3. tehniline lisa – äärepoolseimate piirkondade laevastike haldamise tulemused 79

1. SISSEJUHATUS

Nõukogu määruse (EÜ) nr 2371/2002[1] artiklis 14 ja komisjoni määruse (EÜ) nr 1438/2003[2] artiklis 12 nõutakse, et liikmesriigid esitaksid komisjonile enne iga aasta 1. maid aruande eelmisel aastal püügivõimsuse ja kalapüügivõimaluste püsiva tasakaalu saavutamiseks tehtud jõupingutuste kohta. Liikmesriikide aruanded on avaldatud „Europa” kodulehel.[3] Komisjon koostas nende aruannete ja ühenduse kalalaevastiku registri[4] andmete põhjal 2005. aasta kokkuvõtte, mis esitati kalanduse teadus-, tehnika- ja majanduskomiteele (STECF) ning kalanduse ja vesiviljeluse korralduskomiteele. Käesoleva aruandega esitab komisjon nõukogule ja Euroopa Parlamendile kõnealuse kokkuvõtte, millele on lisatud eespool nimetatud komiteede arvamused.

Käesolev aruanne koosneb kahest osast:

- esimeses osas kirjeldatakse eeskirju, mida liikmesriigid peavad järgima oma laevastike haldamisel, ning tehakse kokkuvõte komisjoni määruse (EÜ) nr 1438/2003 artikli 13 alusel esitatud teabest laevastikupoliitika rakenduseeskirjade täitmise kohta;

- teises osas on esitatud liikmesriikide laevastike võimsuse areng 2005. aastal arvuliste tabelite ja graafikutena, mis sisaldavad asjakohaseid andmeid kõikide riikide laevade registrisse kandmise ja registrist väljaarvamise kohta.

2. LAEVASTIKU HALDAMINE UUENDATUD ÜHISE KALANDUSPOLIITIKA TINGIMUSTES

Vastavalt 2002. aasta detsembris vastuvõetud ühisele kalanduspoliitikale kehtib kalalaevastike haldamisel reegel, et laevastiku võimsust, väljendatuna tonnaaži ja mootorivõimsusena, ei tohi suurendada rohkem kui seda võimsust samal ajavahemikul vähendatakse (vt 1. tehniline lisa).

3. KOKKUVÕTE LIIKMESRIIKIDE AASTAARUANNETEST

Ettenähtud tähtajaks, s.t 30. aprilliks 2006, esitasid ka sel aastal oma aastaaruanded vaid kümme liikmesriiki, ülejäänud aruanded hilinesid (näiteks Itaalia ja Prantsusmaa aruanded hilinesid mitu kuud). Ühendkuningriik ei esitanud aastaaruannet. Lisaks sellele ei ole liikmesriikide aruannetes esitatud teave ühtlane ja vahel pole kinni peetud vormi- ja sisunõuetest. Mitme liikmesriigi aruanne oli jälle pikem kui lubatud kümme lehekülge ning nendele oli lisatud mitmeid lisasid ja selgitavaid tabeleid.

Nimetatud ebakõlade tagajärjel oli liikmesriikide aruannete ühtne hindamine problemaatiline ja komisjonil oli kalanduse teadus-, tehnika- ja majanduskomitee le ning kalanduse ja vesiviljeluse korralduskomiteele koondaruande õigeaegse esitamisega (31. juuliks 2006) tõsiseid raskusi.

a) Laevastike kirjeldus seoses püügivõimalustega

Liikmesriikide aruannetes esitati kalalaevastike üldine kirjeldus aluste arvu, võimsuse, si htliikide ja püügipiirkondade kaupa. Lisaks sellele kasutasid liikmesriigid erinevaid kalalaevastiku osadeks jagamise süsteeme: mõned liikmesriigid kasutasid MAGP IV jaotust, teised rakendasid riiklikke osadeks jagamise süsteeme. Põhimõtteliselt jagatakse riiklikud kalalaevastikud osadeks järgmiselt:

- Saksamaal, Prantsusmaal, Portugalis, Soomes ja Iirimaal (mõningate täiendustega) kasutatakse MAGP IV jaotust;

- Taanis ja Küprosel kalalaevade tüübi/püügivahendite/kogupikkuse järgi;

- Kreekas ja Sloveenias kogupikkuse ja püügivahendite järgi;

- Belgias püügivahendite järgi;

- Hispaanias, Lätis, Leedus ja Poolas geograafiliste püügipiirkondade ja kalalaevade tüübi järgi;

- Eestis ja Rootsis (selle erandiga, et näitajana kasutatakse püügipiirkondi) kogupikkuse, püügipiirkondade, püügivahendite ja kalaliikide järgi;

- Madalmaades jagatakse kaheks: vesiviljeluse ja emamaalaevastik (peamiselt kutrid).

Paljud liikmesriigid rõhutasid, et väikesemahulise rannapüügi laevastikul (moodustab rohkem kui 80% ühenduse kalalaevastikust) on väga tähtis sotsiaal-majanduslik mõju rannaäärsetele kogukondadele. Näiteks Rootsis ja Kreekas on selle sektori haldamise parandamine ja arendamine esmatähtis ülesanne.

