correcting Directive 2009/45/EC of the European Parliament and of the Council on safety rules and standards for passenger ships
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Directive 2009/45/EC of the European Parliament and of the Council of 6 May 2009 on safety rules and standards for passenger ships (1), and in particular Article 10(2) and (3) thereof,
Whereas:

Commission Delegated Regulation (EU) 2020/411 (2) contained an error in the amended Section 2, Chapter II-1, Part B of Annex I to Directive 2009/45/EC. |
(2) |
Section 2, Chapter II-1, Part B of Annex I to Directive 2009/45/EC as amended by Delegated Regulation (EU) 2020/411 does not exclude Regulation 8.1 from the scope of application of the respective part of the International Convention for the Safety of Life At Sea, done at London on 1 November 1974 (the 1974 SOLAS Convention), as amended, to passenger ships of category B, C, and D. |

During the negotiations over the draft of Delegated Regulation (EU) 2020/411, experts agreed that Safe Return to Port requirements encoded in Regulation 8.1 of Chapter II-1, Part B of the 1974 SOLAS Convention should not apply to passenger ships of category B, C, and D, as it would be disproportionate considering the circumstances under which those categories of ships operate. |

Directive 2009/45/EC should therefore be corrected accordingly, |
HAS ADOPTED THIS REGULATION:
Article 1
In Section 2, Chapter II-1 of Annex I to Directive 2009/45/EC, Part B is replaced by the following:
‘PART B – INTACT STABILITY, SUBDIVISION AND DAMAGE STABILITY
Ships shall apply the requirements in the appropriate provisions of SOLAS Chapter II-1, parts B to B-4, as amended, with the exception of Regulation 8.1.’
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION REGULATION (EU) 2022/1181

amending the preamble of Annex V to Regulation (EC) No 1223/2009 of the European Parliament and of the Council on cosmetic products

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 1223/2009 of the European Parliament and of the Council of 30 November 2009 on cosmetic products (1), and in particular Article 31(1) thereof,
Whereas:

The substance formaldehyde (CAS No 50-00-0, EC No 200-001-8) has been classified as a carcinogen (Category 1B) and a skin sensitizer (Category 1) in Part 3 of Annex VI to Regulation (EC) No 1272/2008 (2). According to Article 15 of Regulation (EC) No 1223/2009, substances classified as carcinogenic of category 1B in that Annex are to be prohibited from use in cosmetic products. Therefore, the use of formaldehyde as such has been prohibited in cosmetic products and is currently listed in entry 1577 of Annex II to Regulation (EC) No 1223/2009. |

Annex V to Regulation (EC) No 1223/2009 contains a list of substances allowed for use in cosmetic products as preservatives. Certain of those preservatives are gradually releasing formaldehyde in order to fulfil a preserving function in the final cosmetic product (so called formaldehyde releasers). Formaldehyde releasers are used in both leave-on and rinse-off cosmetic products. |

In order to inform consumers sensitised to formaldehyde about the presence of formaldehyde that may trigger an allergic reaction, it is set out in point 2 of the preamble of Annex V to Regulation (EC) No 1223/2009 that all finished products containing substances which are listed in that Annex and which release formaldehyde are to be labelled with the specific warning ‘contains formaldehyde’ where the concentration of formaldehyde in the finished product exceeds 0,05 %. |

The Scientific Committee on Consumer Safety (SCCS) concluded, in its scientific advice of 7 May 2021 (3), that the present threshold of 0,05 % (500 ppm) does not sufficiently protect consumers sensitised to formaldehyde. The SCCS further concluded that in order to protect the vast majority of those consumers, the current threshold for the labelling requirement should be reduced to 0,001 % (10 ppm), which should apply to the total formaldehyde released irrespective of whether a product contains one or more formaldehyde releaser(s). |

In light of the SCCS opinion, it can be concluded that the potential risk to human health arising from the use of certain substances that release formaldehyde in finished cosmetic products justify a lower threshold regarding the requirement to label such products with the specific warning ‘contains formaldehyde’ than the one currently applicable. That threshold should be decreased as proposed by the SCCS. Regulation (EC) No 1223/2009 should therefore be amended accordingly. |

