COUNCIL IMPLEMENTING REGULATION (EU) 2023/2793

of 11 December 2023

implementing Regulation (EU) 2023/1529 concerning restrictive measures in view of Iran’s military support of Russia’s war of aggression against Ukraine

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Regulation (EU) 2023/1529 of 20 July 2023 concerning restrictive measures in view of Iran’s military support of Russia’s war of aggression against Ukraine (1), and in particular Article 7(1) thereof,

Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

On 20 July 2023, the Council adopted Regulation (EU) 2023/1529.

In its conclusions of 20 and 21 October 2022, 15 December 2022, 23 March 2023, 29 and 30 June 2023, and 26 and 27 October 2023, the European Council strongly condemned the military support to Russia’s war of aggression provided by the Iranian authorities, which must stop.

In its conclusions of 12 December 2022, the Council strongly condemned and considered unacceptable any type of military support by Iran, including deliveries of unmanned aerial vehicles (UAVs), to Russia’s illegal, unprovoked and unjustified war of aggression against Ukraine, which grossly violates international law and the principles of the Charter of the United Nations. The weapons provided by Iran are being used indiscriminately by Russia against Ukraine’s civilian population and infrastructure, causing horrendous destruction and human suffering.

Russia is using Iran-produced UAVs in support of its war of aggression, which violates the sovereignty, independence and territorial integrity of Ukraine, including against civilians and civilian infrastructure. The Iranian State-sponsored programme for the development and production of UAVs therefore contributes to violations of the Charter of the United Nations and of fundamental principles of international law. The programme is run by the Ministry of Defence and Armed Forces Logistics of Iran and the Islamic Revolutionary Guard Corps, which are both sanctioned by the Union, and includes the procurement, development, production and transfer of UAVs, notably to Russia. It is based on State-owned as well as private companies and benefits from domestic research capabilities.

In that context, six persons and five entities should be included in the list of natural and legal persons, entities and bodies subject to restrictive measures set out in Annex III to Regulation (EU) 2023/1529.

The title of Regulation (EU) 2023/1529 in certain language versions should be amended in order to correspond to the title of Council Decision (CFSP) 2023/1532 (2).

(7)

Regulation (EU) 2023/1529 should therefore be amended accordingly,

HAS ADOPTED THIS REGULATION:

Article 1

Regulation (EU) 2023/1529 is amended as follows:

(1)

the title is replaced by the following:

‘Council Regulation (EU) 2023/1529 of 20 July 2023 concerning restrictive measures in view of Iran’s military support to Russia’s war of aggression against Ukraine’;

(2)

Annex III is amended in accordance with the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the date of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