Enamik liikmesriike proovisid aruannetes hinnata kalalaevastiku püügivõimsuse ja olemasolevate kalapüügivõimaluste vahelist tasakaalu. Olemasolevate kalavarude ja kalalaevastiku vahelise korrelatsiooni kindlaksmääramiseks kasutati erinevaid meetodeid. Mitu liikmesriiki analüüsis olemasolevate kalavarude ja püügivõimsuse muutuste seoseid kalalaevastiku kõikides osades. Mõned liikmesriigid kasutasid kalalaevastiku püügivõimsuse muutuse hindamisel sotsiaal-majanduslikku meetodit.

2005. aastal rakendasid liikmesriigid olemasolevate kalavarude ja kalalaevastike püügivõimsuse vahel parema tasakaalu saavutamiseks erinevaid meetmeid: kalalaevastike püügivõimsuse vähendamist, püügipäevade arvu vähendamist, kalavarudele juurdepääsu piiramist riiklikul tasandil, püügilitsentside arvu vähendamist, püügikvootide jagamist jne. Kõik liikmesriigid teatasid kalalaevastiku püügivõimsuse järk-järgulisest vähendamisest 2005. aastal nii GT-des kui kW-des, mis saavutati peamiselt tegevuse lõpetamise kavade abil.

b) Püügikoormuse vähendamise kava mõju püügivõimsusele

Nagu eespool osutati, kohaldasid liikmesriigid 2005. aastal erinevaid taastamise meetmeid ning püügikoormuse vähendamise kavasid. Püügikoormuse piirangud (mõned on sätestatud nõukogu määruses (EÜ) nr 27/2005[5]) mõjutasid kõiki Kattegatis, Põhjamerel ja Skagerrakis, šotimaa läänerannikuvetes, La Manche'i idaosas, Iiri merel, Biskaia lahes, Kantaabria merel ja Pürenee poolsaarest läänes ning Läänemerel kalastanud liikmesriike. Nende meetmete rakendamine tähendas merepäevade arvu ja kasutatavate püügivahendite piiramist.

Enamik asjaomaseid liikmesriike teatas püügikoormuse stabiilsest vähenemisest. Ühtlasi teatasid asjaomased liikmesriigid, et püügikoormuse vähenemine saavutati peamiselt erinevate püügikoormuse vähendamise ja tegevuse lõpetamise kavade rakendamisega nii ühenduse kui ka liikmesriigi tasandil. Mõned liikmesriigid väitsid, et kütusehindade tõus 2005. aastal mängis samuti olulist rolli püügikoormuse vähenemisel. Mõned liikmesriikide märkused 2005. aasta püügikoormuse kavade kohta:

Belgia: 2005. aastal hõlmas kalalaevastiku tegevus Põhjamerd, läänerannikuvete piirkonda ja Biskaia lahte, arvestades määruses 27/2005 sätestatud piirangutega. Igas piirkonnas pidi kalalaevastik (välja arvatud krevetipüügilaevad) pidama kinni kas taastamis- või majandamiskavast. Lisaks sellele piiratakse Belgias aastas lubatud merepäevade arvu laevastiku iga aluse kohta kõikides kalastuspiirkondades.

Teatud piimtraalidega varustatud kalalaevad pidasid merepäevade arvu piiramist tursavarude taastamise piirkonnas tõeliseks takistuseks. Merepäevade arvu kogu laevastiku kohta ei ületatud, kuna teatavad alused ei kasutanud oma päevi ära. Hoolimata merepäevade arvu piiramisest püüti kvoodid täis.

Taani: Põhjamere tursavarude taastamise kava mõju oli selline, et võrreldes 2004. aasta 81 330 merepäevaga viibiti merel 71 642 päeva, mis tähendab 12%-list vähenemist. Kalavarude majandamise ja laevastiku haldamise vahelisi seoseid lubatud kogupüügi/kvoodipiirangute ning püügikoormuse/püügivõimsuse osas uuriti vastava uurimisprojekti raames. Jõuti järeldusele, et majanduslikust seisukohast, mille kohaselt hinnatakse laevastiku majanduslikku suutlikkust kalavarude kasutamisel kõrgelt, tuleb laevastikku vähendada. Nelja lühiajalise stsenaariumi analüüs näitas, et aluste arv väheneks oluliselt kõikidel juhtudel, välja arvatud siis, kui piiratakse aluste tegevust (merepäevi). Pikemas perspektiivis võib oodatav tulemus väljenduda kalavarude märkimisväärses taastumises. Samas on võimalik saavutada samasugune tulemus laevastiku nõuetekohase haldamisega, mis on võrreldav kalavarude majandamisega. Töö kalalaevade arvu ja kalapüügivõimaluste vahelise tasakaalu leidmiseks jätkub.

