    RÈGLEMENT (CE) N o 790/2009 DE LA COMMISSION

    du 10 août 2009

    modifiant, aux fins de son adaptation au progrès technique et scientifique, le règlement (CE) no 1272/2008 du Parlement européen et du Conseil relatif à la classification, à l’étiquetage et à l’emballage des substances et des mélanges

    (Texte présentant de l'intérêt pour l'EEE)

    LA COMMISSION DES COMMUNAUTÉS EUROPÉENNES,

    vu le traité instituant la Communauté européenne,

    vu le règlement (CE) no 1272/2008 du Parlement européen et du Conseil du 16 décembre 2008 relatif à la classification, à l'étiquetage et à l'emballage des substances et des mélanges, modifiant et abrogeant les directives 67/548/CEE et 1999/45/CE et modifiant le règlement (CE) no 1907/2006 (1), et notamment son article 53,

    considérant ce qui suit:

    L'annexe VI, partie 3, du règlement (CE) no 1272/2008 contient deux listes de substances dangereuses faisant l'objet d'une classification et d'un étiquetage harmonisés. Le tableau 3.1 énumère les substances dangereuses faisant l'objet d'une classification et d'un étiquetage harmonisés fondés sur les critères définis à l'annexe I, parties 2 à 5, du règlement (CE) no 1272/2008. Le tableau 3.2 établit la liste des substances dangereuses faisant l'objet d'une classification et d'un étiquetage harmonisés fondés sur les critères définis à l'annexe VI de la directive 67/548/CEE du Conseil du 27 juin 1967 concernant le rapprochement des dispositions législatives, réglementaires et administratives relatives à la classification, l'emballage et l'étiquetage des substances dangereuses (2). Il convient de modifier ces deux listes afin de mettre à jour la classification des substances dangereuses qui y figurent déjà et d'y inclure de nouvelles classifications harmonisées. Il est également nécessaire de supprimer les entrées correspondant à certaines substances.

    Il est nécessaire de modifier l'annexe VI du règlement (CE) no 1272/2008 afin de tenir compte des modifications récemment apportées à l'annexe I de la directive 67/548/CEE par la directive 2008/58/CE de la Commission du 21 août 2008 portant trentième adaptation au progrès technique de la directive 67/548/CEE du Conseil (3) et par la directive 2009/2/CE du 15 janvier 2009 de la Commission portant trente et unième adaptation au progrès technique de la directive 67/548/CEE du Conseil (4). Ces mesures constituent des adaptations au progrès technique et scientifique au sens de l'article 53 du règlement (CE) no 1272/2008.

    Le considérant 53 du règlement (CE) no 1272/2008 souligne qu'il convient de tenir pleinement compte des travaux réalisés et de l'expérience acquise dans le cadre de la directive 67/548/CEE, notamment pour la classification et l'étiquetage des substances spécifiques listées à l'annexe I de ladite directive.

    Il convient que les classifications harmonisées établies à l'annexe VI, partie 3, du règlement (CE) no 1272/2008 tel que modifié par le présent règlement ne s'appliquent pas immédiatement, car un certain délai sera nécessaire pour permettre aux opérateurs d'adapter l’étiquetage et l’emballage des substances et des mélanges aux nouvelles classifications. De plus, un certain délai sera également nécessaire pour permettre aux opérateurs de se conformer aux nouvelles obligations d'enregistrement qui découlent des nouvelles classifications harmonisées pour les substances classées cancérogènes, mutagènes ou toxiques pour la reproduction, catégories 1A et 1B (tableau 3.1) et catégories 1 et 2 (tableau 3.2), ou très toxiques pour les organismes aquatiques et pouvant entraîner des effets néfastes à long terme pour l'environnement aquatique, en particulier à celles fixées à l'article 23 du règlement (CE) no 1907/2006 du Parlement européen et du Conseil du 18 décembre 2006 concernant l'enregistrement, l'évaluation et l'autorisation des substances chimiques, ainsi que les restrictions applicables à ces substances (REACH), instituant une agence européenne des produits chimiques, modifiant la directive 1999/45/CE et abrogeant le règlement (CEE) no 793/93 du Conseil et le règlement (CE) no 1488/94 de la Commission ainsi que la directive 76/769/CEE du Conseil et les directives 91/155/CEE,93/67/CEE,93/105/CE et 2000/21/CE de la Commission (5).

    Pour les substances visées par le présent règlement, qui sont mises à jour ou ajoutées à l'annexe VI, partie 3, du règlement (CE) no 1272/2008, il convient également de faire coïncider l'obligation de classifier ces substances conformément aux classifications harmonisées définies à l'annexe VI, partie 3, du règlement (CE) no 1272/2008 tel que modifié par le présent règlement, avec la date prévue à l’article 23 du règlement (CE) no 1907/2006, et dès lors que le présent règlement s'applique à compter du 1er décembre 2010.

    Il y a lieu de permettre aux fournisseurs d'appliquer les classifications harmonisées définies à l'annexe VI, partie 3, du règlement (CE) no 1272/2008 tel que modifié par le présent règlement, et d'adapter l’étiquetage et l’emballage en conséquence avant le 1er décembre 2010, comme le prévoit le règlement (CE) no 1272/2008.

    L'entrée no 607-674-00-0 (branched C10-alkyl benzoates) figure par erreur dans la version publiée de la directive 2009/2/CE. Il convient donc de corriger cette erreur matérielle et de ne pas inclure cette entrée dans l'annexe VI du règlement (CE) no 1272/2008.

    Les mesures prévues au présent règlement sont conformes à l’avis du comité institué par l’article 133 du règlement (CE) no 1907/2006,

    A ARRÊTÉ LE PRÉSENT RÈGLEMENT:

    Article premier

    La partie 3 de l'annexe VI du règlement (CE) no 1272/2008 est modifiée comme suit:

    1)

    Le tableau 3.1 est modifié comme suit:

    a)

    les entrées correspondant aux entrées de l'annexe I sont remplacées par les entrées figurant dans cette annexe;

    b)

    les entrées de l'annexe II sont insérées conformément à l'ordre des entrées figurant dans le tableau 3.1;

    c)

    les entrées de l'annexe III sont supprimées du tableau 3.1;

    2)

    Le tableau 3.2 est modifié comme suit:

    a)

    les entrées correspondant aux entrées de l'annexe IV sont remplacées par les entrées figurant dans cette annexe;

    b)

    les entrées de l'annexe V sont insérées conformément à l'ordre des entrées figurant dans le tableau 3.2;

    c)

    les entrées de l'annexe III sont supprimées du tableau 3.2;

    Article 2

    1.   Le présent règlement entre en vigueur le vingtième jour suivant celui de sa publication au Journal officiel de l'Union européenne.

    2.   L'article 1er s’applique à compter du 1er décembre 2010.

    3.   Les classifications harmonisées de l'annexe VI, partie 3, du règlement (CE) no 1272/2008 tel que modifié par le présent règlement peuvent être appliquées avant le 1er décembre 2010.

    Le présent règlement est obligatoire dans tous ses éléments et directement applicable dans tout État membre.
