Bruxelles, le 17.03.2005 COM(2005) 95 final Proposition de DÉCISION DU CONSEIL définissant la position à adopter, au nom de la Communauté, au Conseil international des céréales et au comité de l'aide alimentaire (PRÉSENTÉE PAR LA COMMISSION) EXPOSÉ DES MOTIFS L'accord international sur les céréales de 1995 se compose de deux parties: la convention relative à l'aide alimentaire de 1999 et la convention sur le commerce des céréales de 1995. La convention relative à l'aide alimentaire de 1999 a été conclue par la Communauté par décision 2000/421/CE du Conseil. Elle restera en vigueur jusqu'au 30 juin 2005, compte tenu de sa prorogation par décision du comité de l'aide alimentaire du 23 juin 2003. La convention sur le commerce des céréales de 1995 est prorogée jusqu'au 30 juin 2005 par décision du Conseil international des céréales du 24 juin 2003. Dans l'intérêt de la Commission et des États membres, il est nécessaire d'apporter certaines modifications à la convention relative à l'aide alimentaire en vigueur. De l'avis général, ces modifications doivent être débattues entre les membres, dans le cadre de la convention relative à l'aide alimentaire, au cours des deux années de la période de prorogation. Toutefois, compte tenu des liens entre ces questions et les négociations de l'OMC actuellement en cours sur le programme de Doha pour le développement, y compris les discussions relatives aux règles et disciplines applicables à l'ensemble de l'aide alimentaire dans ce cadre, il est prématuré à ce stade d'adopter les modifications précitées. Il apparaît donc opportun de proroger encore une fois les deux conventions, en attendant que les négociations de l'OMC aboutissent, pour une période de deux ans au maximum. À cette fin, la décision autorisant la Commission à négocier, au nom de la Communauté européenne, la révision de la convention relative à l'aide alimentaire de 1999, adoptée par le Conseil le 27 novembre 2003, devra implicitement continuer à s'appliquer jusqu'à la fin de la prorogation proposée de ladite convention. Implications financières La contribution de la Communauté au budget administratif de l'accord international sur les céréales, qui couvre les deux conventions, est inscrite à l'article 05 06 01 (ex-B7-8210) du budget de l'Union européenne (accords internationaux en matière agricole). L'engagement pris par la Communauté européenne de fournir une aide alimentaire dans le cadre de la convention relative à l'aide alimentaire implique des dépenses au titre des articles 21 02 01 (produits à mobiliser au titre de la convention relative à l'aide alimentaire) et 21 02 02 (autres aides en produits, actions d'appui et transport, distribution, mesures d'accompagnement et de contrôle de la mise en œuvre). Conclusions - La Commission propose que le Conseil autorise la Commission à voter, au nom de la Communauté européenne, conformément à l'article XXV, point b), de la convention relative à l'aide alimentaire de 1999, en faveur de la prorogation de cette convention, pour une période de deux ans au maximum; - la Commission propose que le Conseil autorise la Commission à voter, au nom de la Communauté européenne, conformément à l'article 33, paragraphe 2, de la convention sur le commerce des céréales de 1995, en faveur de la prorogation de cette convention, pour une période de deux ans au maximum. La prorogation de ces deux conventions est dans l'intérêt de la Communauté. Compte tenu de cette prorogation, il est convenu que le mandat donné par le Conseil à la Commission de négocier la révision de la convention relative à l'aide alimentaire s'applique pour la même période. Proposition de DÉCISION DU CONSEIL définissant la position à adopter, au nom de la Communauté, au Conseil international des céréales et au comité de l'aide alimentaire LE CONSEIL DE L'UNION EUROPÉENNE, vu le traité instituant la Communauté européenne, et notamment son article 181 en liaison avec l'article 300, paragraphe 2, vu la proposition de la Commission, considérant ce qui suit: La convention relative à l'aide alimentaire de 1999 a été conclue par la Communauté par décision 2000/421/CE du Conseil[1] et prorogée par décision du comité de l'aide alimentaire en juin 2003. Elle reste en vigueur jusqu'au 30 juin 2005. Une nouvelle prorogation de deux ans au maximum de cette convention est dans l'intérêt de la Communauté et de ses États membres. C'est pourquoi il convient que la Commission, qui représente la Communauté au sein du comité de l'aide alimentaire, soit autorisée par une décision du Conseil à voter en faveur de cette prorogation. La convention sur le commerce des céréales de 1995 a été conclue par la Communauté par décision 96/88/CE du Conseil[2] et modifiée et prorogée en juin 1999 pour une période de deux ans par décision 1999/C262/01 du Conseil[3]. Elle a été prorogée une dernière fois par décision