COMMISSION DELEGATED REGULATION (EU) 2022/204
of 8 December 2021
amending Delegated Regulation (EU) 2015/242 laying down detailed rules on the functioning of the Advisory Councils under the Common Fisheries Policy
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1380/2013 of the European Parliament and of the Council of 11 December 2013 on the Common Fisheries Policy, amending Council Regulations (EC) No 1954/2003 and (EC) No 1224/2009 and repealing Council Regulations (EC) No 2371/2002 and (EC) No 639/2004 and Council Decision 2004/585/EC (1), and in particular Article 45(4) thereof,
Whereas:

Article 43 of Regulation (EU) No 1380/2013 provides for the establishment of Advisory Councils, which are to promote a balanced representation of all stakeholders in the field of fisheries and aquaculture and to contribute to the objectives of the common fisheries policy. |

In accordance with Article 45(4) of Regulation (EU) No 1380/2013, the Commission adopted Commission Delegated Regulation (EU) 2015/242 (2) laying down detailed rules on the functioning of Advisory Councils under the common fisheries policy. |
(3) |
The Commission adopted Delegated Regulation (EU) 2017/1575 (3) amending Delegated Regulation (EU) 2015/242 to clarify the definition of ‘sector organisations’, specify the procedure for classifying members of the Advisory Councils in one of the two categories of stakeholders referred to in Article 45(1) of Regulation (EU) No 1380/2013, and grant both categories the right to decide autonomously on their representation in the executive committee. |

The Advisory Councils and the Member States have been consulted in the light of the experience gained in the application of Delegated Regulation (EU) 2015/242. |

In order to ensure a more balanced representation of all interests and improve the impartiality of the chairs, it is appropriate that Advisory Councils designate, by consensus, a chairperson and at least one vice-chairperson belonging to different categories of stakeholders as referred to in Article 45(1) of Regulation (EU) No 1380/2013. Working groups should be chaired, where possible, by representatives of the two categories of stakeholders. Advisory Councils should be empowered to designate a chairperson and vice-chairpersons from outside the Advisory Councils. |

In order to ensure a smooth functioning of the Advisory Councils, it is necessary to further specify the criteria for the classification of the members of the Advisory Councils in the two categories of stakeholders referred to in Article 45(1) of Regulation (EU) No 1380/2013. |

Article 2(2) of Delegated Regulation (EU) 2015/242 defines sector organisations as organisations representing the fisheries and, where appropriate, aquaculture operators, and representatives of the processing and marketing sectors. Article 4(30) of Regulation (EU) No 1380/2013 defines ‘operator’ as a natural or legal person who operates or holds any undertaking carrying out any of the activities related to any stage of production, processing, marketing, distribution and retail chains of fisheries and aquaculture products. The criteria for classifying members of the Advisory Councils should therefore allow for the classification of organisations representing the above-mentioned sectors in the category ‘sector organisations’. In addition, suppliers to the above-mentioned sectors, such as fishing net manufacturers or icemakers, should also be classified as ‘sector organisations’. |

An organisation can be assumed representative of the sector when at least 50 % of its members are themselves representatives from the sector or have direct or indirect economic interests in the sector, when it represents employees in the sector, or when at least 50 % of its funding come from the sector. Such organisations should also be considered as ‘sector organisations’ for the purposes of Article 45(1) of Regulation (EU) No 1380/2013. |

In order to ensure a balanced functioning of the Advisory Councils, it is necessary that organisations promoting horizontal principles such as the protection of the environment, consumers and human rights, health, promotion of equality or animal health or welfare are classified as sector organisations when they are representative of the sector in the sense of recitals (7) or (8). Organisations promoting such horizontal principles should therefore only be classified in ‘other interest groups’ if they are independent from the sector, meaning that less than 50 % of their members are themselves representatives from the sector or have direct or indirect economic interest in the sector, that they do not represent employees in the sector, and that less than 50 % of their funding come from the sector. |

