DIRECTIVE 2006/1/EC OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL
of 18 January 2006
on the use of vehicles hired without drivers for the carriage of goods by road
(codified version)

Article 1
For the purposes of this Directive:
‘vehicle’ means a motor vehicle, a trailer, a semi-trailer, or a combination of vehicles intended exclusively for the carriage of goods;
‘hired vehicle’ means any vehicle which, for remuneration and for a determined period, is put at the disposal of an undertaking which engages in the carriage of goods by road for hire or reward or for its own account on the basis of a contract with the undertaking which makes the vehicles available.
Article 2
Ceadóidh gach Ballstát ar a chríoch féin úsáid feithiclí arna bhfruiliú ag gnóthais atá bunaithe ar chríoch Ballstáit eile ar choinníoll:
the contract relates solely to the hiring of a vehicle without a driver and is not accompanied by a service contract concluded with the same undertaking covering driving or accompanying personnel;
the hired vehicle is at the sole disposal of the undertaking using it during the period of the hire contract;
the hired vehicle is driven by personnel of the undertaking using it.
Soláthrófar cruthúnas ar chomhlíonadh na gcoinníollacha dá dtagraítear i mír 1, pointí (a) go (d), trí na doiciméid seo a leanas a thíolacadh ar pháipéar nó i bhfoirm leictreonach, a bheidh ar bord na feithicle:
the contract of hire, or a certified extract from that contract giving in particular the name of the lessor, the name of the lessee, the date and duration of the contract and the identification of the vehicle;
where the driver is not the person hiring the vehicle, the driver's employment contract or a certified extract from that contract giving in particular the name of the employer, the name of the employee and the date and duration of the employment contract or a recent pay slip.
If need be, the documents referred to in (a) and (b) may be replaced by an equivalent document issued by the competent authorities of the Member State.
Airteagal 3
I gcás ina ndéantar feithicil fhruilithe a chlárú nó a chur i gcúrsaíocht i gcomhréir le dlíthe Ballstáit eile, féadfaidh Ballstát bunaíochta an ghnóthais iompair de bhóthar:
teorainn ama a chur le húsáid na feithicle fruilithe ar a chríoch ar choinníoll go gceadófar don ghnóthas iompair de bhóthar céanna an fheithicil fhruilithe a úsáid ar feadh tréimhse 2 mhí, ar a laghad, i ndiaidh a chéile in aon bhliain féilire ar leith; sa chás sin, féadfaidh an Ballstát a cheangal nach mairfidh an conradh fruilithe níos faide ná an teorainn ama arna socrú ag an mBallstát sin;
a cheangal go gclárófar an fheithicil fhruilithe i gcomhréir lena rialacha náisiúnta clárúcháin tar éis tréimhse nach lú ná 30 lá; féadfaidh an Ballstát a cheangal sa chás sin nach mairfidh an conradh fruilithe níos faide ná an tréimhse cúrsaíochta roimh an gceanglas clárúcháin;
teorainn a chur le líon na bhfeithiclí fruilithe a fhéadfaidh gnóthas a úsáid ar choinníoll go gceadófar líon íosta feithiclí arb é 25 % ar a laghad den fhlít feithiclí earraí atá ar fáil don ghnóthas de bhun Airteagal 5(1), pointe (g), de Rialachán (CE) Uimh. 1071/2009 an 31 Nollaig den bhliain roimh úsáid na feithicle fruilithe nó ar an lá a thosaigh an gnóthas ag úsáid na feithicle fruilithe, de réir mar a chinnfidh an Ballstát; i gcás gnóthas a bhfuil flít níos mó ná feithicil amháin agus níos lú ná ceithre fheithicil ina iomláine aige, áfach, féadfaidh sé feithicil amháin ar a laghad den sórt sin a úsáid; i gcomhréir leis an bpointe sin tagraíonn an líon íosta don fhlít feithiclí earraí atá ar fáil don ghnóthas ar bhonn na bhfeithiclí a cláraíodh nó a cuireadh i gcúrsaíocht i gcomhréir le dlíthe an Bhallstáit sin;
teorainn a chur le húsáid na bhfeithiclí sin le haghaidh oibríochtaí iompair ar a gcuntas féin.
Airteagal 3a
Article 4
This Directive shall not affect the regulations of a Member State which lays down less restrictive conditions for the use of hired vehicles than those specified in Articles 2 and 3.
Article 5
Without prejudice to Articles 2 and 3, this Directive shall not affect the application of the rules concerning:
the organisation of the market for the carriage of goods by road for hire or reward and own account and in particular access to the market and quota restrictions on road capacities;
prices and conditions for the carriage of goods by road;
the formation of hire prices;
the import of vehicles;
the conditions governing access to the activity or occupation of road-vehicle lessor.
Airteagal 5a
Faoin 7 Lúnasa 2027, cuirfidh an Coimisiún tuarascáil faoi bhráid Pharlaimint na hEorpa agus na Comhairle maidir le cur chun feidhme agus iarmhairtí na Treorach seo. Áireofar sa tuarascáil sin faisnéis faoi úsáid feithiclí arna bhfruiliú i mBallstát eile seachas Ballstát bunaíochta an ghnóthais a bhfuil an fheithicil fruilithe aige. Tabharfar aird sa tuarascáil sin freisin ar na tionchair ar shábháilteacht ar bhóithre, ar an gcomhshaol, ar ioncam cánach agus ar fhorfheidhmiú na rialacha cabatáiste i gcomhréir le Rialachán (CE) Uimh. 1072/2009. Ar bhonn na tuarascála sin, déanfaidh an Coimisiún measúnú arís an gá bearta forlíontacha a mholadh.
Airteagal 5b
Article 6
Directive 84/647/EEC is hereby repealed, without prejudice to the obligations of the Member States relating to the time-limits for transposition into national law of the Directives listed in Annex I, Part B.
References to the repealed Directive shall be construed as references to this Directive and should be read in accordance with the correlation table set out in Annex II.
Article 7
This Directive shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
Article 8
This Directive is addressed to the Member States.
