az egyes tagállamokban a magas patogenitású madárinfluenza kitörésével kapcsolatos védintézkedésekről szóló (EU) 2017/247 végrehajtási határozat mellékletének módosításáról

tekintettel az Európai Unió működéséről szóló szerződésre,

tekintettel a belső piac megvalósításának céljával a Közösségen belüli kereskedelemben alkalmazható állategészségügyi ellenőrzésekről szóló, 1989. december 11-i 89/662/EGK tanácsi irányelvre (1) és különösen annak 9. cikke (4) bekezdésére,

tekintettel az egyes élőállatok és állati termékek Közösségen belüli kereskedelmében a belső piac megvalósításának céljával alkalmazandó állategészségügyi és tenyésztéstechnikai ellenőrzésekről szóló, 1990. június 26-i 90/425/EGK tanácsi irányelvre (2) és különösen annak 10. cikke (4) bekezdésére,

mivel:

Az (EU) 2017/247 bizottsági végrehajtási határozatot (3) a Bizottság azt követően fogadta el, hogy több tagállamban (a továbbiakban: „érintett tagállamok”) a H5 altípusba tartozó, magas patogenitású madárinfluenza kitörését észlelték, és az érintett tagállamok illetékes hatóságai a 2005/94/EK tanácsi irányelv (4) 16. cikkének (1) bekezdésében előírtaknak megfelelően védő- és megfigyelési körzeteket hoztak létre.

Az (EU) 2017/247 végrehajtási határozat úgy rendelkezik, hogy az érintett tagállamok illetékes hatóságai által a 2005/94/EK irányelvnek megfelelően kialakított védő- és megfigyelési körzeteknek magukban kell foglalniuk legalább a szóban forgó végrehajtási határozat mellékletében védő- és megfigyelési körzetekként felsorolt területeket. Az (EU) 2017/247 végrehajtási határozat azt is előírja, hogy a védő- és megfigyelési körzetekben a 2005/94/EK irányelv 29. cikkének (1) bekezdése, illetve 31. cikke alapján alkalmazandó intézkedéseket legalább az említett végrehajtási határozat mellékletében a szóban forgó körzetekre vonatkozóan meghatározott időpontokig fenn kell tartani.

Elfogadása óta az (EU) 2017/247 végrehajtási határozat módosítására több alkalommal is sor került annak érdekében, hogy a madárinfluenzát illetően tükrözze az uniós járványügyi helyzet alakulását. Többek között az (EU) 2017/696 bizottsági végrehajtási határozat (5) is módosította az (EU) 2017/247 végrehajtási határozatot, a naposcsibe-szállítmányoknak az (EU) 2017/247 végrehajtási határozat mellékletében szereplő területekről való szállítására vonatkozó szabályok megállapítása érdekében. Ez a módosítás figyelembe vette, hogy az egyéb baromfiárukhoz viszonyítva a naposcsibék igen alacsony kockázatot jelentenek a magas patogenitású madárinfluenza terjedése szempontjából.

Az (EU) 2017/247 végrehajtási határozatot később az (EU) 2017/1841 bizottsági végrehajtási határozat (6) is módosította, és rendelkezett a magas patogenitású madárinfluenza terjedésének fokozott veszélye esetén az alkalmazandó járványvédelmi intézkedések megerősítéséről. A módosítás nyomán az (EU) 2017/247 végrehajtási határozat immár arról rendelkezik, hogy a magas patogenitású madárinfluenza kitörését vagy kitöréseit követően a 2005/94/EK irányelv 16. cikke (4) bekezdésének megfelelően az érintett tagállamokban további, korlátozás alattálló körzeteket kell uniós szinten meghatározni, és megállapítja az utóbbiakban alkalmazandó intézkedések időtartamát. Az (EU) 2017/247 végrehajtási határozat most már az élő baromfi, a naposcsibe és a keltetőtojás szállítmányainak a további, korlátozás alatt álló körzetekből más tagállamokba történő, bizonyos feltételek melletti szállításával kapcsolatban is szabályokat határoz meg.

