***** COMMISSION REGULATION (EEC) No 3561/85 of 17 December 1985 concerning information about inspections of fishing activities carried out by national control authorities THE COMMISSION OF THE EUROPEAN COMMUNITIES, Having regard to the Treaty establishing the European Economic Community, Having regard to Council Regulation (EEC) No 2057/82 of 29 June 1982 establishing certain control measures for fishing activities by vessels of the Member States (1), as amended by Regulation (EEC) No 1729/83 (2) and in particular Article 13 thereof, Whereas Article 1 of Regulation (EEC) No 2057/82 requires Member States to inspect fishing vessels in connection with conservation and control measures and to take penal or administrative action where infringements are observed; whereas, pursuant to Article 5 of that Regulation, the Commission must be informed about the inspections and controls carried out and their results; whereas it is therefore necessary to specify in which form this information should be transmitted to the Commission; Whereas the measures provided for in this Regulation are in accordance with the opinion of the Management Committee for Fishery Resources, HAS ADOPTED THIS REGULATION: Article 1 1. Each year, by 1 March, Member States shall communicate to the Commission in respect of the previous calendar year (a) the number of days of inspection at sea carried out by national inspection vessels in each ICES division, NAFO region and/or CECAF region; (b) the information in the form as laid down in the Annex concerning; - inspections of fishing vessels carried out at sea or in port and of the catch landed, - official written warnings given, - administrative penalties imposed, - infringements brought to court. 2. For the purposes of this Regulation: - 'Official written warnings given' shall mean written notification by the authorities to a captain or other person responsible for an infringement, who is not brought to court, of infringements committed by him and of the penalties which may be imposed if the infringements are repeated, - 'Administrative penalties imposed' shall mean financial or other penalties imposed by the authorities as a result of an infringement or administrative decision infringement taken as a result of that adversely affecting the activities of a captain or other person responsible for an infringement, - 'infringements brought to court' means infringements brought to court, whatever the action of the court. 3. The Commission shall provide the Member States with a summary of the information received pursuant to paragraphs 1 and 2. Article 2 This Regulation shall enter into force on the third day following its publication in the Official Journal of the European Communities. It shall apply from 1 January 1987. This Regulation shall be binding in its entirety and directly applicable in all Member States. Done at Brussels, 17 December 1985.