Article 4(28) of Regulation (EC) No 1224/2009 defines ‘recreational fisheries’ as non-commercial fishing activities exploiting marine living aquatic resources for recreation, tourism or sport. Organisations representing recreational or sport fishing, since they differ in nature, objectives and means from sector organisations as defined in Article 2(2) of Delegated Regulation (EU) 2015/242, should be classified as ‘other interest groups’. |

The fisheries and aquaculture sector is increasingly faced with the need to engage with stakeholders competing for different uses of the sea, including for energy production, extraction, tourism or conservation purposes. Such stakeholders might have interests that diverge from the ones of the fisheries and aquaculture sector. It is therefore necessary that organisations participating to the tasks of the Advisory Councils as defined in Article 44 of Regulation (EU) No 1380/2013 and representing or having direct or indirect economic interests linked to the use of the marine environment or maritime space other than commercial fishing, aquaculture or the processing, marketing, distribution and retail of seafood are classified in ‘other interest groups’ |

Specific attention should be paid to ensuring a balanced and wide representation of all stakeholders in the Advisory Councils, including other interest groups and representatives from small scale fleets. |

In order to meet the requirements of Article 43(1) of Regulation (EU) No 1380/2013, which provides that Advisory Councils are established to contribute to the achievement of the objectives of the Common Fisheries Policy as set out in article 2 thereof, it is necessary to detail the working methods which the Advisory Councils should respect when developing recommendations. |

Advisory Councils, as bodies pursuing a goal of common European interest, are granted Union financial support. Therefore, their functioning should be regularly monitored and evaluated through the performance of external, regular and independent performance reviews |

Therefore, Delegated Regulation (EU) 2015/242 should be amended accordingly, |
HAS ADOPTED THIS REGULATION:
Article 1
Delegated Regulation (EU) 2015/242 is amended as follows:

Article 4 is replaced by the following: ‘Article 4 Structure and organisation of the Advisory Councils 1. In addition to the provisions of Article 43(1), Article 45(1) to (3) and Annex III of Regulation (EU) No 1380/2013, the Advisory Councils’ structure and organisation shall comply with paragraphs 2 to 7 of this Article. 2. The Advisory Council shall designate, by consensus, a chairperson and at least one vice-chairperson. The chairperson may originate from outside the membership of the Advisory Council. In case the chairperson is designated amongst representatives of member organisations, at least one of the vice-chairpersons shall be designated amongst members of the category of sector organisations and other interest groups referred to in Article 2 to which the chairperson does not belong. This principle shall also apply, where possible, to working groups’ chairpersons. 3. The general assembly of an Advisory Council shall:

Based on designations from the sector organisations and from the other interest groups for the seats allotted to them respectively, the general assembly appoints an executive committee of up to 25 members. After consultation of the Commission, the general assembly may decide to appoint an executive committee of up to 30 members to ensure appropriate representation of small scale fleets. 5. The general assembly shall ensure equitable membership fees, which enable balanced and wide representation of all stakeholders taking into account their financial capacity. 6. The general assembly and the executive committee shall ensure a balanced and wide representation of all stakeholders, with emphasis on other interest groups and, where appropriate, small-scale fleets. The number of representatives of small-scale fleets should reflect the share of small scale fleets within the fishing sector of the Member States concerned.’ |

Article 5 is replaced by the following: ‘Article 5 Working methods 1. The Advisory Council shall ensure that the recommendations and suggestions issued:
2. When deciding on its working methods, the Advisory Council shall seek to ensure the efficiency and full participation of all members through the use of modern IT communication means and the provision of interpretation and translation services.’ |

The following Article 7a is inserted: ‘Article 7a Performance reviews The Advisory Council shall subject itself at least once every five years to an independent performance review. This review shall aim to identify best practices and shortcomings, list recommendations aiming at improving the functioning of the Advisory Council and assess its overall contribution to the objectives of the Common Fisheries Policy as set out in Regulation (EU) No 1380/2013. The results of these reviews shall be made public and, where shortcomings in the functioning of the Advisory Council are identified, shall be accompanied by an action plan setting out concrete actions and a clear timeframe for their implementation.’ |