The industry should be allowed a reasonable period of time to adapt to the new requirements by making the necessary adjustments to labelling, as well as to product formulations that are necessary to ensure that only cosmetic products complying with the new requirements are placed on the market. Economic operators should also be allowed a reasonable period of time to withdraw cosmetic products which do not comply with the new requirements from the market and which were placed on the market before the new labelling provision becomes applicable. Therefore, considering the relatively low risk associated to formaldehyde releasers and the large number of cosmetic products concerned the transition period should be 24 and 48 months, respectively. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Cosmetic Products, |
HAS ADOPTED THIS REGULATION:
Article 1
Point 2 to the Preamble of Annex V to Regulation (EC) No 1223/2009 is replaced by the following:
‘2. |
All finished products containing substances which are listed in this Annex and which release formaldehyde shall be labelled with the warning “releases formaldehyde” where the total concentration of formaldehyde released in the finished product exceeds 0,001 % (10 ppm), irrespective of whether the finished product contains one or more substances releasing formaldehyde. However, all finished products containing substances referred to in the first subparagraph which comply with Regulation (EC) No 1223/2009 as applicable on 30 July 2022 may be placed on the Union market until 31 July 2024 and be made available on the Union market until 31 July 2026.’ |
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

Pursuant to Article 50(2)(a) of Regulation (EU) No 1151/2012, Hungary’s application to register the name ‘Derecske alma’ was published in the Official Journal of the European Union (2). |

As no statement of opposition under Article 51 of Regulation (EU) No 1151/2012 has been received by the Commission, the name ‘Derecske alma’ should therefore be entered in the register, |
HAS ADOPTED THIS REGULATION:
Article 1
The name ‘Derecske alma’ (PGI) is hereby entered in the register.
The name specified in the first paragraph denotes a product in Class 1.6. – Fruit, vegetables and cereals, fresh or processed, as listed in Annex XI to Commission Implementing Regulation (EU) No 668/2014 (3).
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

COMMISSION IMPLEMENTING REGULATION (EU) 2022/1183

amending Annexes II and IV to Implementing Regulation (EU) 2020/2002 as regards Union notification and Union reporting on the detection of certain listed diseases

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 23 thereof,
Whereas:

Commission Implementing Regulation (EU) 2020/2002 (2) lays down rules for Union notification and Union reporting on the detection of listed diseases. In particular, Article 3 of Implementing Regulation (EU) 2020/2002 provides that Union notifications are to contain the information specified in Annex II thereto, while Article 5 thereof provides that the notification and reporting regions established by the Member States in accordance with Article 21 of Regulation (EU) 2016/429 are listed in Annex IV to that Implementing Regulation. |

Commission Implementing Regulation (EU) 2018/1882 (3) defines listed diseases into categories A to E diseases, and provides that the disease prevention and control rules for listed diseases referred to in Article 9(1) of Regulation (EU) 2016/429 are to apply to the categories of listed diseases for the listed species and groups of listed species referred to in the table set out in the Annex to that Implementing Regulation. The amendments to be made to Implementing Regulation (EU) 2020/2002 by this Regulation should provide for further details as regards the rules that concern category A diseases in terms of outbreak notification with respect to outbreak location and date of cleaning and disinfection; such additional notification requirements are justified for category A diseases due to the risk they represent for animal health in the Union. |

Commission Delegated Regulation (EU) 2020/687 (4) supplements Regulation (EU) 2016/429 as regards the rules for the control of category A, B and C diseases. Given the importance of providing more detailed information on the disease control measures and the framework information related to the occurrence of outbreaks of category A diseases, Annex II to Implementing Regulation (EU) 2020/2002 should be amended to include information on whether the outbreak occurred in an area already under restrictions following the establishment of restricted zones as provided for in Articles 64, 70, 71, 257, 258 or 259 of Regulation (EU) 2016/429, as this has an impact on the risk represented by such outbreaks. |

The measures laid down in Delegated Regulation (EU) 2020/687 include the establishment of restricted zones following the occurrence of an outbreak of a category A disease and preliminary cleaning and disinfection. Information on such measures should be more clearly submitted in the framework of the Union notification required by Article 3 of Implementing Regulation (EU) 2020/2002. |