Saksamaa: kuna kalalaevastik on väikesearvuline, oli püügikoormuse vähendamise kavade mõju püügivõimsusele väike, mõjutades valdavalt Läänemerel kalastamist. Kalalaevastiku haldamise süsteemi raames, mille eesmärk on saavutada püsiv tasakaal püügivõimsuse ja olemasolevate kalavarude vahel, peab Saksamaa kalalaevastik säilitama talle antud kvootide täitmiseks piisava võimsuse. Saksamaa kalalaevastiku areng näitab, et laevastik on kohanenud nii uuendatud ühise kalanduspoliitika raames kehtestatud majandustingimuste kui ka kalavarude piiratud kättesaadavusega. See ongi põhjus, miks Saksamaa ametiasutustel ei olnud vaja võtta meetmeid kalalaevastiku arendamiseks.

Eesti: järgitakse tursale kehtestatud lubatud kogupüügi piiranguid Läänemeres ning Loode-Atlandi kalastusorganisatsiooni taastamiskava vastavalt nõukogu määrusele (EÜ) nr 27/2005.

Kreeka: mitmeaastaseid majandamis- ja taastamiskavasid ei rakendatud, sest Vahemere kalavarude kohta sellised kavad puuduvad. Samal ajal jätkus nõukogu määruste (EÜ) nr 2792/1999 ja 2369/2002 alusel kalanduse rakenduskava raames püügivõimsuse ja kalapüügivõimaluste ümberkorraldusmeetmete rakendamine.

Hispaania: jätkati 2003. aastal alustatud kalalaevastiku uuendamist ja moderniseerimist vastavalt määruse 2371/2002 sätetele. Sellisel viisil oli võimalik oli koosseisu arvamiste / koosseisust väljaarvamiste abil säilitada püügivõimsuse ning sellest tulenevalt ka püügikoormuse mõningase vähenemise tendentsi.

2005. aastal rakendati Cadizi lahe kalastuspiirkonnas kahte riiklikku kava. Need olid seotud traalide ja seinnootadega püütavate kalavarude taastamise ja säästva majandamisega ning hõlmasid peamiselt püügikoormuse vähendamise meetmeid. Püügipäevade arvu vähendamisega suudeti eelmisel aastal vähendada püügikoormust ligikaudu 32%.

Prantsusmaa: 2005. aastal jäi Prantsusmaa emamaalaevastiku püügivõimsus samaks ja tegevuse lõpetamiseks riigiabi ei eraldatud. Uus tegevuse lõpetamise kava on ette nähtud aastaks 2006 ning see on suunatud kalalaevadele, millega püütakse ülepüütud kalavarusid. Taastamiskavade raames või lubatud kogupüügi ja kvootide määruse IV lisa sätete alusel vastu võetud püügikoormuse piirangud mõjutavad 850 laeva. Kõnealuste meetmete tulemusel püügivõimsust 2005. aastal ei vähendatud.

Iirimaa: kalavarude taastamise kavade rakendusalasse jäävad Iirimaa kalavarud on väga mitmekesised. Seetõttu on keeruline hinnata püügikoormuse vähendamise kavade mõju püügivõimsusele. Nõukogu määruse (EÜ) nr 27/2005 järgimiseks võttis Iirimaa kasutusele süsteemi, mille kohaselt on teatud piirkondades ja teatud püügivarustust kasutavad kalalaevad kohustatud täitma vormi „Merepäevade ametlik deklaratsioon“. Lisaks püügikoormuse vähendamise meetmetele, mis on seotud mitmeaastase tursavarude taastamise kavaga Iiri meres ja šotimaa läänerannikuvetes, on olemas ka üldine püügikoormuse kontrolli mehhanism, mida kohaldatakse põhjalähedaste liikide (kaasa arvatud krabide ja kammkarpide) suhtes üldiselt kõikides Iirimaad ümbritsevates vetes. Iirimaa jälgis nende kalavarude püügikoormuse taset ning kehtestas haldusmeetmed, mis tagaksid, et kalalaevastik ei ületa lubatud püügikoormust.

2005. aastal algatas Iiri merendusminister uue kava, mille eesmärk oli arvata laevastikust välja kuni 25% põhjalähedaste liikide püügiga tegelevatest vanematest, suurematest ja aktiivsematest (mitmeotstarbelised ja piimtraalid) laevadest ning arvata üleliigse püügivõimsuse likvideerimiseks välja osa kammkarpide püügiga tegelevatest alustest. Selle kava raames vähendati 2005. aastal kalalaevastikku 22 aluse võrra (kokku 2464 GT ja 7742 kW).

Itaalia: 2005. aastal registreeritud lossimiste vähenemist võib seostada nii aluste arvu kui ka tegevusaktiivsuse vähenemisega. Sellega seoses tuleks märkida, et kütuse hinna tõus on oluliselt mõjutanud püügipäevade arvu, sest paljud ettevõtjad olid sunnitud oma kalastusstrateegiat muutma, s.t piirama tegevuskulude kontrolli all hoidmiseks püügikoormust. 2005. aastal, nagu eelnevatelgi aastatel, andis püügivõimsuse vähendamine riigi toel häid tulemusi. Kuigi see pole mõjutanud koosseisu arvamise / koosseisust väljaarvamise kava järgimise hindamist, on püügikoormus Itaalia vetes absoluutarvudes märgatavalt vähenenud.