The Annex “Criteria for classifying Members of the Advisory Councils under the categories ‘sector organisations’ or ‘other interest groups’” is added: ‘ANNEX Criteria for classifying members of the Advisory Councils under the categories ‘sector organisations’ or ‘other interest groups’ 1. An organisation shall be classified ‘sector organisation’ when at least one of the following criteria is met:

Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION IMPLEMENTING REGULATION (EU) 2022/205
of 14 February 2022
amending Annex I to Implementing Regulation (EU) 2021/605 laying down special control measures for African swine fever

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/429 of the European Parliament and of the Council of 9 March 2016 on transmissible animal diseases and amending and repealing certain acts in the area of animal health (‘Animal Health Law’) (1), and in particular Article 71(3) thereof,
Whereas:

African swine fever is an infectious viral disease affecting kept and wild porcine animals and can have a severe impact on the concerned animal population and the profitability of farming causing disturbance to movements of consignments of those animals and products thereof within the Union and exports to third countries. |
(2) |
Commission Implementing Regulation (EU) 2021/605 (2) was adopted within the framework of Regulation (EU) 2016/429, and it lays down special disease control measures regarding African swine fever to be applied for a limited period of time by the Member States listed in Annex I thereto (the Member States concerned), in restricted zones I, II and III listed in that Annex. |

The areas listed as restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2021/605 are based on the epidemiological situation of African swine fever in the Union. Annex I to Implementing Regulation (EU) 2021/605 was last amended by Commission Implementing Regulation (EU) 2022/136 (3) following changes in the epidemiological situation as regards that disease in Poland. |

Any amendments to restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2021/605 should be based on the epidemiological situation as regards African swine fever in the areas affected by that disease and the overall epidemiological situation of African swine fever in the Member State concerned, the level of risk for the further spread of that disease, as well as scientifically based principles and criteria for geographically defining zoning due to African swine fever and the Union’s guidelines agreed with the Member States at the Standing Committee on Plants, Animals, Food and Feed and publicly available on the Commission’s website (4). Such amendments should also take account of international standards, such as the Terrestrial Animal Health Code (5) of the World Organisation for Animal Health and justifications for zoning provided by the competent authorities of the Member States concerned. |

Since the date of adoption of Implementing Regulation (EU) 2022/136 there have been new outbreaks of African swine fever in wild porcine animals in Slovakia. In addition, the epidemiological situation in certain zones listed as restricted zones III in Poland has improved as regards kept porcine animals, due to the disease control measures being applied by that Member State in accordance with Union legislation. Also, the epidemiological situation in certain zones listed as restricted zones II in Lithuania has improved as regards wild porcine animals, due to the disease control measures being applied by that Member State in accordance with Union legislation. |

In February 2022, an outbreak of African swine fever in a wild porcine animal was observed in the Liptovský Mikuláš district in Slovakia in an area currently listed as restricted zone II in Annex I to Implementing Regulation (EU) 2021/605, located in close proximity to an area currently listed as restricted zone I thereof. This new outbreak of African swine fever in a wild porcine animal constitutes an increased level of risk, which should be reflected in that Annex. Accordingly, this area of Slovakia currently listed as restricted zone I in that Annex, that is in close proximity to the area listed in restricted zone II affected by this recent outbreak of African swine fever, should now be listed as restricted zone II in that Annex instead of as restricted zone I thereof. |

Following this recent outbreak of African swine fever in a wild porcine animal in Slovakia and taking into account the current epidemiological situation as regards African swine fever in the Union, zoning in this Member State has been reassessed and updated. In addition, the risk management measures in place have also been reassessed and updated. These changes should be reflected in Annex I to Implementing Regulation (EU) 2021/605. |