Annex IV to Implementing Regulation (EU) 2020/2002 does not include an entry for the United Kingdom in respect of Northern Ireland. For that reason, the United Kingdom (Northern Ireland) should be listed in Annex IV to Implementing Regulation (EU) 2020/2002 where relevant for Northern Ireland. |

Annexes II and IV to Implementing Regulation (EU) 2020/2002 should therefore be amended accordingly. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |

amending Regulation (EU) No 468/2010 establishing the EU list of vessels engaged in illegal, unreported and unregulated fishing

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EC) No 1005/2008 of 29 September 2008 establishing a Community system to prevent, deter and eliminate illegal, unreported and unregulated fishing, amending Regulations (EEC) No 2847/93, (EC) No 1936/2001 and (EC) No 601/2004 and repealing Regulations (EC) No 1093/94 and (EC) No 1447/1999 (1), and in particular Article 30 thereof,
Whereas:

Chapter V of Regulation (EC) No 1005/2008 lays down procedures for the identification of fishing vessels engaged in illegal, unreported and unregulated fishing (‘IUU fishing’) as well as procedures for establishing a Union list of such vessels (‘the Union list’). Article 37 of that Regulation provides for actions to be taken against fishing vessels included in that list. |

The Union list was established by Commission Regulation (EU) No 468/2010 (2) and subsequently amended by Commission Implementing Regulations (EU) No 724/2011 (3), (EU) No 1234/2012 (4), (EU) No 672/2013 (5), (EU) No 137/2014 (6), (EU) 2015/1296 (7), (EU) 2016/1852 (8), (EU) No 2017/2178 (9), (EU) No 2018/1883 (10), (EU) No 2020/269 (11) and (EU) No 2021/1120 (12). |

According to Article 30(1) of Regulation (EC) No 1005/2008, vessels included in the IUU vessel lists adopted by regional fisheries management organisations are to be included in the Union list. |

All regional fishery management organisations provide for the establishment and regular up-date of IUU vessel lists in accordance with their respective rules (13). |
(5) |
According to Article 30 of Regulation (EC) No 1005/2008, upon the receipt from regional fisheries management organisations of the lists of fishing vessels presumed or confirmed to be involved in IUU fishing, the Commission is to update the Union list. Since the Commission has received new lists from the regional fisheries management organisations, the Union list should now be updated. |

Considering that the same vessel might be listed under different names and/or flags depending on the time of its inclusion on the regional fisheries management organisations lists, the updated Union list should include the different names and/or flags as established by the relevant regional fisheries management organisations. |
(7) |
The vessel ‘Eros Dos’ (14) has been removed from the list established by the North-East Atlantic Fisheries Commission (‘NEAFC’), in line with Article 44 of NEAFC Scheme of Control and Enforcement. As the decision was taken by the relevant regional fisheries management organisation, under the terms of Article 30(1) of Regulation (EC) No 1005/2008, this vessel should accordingly be removed from the Union list, despite the fact that it has not yet been deleted from the list established by the Indian Ocean Tuna Commission (‘IOTC’), the Northwest Atlantic Fisheries Organisation (‘NAFO’) and the South East Atlantic Fisheries Organisation (‘SEAFO’). |

The vessel ‘Xin Shi Ji 16’ (15), which is currently included in the Union list, has been removed from the list established by the Inter-American Tropical Tuna Commission (‘IATTC’), in line with Resolution C-15-01 (16) of that regional fisheries management organisation. As the decision was taken by the relevant regional fisheries management organisation, under the terms of Article 30(1) of Regulation (EC) No 1005/2008, this vessel should thus be removed from the Union list despite the fact that it has not yet been deleted from the list established by the NEAFC. |

Regulation (EU) No 468/2010 should therefore be amended accordingly. |

granting a Union authorisation for the biocidal product family ‘Contec Hydrogen Peroxide Biocidal Product Family’

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 528/2012 of the European Parliament and of the Council of 22 May 2012 concerning the making available on the market and use of biocidal products (1), and in particular the Article 44(5), first subparagraph, thereof,
Whereas:

On 3 December 2020, Contec Europe submitted an application, in accordance with Article 43(1) of Regulation (EU) No 528/2012, for authorisation of a biocidal product family named ‘Contec Hydrogen Peroxide Biocidal Product Family’ of product-type 2, as described in Annex V to that Regulation, providing written confirmation that the competent authority of Slovenia had agreed to evaluate the application. The application was recorded under case number BC-PP063133-29 in the Register for Biocidal Products. |