Küpros: kaks põhjatraalerit lammutati vanametalliks ja kaks anti kohalike muuseumite käsutusse. Kokku arvati kalalaevastikus lõplikult välja 2864 GT ja 5423 kW.

Läti: 2005. aastal anti riigi abiga vanarauaks 31 alust. Kõik alused arvati välja Läänemere kalalaevastikust. Peamiseks põhjuseks, miks laevaomanikud taotlesid tegevuse lõpetamist, oli Läänemere kalavarude kehv olukord. Kuna eriti kehvas seisus on tursavarud, oli enamik tegevuse lõpetanud laevadest tursapüügilaevad. Teisteks peamisteks mahakandmise põhjusteks olid laevade kõrge vanus ja kehv tehniline seisund ning kütuse hinna tõus ja muude kalapüügiga seotud kulutuste suurenemine.

Püügikoormuse vähendamise kava ja Läti kalalaevade riigiabita eksportimise või vanametalli andmise mõjul vähenes tursapüügilaevade võimsus 11%. Alates 1. maist 2004 on püügivõimsuse vähenemine mõjunud tursavarudele ja selle Läänemere kõige tähtsama kalavaru taastumisele positiivselt.

Leedu : võrreldes 2004. aastaga vähenes 2005. aastal Läänemerel ja selle rannikuvetes kalastavate kalalaevade püügivõimsus 1576 GT ja 3104 kW tänu sellele, et laevu lammutati riigiabi toel vanametalliks. Tänu Läänemerel kalastavate laevade püügivõimsuse 22%-lisele vähenemisele suurenesid ülejäänud laevade püügikvoodid.

Malta: eelmiste aastatega võrreldes jäid kalapüügi hooajalisus ja püügi tavad 2005. aastal üldjoontes samadeks, ilma et püügikoormus oleks üheski kalastuspiirkonnas suurenenud. Ühtegi püügikoormuse vähendamise kava ei rakendatud ning mingit mõju püügivõimsusele neil ei olnud. Malta kalavarusid majandati vastavalt nõukogu määrusele 813/2004, millega on kehtestatud püügikoormuse kontrolli meetmed Malta rannikuvetes. Malta kalalaevastiku poolt püütavate kalavarude olukord on nii hea, et püügivõimsust pole vaja vähendada.

Madalmaad: Hollandi kutter-laevastiku olukord on olnud juba aastaid murettekitav, sest kvoodid on vähenenud ja kulutused oluliselt suurenenud. Viimastel aastatel on märgatavalt vähenenud eelkõige lestapüügivõimalused. Seetõttu on ametiasutused ja kalatööstus töötanud välja mitu algatust, et vähendada survet lestavarudele. Üheks selliseks algatuseks on lõpetada osa kalalaevade tegevus, et seeläbi alaliselt vähendada püügivõimsust. Tänu sellele on püügivõimsus ja püügivõimalused paremini tasakaalus ning see aitab lestavarudel taastuda. Nimetatud algatuse tulemusena paranevad ka allesjäänud kalurite majandusväljavaated, sest püügivõimalused iga laeva kohta suurenevad.

Septembris 2005 jõustus merekalapüügivõimsuse vähendamist käsitlev määrus, mille tulemusel lõpetas tegevuse 29 alust ehk kokku 36092 kW ja 8982 GT. Osaliselt just tänu nimetatud määrusele kutrite arv vähenes, mis aitas saavutada paremat tasakaalu laevastiku ja püügivõimaluste vahel. 2005. aastal vähenes Hollandi kutter-laevastiku kilovatt-püügipäevade arv Põhjamere kalavarude taastamise kava alla kuuluvas piirkonnas võrreldes 2004. aastaga 15%. Ülejäänud kalalaevastiku kohta võib öelda, et selle suurus on kalavarude praegust suurust ja olukorda silmas pidades õigustatud. Varasemad püügivõimsuse vähendamised ja 2005. aastal aset leidnud püügivõimsuse vähendamine on loonud kalavarude ja kalalaevastiku suuruse vahel parema tasakaalu.

Poola: püügikoormuse vähendamise kava käivitati peamiselt seetõttu, et Läänemere tursapüügivõimsus on liiga suur ning kalapüügi tasuvus on väike. 2005. aastal lammutati vanarauaks või vahetas tegevusala 270 kalalaeva, mistõttu püügivõimsus vähenes alaliselt 15564 GT ja 42237 kW.

Portugal: kalalaevastiku tegevust on mõjutanud järgmised püügikoormuse piirangud: (sardiinide) noodapüügi keeld, uusmeremaa merluusi taastamise kava (nõukogu määrus (EÜ) nr 27/2005), Loode-Atlandi kalastusorganisatsiooni (NAFO) süvalesta taastamise kava ning süvamereliikide püüki käsitlevad määrused. Viimase puhul on Portugal kasutanud litsentsisüsteemi, et piirata laevade tegelemist süvamerekalastusega. 2005. aastal kiideti heaks 34 vähendamisettepanekut ning aasta jooksul lammutati emamaalaevastikust vanametalliks 25 alust, mille tulemusel vähenes võimsus 5011 GT ja 10123 kW.