In addition, taking into account the effectiveness of the disease control measures for African swine fever for kept porcine animals in restricted zones III listed in Annex I to Implementing Regulation (EU) 2021/605 being applied in Poland in accordance with Commission Delegated Regulation (EU) 2020/687, and in particular those laid down in Articles 22, 25 and 40 thereof, and in line with the risk mitigation measures for African swine fever set out in the OIE Code, certain zones in the Dolnośląskie, Podkarpackie, Warmińsko-mazurskie and Wielkopolskie regions in Poland, currently listed as restricted zones III in Annex I to Implementing Regulation (EU) 2021/605 should now be listed as restricted zones II in that Annex, due to the absence of African swine fever outbreaks in kept porcine animals in those restricted zones III for the past twelve months. Those restricted zones III should now be listed as restricted zones II taking account of the current African swine fever epidemiological situation. |

Also, taking into account the effectiveness of the disease control measures for African swine fever for kept porcine animals in restricted zones III listed in Annex I to Implementing Regulation (EU) 2021/605 being applied in Poland in accordance with Commission Delegated Regulation (EU) 2020/687, and in particular those laid down in Articles 22, 25 and 40 thereof, and in line with the risk mitigation measures for African swine fever set out in the OIE Code, certain zones in the Lubuskie region in Poland, currently listed as restricted zones III in Annex I to Implementing Regulation (EU) 2021/605 should now be listed as restricted zones II in that Annex, due to the absence of African swine fever outbreaks in kept porcine animals in those restricted zones III for the past three months. Those restricted zones III should now be listed as restricted zones II taking account of the current African swine fever epidemiological situation. |

Finally, taking into account the effectiveness of the disease control measures for African swine fever for wild porcine animals in restricted zones II listed in Annex I to Implementing Regulation (EU) 2021/605 being applied in Lithuania in accordance with Commission Delegated Regulation (EU) 2020/687, and in particular those laid down in Articles 22, 25 and 40 thereof, and in line with the risk mitigation measures for African swine fever set out in the OIE Code, certain zones in the county of Marijampolė in Lithuania, currently listed as restricted zones II in Annex I to Implementing Regulation (EU) 2021/605 should now be listed as restricted zones I in that Annex, due to the absence of African swine fever outbreaks in wild porcine animals in those restricted zones II for the past twelve months. Those restricted zones II should now be listed as restricted zones I taking account of the current African swine fever epidemiological situation. |

In order to take account of the recent developments in the epidemiological situation of African swine fever in the Union, and in order to combat the risks associated with the spread of that disease in a proactive manner, new restricted zones of a sufficient size should be demarcated for Lithuania, Poland and Slovakia and duly listed as restricted zones I, II and III in Annex I to Implementing Regulation (EU) 2021/605. As the situation as regards African swine fever is very dynamic in the Union, when demarcating those new restricted zones, account has been taken of the situation in the surrounding areas. |
(12) |
Given the urgency of the epidemiological situation in the Union as regards the spread of African swine fever, it is important that the amendments to be made to Annex I to Implementing Regulation (EU) 2021/605 by this Implementing Regulation take effect as soon as possible. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |

Annex I to Implementing Regulation (EU) 2021/605 is replaced by the text set out in the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

establishing the equivalence, for the purpose of facilitating the right of free movement within the Union, of COVID-19 certificates issued by the Republic of Benin to the certificates issued in accordance with Regulation (EU) 2021/953 of the European Parliament and of the Council

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2021/953 of the European Parliament and of the Council of 14 June 2021 on a framework for the issuance, verification and acceptance of interoperable COVID-19 vaccination, test and recovery certificates (EU Digital COVID Certificate) to facilitate free movement during the COVID-19 pandemic (1), and in particular Article 8(2) thereof,
Whereas:

Regulation (EU) 2021/953 lays down a framework for the issuance, verification and acceptance of interoperable COVID-19 vaccination, test and recovery certificates (‘EU Digital COVID Certificate’) for the purpose of facilitating the holders’ exercise of their right to free movement during the COVID-19 pandemic. It is also to contribute to facilitating the gradual lifting of restrictions to free movement put in place by Member States, in accordance with Union law, to limit the spread of SARS-CoV-2, in a coordinated manner. |

Regulation (EU) 2021/953 allows for the acceptance of COVID-19 certificates issued by third countries to Union citizens and their family members where the Commission finds that those COVID-19 certificates are issued in accordance with standards that are to be considered as equivalent to those established pursuant to that Regulation. Furthermore, in accordance with Regulation (EU) 2021/954 of the European Parliament and of the Council (2), Member States are to apply the rules laid down in Regulation (EU) 2021/953 to third-country nationals who do not fall within the scope of that Regulation, but who are legally staying or residing in their territory and who are entitled to travel to other Member States in accordance with Union law. Therefore, any equivalence findings laid down in this Decision should apply to COVID-19 vaccination, test and recovery certificates issued by the Republic of Benin to Union citizens and their family members. Similarly, on the basis of Regulation (EU) 2021/954, such equivalence findings should also apply to COVID-19 vaccination, test and recovery certificates issued by the Republic of Benin to third-country nationals legally staying or residing in the territory of the Member States under the conditions laid down in that Regulation. |

On 31 December 2021, the Republic of Benin provided the Commission with detailed information on the issuance of interoperable COVID-19 vaccination, test and recovery certificates under the system entitled ‘COVID certificate system’. The Republic of Benin informed the Commission that it considered that its COVID-19 certificates are being issued in accordance with a standard and a technological system, that are interoperable with the trust framework established by Regulation (EU) 2021/953 and that allow for the verification of the authenticity, validity and integrity of the certificates. In this regard, the Republic of Benin informed the Commission that COVID-19 vaccination, test and recovery certificates issued by the Republic of Benin in accordance with the ‘COVID certificate system’ system contain the data set out in the Annex to Regulation (EU) 2021/953. |

The Republic of Benin also informed the Commission that it accepts vaccination, test and recovery certificates issued by the Member States and EEA countries in accordance with Regulation (EU) 2021/953. |

On 4 February 2022, following a request by the Republic of Benin, the Commission carried out technical tests that demonstrated that the COVID-19 vaccination, test and recovery certificates issued by the Republic of Benin are in accordance with a system, the ‘COVID certificate system’ that is interoperable with the trust framework established by Regulation (EU) 2021/953, and allows for the verification of the authenticity, validity and integrity of the certificates. The Commission also confirmed that the COVID-19 vaccination certificates issued by the Republic of Benin in accordance with the ‘COVID certificate system’ contain the necessary data. |

In addition, the Republic of Benin informed the Commission that it issues interoperable vaccination certificates for COVID-19 vaccines. Those vaccines currently include Comirnaty, Spikevax, Vaxzevria, COVID-19 Vaccine Janssen, CoronaVac, and Covishield. |

The Republic of Benin also informed the Commission that it issues interoperable test certificates for nucleic acid amplification tests and rapid antigen tests listed in the common and updated list of COVID-19 rapid antigen tests agreed by the Health Security Committee, established by Article 17 of Decision No 1082/2013/EU of the European Parliament and of the Council (3), on the basis of the Council Recommendation of 21 January 2021 (4). |

Furthermore, the Republic of Benin informed the Commission that it issues interoperable certificates of recovery. Those certificates are valid for not more than 180 days after the date of the first positive test. |

In addition, the Republic of Benin informed the Commission that when verifiers in Benin verify certificates, the personal data included in them will be processed only to verify and confirm the holder’s vaccination, test result or recovery status and will not be retained afterwards. |