‘Contec Hydrogen Peroxide Biocidal Product Family’ contains hydrogen peroxide as the active substance, which is included in the Union list of approved active substances referred to in Article 9(2) of Regulation (EU) No 528/2012 for product-type 2. |

On 26 May 2021, the evaluating competent authority submitted, in accordance with Article 44(1) of Regulation (EU) No 528/2012, an assessment report and the conclusions of its evaluation to the European Chemicals Agency (‘the Agency’). |

On 15 December 2021, the Agency submitted to the Commission an opinion (2), including the draft summary of the biocidal product characteristics (‘SPC’) of ‘Contec Hydrogen Peroxide Biocidal Product Family’ and the final assessment report on the biocidal product family in accordance with Article 44(3) of Regulation (EU) No 528/2012. |

The opinion concludes that ‘Contec Hydrogen Peroxide Biocidal Product Family’ is a ‘biocidal product family’ within the meaning of Article 3(1), point (s), of Regulation (EU) No 528/2012, that it is eligible for Union authorisation in accordance with Article 42(1) of that Regulation and that subject to compliance with the draft SPC, it meets the conditions laid down in Article 19(1) and (6) of that Regulation. |

On 19 January 2022, the Agency transmitted to the Commission the draft SPC in all the official languages of the Union in accordance with Article 44(4) of Regulation (EU) No 528/2012. |

The Commission concurs with the opinion of the Agency and considers it therefore appropriate to grant a Union authorisation for ‘Contec Hydrogen Peroxide Biocidal Product Family’. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on biocidal products, |
HAS ADOPTED THIS REGULATION:
Article 1
A Union authorisation with authorisation number EU-0027735-0000 is granted to Contec Europe for the making available on the market and use of the biocidal product family ‘Contec Hydrogen Peroxide Biocidal Product Family’ in accordance with the summary of the biocidal product characteristics set out in the Annex.
The Union Authorisation is valid from 31 July 2022 to 30 June 2032.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

Pouring of product shall be done in ventilated rooms only (with min. 3 air change/h).
The use of eye protection during handling of the product is mandatory.
For use in cleanrooms, adequate technical/engineering controls to remove airborne residues is mandatory (e.g. room ventilation or LEV. A minimum ventilation rate of 360/hr is mandatory for cleanrooms where the product is applied.
If the product is applied by wiping, the disinfection must be limited to small area.
When using the product with a mop to disinfect floors or other large surfaces in cleanrooms, additional risk mitigation measures must be considered:

Use of respiratory protective equipment (RPE) providing a protection factor of 10 is mandatory for the professional user and all other personnel within the room. At least a powered air purifying respirator with helmet/hood/mask (TH1/TM1), or a half/full mask with combination filter gas/P2 is required (filter type (code letter, colour) to be specified by the authorisation holder within the product information). |

Technical or engineering controls to remove airborne residues is mandatory (e.g. ventilation or LEV) before professionals are permitted to enter into treated areas after large surface disinfection. DIRECT/INDIRECT EFFECTS
Causes serious eye irritation. No other health injuries are known or expected under normal use.
FIRST AID INSTRUCTIONS
IF INHALED: If symptoms occur, call a POISON CENTRE or a doctor.
IF SWALLOWED: Rinse mouth. Give something to drink, if exposed person is able to swallow. Do NOT induce vomiting. Call a POISON CENTRE or a doctor.
IF ON SKIN: Wash skin with water. If symptoms occur, call a POISON CENTRE or a doctor.
IF IN EYES: Rinse with water. Remove contact lenses, if present and easy to do. Continue rinsing for 5 minutes. Call a POISON CENTRE or a doctor.
EMERGENCY MEASURES TO PROTECT THE ENVIRONMENT
Avoid release to the environment.
5.4. Instructions for safe disposal of the product and its packaging
Disposal of this packaging should at all times comply with the waste disposal legislation and any regional local authority requirements.
Do not discharge unused product on the ground, into water courses, into pipes (sink, toilets…) nor down the drains.
5.5. Conditions of storage and shelf-life of the product under normal conditions of storage
Store in a dry well ventilated area and protect from damage and direct sunlight.
Store in properly designed bulk storage tanks or in original vented container.
Keep container tightly closed.
Do not freeze.
Do not store at temperature above 30°C.
The shelf-life: 24 months.