Sloveenia: ei saa teatada püügikoormuse vähendamise kava mõjust püügivõimsusele, sest majandamis- ja taastamiskavasid pole Vahemere kalavarude kohta veel kehtestatud. Samuti pole Sloveenial kalalaevade tegevuse lõpetamise ega väljaarvamise kavasid.

Soome: töötati välja spetsiaalne püügivõimsuse vähendamise kava. Vajadus sellise kava järele oli tingitud sellest, et räime- ja kilupüügi võimsus on liiga suur, samuti on Läänemerel kehtestatud triivvõrguga püüdmise keeld. Soome rakendas püügivõimsuse vähendamise kava pelaagiliste traalerite ja passiivpüünistega laevade suhtes. Riigiabi toel vähendati võimsust 1378 GT ja 6025 kW.

Pelaagilise püügi koormus on märgatavalt vähenenud: ligikaudu 15% aastatel 2003–2005. Põhjalähedaste liikide (peamiselt tursa) püük veetavate püüniste ja passiivpüünistega vähenes 2005. aastal ligikaudu 79%, kuid see tohutu langus on seotud vaid väikese saagi ja üksikute alustega. Kõige rohkem on püügikoormus viimastel aastatel langenud lõhe, forelli ja mageveeliikide osas: ligikaudu 88%.

Rootsi: Põhjameres, Skagerrakis ja Kattegatis kehtestatud mitmeaastaste majandamis- ja taastamiskavade alusel on püügivõimsus väiksemate lubatud kogupüükide ja merepäevade väiksema arvu tõttu tasapisi langenud. Võimsuse vähendamisele on kaasa aidanud ka riiklikud eeskirjad, millega on muudetud traalipüügi piirkonda, kehtestatud suurusselektiivsete traalide kasutamise kohustus ning piiratud rannalähedast traali- ja noodapüüki. Spetsiaalne Läänemere tursapüügilitsents on piiranud seda liiki kalade püügi võimsust.

Pidades silmas põhjakalavarude murettekitavat olukorda Kattegatis ja Skagerrakis ning arvestades passiivpüünistega rannapüüki, on piiratud kalapüügivõimalusi rannalähedases traalipüügi piirkonnas. Piirangud tähendasid seda, et seinnoodaga kalastamine keelati veel kahes fjordisüsteemis. Ajalised piirangud on kehtestatud seinnoodaga kalastamisele tulede valgel. Pelaagilise heeringa püügi võimalused on samuti piiratud ja kõige suurematele pelaagilise püügi laevadele ei anta enam rannapüügilitsentse. Pelaagiline traalipüük on keelatud piirkondades, mis on iseäranis tähtsad lõkspüüniseid kasutavatele kaluritele.

Kokkuvõttes kinnitas enamik liikmesriike, et olemasolevad püügikoormuse vähendamise kavad on üldiselt andnud häid tulemusi ning aidanud saavutada püügivõimsuse ja püügivõimaluste vahelist tasakaalu. Lisaks sellele olid mõned liikmesriigid seisukohal, et püügivõimsuse ja püügikoormuse vähendamise meetmeid võiks tulevikus täiustada.

Näiteks Belgia märkis, et nende kalurid teavad juba ammu, et kalavarude tase pole sama, mis kümme aastat tagasi. Seetõttu kalurid mõistavad, et kalavarude säilitamiseks tuleb võtta teatavaid meetmeid ning et kalalaevastikku tuleb vähendada, nii et need, kes edasi tegutsevad, saaksid kalastada säästvalt ja majanduslikult tasuvalt. Et majandamis- või taastamiskavadest tulenevad piirangud oleksid kalurite jaoks usutavad ja vastuvõetavad, peavad need andma märgatavaid tulemusi siiski lühikese või keskmise ajavahemiku jooksul. Belgias läbi viidud uuring näitas, et kui arvestada praegust hinnastruktuuri ja püügivõimalusi, tuleks Belgia kalalaevastiku võimsust vähendada 10 000 kW võrra (s.o 15% kalalaevastiku praegusest võimsusest), et see lähiajal omadega välja tuleks.

Rootsi tegi samuti ettepaneku, et püügivõimsuse ja püügivõimaluste vahelise tasakaalu saavutamiseks tuleks võimsust veelgi vähendada. See on ka kalalaevastiku pikaajalise elujõulisuse saavutamise eeltingimuseks. Kalavarud jäävad järgnevatel aastatel tõenäoliselt samale tasemele, seega on oodata kalalaevade arvu jätkuvat vähendamist. Püügivõimsuse ja kalavarude vahelise tasakaalu saavutamiseks on samuti oluline ühendada laevastiku haldamine teiste meetmetega, näiteks kvootide ja püügivõimaluste eraldamise meetmete ning püügikoormuse ja püügivahendite piiramisega.

c) Tugevad ja nõrgad küljed

Koosseisu arvamise / koosseisust väljaarvamise kavast pidasid kõik liikmesriigid kinni. Enamikul juhtudel edastati riiklikku laevastikuregistrit käsitlevad andmed komisjonile edukalt vastavalt määrusele 26/2004. Siiski esines mõningaid organisatsioonilisi ning andmetöötlusega seotud raskusi, mis olid tingitud mõnede liikmesriikide piiratud haldussuutlikkusest. Raskustest hoolimata paranes 2005. aastal liikmesriikide poolt komisjonile edastatud andmete kvaliteet märgatavalt. Üheks tähtsamaks ülesandeks oli laevastikuregistri andmete jätkuv ristkontroll ja hoiatusteadete kontrollimine.