Ezenfelül az (EU) 2017/247 végrehajtási határozat mellékletének módosítására is több alkalommal sor került annak érdekében, hogy tükrözze az érintett tagállamok által a 2005/94/EK irányelv értelmében létrehozott védő- és megfigyelési körzetek határait érintő változásokat. Az (EU) 2017/247 végrehajtási határozat mellékletét legutóbb az (EU) 2017/1969 bizottsági végrehajtási határozat (7) módosította, miután Olaszország és Bulgária arról értesítették a Bizottságot, hogy Lombardia és Veneto tartományban, illetve Haszkovo megyében a magas patogenitású madárinfluenza kitöréseit észlelték. Olaszország és Bulgária arról is értesítették a Bizottságot, hogy a 2005/94/EK irányelvnek megfelelően a fertőzött baromfitartó gazdaságok körül védő- és megfigyelési körzeteket hoztak létre.

Az (EU) 2017/247 végrehajtási határozat legutóbbi, az (EU) 2017/1969 végrehajtási határozat általi módosítása óta Olaszország a H5N8 altípusba tartozó, magas patogenitású madárinfluenza újabb, Lombardia tartomány egyes baromfitartó gazdaságaiban észlelt kitöréseiről értesítette a Bizottságot. Olaszország arról is értesítette a Bizottságot, hogy a közelmúltbeli madárinfluenza-kitöréseket követően meghozta a 2005/94/EK irányelvben előírt szükséges intézkedéseket, beleértve az összes fertőzött baromfitartó gazdaság körüli védő- és megfigyelési körzetek létrehozását.

A Bizottság megvizsgálta azokat az intézkedéseket, amelyeket Olaszország a magas patogenitású madárinfluenzának a területén való közelmúltbeli kitöréseit követően a 2005/94/EK irányelvnek megfelelően meghozott, és meggyőződött arról, hogy az Olaszország illetékes hatóságai által létrehozott védő- és megfigyelési körzetek határai elegendő távolságra vannak azoktól a gazdaságoktól, amelyekben a H5N8 altípusba tartozó, magas patogenitású madárinfluenza kitörését megállapították.

Az Unión belüli kereskedelem szükségtelen megzavarásának megelőzése, valamint a harmadik országok által felállított indokolatlan kereskedelmi akadályok elkerülése érdekében minél hamarabb meg kell határozni uniós szinten, Olaszországgal együttműködve a magas patogenitású madárinfluenza közelmúltbeli olaszországi kitöréseit követően a 2005/94/EK irányelvnek megfelelően e tagállamban létrehozott védő- és megfigyelési körzeteket. Ezért az (EU) 2017/247 végrehajtási határozat mellékletében az Olaszországra vonatkozó bejegyzést naprakésszé kell tenni, az e tagállamban a szóban forgó betegséggel kapcsolatban fennálló legújabb epidemiológiai helyzet figyelembevétele érdekében. Az (EU) 2017/247 végrehajtási határozat mellékletében szereplő jegyzékeket új bejegyzésekkel kell kiegészíteni Olaszország esetében Lombardia tartománynak a jelenleg a 2005/94/EK irányelvnek megfelelően korlátozások alatt álló egyes területeire vonatkozóan.

Az uniós szintű regionalizáció aktualizálásának érdekében az (EU) 2017/247 végrehajtási határozat mellékletét indokolt ennek megfelelően úgy módosítani, hogy az tartalmazza a magas patogenitású madárinfluenza közelmúltbeli olaszországi kitöréseit követően a 2005/94/EK irányelvnek megfelelően a szóban forgó tagállamban létrehozott védő- és megfigyelési körzeteket és az azokban alkalmazandó korlátozások időbeli hatályát.

(10)	Az (EU) 2017/247 végrehajtási határozatot ezért ennek megfelelően módosítani kell.

(11)	Az e határozatban előírt intézkedések összhangban vannak a Növények, Állatok, Élelmiszerek és Takarmányok Állandó Bizottságának véleményével,
