COMMISSION IMPLEMENTING REGULATION (EU) 2020/1279
of 9 September 2020
concerning the classification of certain goods in the Combined Nomenclature
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 952/2013 of the European Parliament and of the Council of 9 October 2013 laying down the Union Customs Code (1), and in particular Article 57(4) and Article 58(2) thereof,
Whereas:

In order to ensure uniform application of the Combined Nomenclature annexed to Council Regulation (EEC) No 2658/87 (2), it is necessary to adopt measures concerning the classification of the goods referred to in the Annex to this Regulation. |
(2) |
Regulation (EEC) No 2658/87 has laid down the general rules for the interpretation of the Combined Nomenclature. Those rules apply also to any other nomenclature which is wholly or partly based on it or which adds any additional subdivision to it and which is established by specific provisions of the Union, with a view to the application of tariff and other measures relating to trade in goods. |

Pursuant to those general rules, the goods described in column (1) of the table set out in the Annex should be classified under the CN code indicated in column (2), by virtue of the reasons set out in column (3) of that table. |

It is appropriate to provide that binding tariff information issued in respect of the goods concerned by this Regulation which does not conform to this Regulation may, for a certain period, continue to be invoked by the holder in accordance with Article 34(9) of Regulation (EU) No 952/2013. That period should be set at three months. |

The measures provided for in this Regulation are in accordance with the opinion of the Customs Code Committee, |
HAS ADOPTED THIS REGULATION:
Article 1
The goods described in column (1) of the table set out in the Annex shall be classified within the Combined Nomenclature under the CN code indicated in column (2) of that table.
Article 2
Binding tariff information which does not conform to this Regulation may continue to be invoked in accordance with Article 34(9) of Regulation (EU) No 952/2013 for a period of three months from the date of entry into force of this Regulation.
Article 3
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

The article is designed to be worn on the body or on clothes. It is considered a small object of personal adornment (see also Harmonized System Explanatory Notes (HSEN) to heading 7117, first paragraph). Classification under heading 8306 as ‘ornaments of base metal’ is excluded as the article is not of a kind designed essentially for decoration, in homes, offices, etc. (see also the HSEN to heading 8306, part (B), first paragraph). That heading covers only medallions other than those for personal adornment (see also the HSEN to heading 8306, part (B), third paragraph, (1)). Consequently, the article is to be classified under CN code 7117 19 00 as ‘other imitation jewellery of base metal’. |

COMMISSION IMPLEMENTING REGULATION (EU) 2020/1280

concerning the non-renewal of the approval of the active substance benalaxyl, in accordance with Regulation (EC) No 1107/2009 of the European Parliament and of the Council concerning the placing of plant protection products on the market, and amending the Annex to Commission Implementing Regulation (EU) No 540/2011

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 1107/2009 of the European Parliament and of the Council of 21 October 2009 concerning the placing of plant protection products on the market and repealing Council Directives 79/117/EEC and 91/414/EEC (1), and in particular Article 20(1) and Article 78(2) thereof,
Whereas:

Commission Directive 2004/58/EC (2) included benalaxyl as an active substance in Annex I to Council Directive 91/414/EEC (3). |
(2) |
Active substances included in Annex I to Directive 91/414/EEC are deemed to have been approved under Regulation (EC) No 1107/2009 and are listed in Part A of the Annex to Commission Implementing Regulation (EU) No 540/2011 (4). |
(3) |
The approval of the active substance benalaxyl, as set out in Part A of the Annex to Implementing Regulation (EU) No 540/2011, expires on 31 July 2021. |

An application for the renewal of the approval of the active substance benalaxyl was submitted in accordance with Article 1 of Commission Implementing Regulation (EU) No 844/2012 (5) within the time period provided for in that Article. |

The applicant submitted the supplementary dossiers required in accordance with Article 6 of Implementing Regulation (EU) No 844/2012. The application was found to be complete by the rapporteur Member State. |

The rapporteur Member State prepared a renewal assessment report in consultation with the co-rapporteur Member State and submitted it to the European Food Safety Authority (‘the Authority’) and the Commission on 12 October 2016. |
(7) |
The Authority made the supplementary summary dossier available to the public. The Authority also circulated the renewal assessment report to the applicants and to the Member States for comments and launched a public consultation on it. The Authority forwarded the comments received to the Commission. |
(8) |
On 19 December 2019, the Authority communicated to the Commission its conclusion (6) on whether benalaxyl can be expected to meet the approval criteria provided for in Article 4 of Regulation (EC) No 1107/2009. |

