Newcastle United Football Company Ltd, on the interpretation of Article 59 of the EC Treaty (now, after amendment, Article 49 EC),THE COURT,,
after considering the written observations submitted on behalf of:
having regard to the national court's reply to a request for clarification pursuant to Article 104(5) of the Rules of Procedure, received at the Court on 26 February 2002,having regard to the Report for the Hearing,
after hearing the oral observations of Bacardi-Martini SAS and Cellier des Dauphins, represented by N. Green and M. Hoskins; the United Kingdom Government, represented by G. Amodeo and K. Beal; the French Government, represented by R. Loosli-Surrans; and the Commission, represented by H. van Lier, acting as Agent, at the hearing on 14 May 2002,
after hearing the Opinion of the Advocate General at the sitting on 26 September 2002,
