a 64/432/EGK, 90/539/EGK, 92/35/EGK, 92/119/EGK, 93/53/EGK, 95/70/EK, 2000/75/EK, 2001/89/EK, 2002/60/EK tanácsi irányelvnek és a 2001/618/EK bizottsági határozatnak a nemzeti referencialaboratóriumok és az állami intézetek jegyzékei tekintetében történő módosításáról

AZ EURÓPAI KÖZÖSSÉGEK BIZOTTSÁGA,
tekintettel az Európai Közösséget létrehozó szerződésre,
tekintettel a szarvasmarhafélék és a sertések Közösségen belüli kereskedelmét érintő állat-egészségügyi problémákról szóló, 1964. június 26-i 64/432/EGK tanácsi irányelvre (1) és különösen annak 8. cikkére, 9. cikke (2) bekezdésére, 10. cikke (2) bekezdésére és 16. cikke (1) bekezdésének második albekezdésére,
tekintettel a baromfi és a keltetőtojás Közösségen belüli kereskedelmére és harmadik országból történő behozatalára irányadó állat-egészségügyi feltételekről szóló, 1990. október 15-i 90/539/EGK tanácsi irányelvre (2) és különösen annak 34. cikkére,
tekintettel az afrikai lópestis elleni küzdelemre irányuló ellenőrzési szabályok és intézkedések meghatározásáról szóló, 1992. április 29-i 92/35/EGK tanácsi irányelvre (3) és különösen annak 18. cikkére,
tekintettel az egyes állatbetegségek elleni védekezésre irányuló általános közösségi intézkedések, valamint a sertések hólyagos betegségére vonatkozó külön intézkedések bevezetéséről szóló, 1992. december 17-i 92/119/EGK tanácsi irányelvre (4) és különösen annak 24. cikke (2) bekezdésére,
tekintettel az egyes halbetegségek elleni védekezés céljából közösségi minimumintézkedések bevezetéséről szóló, 1993. június 24-i 93/53/EGK tanácsi irányelvre (5) és különösen annak 18. cikke második bekezdésére,
tekintettel a kéthéjú kagylókat érintő egyes betegségek elleni védekezés céljából közösségi minimumintézkedések bevezetéséről szóló, 1995. december 22-i 95/70/EK tanácsi irányelvre (6) és különösen annak 9. cikke második bekezdésére,
tekintettel a kéknyelv betegség elleni védekezésre és felszámolására vonatkozó külön rendelkezések megállapításáról szóló, 2000. november 20-i 2000/75/EK tanácsi irányelvre (7) és különösen annak 19. cikke második bekezdésére,
tekintettel a klasszikus sertéspestis elleni védekezésre irányuló közösségi intézkedésekről szóló, 2001. október 23-i 2001/89/EK tanácsi irányelvre (8) és különösen annak 25. cikke (2) bekezdésére,
tekintettel az afrikai sertéspestis elleni védekezésre vonatkozó külön rendelkezések megállapításáról, valamint a fertőző sertésbénulás (Teschen-betegség) és az afrikai sertéspestis tekintetében a 92/199/EK irányelv módosításáról szóló, 2002. június 27-i 2002/60/EK tanácsi irányelvre (9) és különösen annak 26. cikke (1) bekezdésére,
mivel:

A 64/432/EGK irányelv meghatározza a tuberkulinok és reagensek hivatalos teszteléséért felelős állami intézetek és nemzeti referencialaboratóriumok jegyzékét, a szarvasmarhák brucellózisával foglalkozó nemzeti referencialaboratóriumok jegyzékét, a laboratórium standard munkaantigénjének a koppenhágai állami állategészségügyi szérum-laboratórium (State Veterinary Serum Laboratory) által biztosított hivatalos EGK-szabványszérummal (EI szérum) szembeni hitelesítéséért felelős hivatalos intézetek jegyzékét, a szarvasmarhák enzootikus leukózisára vonatkozóan.

A 90/539/EGK irányelv előírja a tagállamok számára olyan nemzeti referencialaboratóriumok kijelölését, amelyek a diagnosztikai módszerek összehangolásáért és a módszerek engedélyezett laboratóriumok általi alkalmazásáért felelősek. A nemzeti referencialaboratóriumok felsorolását a szóban forgó irányelv tartalmazza.

A 92/35/EGK irányelv előírja a tagállamok számára olyan nemzeti referencialaboratóriumok kijelölését, amelyek a diagnosztikai módszerek összehangolásáért és a módszerek engedélyezett laboratóriumok általi alkalmazásáért felelősek. A nemzeti referencialaboratóriumok felsorolását a szóban forgó irányelv tartalmazza.