In its conclusion, the Authority identified a number of concerns. In particular, the potential groundwater contamination by relevant metabolites could not be excluded. Furthermore, a long-term risk to to birds and earthworm-eating birds from secondary poisoning from benalaxyl was identified as a critical area of concern. Concerns were also identified in relation to the long-term risk to non-target arthropods for all representative uses. Finally, following the request by the Authority for additional information to assess the endocrine disrupting potential of benalaxyl, the applicant confirmed that no additional studies would be performed or submitted. Consequently, it cannot be concluded that the substance has no endocrine disrupting properties. |

The Commission invited the applicant to submit its comments on the conclusion of the Authority. Furthermore, in accordance with the third subparagraph of Article 14(1) of Implementing Regulation (EU) No 844/2012, the Commission invited the applicant to submit comments on the renewal report. The applicant submitted its comments, which have been carefully examined. |

However, despite the arguments put forward by the applicant, the concerns regarding the active substance could not be eliminated. |
(12) |
Consequently, it has not been established with respect to one or more representative uses of at least one plant protection product that the approval criteria provided for in Article 4 of Regulation (EC) No 1107/2009 are satisfied. It is therefore appropriate not to renew the approval of the active substance benalaxyl in accordance with Article 20(1)(b) of that Regulation. |

Implementing Regulation (EU) No 540/2011 should therefore be amended accordingly. |
(14) |
Member States should be given sufficient time to withdraw authorisations for plant protection products containing benalaxyl. |
(15) |
For plant protection products containing benalaxyl, where Member States grant any grace period in accordance with Article 46 of Regulation (EC) No 1107/2009, that period should not exceed 12 months from the date of entry into force of this Regulation. |
(16) |
Commission Implementing Regulation (EU) 2020/869 (7) extended the approval period of benalaxyl to 31 July 2021 in order to allow the renewal process to be completed before the expiry of the approval period of that substance. However, given that a decision on the non-renewal of the approval is being taken ahead of the expiry of that extended approval period, this Regulation should apply as soon as possible. |

This Regulation does not prevent the submission of a further application for the approval of benalaxyl pursuant to Article 7 of Regulation (EC) No 1107/2009. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
Non-renewal of the approval of the active substance
The approval of the active substance benalaxyl is not renewed.
Article 2
Amendment to Implementing Regulation (EU) No 540/2011
In Part A of the Annex to Implementing Regulation (EU) No 540/2011, row 84, on benalaxyl, is deleted.
Article 3
Transitional measures
Member States shall withdraw authorisations for plant protection products containing benalaxyl as an active substance by 5 April 2021.
Article 4
Grace period
Any grace period granted by Member States in accordance with Article 46 of Regulation (EC) No 1107/2009 shall expire by 5 October 2021.
Article 5
Entry into force
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

Having regard to Regulation (EC) No 1107/2009 of the European Parliament and of the Council of 21 October 2009 concerning the placing of plant protection products on the market and repealing Council Directives 79/117/EEC and 91/414/EEC (1), and in particular Article 13(2) thereof,

According to Article 80(1)(a) of Regulation (EC) No 1107/2009, Council Directive 91/414/EEC (2) is to apply, with respect to the procedure and the conditions for approval, to active substances for which a decision has been adopted in accordance with Article 6(3) of that Directive before 14 June 2011. For ethametsulfuron-methyl Commission Decision 2011/124/EU (3) has been adopted in accordance with Article 6(3) of that Directive on 23 February 2011. |

On 29 June 2010, DuPont de Nemours GmbH submitted an application for the inclusion of the active substance ethametsulfuron-methyl in Annex I to Directive 91/414/EEC to the United Kingdom in accordance with Article 6(2) of Directive 91/414/EEC. Decision 2011/124/EU confirmed that the dossier was ‘complete’ in the sense that it could be considered as satisfying, in principle, the data and information requirements of Annexes II and III to Directive 91/414/EEC. |

Subsequently, FMC Agricultural Solutions A/S acquired all rights concerning ethametsulfuron-methyl from DuPont de Nemours GmbH. |
(4) |
The assessment of the effects of ethametsulfuron-methyl on human and animal health and the environment for the uses proposed by the applicant has been carried out in accordance with the procedure provided in Article 6(2) and (4) of Directive 91/414/EEC. The United Kingdom submitted a draft assessment report to the Commission and the European Food Safety Authority (‘the Authority’) on 17 September 2012. |

