replacing Annexes I, II, III and IV to Regulation (EC) No 861/2007 of the European Parliament and of the Council establishing a European Small Claims Procedure
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 861/2007 of the European Parliament and of the Council of 11 July 2007 establishing a European Small Claims Procedure (1), and in particular Article 26 thereof,
Whereas:

Regulation (EC) No 861/2007 establishes in its Annexes the forms to be used to facilitate its application. |
(2) |
Regulation (EC) No 861/2007 was amended by Regulation (EU) 2015/2421 of the European Parliament and of the Council (2). The introduced changes to the European Small Claims Procedure should be reflected in the forms in the annexes. For the sake of clarity, it is appropriate to replace the whole Annexes. |
(3) |
As the amendments to Regulation (EC) No 861/2007 will start to apply on 14 July 2017, this Regulation should enter into force on 14 July 2017. |
(4) |
In accordance with Article 3 and Article 4a(1) of Protocol No 21 on the position of the United Kingdom and Ireland in respect of the area of freedom, security and justice, annexed to the Treaty on European Union and to the Treaty on the Functioning of the European Union, the United Kingdom and Ireland have notified their wish to take part in the adoption and application of Regulation (EC) No 861/2007 and of Regulation (EU) 2015/2421, and are therefore bound by this Regulation. |

In accordance with Articles 1 and 2 of Protocol No 22 on the position of Denmark, annexed to the Treaty on European Union and to the Treaty on the Functioning of the European Union, Denmark is not taking part in the adoption of this Regulation and is not bound by it or subject to its application. |

Therefore, it is necessary to replace Annexes I to IV to Regulation (EC) No 861/2007, |
HAS ADOPTED THIS REGULATION:
Article 1
Annexes I, II, III and IV to Regulation (EC) No 861/2007 are replaced by the text in the Annex to this Regulation.
Article 2
This Regulation shall enter into force on 14 July 2017.
This Regulation shall be binding in its entirety and directly applicable in the Member States in accordance with the Treaties.

replacing Annex I to Regulation (EC) No 1896/2006 of the European Parliament and of the Council creating a European order for payment procedure
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 1896/2006 of the European Parliament and of the Council of 12 December 2006 creating a European order for payment procedure (1), and in particular Article 30 thereof,
Whereas:

Regulation (EC) No 1896/2006 establishes in its Annexes the forms to be used to facilitate its application. |
(2) |
Regulation (EC) No 1896/2006 was amended by Regulation (EU) 2015/2421 of the European Parliament and of the Council (2) with the effect from 14 July 2017. From that date where a European Order for Payment is opposed, the claimant has the possibility to request that the proceedings continue in accordance with the rules of the European Small Claims Procedure laid down in Regulation (EC) No 861/2007 of the European Parliament and of the Council (3). Appendix 2 and the guidelines thereto in Annex I should take into account such possibility. For the sake of clarity, it is appropriate to replace the whole Annex I. |

As the amendments to Regulation (EC) No 1896/2006 will start to apply on 14 July 2017, this Regulation should enter into force on 14 July 2017. |

This Regulation shall be binding in its entirety and directly applicable in the Member States in accordance with the Treaties.

amending Regulation (EU) No 142/2011 as regards an alternative method for processing certain rendered fats

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 1069/2009 of the European Parliament and of the Council of 21 October 2009 laying down health rules as regards animal by-products and derived products not intended for human consumption and repealing Regulation (EC) No 1774/2002 (1), and in particular Article 20(11)(a) thereof,
Whereas:

Commission Regulation (EU) No 142/2011 (2) lays down rules implementing Regulation (EC) No 1069/2009 including procedures for adoption of an alternative processing method. |
(2) |
Following an application of the competent authority of Finland for the authorisation of an alternative method for use or disposal of animal by-products or derived products, as referred to in Article 20 of Regulation (EC) No 1069/2009, the European Food Safety Authority (EFSA) published a Scientific Opinion on the use of a continuous multi-step catalytic hydro-treatment for the processing of rendered animal fat (Category 1) (3). This method may be used for the production of renewable diesel, renewable jet fuel, renewable propane and renewable gasoline. This method has been assessed by EFSA as a safe alternative method for processing of Category 1 rendered fats and the products may be declared as the end point in the manufacturing chain. |

Annex IV to Regulation (EU) No 142/2011 should therefore be amended accordingly. |
(4) |
Derived products from the processing of Category 1 and 2 materials are to be permanently marked to ensure traceability and to prevent their entry into the food and feed chain. Annex VIII to Regulation (EU) No 142/2011 sets out requirements for the marking of those derived products. However, in accordance with point 3(e) of Chapter V of Annex VIII to that Regulation, marking is not required for renewable fuels referred to in point J of Section 2 of Chapter IV of Annex IV thereto. |

