concerning the election of the ►M2  diputado al Parlamento Europeo ◄ by direct universal suffrage

►M2  Artículo 1 ◄

1.  
En cada uno de los Estados miembros, los diputados al Parlamento Europeo serán elegidos por votación de listas o de voto único transferible, de tipo proporcional.
2.  
Los Estados miembros podrán permitir la votación de listas con voto de preferencia, según las modalidades que ellos establezcan.
3.  
La elección se hará por sufragio universal directo, libre y secreto.

►M2  Artículo 2 ◄

En función de sus características nacionales, los Estados miembros podrán constituir circunscripciones para las elecciones al Parlamento Europeo o establecer otra subdivisión electoral, sin que ello desvirtúe globalmente el carácter proporcional del sistema electoral.

►M2  Artículo 3 ◄

Los Estados miembros podrán establecer un umbral mínimo para la atribución de escaños. A escala nacional, este umbral no podrá ser superior al 5 % de los votos emitidos.

►M2  Artículo 4 ◄

Cada uno de los Estados miembros podrá establecer un límite máximo para los gastos de los candidatos relativos a la campaña electoral.

►M2  El período quinquenal para el que son elegidos los diputados al Parlamento Europeo ◄ shall begin at the opening of the first session following each election.

It may be extended or curtailed pursuant to the second subparagraph of Article 11 (2).

The term of office of each ►M2  diputado al Parlamento Europeo ◄ shall begin and end at the same time as the period referred to in ►M2  apartado 1 ◄ .

1.  
►M2  Diputado al Parlamento Europeo ◄ shall vote on an individual and personal basis. They shall not be bound by any instructions and shall not receive a binding mandate.

A partir de las elecciones al Parlamento Europeo del año 2004, la condición de diputado al Parlamento Europeo será incompatible con la condición de parlamentario nacional.

No obstante, y sin perjuicio de lo dispuesto en el apartado 3,

los miembros del Parlamento nacional irlandés que sean elegidos diputados al Parlamento Europeo en unas elecciones posteriores podrán ejercer simultáneamente ambos mandatos hasta las siguientes elecciones al Parlamento nacional irlandés, aplicándose a partir de entonces lo dispuesto en el primer párrafo del presente apartado,
— 
los miembros del Parlamento nacional del Reino Unido que sean también diputados al Parlamento Europeo durante el período quinquenal que preceda a las elecciones al Parlamento Europeo del año 2004 podrán ejercer simultáneamente los dos mandatos hasta las elecciones del año 2009 al Parlamento Europeo, aplicándose a partir de entonces lo dispuesto en el primer párrafo del presente apartado.

In addition, each Member State may, in the circumstances provided for in ►M2  artículo 8 ◄ , ►M2  ampliar ◄ rules at national level relating to incompatibility.

►M2  Diputado al Parlamento Europeo ◄ to whom ►M2  apartados 1, 2 y 3 ◄ become applicable in the course of the five-year period referred to in Article 5 shall be replaced in accordance with Article 13.

Salvo lo dispuesto en el presente Acto, el procedimiento electoral se regirá, en cada Estado miembro, por las disposiciones nacionales.

Dichas disposiciones nacionales, que podrán en su caso tener en cuenta las particularidades existentes en los Estados miembros, no deberán desvirtuar globalmente el carácter proporcional del modo de elección.

No one may vote more than once in any election of ►M2  diputado al Parlamento Europeo ◄ .

►M2  Artículo 10 ◄

1.  
Elections to the European Parliament shall be held ►M2  en la fecha y en las horas fijadas ◄ by each Member State; for all Member States this date shall fall within the same period starting on a Thursday morning and ending on the following Sunday.
2.  
►M2  Ningún Estado miembro podrá hacer públicos oficialmente sus resultados electorales ◄ until after the close of polling in the Member State whose electors are the last to vote within the period referred to in paragraph 1.

►M2  Artículo 11 ◄

1.  
The Council, acting unanimously after consulting the European Parliament, shall determine the ►M2  el período electoral ◄ for the first elections.
2.  
Subsequent elections shall take place in the corresponding period in the last year of the five-year period referred to in Article 5.

Should it prove impossible to hold the elections in the Community during that period, the Council acting unanimously shall, after consulting the European Parliament, ►M2   ►C2  fijará, al menos un año antes del final del período quinquenal contemplado en el artículo 5, otro período electoral que podrá ser anterior en dos meses como máximo o posterior en un mes como máximo ◄  ◄ or one month after the period fixed pursuant to the preceding subparagraph.

3.  
Without prejudice to ►M2  Article 22 of the Treaty establishing the European Coal and Steel Community, ◄ Article 229 of the Treaty on the Functioning of the European Union ( *1 ) and Article 106a of the Treaty establishing the European Atomic Energy Community ( *2 ), the European Parliament shall meet, without requiring to be convened, on the first Tuesday after expiry of an interval of one month from the end of the ►M2  período electoral ◄ .
4.  
The powers of the outgoing European Parliament shall cease upon the opening of the first sitting of the new European Parliament.

►M2  Artículo 12 ◄

►M2  Pending the entry into force of the uniform electoral procedure referred to in Article 7 (1), ◄ The European Parliament shall verify the credentials of ►M2  diputado al Parlamento Europeo ◄ . For this purpose it shall take note of the results declared officially by the Member States and shall rule on any disputes which may arise out of the provisions of this Act other than those arising out of the national provisions to which the Act refers.

►M2  Artículo 13 ◄

1.  
Un escaño quedará vacante cuando el mandato de un diputado al Parlamento Europeo expire debido a su dimisión, a su fallecimiento o a la anulación de su mandato.
2.  
Salvo lo dispuesto en el presente Acto, cada Estado miembro establecerá los procedimientos adecuados para que, en caso de quedar vacante un escaño, éste sea ocupado durante el resto del período quinquenal contemplado en el artículo 5.
3.  
Cuando la legislación de un Estado miembro establezca expresamente la anulación del mandato de un Diputado al Parlamento Europeo, su mandato expirará en aplicación de las disposiciones de esa legislación. Las autoridades nacionales competentes informarán de ello al Parlamento Europeo.
4.  
Cuando un escaño quede vacante por dimisión o fallecimiento, el Presidente del Parlamento Europeo informará de ello sin tardanza a las autoridades competentes del Estado miembro de que se trate.

Should it appear necessary to adopt measures to implement this Act, the Council, acting unanimously on a proposal from the European Parliament after consulting the Commission, shall adopt such measures after endeavouring to reach agreement with the European Parliament in a conciliation committee consisting of the Council and representatives of the European Parliament.

Declaration on Article 14

As regards the procedure to be followed by the Conciliation Committee, it is agreed to have recourse to the provisions of paragraphs 5, 6 and 7 of the procedure laid down in the joint declaration of the European Parliament, the Council and the Commission of 4 March 1975 ( 1 ).