The draft assessment report was reviewed by the Member States and the Authority. The Authority presented to the Commission its conclusion (4) on the pesticide risk assessment of the active substance ethametsulfuron-methyl on 11 December 2013. In April 2014, the European Commission mandated the Authority to organise and perform a peer review as regards new data on one metabolite of ethametsulfuron-methyl. The Authority presented to the Commission its updated conclusion (5) on 14 July 2014. |

By letter of 7 May 2020, FMC Agricultural Solutions A/S withdrew the application for the approval of ethametsulfuron-methyl. |

Due to the withdrawal of the application, ethametsulfuron-methyl should not be approved. |

authorising France to apply an extension of certain periods specified in Articles 11, 16 and 17 of Regulation (EU) 2020/698 of the European Parliament and of the Council

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2020/698 of the European Parliament and of the Council of 25 May 2020 laying down specific and temporary measures in view of the COVID‐19 outbreak concerning the renewal or extension of certain certificates, licences and authorisations and the postponement of certain periodic checks and periodic training in certain areas of transport legislation (1) and in particular Article 11(4), Article 16(6) and Article 17(5) thereof,
Whereas:

Article 11(2) of Regulation (EU) 2020/698 extends the time limits for the completion, by the holder of a train driver’s licence, of periodic checks which would otherwise have expired or would otherwise expire between 1 March 2020 and 31 August 2020. |
(2) |
Article 16(1) of Regulation (EU) 2020/698 extends the time limits for carrying out the periodic review of port facility security assessments which would otherwise have expired or would otherwise expire between 1 March 2020 and 31 August 2020. |
(3) |
Article 17(1) of Regulation (EU) 2020/698 extends the time limits for the carrying out of the review of port security assessments and port security plans which would otherwise have expired or would otherwise expire between 1 March 2020 and 31 August 2020. |

Each of these Articles permits a Member State to seek a further extension of the extension provided in them, where it considers that the activity in question is likely to remain impracticable beyond 31 August 2020 due to the measures it has taken to prevent or contain the spread of COVID-19. Such extensions should be duly justified and limited to the period strictly necessary to reflect the period during which the completion of formalities, procedures, checks and training is likely to remain impracticable and, in any event, should not be longer than six months. |

By letter dated 31 July 2020, France submitted a reasoned request to apply an extension by six months of the period of six months specified in Article 11(2) of that Regulation. Moreover, France submitted a reasoned request for an authorisation to apply an extension of four months of the period between 1 March 2020 and 31 August 2020, and an extension to 28 February 2021 of the deadline of 30 November 2020, referring to Article 16(1) and 17(1) of Regulation (EU) 2020/698. France provided additional information in support of its requests on 5 and 14 August 2020 as well as 28 August 2020. On that latter date, it amended its request regarding the period of six months specified in Article 11(2), by reducing the extension sought to four months only. On the same date, it withdrew the request it had made on 31 July 2020, for an extension of time periods specified in Articles 9 and 10 of Regulation (EU) 2020/698. |

As regards the request concerning Article 11 of Regulation (EU) 2020/698, according to the information provided by France, the COVID-19 pandemic has particularly affected the French territory, which has led the government to put in place particularly restrictive and protective measures. Those measures reduced the number of periodic medical checks for train drivers to only 6 % of those planned in April 2020. |

According to the information provided by France, despite an improvement in the health situation, and in line with medical expertise, protective measures aimed at preventing the spread of the virus continue to be applied. Those measures reduced the number of periodic checks that could be carried out, to 60 % of normal in May 2020. |
(8) |
In spite of the major efforts undertaken from June 2020, to prioritise delayed checks and increase the number of medical checks carried out, it will not be possible to eliminate the delay in carrying out the medical checks within the extension period provided by Regulation (EU) 2020/698. Indeed, the relevant resources of the health services are also needed to support patients who have been infected with COVID-19. In addition, the number of accredited health professionals to validate the capability of train drivers cannot be significantly increased in the context of the pandemic and in view of the specific nature of those medical examinations. |

Current COVID-19 protocols implemented by French authorities comprise:
These measures reduce capacity by 20 % compared to the ordinary capacity. |
(10) |
Notwithstanding the continuation of these measures, France expects to significantly increase the number of medical examinations carried out during the autumn period, in order to absorb the backlog accumulated. This will however only permit that backlog to be fully absorbed by the end of December. |

As regards Article 16(1) and Article 17(1) of Regulation (EU) 2020/698, according to the information provided by France, the completion of all the reviews of the port security assessments and port facility security assessments that would otherwise have been due or would otherwise be due in 2020 is likely to be impracticable in France until 28 February 2021 due to measures that it has taken to prevent or contain the spread of COVID‐19. |

