Ag féachaint don Chonradh ar Fheidhmiú an Aontais Eorpaigh,
Ag féachaint do Rialachán (AE) 2016/429 ó Pharlaimint na hEorpa agus ón gComhairle an 9 Márta 2016 maidir le galair in-tarchurtha ainmhithe agus lena leasaítear agus lena n-aisghairtear gníomhartha áirithe i réimse na sláinte ainmhithe (‘Dlí maidir le Sláinte Ainmhithe’) (1), agus go háirithe Airteagal 259(1), pointe (c), de,
De bharr an mhéid seo a leanas:

Is galar víreasach tógálach in éin é an fliú éanúil ardphataigineach (HPAI) agus d’fhéadfadh tionchar tromchúiseach a bheith aige ar bhrabúsacht na feirmeoireachta éanlaithe clóis, rud a chuirfeadh isteach ar thrádáil laistigh den Aontas agus ar onnmhairí chuig tríú tíortha. Is féidir le víris HPAI éin imirceacha a ionfhabhtú, rud a fhágann gur féidir leo na víris sin a leathadh thar achair fhada le linn a n-imircí san fhómhar agus san earrach. Dá bhrí sin, is bagairt leanúnach é víris HPAI a bheith in éin fhiáine maidir le tabhairt isteach na víreas sin go díreach agus go hindíreach i mbunaíochtaí ina gcoinnítear éanlaith chlóis nó éin i mbraighdeanas. I gcás ráig de HPAI i mbunaíochtaí ina gcoimeádtar éanlaith chlóis nó éin i mbraighdeanas, tá baol ann go bhféadfaidh an t-oibreán galair leathadh go bunaíochtaí eile den sórt sin. |

Le Rialachán (AE) 2016/429 bunaítear an creat reachtach chun galair a chosc agus a rialú, ar galair iad atá in-tarchurtha go hainmhithe nó go daoine. Tagann HPAI faoin sainmhíniú ar ghalar liostaithe sa Rialachán sin, agus tá sé faoi réir na rialacha coisctheacha agus rialaithe galar a leagtar síos ann. Ina theannta sin, le Rialachán Tarmligthe (AE) 2020/687 ón gCoimisiún (2) déantar forlíonadh ar Rialachán (AE) 2016/429 a mhéid a bhaineann le rialacha i dtaca le galair liostaithe áirithe a chosc agus a rialú, lena n-áirítear HPAI. Go háirithe, foráiltear le hAirteagal 21 den Rialachán Tarmligthe sin, i gcás ráig de ghalar i gcatagóir A i mbunaíocht, go bhfuil an t-údarás inniúil le crios srianta a bhunú láithreach ina mbeidh crios cosanta, crios faireachais, agus más gá, criosanna srianta breise timpeall na gcriosanna cosanta agus faireachais nó cóngarach dóibh. |

Glacadh Cinneadh Cur Chun Feidhme (AE) 2023/2447 ón gCoimisiún (3) ar bhonn Rialachán (AE) 2016/429, agus leagtar síos leis bearta éigeandála ar leibhéal an Aontais i ndáil le ráigeanna de HPAI. |

Go háirithe, le hAirteagal 2, pointe (a), Airteagal 3, pointe (a) agus Airteagal 4, pointe (a) de Chinneadh Cur Chun Feidhme (AE) 2023/2447, foráiltear, faoi seach, tar éis ráigeanna de HPAI, i ndáil leis na criosanna cosanta agus faireachais agus na criosanna srianta breise atá le bunú i gcomhréir le Rialachán Tarmligthe (AE) 2020/687, nach mór do na criosanna sin na limistéir a liostaítear mar chriosanna cosanta agus faireachais agus criosanna srianta breise san Iarscríbhinn sin a chuimsiú ar a laghad. Foráiltear le hAirteagal 2, pointe (b), Airteagal 3, pointe (b) agus Airteagal 4, pointe (b), de Chinneadh Cur Chun Feidhme (AE) 2023/2447 freisin nach mór na bearta atá le cur i bhfeidhm sna criosanna cosanta, faireachais agus sna criosanna srianta breise sin, i gcomhréir leis an Rialachán Tarmligthe sin, a choinneáil ar bun go dtí na dátaí a leagtar amach san Iarscríbhinn a ghabhann leis an gCinneadh Cur Chun Feidhme sin. |

