i problemi logistici, come la necessità di tenere in magazzino diverse versioni dello stesso prodotto per i vari mercati nazionali. Il quadro semplificato aiuterà le imprese, in particolare le PMI, a estendere le attività ad altri mercati dell'UE. - La nuova proposta di " pacchetto per la sicurezza delle automobili " semplificherà l'attuale normativa abrogando 150 direttive sull'omologazione dei veicoli ed introdurrà l'obbligo di munire le autovetture di dispositivi di sicurezza e sistemi di controllo della pressione dei pneumatici, migliorando così nettamente la sicurezza dei veicoli e riducendo le emissioni di CO2. - La direttiva sui diritti dei consumatori contribuirà a far funzionare meglio il mercato interno tra imprese e consumatori riducendo la riluttanza delle aziende nei confronti del commercio transfrontaliero. Diminuirà la frammentazione e semplificherà il quadro normativo esistente abrogando quattro direttive. Questa direttiva migliorerà il quadro normativo e l'adozione di una serie di clausole tipo per i contratti con i consumatori ridurrà sostanzialmente di costi di adeguamento alla normativa. - Il pacchetto di proposte per l'efficienza energetica mira a realizzare un risparmio di energia in settori chiave, ad esempio rafforzando la legislazione relativa all'efficienza energetica applicabile agli edifici e ai prodotti che consumano energia. Il risparmio energetico annuale può facilmente superare, in media, 1000 euro per famiglia. - Nel campo delle statistiche sugli scambi intracomunitari di beni (Intrastat) la soglia di dichiarazione fissata dalla normativa europea esonererà circa 370 000 imprese dall'obbligo di dichiarazione. Ciò rappresenta una riduzione di circa il 52% della popolazione soggetto all'obbligo di dichiarazione in 6 anni (da 720 000 nel 2004 a 350 000 nel 2010). - La proposta concernente l'immissione in commercio e l'utilizzazione degli alimenti per animali favorirà l'innovazione e la competitività delle imprese in questo settore. Il nuovo regolamento comporterà l'abrogazione di sette direttive, portando il numero di pagine da 100 a 30. Anche la dissuasiva procedura di autorizzazione preliminare all'immissione in commercio per determinati prodotti (bioproteine) sarà abolita, non essendo proporzionata al rischio. Per dare un'idea di cosa ciò significhi in termini di riduzione dei costi, il costo totale per l'industria di un'autorizzazione di una nuova bioproteina è stimato in 481 000 euro. - La proposta di rifusione della direttiva relativa alla prevenzione e riduzione integrata dell'inquinamento (IPPC) mira alla rifusione di 7 direttive sulle emissioni industriali in un unico strumento legislativo. Saranno soppresse le parti obsolete delle direttive esistenti, semplificate le prescrizioni relative ai permessi di emissione, ridotte le dichiarazioni a cui sono tenuti gli operatori e sveltite le dichiarazioni degli Stati membri. Questa proposta permetterà una notevole riduzione dei costi amministrativi, stimata in 32 milioni di euro all'anno, e comporterà inoltre una riduzione ancora più significativa, dell'ordine di 150-300 milioni di euro all'anno, degli oneri amministrativi negli Stati membri, a livello nazionale e regionale. - Il " pacchetto GSM " ha lo scopo di aprire le bande di frequenza di 900 e 1800 MHz (frequenze GSM) per utilizzazioni più innovative. Eliminerà la regolamentazione restrittiva che non riflette più lo sviluppo tecnologico e ostacola l'ampia utilizzazione dei servizi mobili a banda larga. - La valutazione dello "stato di salute" della politica agricola comune condurrà a una semplificazione del regime di pagamento unico . In particolare, essa comporta l'abbandono di due sistemi paralleli di sostegno accoppiato e disaccoppiato e il passaggio a un maggiore disaccoppiamento. Si prevede che questo porterà a una riduzione di 0,63 milioni di euro dell'onere amministrativo per gli agricoltori solo nel Regno Unito. La semplificazione elimina anche l'obbligo del ritiro del 10% dei terreni agricoli dalla produzione. Gli agricoltori possono utilizzare tutte le loro terre e non sono più tenuti a seguire le relative procedure e gli Stati membri non devono più controllare l'applicazione di questa misura. Per dare un'idea dei vantaggi, questa