(2025. január 24.)
az egyes tagállamokban a magas patogenitású madárinfluenza kitörésével kapcsolatban alkalmazandó vészhelyzeti intézkedésekről szóló (EU) 2023/2447 végrehajtási határozat mellékletének módosításáról

AZ EURÓPAI BIZOTTSÁG,
tekintettel az Európai Unió működéséről szóló szerződésre,
tekintettel a fertőző állatbetegségekről és egyes állategészségügyi jogi aktusok módosításáról és hatályon kívül helyezéséről szóló, 2016. március 9-i (EU) 2016/429 európai parlamenti és tanácsi rendeletre („Állategészségügyi rendelet”) (1) és különösen annak 259. cikke (1) bekezdése c) pontjára,
mivel:

A magas patogenitású madárinfluenza a madarak fertőző vírusos betegsége, amely jelentősen csökkentheti a baromfitartás jövedelmezőségét, zavart okozva az Unión belüli kereskedelemben és a harmadik országokba irányuló kivitelben. A magas patogenitású madárinfluenza vírusai megfertőzhetik a vándormadarakat, amelyek azután őszi és tavaszi vonulásuk során nagy távolságokat megtéve továbbterjeszthetik ezeket a vírusokat. A magas patogenitású madárinfluenza vírusainak vadon élő madarakban való előfordulása tehát folyamatosan magában hordozza azt a veszélyt, hogy a vírusok közvetlen vagy közvetett úton eljutnak a baromfit vagy fogságban tartott madarakat tartó gazdaságokba. A magas patogenitású madárinfluenza kitörésekor fennáll az a veszély, hogy a kórokozó más – baromfit vagy fogságban tartott madarakat tartó – gazdaságokra is átterjed. |

Az (EU) 2016/429 rendelet jogszabályi keretet hoz létre az állatra vagy emberre átvihető betegségek megelőzéséhez és leküzdéséhez. A magas patogenitású madárinfluenza az említett rendelet szerinti jegyzékbe foglalt betegség fogalommeghatározása alá és az ott megállapított betegségmegelőzési és járványvédelmi szabályok hatálya alá tartozik. Emellett az (EU) 2020/687 felhatalmazáson alapuló bizottsági rendelet (2) kiegészíti az (EU) 2016/429 rendeletet a bizonyos jegyzékbe foglalt betegségek megelőzésére és az e betegségekkel szembeni védekezésre vonatkozó szabályok – köztük a magas patogenitású madárinfluenzára vonatkozó járványvédelmi intézkedések – tekintetében. |

2023. október 24-én a Bizottság az (EU) 2016/429 rendelet alapján elfogadta az (EU) 2023/2447 bizottsági végrehajtási határozatot (3), amely a magas patogenitású madárinfluenza kitöréseivel kapcsolatos uniós szintű vészhelyzeti intézkedéseket állapít meg. |

Az (EU) 2023/2447 végrehajtási határozat úgy rendelkezik, hogy a magas patogenitású madárinfluenza megjelenését követően az érintett tagállamok által az (EU) 2020/687 felhatalmazáson alapuló rendeletnek megfelelően kialakítandó védő-, felügyeleti és további, korlátozás alatt álló körzeteknek legalább a szóban forgó végrehajtási határozat mellékletében védő-, felügyeleti és további, korlátozás alatt álló körzetekként felsorolt területeket magukban kell foglalniuk. |

Az (EU) 2023/2447 végrehajtási határozat mellékletét a közelmúltban az (EU) 2025/124 bizottsági végrehajtási határozat (4) módosította azt követően, hogy Németországban, Olaszországban, Magyarországon és Lengyelországban a magas patogenitású madárinfluenza további előfordulásait észlelték baromfitartó létesítményekben, amit az említett mellékletnek tükröznie kell. |

Az (EU) 2025/124 végrehajtási határozat elfogadását követően Olaszország, Lengyelország és Portugália arról értesítették a Bizottságot, hogy az olaszországi Lombardia és Veneto régióban, a lengyelországi Varmia–Mazúria (Warmińsko-Mazurskie) és Lengyel-Kárpátalja (Podkarpackie voivodships) vajdaságban, valamint a portugáliai lisszaboni kerületben baromfit, illetve fogságban tartott madarakat tartó létesítményekben a magas patogenitású madárinfluenza további kitöréseit észlelték. |

Olaszország, Lengyelország és Portugália meghozták az (EU) 2020/687 felhatalmazáson alapuló rendeletben előírt szükséges járványvédelmi intézkedéseket, beleértve a kitörések körüli védő- és felügyeleti körzetek létrehozását. |
|
(8) |
A Bizottság megvizsgálta az Olaszország, Lengyelország és Portugália által hozott járványvédelmi intézkedéseket, és meggyőződött arról, hogy az említett tagállamok által létrehozott védő- és felügyeleti körzetek határai elegendő távolságra vannak azoktól a létesítménytől, amelyekben megerősítésre került a magas patogenitású madárinfluenza kitörése. |

Az Unión belüli kereskedelem szükségtelen megzavarásának megelőzése, valamint a harmadik országok által felállított indokolatlan kereskedelmi akadályok elkerülése érdekében – az (EU) 2020/687 felhatalmazáson alapuló rendelettel összhangban – az Olaszország, Lengyelország és Portugália által létrehozott védő- és felügyeleti körzetek mielőbbi, a szóban forgó tagállamokkal együttműködésben való, uniós szinten történő meghatározására van szükség. |

Ezért az (EU) 2023/2447 végrehajtási határozat mellékletében módosítani kell az Olaszország, Lengyelország és Portugália tekintetében felsorolt védő- és felügyeleti körzeteket. |
|
(11) |
Ennek megfelelően az (EU) 2023/2447 végrehajtási határozat mellékletét módosítani kell az uniós szintű régiókba sorolás aktualizálása, az Olaszország, Lengyelország és Portugália által az (EU) 2020/687 felhatalmazáson alapuló rendeletnek megfelelően kialakított védő- és felügyeleti körzetek figyelembevétele, valamint az azokban alkalmazandó intézkedések időbeli hatályának meghatározása érdekében. |

Az (EU) 2023/2447 végrehajtási határozatot ezért ennek megfelelően módosítani kell. |
|
(13) |
Tekintettel a magas patogenitású madárinfluenza terjedésével kapcsolatos uniós járványügyi helyzet sürgősségére, fontos, hogy az (EU) 2023/2447 végrehajtási határozat e határozattal való módosítása a lehető leghamarabb hatályba lépjen. |
|
(14) |
Az e határozatban előírt intézkedések összhangban vannak a Növények, Állatok, Élelmiszerek és Takarmányok Állandó Bizottságának véleményével, |
ELFOGADTA EZT A HATÁROZATOT:
1. cikk
Az (EU) 2023/2447 végrehajtási határozat mellékletének helyébe e határozat mellékletének szövege lép.
2. cikk
Ennek a határozatnak a tagállamok a címzettjei.
