COMMISSION IMPLEMENTING REGULATION (EU) 2016/1140
of 8 July 2016
concerning the classification of certain goods in the Combined Nomenclature
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 952/2013 of the European Parliament and of the Council of 9 October 2013 laying down the Union Customs Code (1), and in particular Articles 57(4) and 58(2) thereof,
Whereas:

In order to ensure uniform application of the Combined Nomenclature annexed to Council Regulation (EEC) No 2658/87 (2), it is necessary to adopt measures concerning the classification of the goods referred to in the Annex to this Regulation. |

Regulation (EEC) No 2658/87 has laid down the general rules for the interpretation of the Combined Nomenclature. Those rules apply also to any other nomenclature which is wholly or partly based on it or which adds any additional subdivision to it and which is established by specific provisions of the Union, with a view to the application of tariff and other measures relating to trade in goods. |

Pursuant to those general rules, the goods described in column (1) of the table set out in the Annex should be classified under the CN code indicated in column (2), by virtue of the reasons set out in column (3) of that table. |

It is appropriate to provide that binding tariff information issued in respect of the goods concerned by this Regulation which does not conform to this Regulation may, for a certain period, continue to be invoked by the holder in accordance with Article 34(9) of Regulation (EU) No 952/2013. That period should be set at three months. |

The Customs Code Committee has not issued an opinion within the time limit set by its Chair, |
HAS ADOPTED THIS REGULATION:
Article 1
The goods described in column (1) of the table set out in the Annex shall be classified within the Combined Nomenclature under the CN code indicated in column (2) of that table.
Article 2
Binding tariff information which does not conform to this Regulation may continue to be invoked in accordance with Article 34(9) of Regulation (EU) No 952/2013 for a period of three months from the date of entry into force of this Regulation.
Article 3
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

adopting a list of invasive alien species of Union concern pursuant to Regulation (EU) No 1143/2014 of the European Parliament and of the Council
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1143/2014 of the European Parliament and of the Council of 22 October 2014 on the prevention and management of the introduction and spread of invasive alien species (1), and in particular of Article 4(1) thereof,
Whereas:

Regulation (EU) No 1143/2014 provides that a list of invasive alien species of Union concern (‘the Union list’) is to be adopted on the basis of the criteria laid down in Article 4(3) thereof and meeting the conditions laid down in Article 4(6), which stipulates that the implementation costs, the cost of inaction, the cost-effectiveness and the socioeconomic aspects must be given due consideration. |

The Commission has concluded on the basis of the available scientific evidence and the risk assessments carried out pursuant to Article 5(1) of Regulation (EU) No 1143/2014 that all criteria set out in Article 4(3) of that Regulation are met for the following invasive alien species: Baccharis halimifolia L, Cabomba caroliniana Gray, Callosciurus erythraeus Pallas, 1779, Corvus splendens Viellot, 1817, Eichhornia crassipes (Martius) Solms, Eriocheir sinensis H. Milne Edwards, 1854, Heracleum persicum Fischer, Heracleum sosnowskyi Mandenova, Herpestes javanicus É. Geoffroy Saint-Hilaire, 1818, Hydrocotyle ranunculoides L. f., Lagarosiphon major (Ridley) Moss, Lithobates (Rana) catesbeianus Shaw, 1802, Ludwigia grandiflora (Michx.) The Commission has also concluded that those invasive alien species meet all of the conditions set out in Article 4(6) of Regulation (EU) No 1143/2014. In particular, some of those species are already established in the territory of the Union or even widely spread in certain Member States and there may be cases where it is not possible to eradicate such species in a cost-effective manner. However, it is appropriate to include those species in the Union list, as there are other cost-effective measures that can be implemented: to prevent new introductions or further spread in the territory of the Union; to promote early detection and rapid eradication of species where they are not yet present or not yet widely spread; and to manage them, as appropriate to the specific circumstances of the Member States concerned, including by fishing, hunting or trapping, or any other type of harvesting for consumption or export, provided that these activities are carried out within a national management programme. |

The measures provided for in this Regulation are in accordance with the opinion of the Committee on Invasive Alien Species, |
HAS ADOPTED THIS REGULATION:
Article 1
The list set out in the Annex to this Regulation shall constitute the initial list of invasive alien species of Union concern pursuant to Article 4(1) of Regulation (EU) No 1143/2014.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