On 29 March 2021, the evaluating competent authority submitted, in accordance with Article 44(1) of Regulation (EU) No 528/2012, an assessment report and the conclusions of its evaluation to the European Chemicals Agency (‘the Agency’). |

On 4 November 2021, the Agency submitted to the Commission an opinion (2), including the draft summary of the biocidal product characteristics (‘SPC’) of ‘L+R Propanol PT1 Family’ and the final assessment report on the biocidal product family in accordance with Article 44(3) of Regulation (EU) No 528/2012. |

The opinion concludes that ‘L+R Propanol PT1 Family’ is a biocidal product family within the meaning of Article 3(1), point (s), of Regulation (EU) No 528/2012, that it is eligible for Union authorisation in accordance with Article 42(1) of that Regulation and that subject to compliance with the draft SPC, it meets the conditions laid down in Article 19(1) and (6) of that Regulation. |

On 22 November 2021, the Agency transmitted to the Commission the draft SPC in all the official languages of the Union in accordance with Article 44(4) of Regulation (EU) No 528/2012. |

The Commission concurs with the opinion of the Agency and considers it therefore appropriate to grant a Union authorisation for ‘L+R Propanol PT1 Family’. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Biocidal Products, |
HAS ADOPTED THIS REGULATION:
Article 1
A Union authorisation with authorisation number EU-0027466-0000 is granted to Lohmann & Rauscher International GmbH&Co.KG for the making available on the market and use of the biocidal product family ‘L+R Propanol PT1 Family’ in accordance with the summary of the biocidal product characteristics set out in the Annex.
The Union authorisation is valid from 31 July 2022 until 30 June 2032.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

IF ON SKIN: Immediately wash skin with plenty of water. Thereafter take off all contaminated clothing and wash it before reuse. Continue to wash the skin with water. for 15 minutes. Call a POISON CENTRE or a doctor.
IF INHALED: Move to fresh air and keep at rest in a position comfortable for breathing. Call a POISON CENTRE or a doctor.
IF IN EYES: Immediately rinse with water for several minutes. Remove contact lenses, if present and easy to do. Continue rinsing for at least 15 minutes. Call 112/ambulance for medical assistance.
Information to healthcare personnel/doctor:
The eyes should also be rinsed repeatedly on the way to the doctor if eye exposure to alkaline chemicals (pH > 11), amines and acids like acetic acid, formic acid or propionic acid.
IF SWALLOWED: Immediately rinse mouth. Give something to drink, if exposed person is able to swallow. Do NOT induce vomiting. Call 112/ambulance for medical assistance.
After spilling: Take up with absorbent material (for example sand, kieselgur, universal binder). When picked up, treat material as prescribed under "Disposal considerations".
5.4. Instructions for safe disposal of the product and its packaging
Residuals must be removed from packaging and when emptied completely disposed of in accordance with the regulations for waste removal.
Incompletely emptied packaging must be disposed of in the form of disposal specified by the regional disposer.

Technical measures and storage conditions:
Shelf-life: 36 months
Keep container tightly closed and dry in a cool, well-ventilated place. Protect from direct sunlight.

amending Implementing Decision (EU) 2022/493 as regards the definitive allocation of Union aid to Member States for school fruit and vegetables and for school milk for the period from 1 August 2022 to 31 July 2023

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EU) No 1370/2013 of 16 December 2013 determining measures on fixing certain aids and refunds related to the common organisations of the markets in agricultural products (1), and in particular Article 5(6) thereof,
Whereas:

Pursuant to Article 3 of Commission Implementing Regulation (EU) 2017/39 (2), Member States wishing to participate in the Union aid scheme for the supply of fruit and vegetables, bananas and milk in educational establishments (‘the school scheme’) are to submit to the Commission by 31 January each year their request for Union aid relating to the next school year and, if applicable, update the request for Union aid relating to the ongoing school year. |