The necessary elements for establishing that COVID-19 vaccination, test and recovery certificates issued by the Republic of Benin in accordance with the ‘COVID certificate system’ are to be considered as equivalent to those issued in accordance with Regulation (EU) 2021/953 are thus fulfilled. |
(11) |
Therefore, COVID-19 vaccination, test and recovery certificates issued by the Republic of Benin in accordance with the ‘COVID certificate system’ should be accepted under the conditions referred to in Article 5(5), Article 6(5) and Article 7(8) of Regulation (EU) 2021/953. |
(12) |
In order for this Decision to be operational, the Republic of Benin should be connected to the EU Digital COVID Certificate trust framework established by Regulation (EU) 2021/953. |
(13) |
In order to protect the Union’s interests, in particular in the area of public health, the Commission may use its powers to suspend application of this Decision or repeal it, if the conditions of Article 8(2) of Regulation (EU) 2021/953 are no longer met. |
(14) |
In order to connect the Republic of Benin to the EU Digital COVID Certificate trust framework established by Regulation (EU) 2021/953 as rapidly as possible, this Decision should enter into force on the day of its publication in the Official Journal of the European Union. |
(15) |
The measures provided for in this Decision are in accordance with the opinion of the Committee established by Article 14 of Regulation (EU) 2021/953, |

COVID-19 vaccination, test and recovery certificates issued by the Republic of Benin in accordance with the ‘COVID certificate system’ shall, for the purpose of facilitating the right of free movement within the Union, be considered as equivalent to those issued in accordance with Regulation (EU) 2021/953.
Article 2
The Republic of Benin shall be connected to the EU Digital COVID Certificate trust framework established by Regulation (EU) 2021/953.
Article 3
This Decision shall enter into force on the day of its publication in the Official Journal of the European Union.

establishing the equivalence, for the purpose of facilitating the right of free movement within the Union, of COVID-19 certificates issued by the Hashemite Kingdom of Jordan to the certificates issued in accordance with Regulation (EU) 2021/953 of the European Parliament and of the Council

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2021/953 of the European Parliament and of the Council of 14 June 2021 on a framework for the issuance, verification and acceptance of interoperable COVID-19 vaccination, test and recovery certificates (EU Digital COVID Certificate) to facilitate free movement during the COVID-19 pandemic (1), and in particular Article 8(2) thereof,
Whereas:

Regulation (EU) 2021/953 lays down a framework for the issuance, verification and acceptance of interoperable COVID-19 vaccination, test and recovery certificates (‘EU Digital COVID Certificate’) for the purpose of facilitating the holders’ exercise of their right to free movement during the COVID-19 pandemic. It is also to contribute to facilitating the gradual lifting of restrictions to free movement put in place by Member States, in accordance with Union law, to limit the spread of SARS-CoV-2, in a coordinated manner. |
(2) |
Regulation (EU) 2021/953 allows for the acceptance of COVID-19 certificates issued by third countries to Union citizens and their family members where the Commission finds that those COVID-19 certificates are issued in accordance with standards that are to be considered as equivalent to those established pursuant to that Regulation. Furthermore, in accordance with Regulation (EU) 2021/954 of the European Parliament and of the Council (2), Member States are to apply the rules laid down in Regulation (EU) 2021/953 to third-country nationals who do not fall within the scope of that Regulation, but who are legally staying or residing in their territory and who are entitled to travel to other Member States in accordance with Union law. Therefore, any equivalence findings laid down in this Decision should apply to COVID-19 vaccination certificates issued by the Hashemite Kingdom of Jordan to Union citizens and their family members. Similarly, on the basis of Regulation (EU) 2021/954, such equivalence findings should also apply to COVID-19 vaccination certificates issued by the Hashemite Kingdom of Jordan to third-country nationals legally staying or residing in the territory of the Member States under the conditions laid down in that Regulation. |