semplificazione dovrebbe portare a una riduzione di 4,4 milioni di euro dei costi amministrativi per gli agricoltori nella sola Inghilterra[5]; - Tutte le disposizioni relative al controllo delle attività della pesca saranno riunite nello stesso quadro normativo, con particolare enfasi su un maggiore utilizzo delle tecnologie moderne e di collegamenti con basi di dati. - La riforma del " pacchetto telecom " porterà a una netta diminuzione dei costi amministrativi per l'industria riducendo il numero dei mercati soggetti a una regolamentazione ex ante della concorrenza, semplificando le procedure di vigilanza dei mercati, istituendo un organismo europeo di regolamentazione e riformando la gestione dello spettro. I servizi e le infrastrutture per le comunicazioni elettroniche costituiscono le basi dell'economia nel suo insieme e i miglioramenti in questo settore avranno ripercussioni positive sul resto dell'UE. - La proposta di migliorare l'attuazione dei programmi di politica regionale mira a facilitare la gestione finanziaria e ad accelerare lo stanziamento delle risorse finanziarie comunitarie necessarie a favore dei progetti e programmi operativi. In particolare, la Commissione ha proposto che le spese generali dei progetti siano rimborsate su base forfettaria e che gli aiuti di Stato versati come anticipo ai beneficiari possano essere rimborsati completamente agli enti pubblici dall'UE. Questi cambiamenti saranno di particolare aiuto per le PMI. ; - La modernizzazione del coordinamento dei regimi nazionali di sicurezza sociale faciliterà la libera circolazione dei lavoratori e dei loro familiari nell'UE. Andrà a vantaggio anche dei 173 milioni di titolari della tessera europea di assicurazione malattia, che possono avere accesso all'assistenza sanitaria di uno Stato membro in cui soggiornano temporaneamente, come i cittadini di tale Stato. Il numero delle proposte in attesa di essere esaminate dal Consiglio e dal Parlamento europeo è in aumento. È quindi essenziale esaminare i mezzi per accelerarne l'adozione e impegnarsi per raggiungere un accordo, se possibile, in prima lettura nel processo di codecisione. La Commissione accoglie con favore l'intenzione del Parlamento europeo di istituire strutture specifiche per incoraggiare la semplificazione, come dichiarato nella relazione Medina Ortega recentemente adottata. Il Parlamento europeo ha confermato il suo auspicio che la Commissione utilizzi la rifusione come tecnica legislativa ordinaria, anche quando è proposta la "revisione" dei testi in vigore. È importante tuttavia che il Consiglio e il Parlamento europeo si allineino ai principi e allo spirito dell'esercizio di semplificazione, facendo sì che le proposte adottate siano il più possibile semplici e accelerando il processo decisionale in modo che le imprese, i cittadini e le amministrazioni pubbliche possano beneficiare delle nuove disposizioni. 5. Codificazione Oltre a semplificare la legislazione, la Commissione la codifica, combinando l'atto di base con tutte le successive modifiche in un unico testo. Ciò rende gli atti legislativi più chiari e riduce il volume dell' acquis comunitario. Finora la Commissione ha completato in totale 229 atti di codificazione, di cui 142 sono stati adottati e pubblicati nella Gazzetta ufficiale (102 atti della Commissione e 40 atti del Parlamento europeo e del Consiglio). Questi 142 atti codificati sostituiscono 729 atti precedenti, corrispondenti a circa 1300 pagine della Gazzetta ufficiale. 87 atti sono ancora in attesa di essere sottoposti all'esame del Consiglio e del Parlamento europeo. L'arretrato nella traduzione verso le nuove lingue della legislazione da codificare è stato in gran parte colmato. Il resto delle proposte per il completamento del programma di codificazione, riveduto nel 2006, sarà presentato nel 2009 con una relazione contenente i risultati del programma nel suo insieme. 21 nuovi testi legislativi sono stati selezionati in vista della loro codificazione nel 2009 (allegato 6). 