In particular, there is an exceptionally high number of port security assessments and port facility security assessments to be reviewed in France in 2020: 7 port security assessments and 62 port facility security assessments, and as many port and port facility security plans. As of 3 August 2020, 6 port security assessments and 53 port facility security assessments remained to be reviewed. This is more than the 6 to 8 port security assessments and 27 to 30 port facility security assessments in the years 2021, 2022, 2023 put together. |

According to the information provided by France, the competent authorities responsible for those reviews have been and remain on the front line in managing the repercussions of the COVID-19 crisis. Those authorities also have responsibilities in the areas of civil safety, risk prevention and crisis management. Currently, coastal areas in France in particular are seeing an increase in COVID-19 cases, and authorities in those areas are required to respond. In addition, the organisation of audio or video conferences between relevant parties are complicated by the lack of equipment to ensure the security and confidentiality of information exchanged. Under these circumstances, the competent authorities responsible are facing significant practical difficulties in performing their duties, as physical meetings and travel of relevant personnel also continue to be complex due to measures that remain in place to prevent or contain the spread of COVID-19. |

This, along with the backlog due to the fact that the reviews had to be interrupted between 17 March 2020 and 11 May 2020 (the confinement period in France), makes it impracticable to complete all the necessary reviews in time without an extension. Reviews remained difficult in the post-confinement period, and continue to remain so since the state of health emergency in France came to an end on 10 July 2020. |

In addition, a significant number of the port security assessments and port facility security assessments to be reviewed concern French overseas departments where the COVID-19 pandemic has been and continues to be particularly acute. In addition to staff mobilised by the outbreak in mainland France, limited hospital capacities and the high prevalence of COVID-19 has required strict travel restrictions, including quarantine measures. This has directly affected the work concerning port security, notably in making it difficult for authorised security organisation personnel to travel from mainland France. |

In light of the complexities described above, the completion of port and port facility security assessments in France is likely to remain difficult. Under these circumstances, France estimates that completing the remaining reviews of 2020 and resolving the backlog accrued over the confinement period, would not be practicable without an extension of the reference period to 31 December 2020, and an extension of the deadline to 28 February 2021. |

France should therefore be authorised to apply an extension of the period of four months specified in Article 11(2) of Regulation (EU) 2020/698. France should also be authorised to apply an extension of the periods between 1 March 2020 and 31 August 2020, and of the deadline of 30 November 2020, specified in Article 16(1) and Article 17(1) of Regulation (EU) 2020/698, |
HAS ADOPTED THIS DECISION:
Article 1
France is authorised to apply an extension of four months of the period of six months specified in Article 11(2) of Regulation (EU) 2020/698.
France is authorised to apply an extension of four months of the periods between 1 March 2020 and 31 August 2020 specified in Article 16(1) and Article 17(1) of Regulation (EU) 2020/698.
France is authorised to apply an extension until 28 February 2021 of the deadline of 30 November 2020 specified in Article 16(1) and Article 17(1) of Regulation (EU) 2020/698.

Having regard to Council Directive 89/662/EEC of 11 December 1989 concerning veterinary checks in intra-Community trade with a view to the completion of the internal market (1), and in particular Article 9(4) thereof,
Having regard to Council Directive 90/425/EEC of 26 June 1990 concerning veterinary checks applicable in intra-Union trade in certain live animals and products with a view to the completion of the internal market (2), and in particular Article 10(4) thereof,
Having regard to Council Directive 2002/99/EC of 16 December 2002 laying down the animal health rules governing the production, processing, distribution and introduction of products of animal origin for human consumption (3), and in particular Article 4(3) thereof,
Whereas:

Commission Implementing Decision 2014/709/EU (4) lays down animal health control measures in relation to African swine fever in certain Member States, where there have been confirmed cases of that disease in domestic or feral pigs (the Member States concerned). The Annex to that Implementing Decision demarcates and lists certain areas of the Member States concerned in Parts I to IV thereof, differentiated by the level of risk based on the epidemiological situation as regards that disease. The Annex to Implementing Decision 2014/709/EU has been amended several times to take account of changes in the epidemiological situation in the Union as regards African swine fever that need to be reflected in that Annex. The Annex to Implementing Decision 2014/709/EU was last amended by Commission Implementing Decision (EU) 2020/1257 (5), following changes in the epidemiological situation as regards that disease in Poland. |

Since the date of adoption of Implementing Decision (EU) 2020/1257, there have been new occurrences of African swine fever in domestic pigs and in wild boar in Slovakia. |