Based on the information Member States notified by 31 January 2022, Commission Implementing Decision (EU) 2022/493 (3) fixed the definitive allocation of Union aid for school fruit and vegetables and for school milk for the period from 1 August 2022 to 31 July 2023. |

Pursuant to Article 1 of Commission Implementing Regulation (EU) 2022/861 (4), Member States may submit to the Commission by 15 June 2022 a second request for Union aid for the period from 1 August 2022 to 31 July 2023, linked to the need to cater for the displaced children from Ukraine who are eligible for participation in the school scheme. |

In their second request for Union aid for the period from 1 August 2022 to 31 July 2023, France, the Netherlands, Austria and Slovenia indicated their willingness not to use the entire amount of their definitive allocation of Union aid for school fruit and vegetables and/or for school milk set out in Annex I to Implementing Decision (EU) 2022/493. Bulgaria, Czechia, Germany, Estonia, Greece, Latvia, Lithuania, Hungary, Poland, Romania and Slovakia notified their willingness to use more than their definitive allocation of Union aid for school fruit and vegetables and/or for school milk set out in Annex I to Implementing Decision (EU) 2022/493. Belgium, Bulgaria, Denmark, Ireland, Greece, Spain, Croatia, Italy, Cyprus, Luxembourg, Malta, the Netherlands, Austria, Portugal, Slovenia, Finland and Sweden did not submit a second request for Union aid for school fruit and vegetables and/or for school milk and are therefore regarded as having confirmed their definitive allocations set out in Annex I to Implementing Decision (EU) 2022/493. |

In order to maximise the full potential of available funds and address the difficulties in implementing the school scheme as a result of the displacement of children from Ukraine following the military aggression by Russia against Ukraine on 24 February 2022, it is appropriate to revise the definitive allocation of Union aid for school fruit and vegetables and for school milk for the period from 1 August 2022 to 31 July 2023. The reallocation of the unrequested amounts of definitive allocations of Union aid should take into account the Member States’ second requests for Union aid and is to be based on the number of six- to ten-year old children in the Member States, in accordance with Article 5(5), second subparagraph, of Regulation (EU) No 1370/2013. |

Annex I to Implementing Decision (EU) 2022/493 should therefore be amended accordingly. |

The measures provided for in this Decision are in accordance with the opinion of the Committee for the Common Organisation of the Agricultural Markets, |

amending Annexes I and II to Implementing Decision (EU) 2021/260 as regards Member States or parts thereof for which national measures for certain diseases of aquatic animals are approved in accordance with Article 226(3) of Regulation (EU) 2016/429 of the European Parliament and of the Council

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 226(3) thereof,
Whereas:

Commission Implementing Decision (EU) 2021/260 (2) establishes lists of Member States and parts thereof which are considered to be free from certain diseases of aquatic animals, not listed under Article 9(1), point (d) of Regulation (EU) 2016/429, or which are subject to an eradication programme for those diseases. |
(2) |
Additional Member States or parts thereof, may be added to the list of disease-free areas in Annex I to Implementing Decision (EU) 2021/260, or to the list of areas which are subject to an eradication programme in Annex II to that Implementing Decision, if the Commission is notified in advance, of any measures that may affect the movements of aquatic animals between Member States, so that the measures can be approved, or if necessary, amended. |

Denmark, Finland, France, Italy, Portugal and Slovenia have notified the Commission of parts of their territories, which should be approved as disease-free in accordance with Article 226(3) of Regulation (EU) 2016/429. These include two zones which are free from Koi herpes virus disease (KHV), and several compartments which are free from either Bacterial kidney disease (BKD), KHV or Infectious pancreatic necrosis virus (IPN). Denmark has also notified the Commission of several compartments which are subject to eradication programmes for BKD or IPN and which should be approved, in accordance with Article 226(3) of Regulation (EU) 2016/429. |

The Commission has assessed the information submitted by Denmark, Finland, France, Italy, Portugal and Slovenia regarding the national measures, which they have taken, in accordance with Article 226(3) of Regulation (EU) 2016/429, in order to prevent the introduction or limit the spread of those diseases. The Commission is satisfied that those national measures are necessary in order to prevent the introduction or to control the spread of the diseases. Accordingly, those national measures should be approved, and the zones and compartments in which they apply, should be listed in Annexes I and II to Implementing Decision (EU) 2021/260. |

