establishing the format of the carbon footprint declaration for batteries in accordance with Regulation (EU) 2023/1542 of the European Parliament and of the Council

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2023/1542 of the European Parliament and of the Council of 12 July 2023 concerning batteries and waste batteries, amending Directive 2008/98/EC and Regulation (EU) 2019/1020 and repealing Directive 2006/66/EC 1 , and in particular Article 7(1), fourth subparagraph, point (b) thereof,
Whereas:
(1)Regulation (EU) 2023/1542 and in particular Article 7(1) thereof, provides that certain categories of batteries are to be accompanied by a carbon footprint declaration when placed on the Union market.
(2)Article 7(1) of Regulation (EU) 2023/1542 provides a list of minimum information that is to be included in the carbon footprint declaration. This list applies to all categories of batteries that are to be accompanied by the declaration.
(3)The Commission is to lay down the format of those carbon footprint declarations by means of implementing acts. To ensure uniform conditions in the implementation of the carbon footprint declarations and to provide legal certainty as soon as possible, one single format for the declaration of all categories of batteries included in Article 7 of Regulation (EU) 2023/1542 should be set out.
(4)The measures provided for in this Regulation are in accordance with the opinion of the committee established by Article 39 of Directive 2008/98/EC of the European Parliament and of the Council 2 ,
HAS ADOPTED THIS REGULATION:
Article 1
The format to be used for drawing up the carbon footprint declaration for batteries referred to in Article 7(1), first subparagraph, of Regulation (EU) 2023/1542 is established in the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
