DECISION OF THE EEA JOINT COMMITTEE
No 118/2013
of 14 June 2013
amending Annex IX (Financial services) and Protocol 37 (containing the list provided for in Article 101) to the EEA Agreement
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Articles 98 and 101 thereof,
Whereas:

(1) |
Council Directive 89/298/EEC (1) was repealed by Directive 2003/71/EC of the European Parliament and of the Council (2), which are both incorporated into the EEA Agreement, and consequently the reference to Directive 89/298/EEC should be deleted from the EEA Agreement. |

(2) |
Council Directive 89/592/EEC (3) was repealed by Directive 2003/6/EC of the European Parliament and of the Council (4), which are both incorporated into the EEA Agreement, and consequently the reference to Directive 89/592/EEC should be deleted from the EEA Agreement. |

(3) |
Council Directive 91/308/EEC (5) was repealed by Directive 2005/60/EC of the European Parliament and of the Council (6), which are both incorporated into the EEA Agreement, and consequently the reference to Directive 91/308/EEC should be deleted from the EEA Agreement. |

(4) |
Commission Decision 2001/527/EC (7), which is incorporated into the EEA Agreement, was repealed by Decision 2009/77/EC (8), which was repealed by Regulation (EU) No 1095/2010 of the European Parliament and of the Council (9), and Decision 2001/527/EC should consequently be repealed under the EEA Agreement. |

Commission Decision 2004/5/EC (10), which is incorporated into the EEA Agreement, was repealed by Decision 2009/78/EC (11), which was repealed by Regulation (EU) No 1093/2010 of the European Parliament and of the Council (12), and Decision 2004/5/EC should consequently be repealed under the EEA Agreement. |

Commission Decision 2004/6/EC (13), which is incorporated into the EEA Agreement, was repealed by Decision 2009/79/EC (14), which was repealed by Regulation (EU) No 1094/2010 of the European Parliament and of the Council (15), and Decision 2004/6/EC should consequently be repealed under the EEA Agreement. |

Annex IX and Protocol 37 to the EEA Agreement should therefore be amended accordingly, |
HAS ADOPTED THIS DECISION:
Article 1
The texts of points 13c (Commission Decision 2004/6/EC), 23 (Council Directive 91/308/EEC), 23e (Commission Decision 2004/5/EC), 28 (Council Directive 89/298/EEC), 29 (Council Directive 89/592/EEC) and 31c (Commission Decision 2001/527/EC) of Annex IX to the EEA Agreement are deleted.
Article 2
The text of points 6, 21, 23 and 24 of Protocol 37 to the EEA Agreement is deleted.
Article 3
This Decision shall enter into force on 15 June 2013, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).
Article 4
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
