[pic] | COMMISSIONE DELLE COMUNITÀ EUROPEE | Bruxelles, 27.9.2005 COM(2005) 462 definitivo COMUNICAZIONE DELLA COMMISSIONE AL CONSIGLIO E AL PARLAMENTO EUROPEO Esito dello screening delle proposte legislative pendenti dinnanzi al legislatore COMUNICAZIONE DELLA COMMISSIONE AL CONSIGLIO E AL PARLAMENTO EUROPEO Esito dello screening delle proposte legislative pendenti dinnanzi al legislatore Come annunciato nella sua comunicazione del 16 marzo 2005 intitolata “Una migliore regolamentazione per la crescita e l’occupazione nell’Unione europea”[1] la Commissione ha deciso di introdurre una svolta nella sua strategia volta a garantire che la qualità legislativa in Europa promuova gli obiettivi della partnership per la crescita e l’occupazione. Se vogliamo rafforzare la concorrenzialità dell’Europa, dobbiamo portare il contesto normativo nell’Unione europea al livello più alto possibile. Per raggiungere questo obiettivo dovremo semplificare, ove necessario, e aggiornare il cosiddetto “acquis communautaire”, il corpus legislativo esistente. A tal fine è prevista una serie di misure, tra cui in particolare il lancio di una nuova fase del programma di semplificazione nell’ottobre 2005. La Commissione ha inoltre deciso che l’obiettivo di una migliore regolamentazione dovrà essere integrato nella progettazione delle politiche, e che le nuove proposte legislative presentate dalla Commissione dovranno cercare di promuovere una migliore regolamentazione e contribuire alla concorrenzialità. In particolare tale esigenza viene attuata tramite l’obbligo di sottoporre le nuove iniziative legislative a una valutazione d’impatto, come annunciato nel programma legislativo e di lavoro 2005 della Commissione, per il quale sono stati recentemente adottati degli ampi e particolareggiati orientamenti[2]. Per quanto riguarda le proposte presentate dalla Commissione in passato e ancora pendenti nel processo legislativo, la comunicazione dello scorso ottobre menziona l’intenzione della Commissione di “esaminare le proposte al vaglio del Consiglio o del Parlamento per quanto riguarda la loro pertinenza generale, il loro impatto sulla concorrenzialità e altri effetti.” Gli obiettivi, la procedura e gli esiti di tale processo di screening, il primo di questo tipo, sono presentati nella presente comunicazione. 1. Obiettivi dello screening delle proposte pendenti L’esercizio di screening mirava a mettere le Commissione in grado di assicurare che tutte le proposte legislative pendenti siano pienamente coerenti con le priorità politiche della Commissione stessa e di verificare se eventuali nuove circostanze giustifichino una revisione dell’approccio inizialmente adottato. Nei casi in cui si è ritenuta necessaria una revisione, l’esercizio di screening ha inoltre individuato le misure che sarà necessario adottare (modifiche, sostituzioni o ritiro di proposte pendenti, miglioramento della valutazione d’impatto). Più specificatamente, l’esercizio di screening mirava a vagliare le proposte pendenti sotto tre punti di vista: In primo luogo, le proposte pendenti sono state vagliate alla luce della loro coerenza con gli obiettivi di Lisbona dell’UE, e segnatamente con l’obiettivo di promuovere la concorrenzialità. I criteri adottati per valutare le proposte sotto questo profilo sono quelli specificati nel ‘test di concorrenzialità’ di cui nei recentemente rielaborati orientamenti per la valutazione d’impatto[3]. In secondo luogo, le proposte pendenti sono state analizzate per appurare l’eventuale assenza di progressi di rilievo nel processo legislativo per un determinato periodo di tempo. In questi casi sono state analizzati anche i motivi di tale stagnazione e le possibilità di sbloccare la situazione. In terzo luogo, le proposte pendenti sono state analizzate per appurare se sono in linea con gli attuali requisiti relativi al miglioramento della regolamentazione, segnatamente in funzione di adeguate valutazioni d’impatto. Questo criterio riguarda in particolare le proposte presentate quando le valutazioni d’impatto non erano ancora un requisito formale. 2. Processo dell’esercizio di screening Al momento del lancio dell’esercizio di screening nell’aprile 2005, il numero totale di proposte pendenti era di 489[4]. Il campo d’applicazione dell’esercizio definito nella comunicazione del marzo scorso era esplicitamente limitato alle proposte pendenti la cui data è anteriore al 1° gennaio 2004. Si tratta di un totale di 183 proposte. Queste ultime sono state sottoposte a un’attenta valutazione, al cui termine sono state individuate 100 proposte che rappresentano iniziative legislative autenticamente nuove, le quali sono state poi ulteriormente valutate ai fini di accertare eventuali effetti negativi sulla concorrrenzialità o conseguenze economiche di più ampio raggio. Il resto è costituito da proposte il cui probabile impatto sulla concorrrenzialità è scarso o nullo. Si tratta in massima parte di proposte derivanti da obblighi internazionali o rappresentanti adeguamenti dell’acquis al progresso tecnico o scientifico. Alcune di tali proposte contribuiscono inoltre direttamente al miglioramento della regolamentazione, giacché codificano o semplificano l’acquis. 