Ag féachaint don Chonradh ar Fheidhmiú an Aontais Eorpaigh,
Ag féachaint do Threoir 2011/16/AE ón gComhairle an 15 Feabhra 2011 maidir le comhar riaracháin i réimse an chánachais agus lena n-aisghairtear Treoir 77/779/CEE (1), agus go háirithe Airteagal 20(4) di,
De bharr an mhéid seo a leanas:

Leasaíodh Treoir 2011/16/AE le Treoir (AE) 2021/514 (2) chun feabhas a chur ar na forálacha a bhaineann le gach cineál malartuithe faisnéise agus comhair riaracháin trí fhoráil a dhéanamh maidir le huathmhalartú faisnéise sainordaitheach arna tuairisciú ag Oibreoirí Ardán. |

Ba cheart, dá bhrí sin, Rialachán Cur Chun Feidhme (AE) 2015/2378 ón gCoimisiún (3) a oiriúnú do na leasuithe sin. Ba cheart an t-uathmhalartú faisnéise de bhun Airteagal 8ac(2) de Threoir 2011/16/AE a dhéanamh trí fhormáid ríomhairithe chaighdeánach a úsáid. |

I gcomhréir le Treoir 2011/16/AE, is gá freisin na socruithe praiticiúla a leagan síos maidir le hOibreoirí Ardán Tuairiscithe áirithe a chlárú agus a shainaithint de bhun Airteagal 8ac(4). |

De bhun Airteagal 8ac(6) de Threoir 2011/16/AE, ba cheart clár lárnach a bhunú chun faisnéis nach mór fógra a thabhairt ina leith i gcomhréir le hAirteagal 8ac(5) agus a chur in iúl i gcomhréir le Roinn IV, fomhíreanna F(2) agus F(4), d’Iarscríbhinn V a thaifeadadh. Ba cheart an clár lárnach sin a chur ar fáil d’údaráis inniúla na mBallstát. Ba cheart foirm chaighdeánach a úsáid chun faisnéis den sórt sin a chur in iúl agus a thaifeadadh. |

Déantar foráil in Airteagal 23(4) de Threoir 2011/16/AE maidir le liosta sonraí staidrimh a bhfuil na Ballstáit le soláthar chun críocha a meastóireachta. Ar mhaithe le comhleanúnachas agus deimhneacht dhlíthiúil, ba cheart dáta chur i bhfeidhm an Rialacháin seo a ailíniú leis an dáta cur i bhfeidhm dá bhforáiltear in Airteagal 2(1), an dara fomhír, de Threoir (AE) 2021/514. |

Chuathas i gcomhairle leis an Maoirseoir Eorpach ar Chosaint Sonraí maidir leis na bearta dá bhforáiltear sa Rialachán i gcomhréir le hAirteagal 42(1) de Rialachán (AE) 2018/1725 ó Pharlaimint na hEorpa agus ón gComhairle (4). |

Beidh an fhoirm a bheidh le húsáid chun an fhaisnéis maidir le hOibreoirí Ardán Eisiata agus maidir le hOibreoirí Ardán Eachtrach a chur in iúl don chlár lárnach de bhun Airteagal 8ac(6) de Threoir 2011/16/AE, beidh sí i gcomhréir le hIarscríbhinn XIV a ghabhann leis an Rialachán seo. 2. Is éard a bheidh sna príomhghnéithe a bheidh le taifeadadh sa chlár lárnach, dá bhforáiltear le hAirteagal 8ac(6) de Threoir 2011/16/AE, an fhaisnéis a liostaítear i Roinn IV, fomhíreanna F(2) agus F(4), d’Iarscríbhinn V a ghabhann leis an Treoir sin agus in Iarscríbhinn XVI a ghabhann leis an Rialachán seo. Maidir leis an gclár lárnach a bhunú agus an phróiseáil sonraí pearsanta laistigh den chlár lárnach a dhéanfaidh an Coimisiún thar ceann údaráis inniúla na mBallstát, beidh siad i gcomhréir le Rialachán (AE) 2016/679 ó Pharlaimint na hEorpa agus ón gComhairle (*1) agus Rialachán (AE) 2018/1725 ó Pharlaimint na hEorpa agus ón gComhairle (*2). Measfar údaráis inniúla na mBallstát a bheith ina rialaitheoirí sonraí agus measfar an Coimisiún a bheith ina phróiseálaí sonraí i gcomhréir le Rialachán (AE) 2016/679. 3. Leagtar amach in Iarscríbhinn XVI a ghabhann leis an Rialachán seo formáid na huimhreach aitheantais aonair le haghaidh Oibreoirí Ardán Eachtrach de réir bhrí Airteagal 8ac(4) de Threoir 2011/16/AE. 4. Leagtar amach in Iarscríbhinn XVI a ghabhann leis an Rialachán seo tréimhse choinneála na faisnéise a scriostar as an gclár lárnach, de bhun Roinn IV, fomhír F(5), pointe (d), d’Iarscríbhinn V, agus Airteagal 8ac(5) de Threoir 2011/16/AE. (*1) Rialachán (AE) 2016/679 ó Pharlaimint na hEorpa agus ón gComhairle an 27 Aibreán 2016 maidir le daoine nádúrtha a chosaint i ndáil le sonraí pearsanta a phróiseáil agus maidir le saorghluaiseacht sonraí den sórt sin, agus lena n-aisghairtear Treoir 95/46/CE (An Rialachán Ginearálta maidir le Cosaint Sonraí) (IO L 119, 4.5.2016, lch. 1)." Airteagal 2
Tiocfaidh an Rialachán seo i bhfeidhm an fichiú lá tar éis lá a fhoilsithe in Iris Oifigiúil an Aontais Eorpaigh.
Beidh feidhm aige ón 1 Eanáir 2023.
Beidh an Rialachán seo ina cheangal go huile agus go hiomlán agus beidh sé infheidhme go díreach i ngach Ballstát.
