Operative part

Article 12 of Regulation (EC) No 261/2004 of the Parliament and of the Council of 11 February 2004 establishing common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights, and repealing Regulation (EEC) No 295/91, must be interpreted as meaning that it does not preclude a passenger, already compensated under the Article 7 of that regulation, may be compensated by means of a right to a reduction in the price of the trip he has against a tour operator, provided for by the law of the Member State concerned, to the extent that the latter compensation is granted for individual damage which originates in one of the situations provided for in Article 1(1) of that regulation, which is for the referring court to determine.
