por el que se modifica el Reglamento (CE) n° 2368/2002 del Consejo por el que se aplica el sistema de certificación del Proceso de Kimberley para el comercio internacional de diamantes en bruto y por el que se rectifica el Reglamento (CE) n° 257/2003 de la Comisión

LA COMISIÓN DE LAS COMUNIDADES EUROPEAS,

Visto el Tratado constitutivo de la Comunidad Europea,

Visto el Reglamento (CE) n° 2368/2002 del Consejo, de 20 de diciembre de 2002, por el que se aplica el sistema de certificación del Proceso de Kimberley para el comercio internacional de diamantes en bruto(1), cuya última modificación la constituye el Reglamento (CE) n° 257/2003(2), y, en particular, los apartados 3 y 6 de su artículo 19 y su artículo 20,

Considerando lo siguiente:

(1) El artículo 20 del Reglamento (CE) n° 2368/2002, modificado por el Reglamento (CE) n° 254/2003 del Consejo(3), prevé la modificación de la lista de participantes del sistema de certificación del Proceso de Kimberley, incluidos los miembros de la OMC y los territorios aduaneros independientes que satisfacen los requisitos de dicho sistema.

(2) La Presidencia del sistema de certificación del Proceso de Kimberley y los participantes en el mismo han proporcionado a la Comisión la información pertinente referente al estatuto de participante de, en particular, Argelia, Brasil, Chipre, Hungría, Malasia, Noruega, República Checa, República del Congo, República Popular Democrática de Corea, Venezuela y el territorio aduanero independiente de Taiwán, Penghu Kinmen y Matsu, así como información adicional relativa a otros participantes. La información adicional se refiere a Emiratos Árabes Unidos, China, Ghana, Guinea, Hong Kong, Japón, Laos, Mauricio, Sierra Leona, Tailandia, Togo, Ucrania y Vietnam. Procede, por lo tanto, modificar el anexo II de la manera correspondiente.

(3) El artículo 2 del Reglamento (CE) n° 257/2003 aspiraba a limitar únicamente la aplicación del apartado 1 del artículo 1 a un período renovable de tres meses. Procede, por lo tanto, rectificar el artículo 2 de dicho Reglamento de la manera correspondiente.

(4) Las medidas previstas en el artículo 2 del presente Reglamento se ajustan al dictamen del Comité a que se refiere el artículo 22 del Reglamento (CE) n° 2368/2002.

HA ADOPTADO EL PRESENTE REGLAMENTO:

Artículo 1

El anexo II del Reglamento (CE) n° 2368/2002 será sustituido por el anexo del presente Reglamento.

Artículo 2

La segunda frase del artículo 2 del Reglamento (CE) n° 257/2003 será rectificada de la manera siguiente:"El apartado 1 del artículo 1 del presente Reglamento surtirá efecto durante un período de tres meses a partir de tal fecha.".

Artículo 3

El presente Reglamento entrará en vigor el día siguiente al de su publicación en el Diario Oficial de la Unión Europea.

El presente Reglamento surtirá efecto hasta el 12 de mayo de 2003.

El presente Reglamento será obligatorio en todos sus elementos y directamente aplicable en cada Estado miembro.