Since the multi-step catalytic hydro-treatment for the processing of rendered animal fat (Category 1) reduces the risks to animal and public health as efficiently as the method set out in point J of Section 2 of Chapter IV of Annex IV to Regulation (EU) No 142/2011, it should also be excluded from the marking requirements by adding reference to this method to point 3(e) of Chapter V to Annex VIII to that Regulation. |

Annex VIII to Regulation (EU) No 142/2011 should therefore be amended accordingly. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
In Article 3 of Regulation (EU) No 142/2011, the following point (k) is added:
‘(k) |
renewable diesel, renewable jet fuel, renewable propane and renewable gasoline which fulfil the specific requirements for products from the multi-step catalytic hydro-treatment for the production of renewable fuels set out in point 2(f) of Section 3 of Chapter IV of Annex IV.’ |
Article 2
Annexes IV and VIII to Regulation (EU) No 142/2011 are amended in accordance with the text in the Annex to this Regulation.
Article 3
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending Regulation (EU) No 142/2011 as regards the use of manure of farmed animals as a fuel in combustion plants

THE EUROPEAN COMMISSION,
Having regard to te Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 1069/2009 of the European Parliament and of the Council of 21 October 2009 laying down health rules as regards animal by-products and derived products not intended for human consumption and repealing Regulation (EC) No 1774/2002 (Animal by-products Regulation) (1), and in particular Article 15(1)(e) and Article 27(i) thereof,
Whereas:

Commission Regulation (EU) No 142/2011 (2), lays down rules implementing Regulation (EC) No 1069/2009 including parameters for the disposal of animal by-products as well as for safe treatment, transformation or processing of animal by-products into derived products. |
(2) |
In accordance with Regulation (EC) No 1069/2009, combustion as defined in point 41 of Annex I to Regulation (EU) No 142/2011 is one of the processes to dispose of animal by-products, including manure. |
(3) |
Article 6 of Regulation (EU) No 142/2011 provides for the rules for approval of combustion plants using animal by-products as a fuel. Its paragraph 8 should be amended accordingly to address the use of manure of any farmed animals as a fuel. |
(4) |
Manure of farmed animals may present a sustainable source of fuel for combustion, provided the combustion process complies with specific requirements to efficiently reduce adverse effects of its use as a fuel on animal and public health and the environment. Commission Regulation (EU) No 592/2014 (3) introduced requirements for the use of poultry manure as a fuel in combustion plants. It sets out general requirements for any plant using animal by-products or derived products as fuel and specific requirements for the type of fuel and the type of combustion plant. Manure of farmed animals of species other than poultry may now also be used as a fuel in combustion plants with a total rated thermal input not exceeding 50 MW, under the same conditions as set out for the combustion of poultry manure, including the emission limits and monitoring requirements. |
(5) |
Operators of combustion plants using manure of farmed animals as fuel should take the necessary hygiene measures to prevent spread of possible pathogens. In this respect, such plants should comply with the general requirements for the use of animal by-products and derived products as a fuel as laid down in Chapter IV of Annex III to Regulation (EU) No 142/2011 and specific requirements for particular types of plants and fuels that may be used for combustion to be provided for by this Regulation. |
(6) |
The combustion of manure of herbivores, due to its composition, produces higher emissions of particulate matter than the combustion of poultry manure. To address that problem, this Regulation should provide for more flexible emission limit values of particulate matter for very small combustion plants, in order to allow disposal of the manure which could not otherwise be disposed of as fuel for combustion. |
(7) |
Similarly, this Regulation should allow the competent authorities to grant existing combustion plants a transitional period to comply with requirements on controlled temperature rising of the gas, provided that those emissions do not present risks to public and animal health or the environment. The animal by-products legislation does not prevent Member States from applying the relevant calculation rules for emission limit values, set out in the environmental legislation, when manure of farmed animals is combusted together with other fuels or waste. |
(8) |
Annex XVI to Regulation (EU) No 142/2011 provides for specific requirements for official controls. Following the introduction of requirements for the combustion of manure of farmed animals as a fuel by this Regulation, those specific requirements should also apply with respect to that process. |
(9) |
Annexes III and XVI to Regulation (EU) No 142/2011 should be amended accordingly. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS REGULATION:
Article 1
In Regulation (EU) No 142/2011, in Article 6, paragraph 8 is replaced by the following:
‘8. For the use of manure of farmed animals as a fuel for combustion as set out in Chapter V of Annex III, the following rules shall apply in addition to those referred to in paragraph 7 of this Article:
(a) |
the application for approval that is submitted by the operator to the competent authority in accordance with Article 24(1)(d) of Regulation (EC) No 1069/2009 must contain evidence certified by the competent authority or by a professional organisation authorised by the competent authorities of the Member State, that the combustion plant in which the manure of farmed animals is used as a fuel fully meets the requirements laid down in points B(3), B(4) and B(5) of Chapter V of Annex III to this Regulation, without prejudice to the possibility for the competent authorities of the Member State to grant a derogation from compliance with certain provisions in accordance with point C(4) of Chapter V of Annex III; |
(b) |
the procedure for approval provided for in Article 44 of Regulation (EC) No 1069/2009 shall not be completed until at least two consecutive checks, one of them unannounced, have been carried out by the competent authority or by a professional organisation authorised by that authority, during the first six months of the operating of the combustion plant, including the necessary temperature and emission measurements. After the results of those checks showed compliance with the requirements set out in points B(3), B(4) and B(5) and, where applicable, with point C(4) of Chapter V of Annex III to this Regulation, full approval can be granted.’ |
Article 2
Annexes III and XVI to Regulation (EU) No 142/2011 are amended in accordance with the text in the Annex to this Regulation.
Article 3
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