6. Le prossime tappe 6.1. Iniziative in preparazione per il 2009 La Commissione ha incluso 33 iniziative di semplificazione nel suo programma legislativo e di lavoro per il 2009[6] (allegato 7). Ad esempio: - la revisione della direttiva 2000/35/CE relativa alla lotta contro i ritardi di pagamento nelle transazioni commerciali , che scoraggerà le autorità pubbliche e le imprese dal ritardare i pagamenti ai fornitori e incoraggerà i creditori a chiedere un indennizzo in caso di ritardo di pagamento. Questa iniziativa fa parte dello "Small Business Act" per l'Europa e del piano europeo di ripresa economica; - la semplificazione della normativa comunitaria sui trattori agricoli e forestali, che sostituisce 24 direttive con un regolamento; - la modifica e la modernizzazione del regolamento (CE) n. 44/2001 per adattarlo ai nuovi strumenti internazionali e garantire il riconoscimento e l'esecuzione delle sentenze straniere in materia civile e commerciale , con la soppressione delle tappe intermedie attraverso cui devono passare i cittadini (exequatur) affinché una decisione giudiziaria sia riconosciuta ed eseguita all'estero; - la riforma dell' organizzazione comune dei mercati nel settore della pesca e dell'acquacoltura , che si concentra su attività di pesca e di commercializzazione sostenibili. Essa consiste nell'adeguamento all'evoluzione del mercato, nel rafforzamento della coerenza con altri elementi della politica comune della pesca e delle politiche comunitarie attinenti (commercio, salute e protezione dei consumatori, ambiente) e promuoverà un maggiore utilizzo dei mezzi elettronici. Inoltre, la Commissione continua a lavorare con gli Stati membri per cercare altre possibilità di semplificare la normativa sulla politica di coesione e ridurre l'onere amministrativo per i beneficiari. 6.2. Analisi dell ' acquis e future attività di semplificazione Come annunciato nel secondo esame strategico del programma per legiferare meglio nell'Unione europea, la Commissione ha svolto un'analisi approfondita dell' acquis . Come primo passo è stato eseguito un esame sistematico dell' acquis per individuare i più importanti strumenti normativi. In seguito a quest'esame sono stati selezionati 3.600 atti. Questi atti sono stati oggetto di un'analisi più dettagliata per determinare se erano aggiornati o se era opportuna una semplificazione. La serie completa dei risultati per settore politico sarà pubblicata sul sito dedicato alla semplificazione del portale Europa[7] per offrire una chiara visione degli sforzi compiuti finora dalla Commissione in materia di semplificazione. I risultati dell'analisi mostrano in quale misura: - la semplificazione è già stata realizzata; - la semplificazione è programmata per il 2009; - vi sono possibilità di semplificazione durante il mandato della prossima Commissione; oppure - non sono previste misure di semplificazione, vale a dire il testo è chiaro, aggiornato e proporzionato agli obiettivi politici. In certi casi le modifiche della legislazione potrebbero offrire vantaggi, che sarebbero però inferiori rispetto ai costi e agli oneri per le imprese e le amministrazioni pubbliche, in particolare in termini di recepimento. Il quadro che ne emerge dimostra progressi significativi. Circa due terzi degli atti, che riguardano principalmente l'agricoltura, il mercato interno, i trasporti, le imprese, la sanità e l'ambiente, sono stati semplificati nel quadro del programma modulato di semplificazione, del programma di codificazione o di altre iniziative della Commissione, oppure sono stati inclusi nelle proposte di semplificazione previste per il 2009 (allegato 2). Questa valutazione prepara anche il terreno per altre attività di semplificazione. Esaminando gli atti in vigore nel loro contesto settoriale, la Commissione procede verso la semplificazione con un approccio integrato. Altre 81 azioni (allegato 1) potrebbero essere incluse nelle future iniziative di semplificazione. Ad esempio: - l'allineamento di 15 direttive di armonizzazione tecnica alla decisione che stabilisce un quadro comune per la commercializzazione dei prodotti . Questa decisione definisce elementi comunemente utilizzati nella legislazione di armonizzazione tecnica in un formato standardizzato, che dovrebbe essere introdotto nella legislazione futura. L'obiettivo è garantire una maggiore coerenza dell'ambiente giuridico e creare una "cultura" legislativa comune. Ciò migliorerà la qualità della nostra legislazione e ridurrà gli oneri