Belgique

L’autorité judiciaire d’exécution compétente en Belgique:

—	the investigative judge (juge d’instruction – onderzoeksrechter), the Council Chamber (chambre du conseil – raadkamer) [et, à un niveau de juridiction supérieur,] the indictment chamber (chambre des mises en accusation – kamer van inbeschuldigingstelling) ou;

—	[le procureur] (the public prosecutor) si la personne concernée consent à sa remise.

Bulgarie

La Bulgarie désigne le tribunal compétent du district où la personne recherchée qui fait l’objet d’un mandat d’arrêt a été interpellée, pour que l’autorité compétente statue sur l’exécution du mandat d’arrêt.

République tchèque

Les autorités habilitées à exécuter un mandat d’arrêt en République tchèque sont les parquets régionaux, le parquet municipal à Prague, les tribunaux régionaux et le tribunal municipal à Prague.

Les autorités judiciaires d’exécution, au sens de l’article LAW.SURR.78, point c), sont les ministères publics des tribunaux régionaux supérieurs, à qui il appartient de prendre, dans le cadre de la remise de personnes, la décision ayant force de chose jugée, sur la base des décisions prises par ces tribunaux régionaux supérieurs.

Estonie

Les autorités compétentes, dans le droit estonien (code d’instruction criminelle), pour exécuter un mandat d’arrêt sont les suivantes:

—	Les autorités judiciaires compétentes sont le tribunal de district de Harju et le tribunal de district de Tartu.

Irlande

L’autorité judiciaire d’exécution pour l’Irlande est la High Court.

Grèce

PUBLIC PROSECUTOR’S OFFICE AT THE COURT OF APPEALS

Espagne

L’autorité compétente pour exécuter un mandat d’arrêt est le juge d’instruction de la Cour centrale (Juez Central de Instrucción de la Audiencia Nacional). Lorsque le mandat concerne un mineur, c’est le juge du tribunal central de la jeunesse (Juez Central de Menores) qui est compétent.

France

En France, les autorités judiciaires compétentes pour exécuter les mandats d’arrêt européens sont le parquet général et la chambre de l’instruction.

Croatie

Les tribunaux de comitat sont compétents pour les exécutions, en fonction du lieu où la personne est domiciliée ou séjourne. Si cette personne n’est pas domiciliée en République de Croatie ou n’y a pas de lieu de séjour, c’est le tribunal de comitat du lieu où elle a été arrêtée qui sera compétent.

Italie

Les cours d’appel seront les autorités compétentes pour l’exécution des mandats d’arrêt.

Toutefois, le traitement des demandes implique le concours du service de coopération internationale de la police (International Police Cooperation Service) auprès du département de la sécurité publique (Department of Public Security) du ministère de l’intérieur, qui constitue le point de contact entre les offices d’investigation nationaux (National Investigative Offices) et les organes de police collatéraux pour l’échange d’informations, la transmission et la réception des documents liés.

Chypre

L’autorité judiciaire d’exécution compétente est un juge du tribunal de district dans la juridiction duquel la personne concernée se trouve ou est censée se trouver, et un juge du tribunal de district de Nicosie lorsque l’adresse de la personne concernée est inconnue.

Belgique

En ce qui concerne les mandats d’arrêt délivrés à des fins de poursuites, l’autorité judiciaire d’émission est:

—	le juge d’instruction /onderzoeksrechter; ou

—	le procureur.

En ce qui concerne les mandats d’arrêt délivrés à des fins d’exécution d’une peine ou d’une mesure de sûreté privative de liberté, l’autorité judiciaire d’émission compétente est le procureur.

Bulgarie

La Bulgarie désigne:

1)	le procureur concerné comme autorité compétente pour délivrer un mandat d’arrêt pendant la phase phase préalable au procès pénal et pour les personnes condamnées, et

2)	la juridiction concernée comme autorité compétente pour délivrer un mandat d’arrêt pendant la phase du procès pénal.

République tchèque

Les instances habilitées à délivrer un mandat d’arrêt dans la République tchèque sont les cours locales (local courts), de district (district courts) et régionales (regional courts), les hautes cours (high courts), les cours municipales (municipal courts) de Prague et Brno ainsi que la cour suprême de la République tchèque.

Les autorités judiciaires d’émission visées à l’article LAW.SURR.78 (d) sont les cours locales (local courts) et régionales (regional courts), les tribunaux régionaux supérieurs (higher regional courts) ainsi que la Cour fédérale de justice (Federal Court of Justice). Les procureurs de ces juridictions seront chargés de l’exécution des mandats d’arrêts et seront également les personnes de contact compétentes pour toutes les questions concernant la reconnaissance des mandats d’arrêt et la remise.

Les autorités judiciaires compétentes pour émettre un mandat d’arrêt sont les suivantes:

—	le mandat d’arrêt aux fins de poursuite est émis par le procureur;

—	le mandat d’arrêt aux fins d’une procédure judiciaire est émis par la juridiction qui conduit l’instance;

L’autorité compétente pour délivrer un mandat d’arrêt est le juge ou la juridiction chargé de l’affaire.

France

La France désigne les procureurs au sein du ministère public comme autorités judiciaires compétentes pour délivrer un mandat d’arrêt aux fins de l’exécution de mandats d’arrêt délivrés par un juge d’instruction, une juridiction de jugement ou un juge de l’application des peines, et pour veiller à ce que les peines privatives de liberté soient exécutées.

Croatie

Les parquets (State attorneys’ offices) habilités à engager les poursuites sont compétents aux fins de la procédure avant la délivrance de l’ordonnance de mise en accusation. Ensuite, c’est l’instance chargée de la procédure pénale qui est compétente.

Dans la phase d’exécution de la peine ou de la mesure privative de liberté, l’autorité judiciaire compétente pour émettre un mandat d’arrêt sera le procureur de l’autorité judiciaire d’exécution.

L’autorité judiciaire d’émission compétente est un juge de tribunal de district (Judge of the District Court) compétent pour poursuivre l’infraction ou le tribunal qui a rendu la décision sur la peine ou la mesure de sûreté. Les autorités judiciaires slovènes compétentes pour délivrer un mandat d’arrêt sont les tribunaux locaux (okrajna sodišča) et régionaux (okrožna sodišča). Les tribunaux locaux sont compétents en cas d’infractions pénales passibles, à titre de peine principale, d’une amende ou d’une peine de prison de trois ans maximum. Bulgarie

La Bulgarie désigne le ministre de la justice comme autorité chargée de recevoir les demandes de transit et les documents nécessaires, de même que toute autre correspondance officielle concernant les demandes de transit. Le ministre transmet immédiatement la demande de transit au bureau du procureur de la Cour suprême de cassation (Supreme Cassation Prosecution Office), qui autorise le transit de la personne recherchée sur le territoire de la République de Bulgarie et informe l’État membre requérant de sa décision.