In Annex III, Chapter V, the following point C is added: ‘C. Combustion plants in which manure of farmed animals other than poultry manure set out in point B is used as a fuel for combustion 1. Type of plant: Combustion plants with a total rated thermal input not exceeding 50 MW. 2. Starting material: Exclusively manure of farmed animals other than poultry manure set out in point B, to be used as a fuel for combustion in accordance with the requirements set out in point 3. The combustion of other animal by-products or derived products shall not be allowed for use as a fuel in combustion plants referred to in point 1. Manure of farmed animals other than poultry manure set out in point B generated outside the holding should not come in contact with farmed animals. 3. Methodology: Combustion plants in which manure of farmed animals other than poultry manure set out in point B is used as a fuel shall comply with requirements set out in points B(3), B(4) and B(5). 4. Derogation and transitional period: The Member State competent authority responsible for environmental issues may:

COMMISSION IMPLEMENTING REGULATION (EU) 2017/1263
of 12 July 2017
updating the list of invasive alien species of Union concern established by Implementing Regulation (EU) 2016/1141 pursuant to Regulation (EU) No 1143/2014 of the European Parliament and of the Council
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1143/2014 of the European Parliament and of the Council of 22 October 2014 on the prevention and management of the introduction and spread of invasive alien species (1), and in particular Article 4(1) and (2) thereof,
Whereas:

Commission Implementing Regulation (EU) 2016/1141 (2) establishes a list of invasive alien species of Union concern (‘the Union list’), which is to be kept updated as appropriate, in accordance with Article 4(2) of Regulation (EU) No 1143/2014. |
(2) |
The Commission has concluded, on the basis of the available evidence and the risk assessments carried out pursuant to Article 5(1) of Regulation (EU) No 1143/2014, that all criteria set out in Article 4(3) of that Regulation are met for the following invasive alien species: Alopochen aegyptiacus Linnaeus, 1766; Alternanthera philoxeroides (Mart.) Griseb.; Asclepias syriaca L.; Elodea nuttallii (Planch.) St. John; Gunnera tinctoria (Molina) Mirbel; Heracleum mantegazzianum Sommier & Levier; Impatiens glandulifera Royle; Microstegium vimineum (Trin.) A. Camus; Myriophyllum heterophyllum Michaux; Nyctereutes procyonoides Gray, 1834; Ondatra zibethicus Linnaeus, 1766; Pennisetum setaceum (Forssk.) Chiov. |

The Commission has concluded that for all those invasive alien species all elements set out in Article 4(6) of Regulation (EU) No 1143/2014 have been duly considered. |
(4) |
Some Member States envisage applying to the Commission for authorizing the continuation of farming Nyctereutes procyonoides Gray, 1834 under Article 9 of Regulation (EU) No 1143/2014 for alleged compelling public interests of a social or economic nature. Against this background, the inclusion of this species on the Union list should be subject to a transition period to allow completing the procedure of Article 9 of that Regulation before the listing of this species takes effect. |
(5) |
Since the date of adoption of Implementing Regulation (EU) 2016/1141, the CN codes laid down in Council Regulation (EEC) No 2658/87 (3) have been updated, with the most recent amendments having been laid down in Commission Implementing Regulation (EU) 2016/1821 (4). Implementing Regulation (EU) 2016/1141 should therefore be amended accordingly. |

establishing the allocation coefficient to be applied to the quantities covered by the applications for import licences lodged from 30 June to 7 July 2017 in the context of the tariff quota for maize opened by Regulation (EC) No 969/2006