Column (i): Species
This column indicates the scientific name of the species. Synonyms are included in parenthesis.
Column (ii): CN codes for live specimens.
This column indicates the Combined Nomenclature (CN) codes for the live specimens. The goods classified under the CN codes in this column shall be subject to official controls under Article 15 of Regulation (EU) No 1143/2014.
The CN, established by Regulation (EEC) No 2658/87, is based on the international Harmonized Commodity Description and Coding System (HS) drawn up by the Customs Cooperation Council, now the World Customs Organization (WCO), adopted by the International Convention, concluded in Brussels on 14 June 1983 and approved on behalf of the European Economic Community by Council Decision 87/369/EEC (1) (‘the HS Convention’). The CN reproduces the headings and subheadings of the HS to six digits, with only the seventh and eighth figures creating further subheadings which are specific to it.
Where only certain specified products under any four, six or eight digit code are required to be submitted to checks and no specific subdivision under this code exists in the CN, the code is marked ex (for example, ex 0106 49 00, as CN code 0106 49 00 comprises all other insects and not only the insect species that figure in the table).
Column (iii): CN code for parts that can reproduce
This column indicates, where relevant, the Combined Nomenclature (CN) codes for the parts of the species that can reproduce. See also the note for column (ii). The goods classified under the CN codes in this column shall be subject to official controls under Article 15 of Regulation (EU) No 1143/2014.
Column (iv): Categories of associated goods

adding to the 2016 fishing quotas certain quantities withheld in the year 2015 pursuant to Article 4(2) of Council Regulation (EC) No 847/96
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EC) No 847/96 of 6 May 1996 introducing additional conditions for year-to-year management of TACs and quotas (1), and in particular Article 4(2) thereof,
Whereas:

According to Article 4(2) of Regulation (EC) No 847/96, Member States may ask the Commission, before 31 October of the year of application of a fishing quota allocated to them, to withhold a maximum of 10 % of that quota to be transferred to the following year. The Commission is to add to the relevant quota the quantity withheld. |

Council Regulations (EU) No 1221/2014 (2), (EU) No 1367/2014 (3), (EU) 2015/104 (4) and (EU) 2015/106 (5) fix fishing quotas for certain stocks for 2015 and specify which stocks may be subject to the measures provided for in Regulation (EC) No 847/96. |

Council Regulations (EU) No 1367/2014, (EU) 2015/2072 (6), (EU) 2016/72 (7) and (EU) 2016/73 (8) fix fishing quotas for certain stocks for 2016. |

Certain Member States have requested, before 31 October 2015, pursuant to Article 4(2) of Regulation (EC) No 847/96, that part of their quotas for 2015 be withheld and transferred to the following year. Within the limits indicated in that Regulation, the quantities withheld should be added to the quotas for 2016. |

Following the prolongation and extension of the embargo imposed in 2014 by the Russian Federation on the importation of certain fisheries products from the Union, Regulation (EU) 2015/2072 amended Regulations (EU) No 1221/2014 and (EU) No 2015/104. The amendments provided for the transfer of an increased percentage of quantities not used in 2015 to the quotas allocated for certain stocks in 2016. Where a Member State has used this option in respect of a particular stock, no other flexibility as regards a carry-over of unused fishing opportunities should apply to that stock, therefor excluding it from this Regulation. |

The measures provided for in this Regulation are in accordance with the opinion of the Committee for Fisheries and Aquaculture, |
HAS ADOPTED THIS REGULATION:
Article 1
The fishing quotas fixed for 2016 in Regulations (EU) No 1367/2014, (EU) No 2015/2072, (EU) 2016/72 and (EU) 2016/73 are increased as set out in the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the seventh day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION REGULATION (EU) 2016/1143

amending Annex VI to Regulation (EC) No 1223/2009 of the European Parliament and of the Council on cosmetic products
(Text with EEA relevance)
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 1223/2009 of the European Parliament and of the Council of 30 November 2009 on cosmetic products (1), and in particular Article 31(2) thereof,
Whereas:

Titanium dioxide is authorised both as a colorant under entry 143 of Annex IV to Regulation (EC) No 1223/2009 and as a UV-filter under entry 27 of Annex VI to that Regulation. In accordance with point (3) of the Preamble to Annexes II to VI to Regulation (EC) No 1223/2009, the substances listed in Annexes III to VI to that Regulation do not cover nanomaterials, except where specifically mentioned. Titanium dioxide (nano) is currently not regulated. |
(2) |
According to the opinion of the Scientific Committee on Consumer Safety (‘SCCS’) of 22 July 2013, which was revised on 22 April 2014 (2), the use of titanium dioxide (nano) as a UV-filter in sunscreens, with the characteristics as indicated in the opinion, and at a concentration up to 25 % w/w, can be considered to not pose any risk of adverse effects in humans after application on healthy, intact or sunburnt skin. In addition, considering the absence of a systemic exposure, the SCCS considers that the use of titanium dioxide (nano) in dermally applied cosmetic products should not pose any significant risk to the consumer. |