It is therefore appropriate, to amend Annex I to Implementing Decision (EU) 2021/260, to take account of KHV free zones in France and Italy, BKD and IPN free compartments in Denmark, BKD free compartments in Finland, KHV free compartments in France and Portugal, and IPN free compartments in Slovenia. Annex II to that Implementing Decision should also be amended to take account of the compartments, which are subject to eradication programmes for BKD and IPN in Denmark. |

In addition, Ireland has notified the Commission that all of the Ostreid herpesvirus-1 μvar (OsHV-1μvar) compartments in their territory, which are listed in Annex I to Implementing Decision (EU) 2021/260, should be removed from the list. Annex I to Implementing Decision (EU) 2021/260 should therefore, be amended to take account of that change in status of the OsHV-1μvar free compartments in Ireland. |

Implementing Decision (EU) 2021/260 should therefore, be amended accordingly. |

COMMISSION IMPLEMENTING DECISION (EU) 2022/1189
of 8 July 2022
concerning certain emergency measures relating to African swine fever in Germany
(notified under document C(2022) 4962)

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 259(2) thereof,
Whereas:
(1) |
African swine fever is an infectious viral disease affecting kept and wild porcine animals and can have a severe impact on the concerned animal population and the profitability of farming causing disturbance to movements of consignments of those animals and products thereof within the Union and exports to third countries. |
(2) |
In the event of an outbreak of African swine fever in kept porcine animals, there is a serious risk of the spread of that disease to other establishments of kept porcine animals. |
(3) |
Commission Delegated Regulation (EU) 2020/687 (2) supplements the rules for the control of the listed diseases referred to in Article 9(1)(a), (b) and (c) of Regulation (EU) 2016/429, and defined as category A, B and C diseases in Commission Implementing Regulation (EU) 2018/1882 (3). In particular, Articles 21 and 22 of Delegated Regulation (EU) 2020/687 provide for the establishment of a restricted zone in the event of an outbreak of a category A disease, including African swine fever, and for certain measures to be applied therein. In addition, Article 21(1) of that Delegated Regulation provides that the restricted zone is to comprise a protection zone, a surveillance zone, and if necessary further restricted zones around or adjacent to the protection and surveillance zones. |

Commission Implementing Regulation (EU) 2021/605 (4) lays down special disease control measures regarding African swine fever. In particular, Article 3, point (a), of that Implementing Regulation provides for the establishment of a restricted zone in the case of an outbreak of African swine fever in kept porcine animals, in accordance with Article 21(1) of Delegated Regulation (EU) 2020/687. |

Germany has informed the Commission of the current African swine fever situation on its territory, following an outbreak of that disease in kept porcine animals in the state of Lower Saxony confirmed on 1 July 2022, and, in accordance with Delegated Regulation (EU) 2020/687 and Implementing Regulation (EU) 2021/605, it has established a restricted zone, which comprises protection and surveillance zones, where the general disease control measures laid down in Delegated Regulation (EU) 2020/687 are applied, in order to prevent the further spread of that disease. |
(6) |
In order to prevent any unnecessary disturbance to trade within the Union and to avoid unjustified barriers to trade by third countries, it is necessary to rapidly identify at Union level the restricted zone for African swine fever, which comprises protection and surveillance zones, in Germany in collaboration with that Member State. |
(7) |
Accordingly, the areas identified as protection and surveillance zones in Germany should be set out in the Annex to this Decision and the duration of that regionalisation fixed. |
(8) |
Given the urgency of the epidemiological situation in the Union as regards the spread of African swine fever, it is important that the measures laid down in this Implementing Decision apply as soon as possible. |
(9) |
The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed. |
HAS ADOPTED THIS DECISION:
Article 1
Germany shall ensure that:
(a) |
a restricted zone which comprises a protection zone and a surveillance zone is established immediately by the competent authority of that Member State in accordance with Article 21(1) of Delegated Regulation (EU) 2020/687 and under the conditions set out in that Article; |
(b) |
the protection and surveillance zones referred to in paragraph (a) comprise at least the areas listed in the Annex to this Implementing Decision. |
Article 2
This Decision shall apply until 14 October 2022.
Article 3
This Decision is addressed to the Federal Republic of Germany.