A 92/119/EGK irányelv előírja a tagállamok számára a nemzeti laboratóriumok kijelölését a szóban forgó irányelvben említett összes betegség esetében. A sertések hólyagos betegségét vizsgáló nemzeti laboratóriumok jegyzékét a szóban forgó irányelv tartalmazza.

A 93/53/EGK irányelv előírja a tagállamok számára a nemzeti referencialaboratóriumok kijelölését a szóban forgó irányelvben említett összes betegség esetében. A halbetegségek nemzeti referencialaboratóriumainak jegyzékét a szóban forgó irányelv tartalmazza.

A 95/70/EK irányelv előírja a tagállamok számára a mintavételért és vizsgálatokért felelős nemzeti referencialaboratóriumok kijelölését. A kéthéjú kagylók betegségeit vizsgáló nemzeti referencialaboratóriumok jegyzékét a szóban forgó irányelv tartalmazza.

A 2000/75/EK irányelv előírja a tagállamok számára a laboratóriumi vizsgálatok végzéséért felelős nemzeti laboratóriumok kijelölését. A nemzeti laboratóriumok felsorolását a szóban forgó irányelv tartalmazza.

A 2001/89/EK irányelv előírja a tagállamok számára annak biztosítását, hogy kijelölésre kerüljön a diagnosztikai szabványok és módszerek koordinációjáért felelős nemzeti laboratórium. A nemzeti laboratóriumok felsorolását a szóban forgó irányelv tartalmazza.

A 2002/60/EK irányelv előírja a tagállamok számára annak biztosítását, hogy kijelölésre kerüljön a diagnosztikai szabványok és módszerek koordinációjáért felelős nemzeti laboratórium. A nemzeti laboratóriumok felsorolását a szóban forgó irányelv tartalmazza.

Az Aujeszky-féle betegségre vonatkozó, a sertések Közösségen belüli kereskedelmében alkalmazandó kiegészítő garanciákról, a betegséggel kapcsolatos információnyújtással szemben támasztott kritériumokról, valamint a 93/24/EGK és a 93/244/EKG határozat hatályon kívül helyezéséről szóló, 2001. július 23-i 2001/618/EK bizottsági határozat (10) létrehozza az egyes tagállamokban az ELISA-próba minőségének ellenőrzéséért, valamint különösen a nemzeti referenciaszérumok közösségi referenciaszérumok alapján történő előállításáért és standardizálásáért felelős intézmények jegyzékét. A jegyzéket a szóban forgó határozat tartalmazza.

Szinte valamennyi tagállam illetékes hatósága kérte a több irányelvben és határozatban is felsorolt nemzeti referencialaboratóriumokra vonatkozó adatok frissítését. Ezen kívül helyénvaló az említett jogi aktusokban szereplő nemzeti referencialaboratóriumok és állami intézetek ISO-kódos betűrend szerinti felsorolása valamennyi tagállam esetében.

A közösségi jogszabályok egyértelműsége és következetessége érdekében helyénvaló felváltani az említett irányelvekben és határozatban szereplő jegyzékeket újabbakkal.

A 64/432/EGK, 90/539/EGK, 92/35/EGK, 92/119/EGK, 93/53/EGK, 95/70/EK, 2000/75/EK, 2001/89/EK, 2002/60/EK irányelvet és a 2001/618/EK határozatot ezért ennek megfelelően módosítani kell.

Az e határozatban előírt intézkedések összhangban vannak az Élelmiszerlánc- és Állat-egészségügyi Állandó Bizottság véleményével,
|
ELFOGADTA EZT A HATÁROZATOT:
1. cikk
A 64/432/EGK, 90/539/EGK, 92/35/EGK, 92/119/EGK, 93/53/EGK, 95/70/EK, 2000/75/EK, 2001/89/EK, 2002/60/EK irányelvet és a 2001/618/EK határozatot e határozat mellékletének megfelelően módosítják.
2. cikk
Ezt a határozatot az Európai Unió Hivatalos Lapjában való kihirdetését követő harmadik naptól kell alkalmazni.
3. cikk
Ennek a határozatnak a tagállamok a címzettjei.

A próbához felhasználandó antigénnek a szarvasmarha-leukózis vírus glikoproteinjeit kell tartalmaznia. Az antigént a koppenhágai dán élelmiszer- és állategészségügyi kutatóintézet (Danish Institute for Food and Veterinary Research) által biztosított szabványszérummal (EI szérum) szemben kell szabványosítani.
