concerning the authorisation of Bacillus subtilis ATCC PTA-6737 as a feed additive for chickens for fattening (holder of authorisation Kemin Europa NV)

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EC) No 1831/2003 of the European Parliament and of the Council of 22 September 2003 on additives for use in animal nutrition (1), and in particular Article 9(2) thereof,
Whereas:

Regulation (EC) No 1831/2003 provides for the authorisation of additives for use in animal nutrition and for the grounds and procedures for granting such authorisation. |
(2) |
In accordance with Article 7 of Regulation (EC) No 1831/2003, an application was submitted for the authorisation of the preparation set out in the Annex to this Regulation. That application was accompanied by the particulars and documents required pursuant to Article 7(3) of Regulation (EC) No 1831/2003. |

The application concerns the authorisation of the micro-organism Bacillus subtilis (ATCC PTA-6737) as a feed additive for chickens for fattening, to be classified in the additive category ‘zootechnical additives’. |

The European Food Safety Authority (the Authority) concluded in its opinion of 15 September 2009 (2) that the Bacillus subtilis (ATCC PTA-6737) does not have an adverse effect on animal health, human health or the environment and that the use of that preparation can improve the performance of the animals. The Authority does not consider that there is a need for specific requirements of post market monitoring. It also verified the report on the method of analysis of the feed additive in feed submitted by the Community Reference Laboratory set up by Regulation (EC) No 1831/2003. |

The assessment of that preparation shows that the conditions for authorisation, as provided for in Article 5 of Regulation (EC) No 1831/2003, are satisfied. Accordingly, the use of that preparation should be authorised, as specified in the Annex to this Regulation. |

The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health, |
HAS ADOPTED THIS REGULATION:
Article 1
The preparation specified in the Annex, belonging to the additive category ‘zootechnical additives’ and to the functional group ‘gut flora stabilisers’, is authorised as an additive in animal nutrition subject to the conditions laid down in that Annex.
Article 2
This Regulation shall enter into force on the 20th day following its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending Regulation (EC) No 1974/2006 laying down detailed rules for the application of Council Regulation (EC) No 1698/2005 on support for rural development by the European Agricultural Fund for Rural Development (EAFRD)
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EC) No 1698/2005 of 20 September 2005 on support for rural development by the European Agricultural Fund For Rural Development (EAFRD) (1) and in particular Article 91 thereof,
Whereas:

Regulation (EC) No 1698/2005 established a single legal framework for the EAFRD support for rural development throughout the Community. Commission Regulation (EC) No 1974/2006 (2) complemented that framework by introducing detailed implementing rules. |
(2) |
Article 38(2) of Regulation (EC) No 1698/2005 specifies that for payments linked to Directive 2000/60/EC of the European Parliament and of the Council of 23 October 2000 establishing a framework for Community action in the field of water policy (3), detailed rules, including the maximum amount of support, are to be fixed. |

Pursuant to Article 11(7) of Directive 2000/60/EC, Member States are obliged to establish a programme of measures for each river basin district by 22 December 2009. In accordance with Article 11(2) of that Directive, these measures have to comprise basic measures, including those already required to implement Union legislation for the protection of water, as referred to in Article 11(3) of that Directive and, where necessary, supplementary measures, as referred to in Article 11(4), which may consist in any of the types of measures listed in Part B of Annex VI to that Directive or in other types of measure not listed in that Annex. While voluntary measures and certain mandatory measures may already be supported under Articles 31 and 39 of Regulation (EC) No 1698/2005, detailed rules for the implementation of Article 38(2) of that Regulation need to be defined to cover other mandatory measures. |

In view to avoid overlapping between the meeting standards support as referred to in Article 31 of Regulation (EC) No 1698/2005, on the one hand, which aims at compensating beneficiaries’ temporary disadvantages due to the obligation to adapt to Union standards in certain fields, and the payment under Article 38 of that Regulation linked to Directive 2000/60/EC on the other hand, which aims at compensating beneficiaries permanent disadvantages due to the obligation to comply with the specific requirements for achieving the environmental objectives of that Directive, provision making distinction on the basis of the types of operations concerned should be made. |