The characteristics indicated by the SCCS in its opinion concern the physico-chemical properties of the material (such as purity, structure and physical appearance, particle number size distribution, aspect ratio, volume specific surface area and photocatalytic activity) and whether it is uncoated or coated with specific chemicals. Therefore, these physico-chemical properties and requirements regarding coatings should be reflected in Regulation (EC) No 1223/2009. |

The SCCS also considered that, on the basis of available information, the use of titanium dioxide (nano) in spray products cannot be considered safe. In addition, the SCCS indicated, in a further opinion of 23 September 2014 for clarification of the meaning of the term ‘sprayable applications/products’ for the nano forms of carbon black CI 77266, titanium dioxide and zinc oxide (3), that its concern is limited to spray applications that might lead to exposure of the consumer's lungs to titanium dioxide (nano) by inhalation. |
(5) |
In light of the SCCS opinions mentioned above, titanium dioxide (nano), according to the SCCS's specifications, should be authorised for use as a UV-filter in cosmetic products at a maximum concentration of 25 % w/w, except in applications that may lead to exposure of the end-user's lungs by inhalation. |
(6) |
Annex VI to Regulation (EC) No 1223/2009 should be amended for the purpose of adapting it to technical and scientific progress. |
(7) |
The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Cosmetic Products, |
HAS ADOPTED THIS REGULATION:
Article 1
Annex VI to Regulation (EC) No 1223/2009 is amended in accordance with the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

establishing the standard import values for determining the entry price of certain fruit and vegetables
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007 (1),
Having regard to Commission Implementing Regulation (EU) No 543/2011 of 7 June 2011 laying down detailed rules for the application of Council Regulation (EC) No 1234/2007 in respect of the fruit and vegetables and processed fruit and vegetables sectors (2), and in particular Article 136(1) thereof,
Whereas:

Implementing Regulation (EU) No 543/2011 lays down, pursuant to the outcome of the Uruguay Round multilateral trade negotiations, the criteria whereby the Commission fixes the standard values for imports from third countries, in respect of the products and periods stipulated in Annex XVI, Part A thereto. |
(2) |
The standard import value is calculated each working day, in accordance with Article 136(1) of Implementing Regulation (EU) No 543/2011, taking into account variable daily data. Therefore this Regulation should enter into force on the day of its publication in the Official Journal of the European Union, |
HAS ADOPTED THIS REGULATION:
Article 1
The standard import values referred to in Article 136 of Implementing Regulation (EU) No 543/2011 are fixed in the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

DECISION (EU) 2016/1145 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL

on the mobilisation of the European Globalisation Adjustment Fund (application from Belgium — EGF/2015/012 BE/Hainaut Machinery)
THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) No 1309/2013 of the European Parliament and of the Council of 17 December 2013 on the European Globalisation Adjustment Fund (2014-2020) and repealing Regulation (EC) No 1927/2006 (1), and in particular Article 15(4) thereof,
Having regard to the Interinstitutional Agreement of 2 December 2013 between the European Parliament, the Council and the Commission on budgetary discipline, on cooperation in budgetary matters and on sound financial management (2), and in particular point 13 thereof,
Having regard to the proposal from the European Commission,
Whereas:

The European Globalisation Adjustment Fund (EGF) aims to provide support for workers made redundant and self-employed persons whose activity has ceased as a result of major structural changes in world trade patterns due to globalisation, as a result of a continuation of the global financial and economic crisis, or as a result of a new global financial and economic crisis, and to assist them with their reintegration into the labour market. |
(2) |
The EGF is not to exceed a maximum annual amount of EUR 150 million (2011 prices), as laid down in Article 12 of Council Regulation (EU, Euratom) No 1311/2013 (3). |
(3) |
On 17 December 2015, Belgium submitted application EGF/2015/012 BE/Hainaut Machinery for a financial contribution from the EGF, following redundancies in the economic sector classified under the NACE Revision 2 Division 28 (Manufacture of machinery and equipment n.e.c.) in the NUTS level 2 region of Hainaut (BE32) in Belgium. It was supplemented by additional information provided in accordance with Article 8(3) of Regulation (EU) No 1309/2013. That application complies with the requirements for determining a financial contribution from the EGF laid down in Article 13 of Regulation (EU) No 1309/2013. |
(4) |
In accordance with Article 6(2) of Regulation (EU) No 1309/2013, Belgium has decided to provide personalised services co-financed by the EGF also to 300 young people not in employment, education or training (NEETs). |