On 5 September 2021, the Hashemite Kingdom of Jordan provided the Commission with detailed information on the issuance of interoperable COVID-19 vaccination certificates under the system entitled ‘COVID-19 Vaccination Certificate’. The Hashemite Kingdom of Jordan informed the Commission that it considered that its COVID-19 certificates are being issued in accordance with a standard and a technological system, that are interoperable with the trust framework established by Regulation (EU) 2021/953 and that allow for the verification of the authenticity, validity and integrity of the certificates. In this regard, the Hashemite Kingdom of Jordan informed the Commission that COVID-19 vaccination certificates issued by the Hashemite Kingdom of Jordan in accordance with the ‘COVID-19 Vaccination Certificate’ system contain the data set out in the Annex to Regulation (EU) 2021/953. |

The Hashemite Kingdom of Jordan also informed the Commission that it accepts vaccination and nucleic acid amplification test certificates issued by the Member States and EEA countries in accordance with Regulation (EU) 2021/953. |
(5) |
On 10 December 2021, following a request by the Hashemite Kingdom of Jordan, the Commission carried out technical tests that demonstrated that the COVID-19 vaccination certificates issued by the Hashemite Kingdom of Jordan are in accordance with a system, the ‘COVID-19 Vaccination Certificate’ that is interoperable with the trust framework established by Regulation (EU) 2021/953, and allows for the verification of the authenticity, validity and integrity of the certificates. The Commission also confirmed that the COVID-19 vaccination certificates issued by the Hashemite Kingdom of Jordan in accordance with the ‘COVID-19 Vaccination Certificate’ system contain the necessary data. |

In addition, the Hashemite Kingdom of Jordan informed the Commission that it issues interoperable vaccination certificates for COVID-19 vaccines. Those vaccines currently include Comirnaty, Vaxzevria, BBIBP-CorV and Sputnik V. |
(7) |
The Hashemite Kingdom of Jordan also informed the Commission that it does not issue interoperable test certificates for nucleic acid amplification tests or rapid antigen tests. |
(8) |
Furthermore, the Hashemite Kingdom of Jordan informed the Commission that it does not issue interoperable certificates of recovery. |
(9) |
In addition, the Hashemite Kingdom of Jordan informed the Commission that when verifiers in Jordan verify certificates, the personal data included in them will be processed only to verify and confirm the holder’s vaccination, test result or recovery status and will not be retained afterwards. |
(10) |
The necessary elements for establishing that COVID-19 vaccination certificates issued by the Hashemite Kingdom of Jordan in accordance with the ‘COVID-19 Vaccination Certificate’ system are to be considered as equivalent to those issued in accordance with Regulation (EU) 2021/953 are thus fulfilled. |
(11) |
Therefore, COVID-19 vaccination certificates issued by the Hashemite Kingdom of Jordan in accordance with the ‘COVID-19 Vaccination Certificate’ system should be accepted under the conditions referred to in Article 5(5) of Regulation (EU) 2021/953. |
(12) |
In order for this Decision to be operational, the Hashemite Kingdom of Jordan should be connected to the EU Digital COVID Certificate trust framework established by Regulation (EU) 2021/953. |
(13) |
In order to protect the Union’s interests, in particular in the area of public health, the Commission may use its powers to suspend application of this Decision or repeal it, if the conditions of Article 8(2) of Regulation (EU) 2021/953 are no longer met. |
(14) |
In order to connect the Hashemite Kingdom of Jordan to the EU Digital COVID Certificate trust framework established by Regulation (EU) 2021/953 as rapidly as possible, this Decision should enter into force on the day of its publication in the Official Journal of the European Union. |
(15) |
The measures provided for in this Decision are in accordance with the opinion of the Committee established by Article 14 of Regulation (EU) 2021/953, |
HAS ADOPTED THIS DECISION:
Article 1
COVID-19 vaccination certificates issued by the Hashemite Kingdom of Jordan in accordance with the ‘COVID-19 Vaccination Certificate’ system shall, for the purpose of facilitating the right of free movement within the Union, be considered as equivalent to those issued in accordance with Regulation (EU) 2021/953.
Article 2
The Hashemite Kingdom of Jordan shall be connected to the EU Digital COVID Certificate trust framework established by Regulation (EU) 2021/953.
Article 3
