i cui Stati sono parti contraenti del trattato che istituisce la Comunità europea del carbone e dell'acciaio e del trattato che istituisce la Comunità europea, e

IL CONSIGLIO DELL'UNIONE EUROPEA E LA COMMISSIONE DELLE COMUNITÀ EUROPEE,

da una parte, e

I CAPI DEGLI STATI ACP,

i cui Stati sono, qui di seguito, denominati «Stati ACP»,

dall'altra,

VISTA la quarta convenzione ACP-CE, firmata a Lomé il 15 dicembre 1989, (in prosieguo denominata «la convenzione»), in particolare l'articolo 358,

CONSIDERANDO che la Repubblica d'Austria, la Repubblica di Finlandia e il Regno di Svezia hanno aderito all'Unione europea il 1° gennaio 1995;

CONSIDERANDO che è pertanto opportuno adeguare in tal senso la convenzione e stabilire le misure transitorie da applicare agli scambi tra i nuovi Stati membri e gli Stati ACP;

CONSIDERANDO che si è deciso di limitare la portata di dette misure al periodo di validità della convenzione;

HANNO DECISO di concludere il presente protocollo e a tal fine hanno designato come plenipotenziari:

I CAPI DEGLI STATI ACP:

I QUALI, avendo scambiato i loro pieni poteri, riconosciuti in buona e debita forma,

HANNO CONVENUTO QUANTO SEGUE:

Articolo 1

La Repubblica d'Austria, la Repubblica di Finlandia e il Regno di Svezia diventano parti contraenti della convenzione e delle dichiarazioni allegate all'atto finale firmato a Lomé il 15 dicembre 1989.

Articolo 2

I testi della convenzione compresi i protocolli e gli allegati che ne costituiscono parte integrante, le dichiarazioni allegate all'atto finale e l'accordo che modifica la convenzione, redatti in finnico e in svedese, fanno fede alle stesse condizioni dei testi originali.

Articolo 3

La Repubblica d'Austria è autorizzata a mantenere, fino al 1° gennaio 1996, i dazi doganali e le disposizioni in materia di licenze che applicava, alla data dell'adesione, alle bevande alcoliche e all'alcole etilico non denaturato con titolo alcolometrico volumico inferiore a 80 % vol di cui alla voce 2208 del SA. Dette disposizioni in materia di licenze devono essere applicate senza discriminazioni.

Articolo 4

I cittadini e le società o imprese (a norma dell'articolo 274, paragrafo 2 della convenzione) dell'Austria, della Finlandia e della Svezia e le forniture originarie di detti Stati non possono partecipare né alle gare d'appalto né alle successive commesse indette esclusivamente dai Fondi europei di sviluppo (FES) a cui gli Stati di detti cittadini o società non hanno contribuito.

Articolo 5

Il presente protocollo è parte integrante della convenzione.

Articolo 6

Il presente protocollo è approvato dalle parti contraenti secondo le rispettive procedure. Esso entra in vigore il primo giorno del secondo mese successivo alla data in cui gli strumenti di rettifica o di conclusioni delle parti contraenti sono stati depositari presso il segretariato generale del Consiglio dell'Unione europea.

Articolo 7

Il presente protocollo è redatto, in duplice esemplare, in lingua danese, finnica, francese, greca, inglese, italiana, olandese, portoghese, spagnola, svedese e tedesca, ciascun testo facente ugualmente fede.
