LA COMMISSION DES COMMUNAUTÉS EUROPÉENNES,

vu le traité instituant la Communauté européenne,

vu la directive 94/28/CE du Conseil du 23 juin 1994 fixant les principes relatifs aux conditions zootechniques et généalogiques applicables à l’importation en provenance des pays tiers d’animaux, de spermes, d’ovules et d’embryons et modifiant la directive 77/504/CEE concernant les animaux de l’espèce bovine reproducteurs de race pure ( 1 ), et notamment son article 3, paragraphe 1,

considérant ce qui suit:

(1)	La directive 94/28/CE fixe les principes relatifs aux conditions zootechniques et généalogiques applicables à l’importation en provenance des pays tiers de certains animaux de race pure, ainsi que de leurs spermes, ovules et embryons.

(2)

En vertu de la directive 94/28/CE et sans préjudice de la législation communautaire en matière de police sanitaire et de santé publique, les animaux ne peuvent être importés en tant qu’animaux «de race pure» ou «hybrides» que si certaines conditions sont réunies. L'une de ces conditions implique que les animaux soient inscrits ou enregistrés dans un livre généalogique ou un registre tenu par une instance au sens de cette directive et que les spermes, ovules et embryons ne puissent être importés que s’ils proviennent d’un animal inscrit ou enregistré dans un tel livre généalogique ou registre.

(3)	L’Argentine, la Bulgarie, le Canada, Israël, l’Islande, la Nouvelle-Zélande et les États-Unis ont communiqué à la Commission une liste des instances qu’ils ont autorisées à tenir un livre généalogique ou un registre d’animaux de race pure destinés à être importés au titre de la directive 94/28/CE.

(4)	Il convient donc d’établir, aux fins de la directive 94/28/CE, la liste des instances autorisées à tenir un livre généalogique ou un registre pour les animaux et produits visés dans la présente décision.

(5)	Les mesures prévues à la présente décision sont conformes à l’avis du comité zootechnique permanent,

A ARRÊTÉ LA PRÉSENTE DÉCISION:

Aux fins de la directive 94/28/CE, la liste des instances autorisées à tenir un livre généalogique ou un registre pour les animaux des espèces bovine, porcine, ovine et caprine reproducteurs «de race pure» — ou «hybrides» dans le cas de l’espèce porcine —, ainsi que pour leurs spermes, ovules et embryons, figure à l’annexe de la présente décision.

Les États membres autorisent les importations d’animaux des espèces bovine, porcine, ovine et caprine reproducteurs «de race pure» — ou «hybrides» dans le cas de l’espèce porcine —, ainsi que de leurs spermes, ovules et embryons, à condition qu’ils soient inscrits ou enregistrés dans un livre généalogique ou un registre tenu par une instance figurant à l’annexe de la présente décision.