Having regard to Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007 (1), and in particular Article 188(1) and (3) thereof,
Whereas:

Commission Regulation (EC) No 969/2006 (2) opened an annual import tariff quota of 277 988 tonnes of maize (order number 09.4131). |
(2) |
Article 2(1) of Regulation (EC) No 969/2006 fixes a quantity of 138 994 tonnes for the subperiod No 2 from 1 July to 31 December 2017. |
(3) |
The quantities covered by the applications for import licences lodged from 30 June 2017 as from 13.00 to 7 July 2017 at 13.00 (Brussels time) exceed those available. The extent to which import licences may be issued should therefore be determined by establishing the allocation coefficient to be applied to the quantities requested, calculated in accordance with Article 7(2) of Commission Regulation (EC) No 1301/2006 (3). |

Import licences should no longer be issued under Regulation (EC) No 969/2006 for the current quota period. |
(5) |
In order to ensure the efficiency of the measure, this Regulation should enter into force on the day of its publication in the Official Journal of the European Union, |
HAS ADOPTED THIS REGULATION:
Article 1
1. The quantities covered by the applications for import licences in respect of the quota referred to in Article 2(1) of Regulation (EC) No 969/2006 (order number 09.4131) lodged from 30 June 2017 as from 13.00 to 7 July 2017 at 13.00 (Brussels time) shall be multiplied by an allocation coefficient of 2,556976 %.
2. The submission of new import licence applications in respect of the quota referred to in Article 2(1) of Regulation (EC) No 969/2006 (order number 09.4131) is suspended as from 7 July 2017 at 13.00 (Brussels time) for the current quota period.
Article 2
This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending the Annex to Implementing Decision 2014/709/EU concerning animal health control measures relating to African swine fever in certain Member States
(notified under document C(2017) 4686)

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Directive 89/662/EEC of 11 December 1989 concerning veterinary checks in intra-Community trade with a view to the completion of the internal market (1), and in particular Article 9(4) thereof,
Having regard to Council Directive 90/425/EEC of 26 June 1990 concerning veterinary and zootechnical checks applicable in intra-Community trade in certain live animals and products with a view to the completion of the internal market (2), and in particular Article 10(4) thereof,
Having regard to Council Directive 2002/99/EC of 16 December 2002 laying down the animal health rules governing the production, processing, distribution and introduction of products of animal origin for human consumption (3), and in particular Article 4(3) thereof,
Whereas:

Commission Implementing Decision 2014/709/EU (4) lays down animal health control measures in relation to African swine fever in certain Member States. The Annex to that Implementing Decision demarcates and lists certain areas of those Members States in Parts I to IV thereof, differentiated by the level of risk based on the epidemiological situation. That list includes certain areas of Estonia, Lithuania and Poland. |

In June 2017, two outbreaks of African swine fever in domestic pigs occurred in the county of Parnu in Estonia and in the municipality of Varena in Lithuania, in areas currently listed in Part II of the Annex to Implementing Decision 2014/709/EU. The occurrence of these outbreaks constitutes an increase in the level of risk that needs to be taken into account. |

In June 2017, one cases of African swine fever in wild boar was observed in the gmina of Sokółka in Poland in an area currently listed in Part I of the Annex to Implementing Decision 2014/709/EU. The occurrence of this case constitutes an increase in the level of risk that needs to be taken into account. |

The evolution of the current epidemiological situation of African swine fever in the affected domestic and feral pig populations in the Union should be taken into account in the assessment of the animal health risk posed by the new disease situation in Estonia, Lithuania and Poland. In order to focus the animal health control measures provided for in Implementing Decision 2014/709/EU, and to prevent the further spread of African swine fever, while preventing any unnecessary disturbance to trade within the Union, and avoiding unjustified barriers to trade by third countries, the Union list of areas subject to the animal health control measures set out in the Annex to that Implementing Decision should be amended to take into account of the changes in the epidemiological situation as regards that disease in Estonia, Lithuania and Poland. Accordingly, the areas affected by the new outbreaks in Estonia and Lithuania should now be listed in Part III, instead of in Part II of that Annex and the relevant area of Poland should now be listed in Part II, instead of Part I, of that Annex. |

The Annex to Implementing Decision 2014/709/EU should therefore be amended accordingly. |

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Plants, Animals, Food and Feed, |
HAS ADOPTED THIS DECISION:
Article 1
The Annex to Implementing Decision 2014/709/EU is replaced by the text set out in the Annex to this Decision.

This Decision is addressed to the Member States.
