    Form of order sought

    declare that, by failing to adopt all the laws, regulations and administrative provisions necessary to transpose Commission Directive 2010/61/EU of 2 September 2010 adapting for the first time the Annexes to Directive 2008/68/EC of the European Parliament and of the Council on the inland transport of dangerous goods to scientific and technical progress (1) and, in any event, by failing to communicate them to the Commission, the Kingdom of Belgium has failed to fulfil its obligations under Article 2(1) of that directive;

    order the Kingdom of Belgium to pay the costs.

    Pleas in law and main arguments

    The period for transposing Commission Directive 2010/61/EU of 2 September 2010 expired on 30 June 2011.