amministrativi; - la semplificazione delle norme di attuazione della politica agricola comune , in seguito all'adozione della valutazione dello "stato di salute" relativamente al meccanismo di gestione degli interventi; - la revisione della legislazione sulle minacce per la salute (malattie trasmissibili e minacce chimiche, biologiche e radio nucleari) e la salute e il benessere degli animali e i mangimi . - un'ulteriore riduzione degli oneri nel campo delle statistiche grazie al programma di modernizzazione delle statistiche europee sulle imprese e sugli scambi MEETS ( Modernisation of European Enterprise and Trade Statistics ). Questo programma migliorerà i metodi di raccolta dei dati negli Stati membri con un maggior ricorso a dati amministrativi e contabili e migliori metodi di campionamento nonché con un utilizzo migliore e più intensivo delle fonti disponibili. 7. CONCLUSIONI Dopo il lancio della strategia per la semplificazione del quadro normativo, avvenuto nel 2005, la semplificazione ha assunto un ruolo importante nei lavori della Commissione. Mediante una serie di attività coordinate, la Commissione ha istituito un quadro d'azione politico e pratico che offre vantaggi tangibili a cittadini, imprese e amministrazioni pubbliche. Al fine di rendere la legislazione più chiara e comprensibile, essa ha proposto di eliminare dal corpus legislativo comunitario circa 1300 atti, il 10% dell' acquis . La semplificazione è un processo continuo. Il quadro ottenuto con l'analisi dell' acquis prepara il terreno per i lavori futuri. Un programma che è iniziato con un numero limitato di iniziative sparse copre ora tutti i settori politici ed è realizzato sempre più con un approccio settoriale. Ciò significa che si esamina tutta la legislazione che concerne un dato settore politico per individuare sovrapposizioni, incoerenze e oneri regolamentativi eccessivi. L'obiettivo è valutare l'efficacia globale del quadro normativo, settore per settore. Per far avanzare il programma di semplificazione, la Commissione avrà bisogno del sostegno politico delle altre istituzione dell'UE e degli Stati membri. Il Parlamento europeo e il Consiglio sono invitati ad adoperarsi per adottare al più presto le proposte in sospeso e a preservare le disposizioni di semplificazione nel corso del processo decisionale. Gli Stati membri sono invitati a proseguire i loro programmi di semplificazione e ad applicare la legislazione comunitaria con uno spirito di semplificazione, senza aggiungere misure inutili. In Europa i cittadini e le imprese sono confrontati quotidianamente con un complesso di disposizioni legislative comunitarie, nazionali e regionali. Solo grazie a uno sforzo coordinato di semplificazione a tutti questi livelli il quadro normativo risponderà nel miglior modo possibile al suo scopo: salvaguardare la crescita e il benessere riducendo gli oneri al minimo necessario. The objective of this initiative is to integrate into a single legislative instrument the provisions on the protection of the health and safety of workers from the risks of musculo-skeletal disorders at work. These provisions are currently fragmented over different directives, namely Council Directive 90/269/EEC and Council Directive 90/270/EEC. It will benefit employers in terms of legal clarity and workers in terms of providing better protection against the risks of musculo-skeletal disorders. | 13. | Revision of Directive 2000/35 of the European Parliament and Council on combating late payment in commercial transactions | Revision | Several key provisions of the current Directive are unclear or difficult to implement, thereby creating various hurdles for businesses to claim their rights in case of late payment. The overall objective is to discourage debtors from paying late and to provide creditors with measures that enable them to fully exercise all their rights when paid late. The simplification would entail a clarification of the calculation of the applicable interest rate, a better description of the nature and extent of “retention of title”, a new definition of the types of commercial transactions covered by the Directive and a clearer definition of “relevant recovery costs” to include internal administrative costs linked to