Leasaíodh an Iarscríbhinn a ghabhann le Cinneadh Cur Chun Feidhme (AE) 2023/2447 go deireanach le Cinneadh Cur Chun Feidhme (AE) 2026/721 ón gCoimisiún (4) tar éis ráigeanna de HPAI sa tSeicia, sa Danmhairg, sa Ghearmáin, sa Fhrainc, san Iodáil, sa Pholainn agus sa Ríocht Aontaithe i ndáil le Tuaisceart Éireann i mbunaíochtaí inar coimeádadh éanlaith chlóis nó éin i mbraighdeanas. |

Ó bhí dáta glactha Chinneadh Cur Chun Feidhme (AE) 2026/721 ann, tá fógra tugtha ag an tSeicia, an Ísiltír agus an Pholainn don Choimisiún faoi ráigeanna nua den fhliú éanúil ardphataigineach sna Ballstáit sin i mbunaíochtaí inar coimeádadh éanlaith chlóis nó éin i mbraighdeanas. Go háirithe, bhain na fógraí sin le dhá ráig in éanlaith chlóis i réigiúin Hradec Králové agus Nymburk sa tSeicia, le dhá ráig i gcúigí Drenthe agus Noord Brabant san Ísiltír, agus le trí ráig i gcúigí Łódzkie, Warmińsko-Mazurskie, agus Wielkopolskie sa Pholainn. |

Tá scrúdú déanta ag an gCoimisiún ar na bearta rialaithe galar atá déanta ag an tSeicia, an Ísiltír agus an Pholainn agus tá sé sásta maidir le teorainneacha na gcriosanna cosanta agus faireachais arna mbunú ag na Ballstáit faoi seach le haghaidh na ráigeanna a dtugtar tuairisc orthu, go bhfuil siad fada go leor ó na bunaíochtaí ina bhfuil na ráigeanna de HPAI deimhnithe. |

Chuir an Ríocht Aontaithe, i ndáil le Tuaisceart Éireann, an Coimisiún ar an eolas faoi dháta an ghlantacháin agus an díghalraithe sa bhunaíocht atá buailte ag ráig XI-HPAI(P)-2026-00001 i gceantar Chathair Dhoire agus an tSratha Báin. Dá bhrí sin, ní mór síneadh aon lae amháin a chur le fad na gcriosanna cosanta agus faireachais arna mbunú ag an Ríocht Aontaithe, i ndáil le Tuaisceart Éireann, le haghaidh na ráige sin i gcomhréir le hAirteagal 39 agus Airteagal 55 de Rialachán Tarmligthe (AE) 2020/687. |

Ina theannta sin, an glanadh agus an díghalrú sna bunaíochtaí atá buailte ag ráigeanna DE-HPAI(P)-2026-00034, bunaíochtaí atá lonnaithe i stát Niedersachsen sa Ghearmáin, agus PL-HPAI(P)-2026-00047, bunaíochtaí atá lonnaithe i gcúige Wielkopolskie sa Pholainn, cuireadh i gcrích iad níos déanaí ná mar a bhíothas ag súil leis. Dá bhrí sin, is gá síneadh a chur le fad na gcriosanna cosanta agus faireachais arna mbunú ag an nGearmáin agus an Pholainn faoi seach le haghaidh na ráigeanna sin, i gcomhréir le hAirteagail 39 agus 55 de Rialachán Tarmligthe (AE) 2020/687. |

Chun aon suaitheadh nach bhfuil gá leis ar thrádáil laistigh den Aontas a chosc agus chun nach bhforchuirfidh tríú tíortha bacainní gan údar ar thrádáil, is gá tuairisc a thabhairt go mear ar leibhéal an Aontais, i gcomhar leis an tSeicia, an Ísiltír agus an Pholainn, ar na criosanna cosanta agus faireachais arna mbunú ag na Ballstáit sin i gcomhréir le Rialachán Tarmligthe (AE) 2020/687. |

Dá bhrí sin, an liosta limistéar atá le bheith faoi réir criosanna cosanta agus faireachais i gcás na Seicia, na hÍsiltíre agus na Polainne san Iarscríbhinn a ghabhann le Cinneadh Cur Chun Feidhme (AE) 2023/2447, ba cheart é a leasú chun teorainneacha iomchuí na gcriosanna cosanta agus faireachais arna mbunú ag na Ballstáit sin a chur san áireamh, tar éis na ráigeanna nua de HPAI a tharla le déanaí iontu, agus ní mór fad riachtanach na mbeart atá le cur i bhfeidhm sna criosanna sin a leagan amach, i gcomhréir le Rialachán Tarmligthe (AE) 2020/687. |
