    Maximum aid intensity:

    1.   Investment in farms for primary production:

    up to 50 % of eligible costs in less-favoured areas,

    up to 40 % of eligible costs in other areas,

    up to 60 % of eligible costs in less-favoured areas and up to 50 % of eligible costs in other areas, where the investment is made by young farmers within five years of setting up.

    The purpose of the aid is to invest in the restoration of farm features, to purchase equipment to be used for agricultural production, to invest in permanent crops and in farmland improvement and pasture management.

    2.   Conservation of traditional landscapes and buildings:

    up to 100 % of actual costs as regards investment in non-productive features,

    up to 60 % of actual costs, or 75 % in less-favoured areas, as regards investment in productive assets on farms, provided that the investment does not entail any increase in the production capacity of the farm,

    additional aid may be granted at a rate of up to 100 % to cover the extra costs incurred by using traditional materials necessary to maintain the heritage features of buildings.

    3.   Aid towards the payment of insurance premiums:

    the amount of municipal support is the difference between the amount of co-financing of insurance premiums from the national budget up to 50 % of eligible costs of insurance premiums for insuring crops and fruit and insuring livestock against disease.

    4.   Aid for land reparcelling:

    up to 100 % of eligible legal and administrative costs.

    5.   Provision of technical support in the agricultural sector:

    up to 100 % of the eligible costs concerning the education and training of farmers, consultancy services, the organisation of forums, competitions, exhibitions and fairs, publications, catalogues and websites and replacement services,

    the aid is to be granted in the form of subsidised services and must not involve direct payments of money to producers

    Maximum aid intensity: Article 6 of Regulation (EC) No 1857/2006 as regards land-dependent agricultural undertakings (arable farming, open-air and glasshouse horticulture, arboriculture, cattle farming, and chicken and poultry farming, where the farms' yield depends predominantly on the production potential of undeveloped land in their immediate vicinity).

    A condition for granting a subsidy is that the entire holding being left (premises, buildings and land belonging to the farm) should become available for the purposes of achieving public objectives (reducing environmental impact, nature conservation, spatial structure improvements). Compensation is based on the representative market value

    Date of implementation: Implementation will start after publication in the Official Journal of the European Union, as set out in Article 18(1) of Regulation (EC) No 1857/2006

    Duration of scheme or individual aid award: Until 31 December 2013

    Objective: Relocation in the public interest of farm buildings belonging to land-dependent agricultural undertakings with good future prospects (arable farming, open-air and glasshouse horticulture, arboriculture, cattle farming, and chicken and poultry farming, where the farms' yield depends predominantly on the production potential of undeveloped land in their immediate vicinity), where the farmland is needed in order to achieve public objectives as regards:

    Natura 2000 sites, other parts of the protected areas network and strong corridor links,

    changes to water management arrangements, including those resulting from transposition of the Water Framework Directive (WFD),

    improving farm structure through the reparcelling of plots.

    Agricultural undertakings sell their premises and all related farmland at the ‘old’ location to the Land Management Service (Bureau Beheer Landbouwgronden — BBL) or to a regional authority for the price they would fetch on the open market (representative market value) and buy new premises and farmland to continue farming operations elsewhere. Eligible costs are as follows:

    legal fees,

    land registry fees,

    costs of specialist services (advice from estate agents, accountants, architects, etc.) for the purposes of relocation only,

    removal expenses.

    the representative market value of the ‘new’ farm premises and buildings; and

    (b)

    any investments for setting up, modernising, replacing and/or extending the ‘new’ farm buildings

    Other information: Sheets 125 and 216 of the 2007-2013 Rural Development Programme refer to the possibility of subsidising the relocation of businesses. The current measure, based on the exemption Regulation (Regulation (EC) No 1857/2006), provides scope for subsidising relocations in the public interest that goes beyond the possibilities mentioned in the sheet as regards reducing ammonia emissions and deposits and restoring irrigation systems. The policy objectives are set out in the Living Countryside Agenda and the multiannual programmes of the respective provinces.

    Subsidies may not be granted under the relocation scheme for land-dependent agricultural undertakings if they are being granted for (part of) the same undertaking under the relocation scheme for intensive agricultural undertakings (XA 62/05), and vice versa

    3.   Provision of technical support:

    up to 100 % of costs concerning education and training, consultancy services provided by third parties, the organisation of forums, competitions, exhibitions and fairs, publications and websites. The aid is to be granted in the form of subsidised services and must not involve direct payments of money to producers

    The support is to be granted for the modernization of agricultural holdings, the purchase of equipment and the management of pastures for primary agricultural production.

    2.   Aid for conserving traditional landscapes and buildings:

    up to 60 % of eligible costs in other areas, and up to 75 % in less-favoured areas,

    additional aid may be granted at a rate of up to 100 % to cover the extra costs incurred by using traditional materials necessary to maintain the heritage features of buildings.

    3.   Relocation of farm buildings in the public interest:

    up to 100 % of eligible costs where the relocation simply consists of the dismantling, removal and re-erection of existing facilities,

    where the relocation results in the farmer benefiting from more modern facilities, the farmer must contribute at least 60 %, or 50 % in less-favoured areas, of the increase in the value of the facilities concerned after relocation. If the beneficiary is a young farmer, this contribution is to be at least 55 % or 45 % respectively,

    where the relocation results in an increase in production capacity, the contribution from the beneficiary must be at least 60 %, or 50 % in less-favoured areas, of the expenses relating to this increase. If the beneficiary is a young farmer, this contribution is to be at least 55 % or 45 % respectively.

    4.   Aid towards the payment of insurance premiums:

    the amount of municipal co-financing is the difference between the amount of co-financing of insurance premiums from the national budget and up to 50 % of eligible costs of insurance premiums for insuring crops and fruit and for insuring livestock against disease.

    5.   Aid for land reparcelling:

    up to 100 % of actual legal and administrative costs incurred.

    6.   Aid to encourage the production of quality agricultural products:

    up to 100 % of actual costs incurred or of activities, insofar as they relate to improving the quality of agricultural products. The aid is to be granted in the form of subsidised services and must not involve direct payments of money to producers.

    7.   Provision of technical support in the agricultural sector:

    up to 100 % of costs concerning farmers' education and training, consultancy services, the organisation of forums, competitions, exhibitions, fairs, publications, catalogues and websites, the dissemination of scientific knowledge and the replacement of a farmer and a farmer's partner during illness and leave. The aid is to be granted in the form of subsidised services and must not involve direct payments of money to producers