late payment. | 14. | Regulation relating to the type-approval of agricultural and forestry vehicles | Recast | The proposal will simplify EC legislation on agricultural and forestry tractors by replacing existing legislation (including the present Framework Directive and the separate Directives) by one main Regulation. The proposal aims at taking account of market developments, changes in fishing activities and the shortcomings detected in the implementation of the provisions currently in force. | 22. | Commission implementation rules on the reformed control and enforcement framework | Revision | The new rules will modernize and simplify procedures for national administrations and stakeholders and will facilitate better enforcement. Administrative burden and constraints for the sector and public administrations are to be alleviated, with an increased use of IT tools to reduce reporting obligations. All aspects related to control and monitoring of fisheries activities (declaration of catches, tolerance margins, landing declarations, transport, localisation of the fleet, etc.) will be simplified. Also new elements to address the challenges of Illegal, Unreported and Unregulated (IUU) fishing will be included. | 23. | Commission Communication on formal recognition of obsolescence and four proposals repealing obsolete legal instruments in the field of the Common Fisheries Policy | Repeal | Screening of the body of Community law relating to the Common Fisheries Policy (CFP) within the context of the "2006-2008 Action Plan for simplifying and improving the CFP" revealed that a number of Acts of Community law have exhausted their legal effects, though they have not been formally repealed or have no indication of a time limit as to their validity. It is also necessary to bring the existing directive into line with the "New Approach" rules on the free movement of goods which is in the final stages of formal adoption, in line with the new legislative framework for the marketing of products. | 31. | Recast of First Railway Package legislation: simplification and modernisation of the legislative framework for access to the rail transport market | Recast | In order to simplify the legislation, the three Directives will be merged and restructured while eliminating cross-references across the legal acts. This will lead to improved readability and hence enable better and harmonised implementation in MSs thus potentially reducing administrative burdens. Furthermore, other legal provisions, in particular institutional arrangements, such as strengthening of the powers of regulatory bodies and a strengthened cooperation of rail infrastructure managers for international services, will be enhanced to promote the emergence of a genuine internal market and to eliminate barriers to the provisions of international rail transport services. Overall by enhancing the legal and institutional framework the Commission hopes to see market access cost of railway undertakings being reduced. | 32. | Marine Equipment Directive | Recast | Directive 96/98/EC has been technically amended three times since its adoption and a further two technical amendments are currently under preparation (respectively concerning the committee procedure and the technical annexes). Furthermore, the new legislative framework for the marketing of products will have a direct impact on a number of basic elements (notified bodies, market surveillance, and safeguard clause). Lastly, the current system of periodical technical updates is in need of an in-depth revision in order to keep pace with the legislative production of the International Maritime Organisation. It is intended to recast or to repeal the existing Directive and replace it with a new one. | 33. | Recast of the Community regulatory framework regarding transport of radioactive material | Recast | At Community level there are currently more than 30 directives, regulations and recommendations governing the transport of radioactive material. There are also non-binding international rules. Inconsistent transposition of these rules means that there is an unnecessary degree of complexity causing practical problems on the ground in Member States, including increased costs and delays.