3. Esiti del processo di screening Sulla base di un’analisi particolareggiata di tutte le proposte pendenti, la Commissione prevede due principali tipi di azione: (1) Proposte da ritirare. La Commissione intende ritirare un totale di 68 proposte. Si tratta di proposte giudicate incoerenti con gli obiettivi di Lisbona o con i principi relativi al miglioramento della regolamentazione, o di proposte che non rappresentano progressi di rilievo nel processo legislativo o non sono più pertinenti[5] (ad esempio se gli obiettivi sono già in corso di raggiungimento attraverso altri mezzi o verranno raggiunti attraverso altri mezzi). Alcune di tali proposte potrebbero essere rivalutate alla luce di un’ulteriore analisi. In alcuni casi la Commissione intende procedere a una rivalutazione della necessità di un intervento legislativo alla luce dei risultati di una nuova valutazione d’impatto generalizzata. (2) Proposte da mantenere nel processo legislativo, a condizione di sottoporre un’analisi economica alla valutazione dell’autorità legislativa[6]. Si tratta di 5 proposte della cui importanza la Commissione rimane comunque convinta, ma per le quali la presentazione dell’analisi d’impatto supplementare agevolerà probabilmente il processo decisionale da parte dell’autorità legislativa. In seguito allo screening da parte della Commissione saranno dunque 73 proposte le pendenti soggette a una determinata forma di intervento. Di questo elenco fanno parte le proposte che non corrispondono pienamente agli obiettivi della concorrenzialità, quelle che necessitano di un’ulteriore analisi economica da sottoporre alla valutazione del legislatore e infine quelle che non rappresentano progressi di rilievo nel processo legislativo o sono divenute obsolete. In particolare i ritiri rappresentano circa il 31%[7] di tutte le proposte pendenti precedentemente al 1° gennaio 2004. Il totale degli interventi, comprese le proposte che dovranno essere sottoposte a un’approfondita analisi economica, rappresentano attualmente il 33%[8] di tali proposte pendenti. Per almeno due delle proposte l’esercizio di screening ha peraltro prodotto risultati che non rientrano in nessuna delle suddette categorie. In primo luogo, per quanto riguarda la proposta di direttiva del Consiglio sulle norme minime di sicurezza e di salute relative all’esposizione dei lavoratori ai rischi derivanti dagli agenti fisici – radiazioni ottiche, 1992/0449/COD, per la quale l’esercizio di screening ha portato la Commissione a concludere che gli aspetti relativi all’esposizione dei lavoratori alle radiazioni ottiche naturali dovrebbero essere eliminati, in linea con quanto proposto dal Parlamento europeo. In secondo luogo, per quanto riguarda la proposta relativa al lavoro temporaneo (2002/0072/COD), la Commissione si riserva il diritto di riesaminare la proposta alla luce delle future discussioni in merito ad altre proposte. L’allegato della presente comunicazione riassume la situazione è descrive dettagliatamente le proposte in questione. Conclusione Il processo di screening delle proposte pendenti è il primo processo globale di questo tipo a essere realizzato dalla Commissione, a dimostrazione del suo impegno riguardo alla partnership per la crescita e per l’occupazione nonché all’applicazione dei principi relativi al miglioramento della regolamentazione. I provevdimenti derivanti dal processo di screening, ovvero gli interventi previsti nei confronti delle proposte pendenti e illustrati in allegato, sono stati ideati per favorire il conseguimento degli obiettivi di Lisbona, incoraggiando la concorrenzialità, per creare un migliore quadro legislativo e per eliminare le proposte che non hanno grandi possibilità di essere adottate o sono divenute obsolete. In alcuni casi l’eliminazione delle proposte pendenti farà parte di un lavoro di revisione politica globale, o mirerà al riesame delle proposte alla luce di nuovi elementi politici e di una valutazione d’impatto generalizzata. Conformemente agli impegni assunti nell'accordo quadro sulle relazioni tra il Parlamento europeo e la Commissione (paragrafo 32), con la presente comunicazione la Commissione informa il Parlamento europeo ed il Consiglio prima di procedere al ritiro delle proprie proposte. [3] Cfr. nota 2 [4] In effetti ogni anno la Commissione affronta un volume di circa 200/250 proposte derivanti dagli obblighi internazionali dell’UE, dalla necessità di aggiornare l’“acquis communautaire” e/o di adempiere agli impegni presi con il legislatore. [5] La Commissione ha svolto dei regolari esercizi di ritiro finalizzati a ridurre il numero di proposte pendenti. 34 proposte sono state ritirate nel 1997, 58 nel 1999, 108 nel 2001 e 102 nel 2004. [6] Gas fluorurati, spedizioni di rifiuti, firma della convenzione sui beni mobili d'equipaggiamento degli aereomobili, IVA agenti di viaggio, cooperazione amministrativa in materia di IVA, usi finali dell’energia e servizi energetici.