Directive 2000/60/EC provides common principles and the framework for Union action in the field of water policy. The whole Union legislation on water is coordinated in the framework of that Directive which repealed and replaced several water Directives, and whose ‘programmes of measures’ contain measures which are provided for by previous Directives on water still in force as well as additional measures needed to achieve the objectives of Directive 2000/60/EC itself. In the light of that, since part of the requirements formally related to the implementation of Directive 2000/60/EC result in substance from other Union legislation for the protection of water, and have or should already have been implemented by the Member States, the costs and income foregone possibly occurring at present as a consequence of the application of those requirements should not be considered as eligible for compensation. In addition, Article 4(9) of Directive 2000/60/EC provides that the application of the new provisions of that Directive should guarantee at least the same level of protection as the existing Community legislation. Therefore, it seems proportional and appropriate to exclude compensation of costs and income foregone with reference to the requirements related to the implementation of Directive 2000/60/EC resulting from other Union legislation for the protection of water, as well as to only grant support for requirements that go beyond the level of protection of the Union legislation existing at the time that Directive was adopted. |

In addition, part of the legislation related to the implementation of Directive 2000/60/EC is already included in cross compliance. Beneficiaries of the payments under Article 38 of Regulation (EC) No 1698/2005 are already obliged to respect the statutory management requirements and the good agricultural and environmental condition provided for respectively in Articles 5 and 6 of Council Regulation (EC) No 73/2009 (4) which has established common rules for direct support schemes for farmers under the common agricultural policy as well as certain support schemes for farmers, and in Annexes II and III to that Regulation. Therefore, no compensation should be granted with reference to requirements related to the implementation of Directive 2000/60/EC which are also cross compliance requirements. |

As a consequence of the implementation of Directive 2000/60/EC different levels of constraints for farmers may be introduced. Permanent compensation should be allowed only in case of serious disadvantages. |

The maximum amount of support should be fixed. In addition, a minimum amount of permanent support should be set to reflect that compensation should be granted only in cases of serious disadvantage, and provision should be made for going beyond the maximum amount taking account of specific circumstances to be justified in the rural development programmes. |

Regulation (EC) No 1974/2006 should therefore be amended accordingly. |

The measures provided for in this Regulation are in accordance with the opinion of the Rural Development Committee, |
HAS ADOPTED THIS REGULATION:
Article 1
Regulation (EC) No 1974/2006 is amended as follows:

After Article 26 the following article 26a is inserted: ‘Article 26a 1. As concerns the implementation of Directive 2000/60/EC of the European Parliament and of the Council (5), types of operation eligible for support pursuant to Article 38 of Regulation (EC) No 1698/2005 shall not be eligible for support pursuant to Article 31 of that Regulation. 2. Support pursuant to Article 38(1) of Regulation (EC) No 1698/2005 linked to Directive 2000/60/EC shall be provided only with regard to the cost incurred and the income foregone that result from disadvantages related to specific requirements that:

Article 2
This Regulation shall enter into force on the seventh day following its publication in the Official Journal of the European Union.

concerning the classification of certain goods in the Combined Nomenclature
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EEC) No 2658/87 of 23 July 1987 on the tariff and statistical nomenclature and on the Common Customs Tariff (1), and in particular Article 9(1)(a) thereof,
Whereas:

In order to ensure uniform application of the Combined Nomenclature annexed to Regulation (EEC) No 2658/87, it is necessary to adopt measures concerning the classification of the goods referred to in the Annex to this Regulation. |
(2) |
Regulation (EEC) No 2658/87 has laid down the general rules for the interpretation of the Combined Nomenclature. Those rules apply also to any other nomenclature which is wholly or partly based on it or which adds any additional subdivision to it and which is established by specific provisions of the Union, with a view to the application of tariff and other measures relating to trade in goods. |
(3) |
Pursuant to those general rules, the goods described in column 1 of the table set out in the Annex should be classified under the CN code indicated in column 2, by virtue of the reasons set out in column 3 of that table. |
(4) |
It is appropriate to provide that binding tariff information which has been issued by the customs authorities of Member States in respect of the classification of goods in the Combined Nomenclature but which is not in accordance with this Regulation can, for a period of 3 months, continue to be invoked by the holder, pursuant to Article 12(6) of Council Regulation (EEC) No 2913/92 of 12 October 1992 establishing the Community Customs Code (2). |

The measures provided for in this Regulation are in accordance with the opinion of the Customs Code Committee, |
HAS ADOPTED THIS REGULATION:
Article 1
The goods described in column 1 of the table set out in the Annex shall be classified within the Combined Nomenclature under the CN code indicated in column 2 of that table.
Article 2
Binding tariff information issued by the customs authorities of Member States, which is not in accordance with this Regulation, can continue to be invoked for a period of 3 months pursuant to Article 12(6) of Regulation (EEC) No 2913/92.
Article 3
This Regulation shall enter into force on the 20th day following its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

The steel grid is fitted on the underside of the lid under one of the openings. The tube with the suction nozzle is fitted to the other opening. Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Regulation (EC) No 881/2002 imposing certain specific restrictive measures directed against certain persons and entities associated with Usama bin Laden, the Al-Qaida network and the Taliban, and repealing Council Regulation (EC) No 467/2001 prohibiting the export of certain goods and services to Afghanistan, strengthening the flight ban and extending the freeze of funds and other financial resources in respect of the Taliban of Afghanistan (1), and in particular Article 7(1)(a) thereof,
Whereas:

Annex I to Regulation (EC) No 881/2002 lists the persons, groups and entities covered by the freezing of funds and economic resources under that Regulation. |
(2) |
On 25 January 2010 the Sanctions Committee of the United Nations Security Council decided to remove five natural persons from its list of persons, groups and entities to whom the freezing of funds and economic resources should apply. On the same data it decided to amend identifying data concerning several natural or legal persons, entities, bodies or groups on that list. |

Annex I should therefore be updated accordingly, |
HAS ADOPTED THIS REGULATION:

Having regard to Commission Regulation (EC) No 1580/2007 of 21 December 2007 laying down implementing rules for Council Regulations (EC) No 2200/96, (EC) No 2201/96 and (EC) No 1182/2007 in the fruit and vegetable sector (2), and in particular Article 138(1) thereof,
Whereas:
Regulation (EC) No 1580/2007 lays down, pursuant to the outcome of the Uruguay Round multilateral trade negotiations, the criteria whereby the Commission fixes the standard values for imports from third countries, in respect of the products and periods stipulated in Annex XV, Part A thereto,
HAS ADOPTED THIS REGULATION:
Article 1
The standard import values referred to in Article 138 of Regulation (EC) No 1580/2007 are fixed in the Annex hereto.
Article 2
This Regulation shall enter into force on 9 February 2010.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

The representative prices and additional duties applicable to imports of white sugar, raw sugar and certain syrups for the 2009/10 marketing year are fixed by Commission Regulation (EC) No 877/2009 (3). These prices and duties have been last amended by Commission Regulation (EU) No 99/2010 (4). |

The data currently available to the Commission indicate that those amounts should be amended in accordance with the rules and procedures laid down in Regulation (EC) No 951/2006, |
HAS ADOPTED THIS REGULATION:
Article 1
The representative prices and additional duties applicable to imports of the products referred to in Article 36 of Regulation (EC) No 951/2006, as fixed by Regulation (EC) No 877/2009 for the 2009/10, marketing year, are hereby amended as set out in the Annex hereto.
Article 2
This Regulation shall enter into force on 9 February 2010.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending, for the purpose of adaptation to technical progress, Annex III to Council Directive 76/768/EEC concerning cosmetic products