2005. aastal olid peaaegu kõikidel liikmesriikidel olemas toimivad kalandusandmete integreeritud infosüsteemid, mis sisaldasid sageli erinevaid tarkvararakendusi (laevastikuregistrid, võimsuse reguleerimine, kalalaevatunnistused, lossimisandmed, olemasolevad kvoodid, saagiaruandlus jne). 2005. aastal võeti Iirimaal ja Rootsis kasutusele kalanduse uued integreeritud infosüsteemid. Kalanduse integreeritud infosüsteemi kasutuselevõtu nimel oli tööd tehtud ka Sloveenias. Enamasti ühendavad need süsteemid mitut haldusasutust ning keskhaldusasutusi kohalike asutustega ning parandavad nii oluliselt riiklike kalalaevastike haldamist. Lisaks sellele väitsid liikmesriigid, et nende riiklikud registrid on täpsed, täielikud ja ajakohased.

d) Koosseisu arvamise / koosseisust väljaarvamise kava ja sihttasemete järgimine

Kõik liikmesriigid väitsid oma aruannetes, et täidavad kehtivaid koosseisu arvamise / koosseisust väljaarvamise eeskirju täielikult. Koosseisu arvamise / koosseisust väljaarvamise kava ja sihttasemete (kui on kohaldatav) täitmine 2005. aasta lõpu seisuga on esitatud 1. ja 2. tehnilises lisas. Andmete esitamiseks on kasutatud komisjoni määruses (EÜ) nr 1438/2003 sätestatud valemeid. Ühenduse laevastikuregistri andmete alusel koostatud tehnilised lisad annavad ülevaate nõuete täitmisest ühenduses ja eraldi kõikides liikmesriikides.

4. KOMISJONI JÄRELDUSED

Võrreldes 2004. aastaga on liikmesriikide esitatud aruannete kvaliteet paranenud. Mõned liikmesriigid esitasid ülimalt üksikasjaliku aruande, mille sisu oli kohati põhjalikum kui nõutud. Mitmed liikmesriigid ei pidanud siiski kinni aastaaruande esitamise tähtajast või komisjoni määruse (EÜ) nr 1438/2003 artikliga 13 kehtestatud aastaaruande vormist või sisust. Käesoleva aruande koostamise hetkeks ei olnud Ühendkuningriik oma aastaaruannet esitanud.

Liikmesriigid keskendusid oma aruannetes rohkem kalalaevastike riikliku halduskorra rakendamisele, kuid siiski on püügivõimsuse ja olemasolevate kalapüügivõimaluste tasakaalu põhjalikumalt hinnatud kui eelmistes aruannetes.

Emamaalaevastiku andmed (ühenduse laevastik, välja arvatud ühenduse äärepoolseimates piirkondades registreeritud alused):

Vastavalt ühenduse laevastikuregistri andmetele vähenes ühenduse laevastiku üldvõimsus aastatel 2003–2005 EL-15 liikmesriikides 117 000 GT ja 499 000 kW võrra, mis tähendab EL-15 laevastiku kogutonnaaži 6,27% ja mootorivõimsuse 7,28% netovähenemist. Netovähenemine 2005. aastal oli ligikaudu 50 000 GT, 2004. aastal oli see 23 000 GT ja 2003. aastal 44 000 GT. Vähenemine näib olevat suhteliselt väike, eriti kui arvestada suurt kalastussurvet enamikule ühenduse kalavarudele, eelkõige põhjalähedastele liikidele.

Uutes liikmesriikides on alates 1. maist 2004 püügivõimsust vähendatud 41 000 GT ja 101 000 kW võrra, mis moodustab 18% uute liikmesriikide laevastike kogutonnaažist ja 18% mootorivõimsusest, võrreldes nende püügivõimsusega liitumisel.

2003., 2004. ja 2005. aastal arvati ELi laevastikest ligikaudu 132 000 GT ja 427 000 kW välja riigiabi toel, mis tähendab, et seda võimsust ei saa asendada.

Riigi toel välja arvatud võimsusest arvati valdav osa (112 000 GT ja 373 000 kW) välja EL-15 liikmesriikides. Alates 1. maist 2004 on uutes liikmesriikides riigiabi toel välja arvatud 20 000 GT ja 54 000 kW.

1. tehnilise lisa tabelites 1 ja 2 on esitatud koosseisu arvamise / koosseisust väljaarvamise kava ja sihttasemete täitmine 31. detsembri 2005 seisuga. Enamik liikmesriike on eeskirju järginud. Kreeka ei täitnud tonnaaži osas koosseisu arvamise / koosseisust väljaarvamise kava, kuid mittevastavuse tase oli siiski väga väike, ületades tonnaaži piirtaset üksnes 0,29%. Kreeka ametiasutused on komisjoni hinnangu vaidlustanud. Nende hinnangul on Kreeka koosseisu arvamise / koosseisust väljaarvamise kava täitnud.