Article 1
For the general budget of the European Union for the financial year 2016, the European Globalisation Adjustment Fund shall be mobilised to provide the sum of EUR 1 824 041 in commitment and payment appropriations.
Article 2
This Decision shall enter into force on the day of its publication in the Official Journal of the European Union.
It shall apply from 6 July 2016.

on the position to be adopted, on behalf of the European Union, within the Joint Committee established under the Agreement on the international occasional carriage of passengers by coach and bus (Interbus Agreement), as regards draft Decision No 1/2016 of that Committee

THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union, and in particular Article 91 in conjunction with Article 218(9) thereof,
Having regard to the proposal from the European Commission,
Whereas:

The Agreement on the international occasional carriage of passengers by coach and bus (Interbus Agreement) (1) (the ‘Agreement’) entered into force on 1 January 2003. |
(2) |
In accordance with point (b) of Article 24(2) of the Agreement, the Joint Committee amends or adapts the control documents and other models of documents established in the Annexes to the Agreement. In order to incorporate future measures taken within the Union, and in accordance with point (c) of Article 24(2) of the Agreement, the Joint Committee amends or adapts the Annexes concerning technical standards applying to buses and coaches, as well as Annex 1 regarding the conditions applying to road passenger transport operators. In accordance with point (e) of Article 24(2) of the Agreement, the Joint Committee also amends or adapts the requirements concerning the social provisions. To this end the Joint Committee should act when the Agreement needs to be updated to take account of technical and legislative progress. |

The last update of Union legislation in the Agreement, which was introduced by Decision No 1/2011 of the Joint Committee (2), takes into account Union acts adopted until the end of 2009. It is now appropriate to incorporate new measures that the Union has adopted since then. |

Recommendation No 1/2011 of the Joint Committee (3) sets out a technical report used for roadside checks of coaches and buses. It has become outdated and should therefore be repealed. |
(5) |
It is appropriate to establish the position to be adopted on the Union's behalf within the Joint Committee as regards draft Decision No 1/2016 of that Committee. |

The position of the Union within the Joint Committee should therefore be based on the attached draft Decision, |
HAS ADOPTED THIS DECISION:
Article 1
The position to be adopted on behalf of the European Union within the Joint Committee set up under Article 23 of the Agreement on the occasional carriage of passengers by coach and bus (Interbus Agreement) shall be based on the draft Decision of the Joint Committee attached to this Decision.
Article 2
This Decision shall enter into force on the day of its adoption.

THE JOINT COMMITTEE,
Having regard to the Agreement on the international occasional carriage of passengers by coach and bus (Interbus Agreement) (1), and in particular Article 24 thereof,
Whereas:

Article 23 of the Agreement on the international occasional carriage of passengers by coach and bus (Interbus Agreement) (the ‘Agreement’) establishes a Joint Committee in order to facilitate the management of the Agreement (the ‘Joint Committee’). |
(2) |
In accordance with point (b) of Article 24(2) of the Agreement, the Joint Committee amends or adapts the control documents and other models of documents established in the Annexes to the Agreement. In order to incorporate future measures taken within the Union, and in accordance with point (c) of Article 24(2) of the Agreement, the Joint Committee amends or adapts the Annexes concerning technical standards applying to buses and coaches, as well as Annex 1 regarding the conditions applying to road passenger transport operators. In accordance with point (e) of Article 24(2) of the Agreement, the Joint Committee also amends or adapts the requirements concerning the social provisions. The requirements concerning the social provisions referred to in Article 8 of the Agreement, the conditions applying to road passenger transport operators set out in Annex 1 to the Agreement, the technical standards applying to buses and coaches set out in Annex 2 to the Agreement, the Model of control document for occasional services exempted from authorisation set out in Annex 3 to the Agreement, the Model of authorisation for non-liberalised occasional services set out in Annex 5 to the Agreement and the Model of declaration to be made by Interbus Parties concerning Article 4 and Annex 1 are adapted in accordance with the Annex to this Decision.
Article 2
Recommendation No 1/2011 of the Joint Committee is repealed.