du Conseil international des céréales en juin 2003 et reste en vigueur jusqu'au 30 juin 2005. Une nouvelle prorogation de deux ans au maximum de cette convention est dans l'intérêt de la Communauté et de ses États membres. C'est pourquoi il convient que la Commission, qui représente la Communauté à la convention sur le commerce des céréales, soit autorisée par une décision du Conseil à voter en faveur de cette prorogation, DÉCIDE: Article unique La Communauté européenne est favorable à une prorogation de la convention sur le commerce des céréales de 1995 pour une nouvelle période de deux ans au maximum. La Communauté européenne est favorable à une prorogation de la convention relative à l'aide alimentaire de 1999 pour une nouvelle période de deux ans au maximum. La Commission est autorisée à faire valoir cette position au Conseil international des céréales et au comité de l'aide alimentaire. DESCRIPTION AND GROUNDS Need for Community intervention Because of its economic importance, especially in the agricultural sector, the EC must be represented in international agricultural agreements, which represent an important means for following global developments and defending Community interests for the products concerned. The payment of EC membership contributions enables the objectives of the International Grains Council (IGC) to be attained. The IGC, which is responsible for administering the Agreements relating to the Grains Trade Convention, 1995 and the Food Aid Convention, 1999, promotes the objectives of the Agreements, including international cooperation, exchange of statistical information and forecasting market trends, etc., and for the Food Aid Convention the guarantee that developing countries are ensured a minimum amount of food aid by the European Union. It is therefore in the interests of the EC to be a part of the Agreements. The membership contributions are determined on an annual basis and are due for as long as the EC is a member of the Agreements. It is clear that if the EC had to carry out on its own the same actions as are carried out by the IGC, the total cost of these would be much greater than the cost of the membership contributions. Actions envisaged and arrangements for budget intervention The EC pays membership dues on an annual basis for the International Grains Council. The dues are paid for as long as the EC remains a signatory to the Agreements. The European Community and the Member States participate fully in the activities of the IGC and take full advantage of the benefits of membership. FINANCIAL IMPACT Total financial impact on Part B Commitments (to the 3rd decimal place): EUR 0.930 million for the period of two years. €0.465 million cost is estimated for each year. Calculation The expenditure involved in the application of the two Conventions is covered by annual contributions from all members of the Grains Convention. The contribution of each member for each financial year is fixed in proportion to the number of votes attributed to that member in relation to the total number of votes held by members. The number of votes attributed to each member is adjusted on the basis of the composition of the IGC when the budget for the financial year in question is adopted. There is a total of 2 000 votes in the Convention, of which the European Union holds 410 for 2004/05 (after enlargement). The same figure is projected for 2005/06 and for 2006/07. The estimated cost per vote for the period of extension is €1 134 (410 votes x €1 134/vote = €465 000). The amounts are total expenditure for twelve months. FOLLOW-UP AND EVALUATION Follow-up arrangements The Commission services will participate fully in the Administrative Committees and Council of the IGC; these are the bodies responsible for determining budgetary contributions. A report of these meetings and of the decisions taken in the course of these meetings is published and is freely available to members. Details and frequency of planned evaluations In view of the specific nature of the proposed intervention (extension of Community contribution to the administrative budget of the International Grains Agreement) and of the relatively small sum involved, an external evaluation does not seem justified. The relevance and usefulness of continuing with a contribution to the administrative budget of this Agreement will be evaluated internally, at regular intervals, by means of active Commission involvement in the management committees and in the International Grains Council. ANTI-FRAUD MEASURES The execution and the control of EC contributions are checked in conformity with the rules foreseen by the IOOC Agreement. Specific modalities of audit and control are laid down within the legal basis of this international organisation. The accounts of this organisation are certified by an independent external auditor.
