Ag féachaint don Chonradh ar Fheidhmiú an Aontais Eorpaigh,
Ag féachaint do Rialachán (AE) 2016/429 ó Pharlaimint na hEorpa agus ón gComhairle an 9 Márta 2016 maidir le galair in-tarchurtha ainmhithe agus lena leasaítear agus lena n-aisghairtear gníomhartha áirithe i réimse na sláinte ainmhithe (‘Dlí maidir le Sláinte Ainmhithe’) (1), agus go háirithe Airteagal 259(1), pointe (c), de,
De bharr an mhéid seo a leanas:

Is galar víreasach tógálach in éin é an fliú éanúil ardphataigineach (HPAI) agus d’fhéadfadh tionchar tromchúiseach a bheith aige ar bhrabúsacht na feirmeoireachta éanlaithe clóis, rud a chuirfeadh isteach ar thrádáil laistigh den Aontas agus ar onnmhairí chuig tríú tíortha. Is féidir le víris HPAI éin imirceacha a ionfhabhtú, rud a fhágann gur féidir leo na víris sin a leathadh thar achair fhada le linn a n-imircí san fhómhar agus san earrach. Dá bhrí sin, is bagairt leanúnach é víris HPAI a bheith in éin fhiáine maidir le tabhairt isteach na víreas sin go díreach agus go hindíreach i ngabháltais ina gcoimeádtar éanlaith chlóis nó éin i mbraighdeanas. I gcás ráig HPAI, tá baol ann go bhféadfadh an t-oibreán galair leathadh go gabháltais eile ina gcoimeádtar éanlaith chlóis nó éin i mbraighdeanas. |

Le Rialachán (AE) 2016/429 bunaítear an creat reachtach chun galair a chosc agus a rialú, ar galair iad atá in-tarchurtha go hainmhithe nó go daoine. Tagann HPAI faoin sainmhíniú ar ghalar liostaithe sa Rialachán sin, agus tá sé faoi réir na rialacha coisctheacha agus rialaithe galar a leagtar síos ann. Ina theannta sin, le Rialachán Tarmligthe (AE) 2020/687 ón gCoimisiún (2) déantar forlíonadh ar Rialachán (AE) 2016/429 a mhéid a bhaineann leis na rialacha maidir le galair liostaithe áirithe a chosc agus a rialú, lena n-áirítear bearta rialaithe galar le haghaidh HPAI. |

An 24 Deireadh Fómhair 2023 ghlac an Coimisiún Cinneadh Cur Chun Feidhme (AE) 2023/2447 ón gCoimisiún (3) ar bhonn Rialachán (AE) 2016/429 lena leagtar síos bearta éigeandála ar leibhéal an Aontais i ndáil le ráigeanna HPAI. |

Go háirithe, le Cinneadh Cur Chun Feidhme (AE) 2023/2447 déantar foráil maidir leis na criosanna cosanta agus faireachais agus na criosanna srianta breise atá le bunú ag na Ballstáit lena mbaineann tar éis ráigeanna HPAI, i gcomhréir le Rialachán Tarmligthe (AE) 2020/687, nach mór dóibh ar a laghad na limistéir a liostaítear mar chriosanna cosanta agus faireachais agus criosanna srianta breise a chuimsiú san Iarscríbhinn a ghabhann leis an gCinneadh Cur Chun Feidhme sin. |

Leasaíodh an Iarscríbhinn a ghabhann le Cinneadh Cur Chun Feidhme (AE) 2023/2447 le déanaí le Cinneadh Cur Chun Feidhme (AE) 2025/270 ón gCoimisiún (4) tar éis ráigeanna breise HPAI sa Ghearmáin, san Iodáil, sa Liotuáin, san Ungáir, sa Pholainn agus sa Phortaingéil i mbunaíochtaí inar coimeádadh éanlaithe chlóis nó éin i mbraighdeanas, rud ba ghá a léiriú san Iarscríbhinn sin. |

Ón dáta a glacadh Cinneadh Cur Chun Feidhme (AE) 2025/270, thug an Bheilg, an Bhulgáir, an Ghearmáin, an Iodáil, an Ungáir, an Ísiltír, an Pholainn agus an Phortaingéil fógra don Choimisiún faoi ráigeanna breise HPAI, i mbunaíochtaí inar coimeádadh éanlaith chlóis nó éin i mbraighdeanas agus atá lonnaithe i gcúige Liege sa Bheilg, i gceantar Plovdiv sa Bhulgáir, i stát na Sacsaine Íochtaraí sa Ghearmáin, i réigiún Piemonte san Iodáil, i gcontae Hajdú-Bihar san Ungáir, i gcúige Friesland san Ísiltír, i gcúigí Łódzkie, Lubuskie, Mazowieckie agus Wielkopolskie sa Pholainn agus i gceantar Aveiro sa Phortaingéil. |

Tá na bearta rialaithe galar a cheanglaítear déanta ag an mBeilg, ag an mBulgáir, ag an nGearmáin, ag an Iodáil, ag an Ungáir, ag an Ísiltír, ag an bPolainn agus ag an bPortaingéil i gcomhréir le Rialachán Tarmligthe (AE) 2020/687, lena n-áirítear bunú criosanna cosanta agus faireachais timpeall ar na ráigeanna. |

Tá scrúdú déanta ag an gCoimisiún ar na bearta rialaithe galar a rinne an Bheilg, an Bhulgáir, an Ghearmáin, an Iodáil, an Ungáir, an Ísiltír, an Pholainn agus an Phortaingéil agus tá sé sásta maidir le teorainneacha na gcriosanna cosanta agus faireachais arna mbunú ag na Ballstáit sin, go bhfuil siad fada go leor ó na bunaíochtaí inar deimhníodh na ráigeanna HPAI. |

San Iarscríbhinn a ghabhann le Cinneadh Cur Chun Feidhme (AE) 2023/2447, níl aon limistéar liostaithe faoi láthair mar chrios cosanta agus faireachais le haghaidh na Beilge ná na Bulgáire, agus níl aon limistéar liostaithe mar chrios cosanta le haghaidh na hÍsiltíre. |

Chun aon suaitheadh nach bhfuil gá leis ar thrádáil laistigh den Aontas a chosc agus chun nach bhforchuirfidh tríú tíortha bacainní gan údar ar thrádáil, ní mór tuairisc a thabhairt go mear ar leibhéal an Aontais, i gcomhar leis an mBeilg, leis an mBulgáir, leis an nGearmáin, leis an Iodáil, leis an Ungáir, leis an Ísiltír, leis an bPolainn agus leis an bPortaingéil, ar na criosanna cosanta agus faireachais arna mbunú ag na Ballstáit sin i gcomhréir le Rialachán Tarmligthe (AE) 2020/687. |

Dá bhrí sin, na limistéir atá liostaithe mar chriosanna cosanta agus faireachais le haghaidh na Gearmáine, na hIodáile, na hUngáire, na Polainne, agus na Portaingéile agus mar chrios faireachais le haghaidh na hÍsiltíre san Iarscríbhinn a ghabhann le Cinneadh Cur Chun Feidhme (AE) 2023/2447, ba cheart iad a thabhairt cothrom le dáta. |

I bhfianaise phráinn na staide eipidéimeolaíche san Aontas a mhéid a bhaineann le leathadh HPAI, tá sé tábhachtach go dtiocfaidh na leasuithe atá le déanamh ar Chinneadh Cur Chun Feidhme (AE) 2023/2447 leis an gCinneadh seo i bhfeidhm a luaithe is féidir. |