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Council Directive 76/768/EEC of 27 July 1976 on the approximation of the laws of the Member States relating to cosmetic products (1), and in particular Article 8(2) thereof,
After consulting the Scientific Committee on Consumer Safety,
Whereas:
(1) |
Presently, there are two non-oxidative hair dye substances which are provisionally allowed for use in cosmetic products until 31 December 2010 under the restrictions and conditions laid down in Part 2 of Annex III to Directive 76/768/EEC. |
(2) |
For these two non-oxidative hair dye substances, HC Orange No 2 and 2-hydroxyethylamino-5-nitroanisole, listed under reference Nos 26 and 29 in Part 2 of Annex III, the Scientific Committee on Consumer Safety (hereinafter ‘SCCS’) gave its final opinions on their safety. The SCCS recommended maximum authorised concentrations in the finished cosmetic product of 1,0 % for HC Orange No 2 and of 0,2 % for 2-hydroxyethylamino-5-nitroanisole. Therefore, HC Orange No 2 and 2-hydroxyethylamino-5-nitroanisole can be definitively regulated in Part 1 of Annex III. |
(3) |
Directive 76/768/EEC should therefore be amended accordingly. |
(4) |
In view of a smooth transition for the marketing of products containing HC Orange No 2 not complying with the labelling requirements laid down in this Directive, it is necessary to provide for appropriate transitional periods. |
(5) |
The measures provided for in this Directive are in accordance with the opinion of the Standing Committee on Cosmetic Products, |
HAS ADOPTED THIS DIRECTIVE:
Article 1
Amendment to Directive 76/768/EEC
Annex III to Directive 76/768/EEC is amended in accordance with the Annex to this Directive.
Article 2
Transposition
1. Member States shall adopt and publish, by 1 September 2010 at the latest, the laws, regulations and administrative provisions necessary to comply with this Directive. They shall forthwith communicate to the Commission the text of those provisions.
Member States shall apply the provisions set out in the Annex to this Directive, except the obligations concerning the labelling set out in column (f) of entry 208, from 1 December 2010.
When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.
2. Member States shall communicate to the Commission the text of the main provisions of national law which they adopt in the field covered by this Directive.
Article 3
Transitional provisions
Member States shall take all necessary measures to ensure that after 1 November 2011 no cosmetic products which fail to comply with the obligations concerning the labelling set out in column (f) of entry 208 of Part I of Annex III to Directive 76/768/EEC, as amended by this Directive, are placed on the market by Union manufacturers or by importers established within the Union.
Member States shall take all necessary measures to ensure that after 1 November 2012 no cosmetic products which fail to comply with the obligations concerning the labelling set out in column (f) of entry 208 of Part I of Annex III to Directive 76/768/EEC, as amended by this Directive, are sold or disposed of to the final consumer in the Union.
Article 4
Entry into force
This Directive shall enter into force on the 20th day following its publication in the Official Journal of the European Union.

Addressees
This Directive is addressed to the Member States.

amending Directive 98/8/EC of the European Parliament and of the Council to include acrolein as an active substance in Annex I thereto

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Directive 98/8/EC of the European Parliament and of the Council of 16 February 1998 concerning the placing of biocidal products on the market (1), and in particular Article 11(4) thereof,
Whereas:

The United Kingdom has received on 18 August 2006 an application from Baker Petrolite, in accordance with Article 11(1) of Directive 98/8/EC, for the inclusion of the active substance acrolein in its Annex I for use in product-type 12, slimicides, as defined in Annex V to Directive 98/8/EC. Acrolein was not on the market on the date referred to in Article 34(1) of Directive 98/8/EC as an active substance of a biocidal product. |
(2) |
After carrying out an evaluation, the United Kingdom submitted its report, together with a recommendation, to the Commission on 16 March 2009. |
(3) |
The report was reviewed by the Member States and the Commission within the Standing Committee on Biocidal Products on 17 September 2009, and the findings of the review were incorporated in an assessment report. |
(4) |
It appears from the examinations made that biocidal products used as slimicides and containing acrolein may be expected to satisfy the requirements laid down in Article 5 of Directive 98/8/EC. It is therefore appropriate to include acrolein in Annex I. |
(5) |
Not all potential uses have been evaluated at the Union level. It is therefore appropriate that Member States assess those uses or exposure scenarios and those risks to compartments and populations that have not been representatively addressed in the Union level risk assessment and, when granting product authorisations, ensure that appropriate measures are taken or specific conditions imposed in order to reduce the identified risks to acceptable levels. |
(6) |
In the light of the findings of the assessment report, it is appropriate to require that risk mitigation measures are applied at product authorisation level to products containing acrolein used as slimicides. |
(7) |
In particular, it is appropriate to require that products intended for industrial or professional use be used with appropriate personal protective equipment and that safe operational procedures are established such as the use of air monitoring and exclusion zones, unless it can be demonstrated that risks for industrial or professional users can be reduced by other means. |
(8) |
Appropriate measures should be taken to limit the risks to the marine environment, since unacceptable risks to this compartment have been identified during the evaluation. To this end, certain conditions should be imposed by the competent authorities when authorising the biocidal product, such as ensuring that waste water is monitored and, if necessary, treated before discharge, unless it can be demonstrated that risks for the environment can be reduced by other means. |
(9) |
A reasonable period should be allowed to elapse before an active substance is included in Annex I in order to permit Member States to bring into force the laws, regulations and administrative provisions necessary to comply with this Directive. |
(10) |
Directive 98/8/EC should therefore be amended accordingly. |
(11) |
The measures provided for in this Directive are in accordance with the opinion of the Standing Committee on Biocidal Products, |

THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Decision No 574/2007/EC of the European Parliament and of the Council of 23 May 2007 establishing the External Borders Fund for the period 2007 to 2013 as part of the General programme ‘Solidarity and Management of Migration Flows’ (1), in particular Article 25 thereof,
Whereas:

Decision No 574/2007/EC has been implemented by Commission Decision 2008/456/EC (2). |
(2) |
With regard to the principle of sound financial management, it is appropriate to fix a ceiling for the cumulative total of pre-financing payments to be made for annual programmes. |
(3) |
In accordance with Articles 1 and 2 of the Protocol on the position of Denmark, annexed to the Treaty on European Union and the Treaty on the Functioning of the European Union, Denmark did not take part in the adoption of Decision No 574/2007/EC and is not bound by it nor subject to its application. However, given that Decision No 574/2007/EC builds upon the Schengen acquis under the provisions of Title V of Part Three of the Treaty on the Functioning of the European Union, Denmark in accordance with Article 4 of the Protocol, notified by letter of 19 June 2007 the transposition of Decision No 574/2007/EC in its national law. It is therefore bound under international law by this Decision. |

This Decision constitutes a development of the provisions of the Schengen acquis in which the United Kingdom does not take part, in accordance with Council Decision 2000/365/EC of 29 May 2000 concerning the request of the United Kingdom of Great Britain and Northern Ireland to take part in some of the provisions of the Schengen acquis (3). The United Kingdom is therefore not bound by it or subject to its application. |

This Decision constitutes a development of the provisions of the Schengen acquis in which Ireland does not take part, in accordance with Council Decision 2002/192/EC of 28 February 2002 concerning Ireland’s request to take part in some of the provisions of the Schengen acquis (4). Ireland is therefore not bound by it or subject to its application. |

As regards Iceland and Norway, Decision No 574/2007/EC constitutes a development of provisions of the Schengen acquis within the meaning of the Agreement concluded by the Council of the European Union and the Republic of Iceland and the Kingdom of Norway concerning the latters’ association with the implementation, application and development of the Schengen acquis (5), which fall within the areas referred to in Article 1, points A and B of Council Decision 1999/437/EC of 17 May 1999 on certain arrangements for the application of the Agreement concluded by the Council of the European Union and the Republic of Iceland and the Kingdom of Norway concerning the association of those two States with the implementation, application and development of the Schengen acquis (6). |

