Decisión del Consejo

de 10 de febrero de 2004

que modifica la Decisión 2001/264/CE por la que se adoptan las normas de seguridad del Consejo

EL CONSEJO DE LA UNIÓN EUROPEA,

Visto el Tratado constitutivo de la Comunidad Europea, y en particular el apartado 3 de su artículo 207,

Vista la Decisión 2002/682/CE, Euratom del Consejo, de 22 de julio de 2002, por la que se aprueba su Reglamento interno(1), y en particular su artículo 24,

Considerando lo siguiente:

(1) Los apéndices 1 y 2 de las normas de seguridad del Consejo de la Unión Europea anejos a la Decisión 2001/264/CE(2) contienen respectivamente una lista de Autoridades Nacionales de Seguridad (ANS) y un cuadro comparativo de las clasificaciones de seguridad nacionales.

(2) El 16 de abril de 2003, la República Checa, la República de Estonia, la República de Chipre, la República de Letonia, la República de Lituania, la República de Hungría, la República de Malta, la República de Polonia, la República de Eslovenia y la República Eslovaca firmaron el Tratado relativo a su adhesión a la Unión Europea(3).

(3) De acuerdo con el apartado 2 del artículo 2 de la Decisión 2001/264/CE, dichos Estados deben tomar medidas adecuadas para garantizar el respeto de las normas de seguridad del Consejo cuando se trate información clasificada de la Unión Europea.

(4) A fin de tener en cuenta a estos Estados en los apéndices mencionados, es necesario, desde un punto de vista técnico, modificar la Decisión 2001/264/CE.

(5) El apéndice 2 de la Decisión 2001/264/CE indica que la correspondencia con las categorías de clasificación de la OTAN se determinará cuando se negocie el acuerdo de seguridad entre la Unión Europea y la OTAN.

(6) El 14 de marzo de 2003 se firmó un Acuerdo(4) sobre la seguridad de la información entre la Unión Europea y la OTAN.

(7) Es por consiguiente necesario introducir la correspondencia con los niveles de clasificación de la OTAN en el apéndice 2 de la citada Decisión.

DECIDE:

Artículo 1

La Decisión 2001/264/CE queda modificada como sigue:

a) El apéndice 1 se sustituye por el documento que figura en el anexo I de la presente Decisión;

b) el apéndice 2 se sustituye por el documento que figura en el anexo II de la presente Decisión.

Artículo 2

1. La presente Decisión surtirá efecto el día de su publicación.

2. La presente Decisión únicamente será aplicable a reserva y en la fecha de la entrada en vigor del Tratado de adhesión de 2003, firmado en Atenas el 16 de abril de 2003.