In September 2020, one outbreak of African swine fever in domestic pigs was observed in the district of Rožňava in Slovakia in an area currently listed in Part II of the Annex to Implementing Decision 2014/709/EU. This outbreak of African swine fever in domestic pigs constitutes an increased level of risk, which should be reflected in that Annex. Accordingly, this area of Slovakia listed in Part II of that Annex affected by this recent outbreak of African swine fever, should now be listed in Part III of that Annex instead of in Part II thereof. |

In addition, in September 2020, one case of African swine fever in a feral pig was observed in the district of Trebišov in Slovakia in an area currently listed in Part III of the Annex to Implementing Decision 2014/709/EU, located in close proximity to an area currently listed in Part I thereof. This case of African swine fever in a feral pig constitute an increased level of risk, which should be reflected in that Annex. Accordingly, this area of Slovakia listed in Part I of that Annex, that is in close proximity to the area listed in Part III affected by this recent case of African swine fever, should now be listed in Part II of that Annex instead of in Part I thereof. |

Following the recent outbreak of African swine fever in domestic pigs and the recent case in a feral pig in Slovakia, and taking into account the current epidemiological situation in the Union, regionalisation in this Member State has been reassessed and updated. In addition, the risk management measures in place have also been reassessed and updated. These changes need to be reflected in the Annex to Implementing Decision 2014/709/EU. |

In order to take account of recent developments in the epidemiological situation of African swine fever in the Union, and in order to combat the risks associated with the spread of that disease in a proactive manner, new high-risk areas of a sufficient size should be demarcated for Slovakia and duly listed in Parts II and III of the Annex to Implementing Decision 2014/709/EU. Given that Part III of the Annex to Implementing Decision 2014/709/EU lists the areas where the epidemiological situation is still evolving and very dynamic, when any amendments are made to areas listed in that Part, particular consideration must always be given to the effect on the surrounding areas, as has been done in this instance. Parts I, II and III of that Annex should therefore be amended accordingly. |

Given the urgency of the epidemiological situation in the Union as regards the spread of African swine fever, it is important that the amendments made to the Annex to Implementing Decision 2014/709/EU by this Decision take effect as soon as possible. |

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS DECISION:

The Annex to Implementing Decision 2014/709/EU is replaced by the text set out in the Annex to this Decision.

amending Guideline (EU) 2018/797 on the Eurosystem’s provision of reserve management services in euro to central banks and countries located outside the euro area and to international organisations (ECB/2020/34)
THE GOVERNING COUNCIL OF THE EUROPEAN CENTRAL BANK,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to the Statute of the European System of Central Banks and of the European Central Bank, and in particular Article 12.1, Article 14.3 and Article 23 thereof,
Whereas:

Transparency in reporting and information sharing within the Eurosystem in the context of the provision of Eurosystem reserve management services (ERMS) in euro to central banks and countries located outside the euro area and to international organisations should be further increased to contribute to a more consistent Eurosystem approach towards ERMS customers and to an improved analysis of the functioning of the ERMS. ERMS customers who do not consent to the disclosure of their identity to the Eurosystem central banks and thus do not facilitate transparency in reporting and information sharing within the Eurosystem should not benefit from preferential cash balance remuneration offered on a Tier 1 investment. |

Therefore, Guideline (EU) 2018/797 of the European Central Bank (ECB/2018/14) (1) should be amended accordingly, |
HAS ADOPTED THIS GUIDELINE:
Article 1
Amendments
Article 4 of Guideline (EU) 2018/797 (ECB/2018/14) is replaced by the following:
‘Article 4
Information sharing regarding Eurosystem reserve management services
1. National central banks of the Member States whose currency is the euro shall provide to the ECB any relevant information on providing Eurosystem reserve management services to new and existing customers and inform the ECB when a potential customer approaches them. The ECB may share relevant information within the Eurosystem.
2. National central banks of the Member States whose currency is the euro shall endeavour to obtain a customer’s consent to the disclosure of its identity to the Eurosystem central banks.
3. If a customer’s consent to the disclosure of its identity is not obtained, the national central bank concerned shall provide to the ECB the relevant information without revealing the identity of that customer. In that case, that customer’s limit for the Tier 1 investment facility balances shall be set to zero by each national central bank which does not obtain that customer’s consent to the disclosure of its identity to the Eurosystem central banks.’.
Article 2
Taking effect and implementation
1. This Guideline shall take effect on the day of its notification to the national central banks of the Member States whose currency is the euro.
2. The Eurosystem central banks shall comply with this Guideline from 1 April 2021.