As regards Switzerland, Decision No 574/2007/EC constitutes a development of the provisions of the Schengen acquis within the meaning of the Agreement between the European Union, the European Community and the Swiss Confederation on the Swiss Confederation’s association with the implementation, application and development of the Schengen acquis (7), which fall within the areas referred to in Article 1, points A and B of the Decision 1999/437/EC read in conjunction with Article 3 of Council Decision 2008/146/EC of 28 January 2008 on the conclusion, on behalf of the European Community, of the Agreement between the European Union, the European Community and the Swiss Confederation on the Swiss Confederation’s association with the implementation, application and development of the Schengen acquis (8). |

As regards Liechtenstein, Decision No 574/2007/EC constitutes a development of the provisions of the Schengen acquis within the meaning of the Protocol signed between the European Union, the European Community, the Swiss Confederation and the Principality of Liechtenstein on the accession of the Principality of Liechtenstein to the Agreement between the European Union, the European Community and the Swiss Confederation on the Swiss Confederation’s association with the implementation, application and development of the Schengen acquis, which fall within the areas referred to in Article 1, points A and B of the Decision 1999/437/EC read in conjunction with Article 3 of Council Decision 2008/261/EC of 28 February 2008 on the signature, on behalf of the European Community, and on the provisional application of certain provisions of the Protocol between the European Union, the European Community, the Swiss Confederation and the Principality of Liechtenstein on the accession of the Principality of Liechtenstein to the Agreement between the European Union, the European Community and the Swiss Confederation on the Swiss Confederation’s association with the implementation, application and development of the Schengen acquis (9). |

Decision 2008/456/EC should therefore be amended accordingly, |
HAS ADOPTED THIS DECISION:
Article 1
Decision 2008/456/EC is amended as follows:
1. |
The title of Article 24 is replaced by the following: ‘Progress and final reports on implementation of annual programmes and requests for payments’; |
2. |
In Article 24, the following paragraph 4 is added: ‘4. With reference to Article 41(3) and (4) of the basic act, the cumulative total of pre-financing payments made to a Member State shall not exceed 90 % of the total amount allocated to such Member State in the financing decision approving the annual programme. Where a Member State has nationally committed less than the total amount allocated by the financing decision approving the annual programme, the cumulative total of the pre-financing payments shall not exceed 90 % of the nationally committed amount.’. |

COMMISSION DECISION

concerning the non-inclusion of diazinon in Annex I, IA or IB to Directive 98/8/EC of the European Parliament and of the Council concerning the placing of biocidal products on the market

Having regard to the Treaty on the Functioning of the European Union,
Having regard to Directive 98/8/EC of the European Parliament and of the Council of 16 February 1998 concerning the placing of biocidal products on the market (1), and in particular the second subparagraph of Article 16(2) thereof,
Whereas:

