(Rules of Procedure of the Court of First Instance, Art. 35)

Under Article 35(2)(b) of its Rules of Procedure, the Court of First Instance may authorize, at the request of one of the parties, and after the opposite party has been heard, the use of a language other than the language of the case for all or part of the proceedings.

Such authorization cannot be granted in respect of the written procedure where the intervener requesting it may obtain, by its own means, translations into its own working language of the submissions and other documents in the case, so that its rights would not be adversely affected.

However, as regards the oral procedure, such authorization must be granted since it allows that party to continue to be assisted by counsel of its choice, while not impairing the procedural rights of the main parties to the proceedings and, in particular, not causing any delay in the proceedings.
