Bruselas, 17.03.2005 COM(2005) 95 final Propuesta de DECISIÓN DEL CONSEJO por la que se establece la postura que ha de adoptarse, en nombre de la Comunidad, en el Consejo internacional de los cereales y en el Comité de ayuda alimentaria (presentada por la Comisión) EXPOSICIÓN DE MOTIVOS El Acuerdo internacional sobre los cereales de 1995 se compone de dos partes: el Convenio sobre ayuda alimentaria (1999) y el Convenio sobre el comercio de cereales (1995). El Convenio sobre ayuda alimentaria de 1999 (CAA) fue aprobado por la Comunidad mediante la Decisión 2000/421/CE del Consejo. Dicho Acuerdo permanecerá en vigor hasta el 30 de junio de 2005, tras haber sido prorrogado mediante decisión del Comité de ayuda alimentaria, el 23 de junio de 2003. El Convenio sobre el comercio de cereales de 1995 (CCC) fue prorrogado hasta el 30 de junio de 2005 mediante decisión del Consejo sobre el comercio de los cereales, el 24 de junio de 2003. Tanto la Comisión como los Estados miembros tienen interés en introducir algunos cambios específicos, que consideran necesarios, en el actual Convenio sobre ayuda alimentaria y coinciden en que dichos cambios han de discutirse entre los miembros del Convenio durante la última prórroga concedida de dos años. No obstante, es prematuro llegar a un acuerdo sobre los citados cambios en estos momentos ya que tienen relación con las negociaciones que se están llevando a cabo actualmente en el Programa de Doha para el Desarrollo de la OMC, incluidas las conversaciones sobre las normas y disciplinas aplicables a toda la ayuda alimentaria en este marco. Por consiguiente, es necesario ampliar la duración de ambos convenios hasta obtener el resultado de las negociaciones de la OMC y por un período de hasta dos años. Con este propósito, la Decisión por la que se autoriza a la Comisión para negociar en nombre de la Comunidad Europea la revisión del Convenio sobre ayuda alimentaria de 1999, adoptada por el Consejo el 27 de noviembre de 2003, deberá seguir siendo aplicable implícitamente hasta el final de la prórroga propuesta del Convenio sobre ayuda alimentaria. Repercusiones financieras La participación comunitaria en el presupuesto administrativo del Acuerdo internacional sobre los cereales, que comprende los dos Convenios, se inscribe en la partida 05 06 01 (ex B7-8210) del presupuesto de la Unión Europea (Acuerdos Internacionales de Agricultura). El compromiso de la CE de suministrar ayuda alimentaria mediante el Convenio sobre ayuda alimentaria implica gastos en las partidas 21 02 01 (Productos movilizados en virtud del Convenio sobre ayuda alimentaria) y 21 02 02 (Otras ayudas en forma de productos, acciones de apoyo y transporte, distribución, medidas complementarias y de control de la ejecución). Conclusiones - La Comisión propone que el Consejo autorice a la Comisión para votar en nombre de la Comunidad Europea, de conformidad con el artículo XXV(b) del Convenio sobre ayuda alimentaria de 1999, a favor de ampliar la prórroga de dicho Convenio por un periodo de hasta dos años; - la Comisión propone que el Consejo autorice a la Comisión para votar en nombre de la Comunidad Europea, de conformidad con el artículo 33, apartado 2, del Convenio sobre el comercio de cereales de 1995, a favor de ampliar la prórroga de dicho Convenio por un periodo de hasta dos años. La prórroga de ambos Acuerdos beneficia a la Comunidad. En lo que respecta a la citada prórroga, el mandato del Consejo a la Comisión para negociar la revisión del Convenio sobre ayuda alimentaria es aplicable durante el mismo periodo. Propuesta de DECISIÓN DEL CONSEJO por la que se establece la postura que ha de adoptarse, en nombre de la Comunidad, en el Consejo internacional de los cereales y en el Comité de ayuda alimentaria EL CONSEJO DE LA UNIÓN EUROPEA, Visto el Tratado constitutivo de la Comunidad Europea, y en particular, su artículo 181, en relación con su artículo 300, apartado 2, Vista la propuesta de la Comisión, Considerando lo siguiente: El Convenio sobre ayuda alimentaria de 1999 fue aprobado por la Comunidad mediante la Decisión 2000/421/CE[1] del Consejo y prorrogado mediante decisión del Comité de ayuda alimentaria, en junio de 2003. Dicho Acuerdo sigue en vigor hasta el 30 de junio de 2005. La ampliación de la prórroga de este Acuerdo hasta dos años más beneficia a la Comunidad y a los Estados miembros. Por consiguiente, la Comisión, que representa a la Comunidad en el Comité de ayuda alimentaria, debe estar autorizada mediante una Decisión del Consejo para votar a favor de la citada prórroga. El Convenio sobre el comercio de cereales de 1995 fue aprobado por la Comunidad mediante la Decisión 96/88/CE[2] del Consejo, y modificado y prorrogado en junio de 1999 por la Decisión 1999/C262/01 del Consejo por un periodo de dos años[3]. Dicho Acuerdo fue prorrogado por última vez