Form of order sought

a declaration that, by failing to adopt all the laws, regulations and administrative provisions necessary to comply with Directive 2006/21/EC (1) of the European Parliament and of the Council of 15 March 2006 on the management of waste from extractive industries and amending Directive 2004/35/EC (2) or, in any event, by failing to notify those provisions to the Commission, the Kingdom of Spain has failed to fulfil its obligations under that directive;

an order that the Kingdom of Spain should pay the costs.

Pleas in law and main arguments

The period prescribed for transposition of Directive 2006/21/EC into domestic law expired on 30 April 2008.