1. tehnilise lisa tabelites 3 ja 4 on esitatud püügivõimsuse muutumine ajavahemikul 1. jaanuar 2003 (uute liikmesriikide puhul 1. mai 2004) kuni 31. detsember 2005. Tabelites sisaldub ka aluste arv. Tabel 3 hõlmab kõiki liikmesriike. Üksikasjalikum hinnang liikmesriikide kaupa on esitatud 2. tehnilises lisas.

Äärepoolseimates piirkondades registreeritud laevastike andmed

Äärepoolseimates piirkondades registreeritud laevastike võimsus ja selle muutumine ajavahemikul 1. jaanuar 2003 kuni 31. detsember 2005 on esitatud tabelis 4. Tulemustest on näha, et Hispaania ja Portugali äärepoolseimates piirkondades registreeritud laevastike tonnaaž ja võimsus on märgatavalt vähenenud. Prantsusmaa ülemeredepartemangude osas on aluste koguarv ja nende tonnaaž veidi langenud, võimsus aga suurenenud.

3. tehnilise lisa tabelid kajastavad kõnealuste laevastike erikavade kohaldamist. 17-st äärepoolseima piirkonna laevastikuosast ületas 2005. aasta lõpus võimsuse sihttaseme üks laevastikuosa (4FJ – alla 12-meetrised alused Prantsuse Martinique’i departemangus) ning tonnaaži sihttaseme teine laevastikuosa (CA3 – üle 12-meetrised alused, mis on registreeritud Kanaari saartel ja kalastavad rahvusvahelistes või kolmandate riikide vetes). Erikava ei kohaldata laevastikuosade suhtes hetkest, mil nad saavutavad oma maksimaalse sihttaseme vastavalt nõukogu määrusele (EÜ) nr 639/2004.[6]

Üldised märkused

Nagu eespool märgitud, põhineb käesolev koondaruanne liikmesriikide aastaaruannetel ja ühenduse laevastikuregistrist saadud andmetel. Liikmesriikide esitatud aruannete ja ühenduse laevastikuregistrile esitatud deklaratsioonide andmetes on siiski mõned väikesed erinevused. Tänu liikmesriikide ja komisjoni tehtud jõupingutustele andmete ühtlustamiseks pole need erinevused laevastiku haldamise seisukohalt olulised. Siiski on vaja jätkata tööd erinevuste täielikuks kõrvaldamiseks. Liikmesriikide esitatud aruannetes toodud andmed ei muuda käesoleva aruande järeldusi.

Vastavalt nõukogu määruse (EÜ) nr 2371/2002 artiklile 16 peavad liikmesriigid, kes ei ole täitnud kõnealuse määruse artiklite 11, 13 ja 15 sätteid, vähendama oma püügikoormust sellise tasemeni, milline see oleks pidanud olema artiklite 11, 13 ja 15 täitmise korral. Lisaks võidakse proportsionaalselt vähendada neile Kalanduse Arendusrahastu raames antavat ühenduse finantsabi.

Aastaaruannete kvaliteedi parandamiseks tuleks komisjonil koostöös kalanduse ja vesiviljeluse korralduskomiteega kehtestada konkreetsed suunised aruannete sisu kohta ja võtta kasutusele ühtne metoodika, milles pööratakse rohkem tähelepanu püügivõimsuse muutuste ja kalavarude seoste analüüsile. Neid teemasid arutatakse kalanduse ja vesiviljeluse korralduskomitee järgmistel kohtumistel.

Järgmistes aastaaruannetes tuleks pöörata rohkem tähelepanu 2002. aastal ühenduse laevastiku haldamiseks kehtestatud uue korra mõjule laevastike ja kalavarude parema tasakaalu saavutamisel. Riiklike tegevuse lõpetamise kavade mõju, eelkõige püügikoormuse vähendamisele majandamis- või taastamiskavadega seotud kalavarude puhul, tuleks paremini määrata ja hinnata.

TECHNICAL ANNEX 1 – SUMMARY TABLES AND GRAPHS

Fleet Management in the reformed Common Fisheries Policy

a) Entry/Exit regime

From 1 January 2003 Member States have had to respect a strict entry-exit regime applying to the capacity of their fleets, measured in terms of both tonnage and power. Any entry of capacity into the fleet of a Member State has to be compensated by the previous exit of at least the same amount of capacity (ratio 1:1, “at any time”), unless the entry corresponds to works to improve safety, hygiene or living and working conditions on board (Article 11(5) of Council Regulation (EC) No 2371/2002). For entries of new vessels between 100 and 400 GT built with public aid (the administrative decisions granting aid were possible only until 31 December 2004) the Member State has to withdraw 35% more capacity than it introduces (ratio 1:1.35).

Another important rule is that capacity leaving the fleet with public aid cannot be replaced. Such capacity is subtracted directly from the fleet and also from the reference level established in accordance with Article 12 of Council Regulation (EC) No 2371/2002, and it therefore counts against the entry/exit regime in the ratio 0:1. Capacity reductions supported with public aid are therefore definitive.

