Prior notification of a concentration

(Case COMP/M.4742 — Oxbow/SSM)

On 10 July 2007, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1), by which the undertaking Oxbow Carbon & Minerals LLC (‘OCM’), a part of Oxbow Group (‘Oxbow’, US) acquires, within the meaning of Article 3(1) (b) of the Council Regulation, sole control of the undertaking SSM Coal B.V. (‘SSM’, Netherlands) by way of purchase of shares.

The business activities of the undertakings concerned are:

for Oxbow: the mining, production, and marketing and distribution of a range of solid fuel and other carbon-related products, including coal, calcined coke and petroleum coke;

for SSM: the sourcing, shipping, marketing and distribution of a range of solid fuel and other carbon-related products, including coal and petroleum coke.

On preliminary examination, the Commission finds that the notified concentration could fall within the scope of Regulation (EEC) No 139/2004. However, the final decision on this point is reserved.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.
