EUROOPA ÜHENDUSTE KOMISJON,
võttes arvesse Euroopa Ühenduse asutamislepingut,
võttes arvesse nõukogu 23. juuni 1994. aasta direktiivi 94/28/EÜ, millega nähakse ette põhimõtted seoses zootehniliste ja genealoogiliste nõuetega, mida kohaldatakse loomade, nende sperma, munarakkude ja embrüote impordi suhtes kolmandatest riikidest, ning muudetakse direktiivi 77/504/EMÜ tõupuhaste aretusveiste kohta, ( 1 ) eriti selle artikli 3 lõiget 1,
ning arvestades järgmist:|

Direktiiviga 94/28/EÜ nähakse ette põhimõtted seoses zootehniliste ja genealoogiliste nõuetega, mida kohaldatakse teatavate tõupuhaste loomade, nende sperma, munarakkude ja embrüote impordi suhtes kolmandatest riikidest. |

Ilma et see piiraks veterinaar- ja rahvatervist käsitlevate ühenduse õigusaktide kohaldamist, võib direktiivi 94/28/EÜ kohaselt importida loomi ainult tõupuhtana või ristandina teatavate tingimuste täitmise korral. Üks kõnealustest tingimustest on, et pädev asutus on kandnud loomad kõnealuses direktiivis määratletud asutuse peetavasse tõuraamatusse või registrisse ning spermat, munarakke ja embrüoid võib importida ainult juhul, kui need pärinevad sellisesse tõuraamatusse või registrisse kantud loomalt. |

Ameerika Ühendriigid, Argentina, Bulgaaria, Iisrael, Island, Kanada ja Uus-Meremaa on edastanud komisjonile selliste pädevate asutuste loetelu, mis on heaks kiidetud pidama tõuraamatut või registrit vastavalt direktiivile 94/28/EÜ imporditavate tõupuhaste loomade kohta. |

Seepärast tuleks direktiivi 94/28/EÜ kohaldamiseks koostada nende pädevate asutuste loetelu, mis on heaks kiidetud pidama tõuraamatut või registrit käesolevas otsuses osutatud loomade ja toodete kohta. |

Käesoleva otsusega ettenähtud meetmed on kooskõlas alalise zootehnikakomitee arvamusega, |
ON VASTU VÕTNUD KÄESOLEVA OTSUSE:
Artikkel 1
Direktiivi 94/28/EÜ kohaldamiseks on käesoleva otsuse lisas esitatud nende pädevate asutuste loetelu, mis on heaks kiidetud pidama tõupuhaste aretusveiste, -sigade, -lammaste ja -kitsede, nende sperma, munarakkude ja embrüote ning sigade puhul ka ristandite tõuraamatut või registrit.
Artikkel 2
Liikmesriigid lubavad tõupuhaste veiste, sigade, lammaste ja kitsede, nende sperma, munarakkude ja embrüote ning sigade puhul ka ristandite importi ainult juhul, kui loomad on kantud tõuraamatusse või registrisse, mida peab käesoleva otsuse lisas loetletud pädev asutus.
Artikkel 3
Käesolev otsus on adresseeritud liikmesriikidele.