All of this means that, as a general rule, the capacity of the national fleets cannot increase with respect to its levels on:

- 1 January 2003 for EU-15 Member States in accordance with Article 6 and 7 of Commission Regulation (EC) No 1438/2003;

- 1 May 2004 for new Member States in accordance with Article 1(2) and 1(3) of Commission Regulation (EC) No 916/2004.

In practice this is likely to be the case. However, the implementing rules for the fleet policy allow for the introduction of vessels outside the framework of the entry/exit regime in the case where administrative decisions have been made by the national authorities:

- between 1 January 2000 and 31 December 2002 for those vessels to enter the fleet after 1 January 2003 in EU-15 Member States and,

- between 1 May 2001 and 30 April 2004 for vessels which enter the fleet after 1 May 2004 in new Member States.

These entries have to take place at the most 3 years after the date of the administrative decision (i.e. for EU-15 Member States at the latest by the end of 2005 and for new Member States until 30 April 2007) and must comply with the rules that existed at that time, in particular Article 9 of the Council Regulation (EC) No 2792/1999 regarding Community structural assistance in the fisheries sector.

b) Reference Levels (mainland fleet)

The reference levels for the fleets of Member States are the sum of the global final objectives of Multiannual Guidance Programme (MAGP IV) as established by Article 12 of Council Regulation (EC) No 2371/2002. The general rule is that Member States may not exceed their reference levels at any time.

When a Member State undertakes decommissioning with public aid, these reference levels are automatically reduced by the amount of capacity scrapped. In addition, Member States which gave aid to construction of vessels until the end of 2004 will see their initial 2003 reference level reduced at least by 3% by the end of 2004.

Since the reference levels are a legacy of MAGP IV[7] (period 1997 – 2002), the Council decided that they would not apply to the new Member States (Council Regulation (EC) No 1242/2004[8]).

c) Management of fleet reference levels in the outermost regions

The fishing fleets registered in the Community outermost regions, namely the French Overseas Departments, the Spanish Canary Islands and the Portuguese Azores and Madera have to comply with specific reference levels for these regions in accordance with Council Regulation (EC) No 639/2004[9] and Commission Regulation (EC) No 2104/2004[10].

d) Measurement of tonnage

The measurement of the Community fleet is based on Council Regulation (EC) No 3259/94[11] and Commission Decision No 95/84/EC[12]. These legislative acts establish that the tonnage of vessels of 15 m in length or more has to be measured in accordance with the London Convention, i.e. as a function of the vessel’s total enclosed volume, while for vessels of less than 15 m in length, the regulation defines a system of tonnage calculation based on an estimate of the hull’s volume.

The fleet should have been entirely measured in accordance with Community law by 31 December 2003. Nevertheless, at the end of 2005, for some Member States there remained number of vessels that were not measured in GT.

In cases where the measurement of the fleet has not been completed, the tonnage figures used in this report are a mixture of GT and GRT. That is, for vessels whose GT tonnage is not available the GRT value is used.

e) Community Fishing Fleet Register

In 2004, the new Community Fleet Register was set up in accordance with Commission Regulation (EC) No 26/2004. It became operational on 1st September 2004. This change was necessary in order to follow up the new rules for managing the fishing capacity of the EU fleet which entered into force on 1st January 2003. This system, following the 2002 CFP reform , gives more responsibility to the Member States in achieving a better balance between the fishing capacity of their fleets and the available resources.

The main tool for monitoring the fishing fleet is the Community Fleet Register (CFR). According Commission Regulation (EC) No 26/2004, Member States are obliged on a quarterly basis ("snapshots" shall be sent on the first working day of March, June, September and December) to transmit electronically all relevant information on the characteristics of approximately 88,500 marine fishing vessels, together with information on entries to and exits from the fleet. Furthermore, the CFR is managed via web based application, called the Community Fleet Register On the Net (FRONT). The FRONT is also available for the general public on the following web page: http://ec.europa.eu/comm/fisheries/fleet/index.cfm

It is important to note that all information contained in the Technical Annexes 1, 2 and 3 has been taken from the CFR, with the exception of:

- data on entries corresponding to administrative decisions taken by national authorities before 1 January 2003 (or 1 May 2004 for the new Member States) and for which the special transitional provisions established in the regulation apply;

- data on exits with public aid in some cases where this was not available.

Only in these two cases has the information been taken directly from the Member States.

TECHNICAL ANNEX 3 - RESULTS OF THE OUTERMOST REGIONS FLEETS MANAGMENT

This annex shows Member States compliance at 31 December 2005, with the capacity levels for outermost regions in accordance with Council Regulation (EC) No 639/2004 and Commission Regulation (EC) No 2104/2004.

The reference levels for the outermost regions were fixed for each segment of the fleet on the 1 January 2003. At any later date, the reference level for each segment is calculated by deducting from the initial reference levels the capacity withdrawn with public aid for that particular segment.

It is in this way that the graphs presented below have been calculated. Each of the tables summarises the situation on 31 December 2005.