mediante decisión del Consejo sobre el comercio de cereales en junio de 2003 y sigue en vigor hasta el 30 de junio de 2005. La ampliación de la prórroga de este Acuerdo hasta dos años más beneficia a la Comunidad y a los Estados miembros. Por consiguiente, la Comisión, que representa a la Comunidad en el Convenio sobre el comercio de cereales, debe estar autorizada mediante una Decisión del Consejo para votar a favor de la citada prórroga. DECIDE: Artículo único La Comunidad Europea está a favor de que el Convenio sobre el comercio de cereales de 1995 se prorrogue por un período adicional de hasta dos años. La Comunidad Europea está a favor de que el Convenio sobre ayuda alimentaria de 1999 se prorrogue por un período adicional de hasta dos años. Se autoriza a la Comisión para que exprese su postura en el Consejo internacional de los cereales y en el Comité de ayuda alimentaria. DESCRIPTION AND GROUNDS Need for Community intervention Because of its economic importance, especially in the agricultural sector, the EC must be represented in international agricultural agreements, which represent an important means for following global developments and defending Community interests for the products concerned. The payment of EC membership contributions enables the objectives of the International Grains Council (IGC) to be attained. The IGC, which is responsible for administering the Agreements relating to the Grains Trade Convention, 1995 and the Food Aid Convention, 1999, promotes the objectives of the Agreements, including international cooperation, exchange of statistical information and forecasting market trends, etc., and for the Food Aid Convention the guarantee that developing countries are ensured a minimum amount of food aid by the European Union. It is therefore in the interests of the EC to be a part of the Agreements. The membership contributions are determined on an annual basis and are due for as long as the EC is a member of the Agreements. It is clear that if the EC had to carry out on its own the same actions as are carried out by the IGC, the total cost of these would be much greater than the cost of the membership contributions. Actions envisaged and arrangements for budget intervention The EC pays membership dues on an annual basis for the International Grains Council. The dues are paid for as long as the EC remains a signatory to the Agreements. The European Community and the Member States participate fully in the activities of the IGC and take full advantage of the benefits of membership. FINANCIAL IMPACT Total financial impact on Part B Commitments (to the 3rd decimal place): EUR 0.930 million for the period of two years. €0.465 million cost is estimated for each year. Calculation The expenditure involved in the application of the two Conventions is covered by annual contributions from all members of the Grains Convention. The contribution of each member for each financial year is fixed in proportion to the number of votes attributed to that member in relation to the total number of votes held by members. The number of votes attributed to each member is adjusted on the basis of the composition of the IGC when the budget for the financial year in question is adopted. There is a total of 2 000 votes in the Convention, of which the European Union holds 410 for 2004/05 (after enlargement). The same figure is projected for 2005/06 and for 2006/07. The estimated cost per vote for the period of extension is €1 134 (410 votes x €1 134/vote = €465 000). The amounts are total expenditure for twelve months. FOLLOW-UP AND EVALUATION Follow-up arrangements The Commission services will participate fully in the Administrative Committees and Council of the IGC; these are the bodies responsible for determining budgetary contributions. A report of these meetings and of the decisions taken in the course of these meetings is published and is freely available to members. Details and frequency of planned evaluations In view of the specific nature of the proposed intervention (extension of Community contribution to the administrative budget of the International Grains Agreement) and of the relatively small sum involved, an external evaluation does not seem justified. The relevance and usefulness of continuing with a contribution to the administrative budget of this Agreement will be evaluated internally, at regular intervals, by means of active Commission involvement in the management committees and in the International Grains Council. ANTI-FRAUD MEASURES The execution and the control of EC contributions are checked in conformity with the rules foreseen by the IOOC Agreement. Specific modalities of audit and control are laid down within the legal basis of this international organisation. The accounts of this organisation are certified by an independent external auditor.