Commission Regulation (EC) No 1451/2007 of 4 December 2007 on the second phase of the 10-year work programme referred to in Article 16(2) of Directive 98/8/EC of the European Parliament and of the Council concerning the placing of biocidal products on the market (2) establishes a list of active substances to be assessed, with a view to their possible inclusion in Annex I, IA or IB to Directive 98/8/EC. |
(2) |
Diazinon is included in that list for use in product-type 18, insecticides, acaricides and products to control other arthropods, as defined in Annex V to Directive 98/8/EC. |
(3) |
The deadline for the submission of a complete dossier for active substances for use in product-type 18 was 30 April 2006. No complete dossier was however received within this time period. |
(4) |
The Commission informed the Member States accordingly. On 14 June 2006, the Commission also made that information public by electronic means. |
(5) |
Within the period of three months from that publication, a company indicated an interest in taking over the role of participant for diazinon for use in product-type 18. |
(6) |
Commission Decision 2007/794/EC of 29 November 2007 setting a new deadline for the submission of dossiers for certain substances to be examined under the 10-year work programme referred to in Article 16(2) of Directive 98/8/EC (3) fixed the new deadline for the submission of a dossier to 30 April 2008. |
(7) |
Within this new deadline, before submitting its dossier, the applicant consulted Portugal, the rapporteur Member State designated for the evaluation of diazinon, to enquire whether its reference product, a flea collar, was to be considered as a biocidal product or a veterinary medicinal product. |
(8) |
Portugal, after consultation with the Commission and the other Member States, advised the applicant that most Member States would not consider a flea collar such as the one placed on the market by the applicant as a biocidal but as a veterinary medicinal product, as defined in Article 1(2) of Directive 2001/82/EC of the European Parliament and of the Council (4). |
(9) |
In view of this advice the applicant did not submit a dossier for the inclusion of diazinon in Annex I, IA or IB to Directive 98/8/EC for product-type 18. Pursuant to Article 12(4) of Regulation (EC) No 1451/2007, the role of participant for diazinon for product-type 18 may no longer be taken over. |
(10) |
Since the applicant did not submit a dossier within the prescribed period, diazinon should not be included for product-type 18 in Annex I, IA or IB to Directive 98/8/EC. |
(11) |
It is necessary to establish a longer period for the phasing-out of flea collars placed on the market of certain Member States as biocidal products to allow for their authorisation as veterinary medicinal products in accordance with Directive 2001/82/EC. |
(12) |
The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Biocidal Products, |
HAS ADOPTED THIS DECISION:
Article 1
Diazinon (CAS number 333-41-5, EC number 206-373-8) shall not be included in Annex I, IA or IB to Directive 98/8/EC for product-type 18.
Article 2
Flea collars placed on the market as biocidal products and containing diazinon for use in product-type 18 shall no longer be placed on the market with effect from 1 March 2013.
Other biocidal products containing diazinon for use in product-type 18 shall no longer be placed on the market with effect from 1 March 2011.
Article 3
This Decision is addressed to the Member States.

Having regard to Directive 98/8/EC of the European Parliament and of the Council of 16 February 1998 concerning the placing of biocidal products on the market (1), and in particular the second subparagraph of Article 16(2) thereof,
Whereas:

Commission Regulation (EC) No 1451/2007 of 4 December 2007 on the second phase of the 10-year work programme referred to in Article 16(2) of Directive 98/8/EC of the European Parliament and of the Council concerning the placing of biocidal products on the market (2) establishes a list of active substances to be assessed, with a view to their possible inclusion in Annex I, IA or IB to Directive 98/8/EC. |
(2) |
For a number of substance/product-type combinations included in that list, either all participants have discontinued their participation from the review programme, or no complete dossier was received within the time period specified in Articles 9 and 12(3) of Regulation (EC) No 1451/2007 by the Member State designated as rapporteur for the evaluation. |
(3) |
Consequently, and pursuant to Articles 11(2), 12(1) and 13(5) of Regulation (EC) No 1451/2007, the Commission informed the Member States accordingly. That information was also made public by electronic means on 13 January 2009, 11 February 2009 and 11 March 2009. |
(4) |
Within the period of three months from those publications, no person or Member State indicated an interest in taking over the role of participant for the substances and product-types concerned. |
(5) |
Pursuant to Article 12(5) of Regulation (EC) No 1451/2007, the substances and product-types concerned should therefore not be included in Annex I, IA or IB to Directive 98/8/EC. |
(6) |
In the interest of legal certainty, biocidal products containing active substances for the product-types indicated in the Annex to this Decision should no longer be placed on the market, with effect from a specific date. |
(7) |
The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on Biocidal Products, |
HAS ADOPTED THIS DECISION:
Article 1
The substances indicated in the Annex to this Decision shall not be included for the product-types concerned in Annex I, IA or IB to Directive 98/8/EC.
Article 2
For the purposes of Article 4(2) of Regulation (EC) No 1451/2007, biocidal products containing active substances for the product-types indicated in the Annex to this Decision shall no longer be placed on the market with effect from 9 February 2011.
Article 3
This Decision is addressed to the Member States.
