establishing the standard import values for determining the entry price of certain fruit and vegetables
THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Council Regulation (EC) No 1234/2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation) (1),
Having regard to Commission Regulation (EC) No 1580/2007 of 21 December 2007 laying down implementing rules for Council Regulations (EC) No 2200/96, (EC) No 2201/96 and (EC) No 1182/2007 in the fruit and vegetable sector (2), and in particular Article 138(1) thereof,
Whereas:
Regulation (EC) No 1580/2007 lays down, pursuant to the outcome of the Uruguay Round multilateral trade negotiations, the criteria whereby the Commission fixes the standard values for imports from third countries, in respect of the products and periods stipulated in Annex XV, Part A thereto,
HAS ADOPTED THIS REGULATION:
Article 1
The standard import values referred to in Article 138 of Regulation (EC) No 1580/2007 are fixed in the Annex hereto.
Article 2
This Regulation shall enter into force on 27 January 2009.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION REGULATION (EC) No 76/2009

amending Regulation (EC) No 504/2007 laying down detailed rules for the application of the arrangements for additional import duties in the milk and milk products sector
THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Council Regulation (EC) No 1234/2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation) (1), and in particular Article 143(b) in conjunction with Article 4 thereof,
Whereas:

Article 4(1) of Commission Regulation (EC) No 504/2007 (2) provides that the importer may, on request, for the establishment of the additional duty, have the cif import price of the consignment in question applied, where this is more than the applicable representative price referred to in Article 2(2) thereof. In the absence of such request, paragraph 3 of the same Article provides that the additional duty is to be established on the basis of the representative price referred to in Article 2(2) of the said Regulation. |

The Court of Justice of the European Communities in its judgment given on 13 December 2001 in Case C-317/99 Kloosterboer Rotterdam BV v Minister van Landbouw, Natuurbeheer en Visserij (3) stated that paragraphs 1 and 3 of Article 3 of Commission Regulation (EC) No 1484/95 of 28 June 1995 laying down detailed rules for implementing the system of additional import duties and fixing additional import duties in the poultrymeat and egg sectors and for egg albumin, and repealing Regulation No 163/67/EEC (4), are invalid, inasmuch as they provide that the additional duty referred to therein is, as a general rule, established on the basis of the representative price laid down in Article 2(1) of Regulation (EC) No 1484/95 and that the duty is established on the basis of the cif import price of the shipment concerned only if the importer so requests. Those paragraphs were identical to Article 4(1) and (3) of Regulation (EC) No 504/2007. Article 28(3) of Council Regulation (EC) No 1255/1999 of 17 May 1999 on the common organisation of the market in milk and milk products (5) corresponds to Article 5(3) of Regulation (EEC) No 2777/75 of the Council of 29 October 1975 on the common organisation of the market in poultrymeat (6). Article 4 of Regulation (EC) No 504/2007 should therefore be amended accordingly. |

In order to comply with the Court ruling, Regulation (EC) No 504/2007 should be amended accordingly. |

As from 1 January 2008, some CN codes of Chapter 4 have been amended by Commission Regulation (EC) No 1214/2007 of 20 September 2007 amending Annex I to Council Regulation (EEC) No 2658/87 on the tariff and statistical nomenclature and on the Common Customs Tariff (7). The Annex to Regulation (EC) No 504/2007 should be amended accordingly. |

The measures provided for in this Regulation are in accordance with the opinion of the Management Committee for the Common Organisation of Agricultural Markets, |
HAS ADOPTED THIS REGULATION:
Article 1
Regulation (EC) No 504/2007 is amended as follows:
|
1. |
in Article 2 paragraph 3 is replaced by the following: ‘3. The additional duties applicable pursuant to Article 4 shall be fixed by the Commission at the same time as the representative prices.’; |
|
2. |
the introductory phrase of the first paragraph of Article 3 is replaced by the following: ‘If the difference between the trigger price in question referred to in Article 1(2) and the cif import price of the consignment in question:’; |
|
3. |
Article 4 is replaced by the following: ‘Article 4 1. The additional duty shall be established on the basis of the cif import price of the consignment in question in accordance with the provisions of Article 3. 2. When the cif import price per 100 kg of a consignment is higher than the applicable representative price referred to in Article 2(2), the importer shall present to the competent authorities of the importing Member States at least the following proofs:

In the case referred to in paragraph 2, the importer must lodge the security referred to in Article 248(1) of Commission Regulation (EEC) No 2454/93 (8), equal to the amount of additional duty which he would have paid if the calculation of the additional duty had been made on the basis of the representative price applicable to the product in question. 4. The importer shall have one month from the sale of the products in question, subject to a limit of six months from the date of acceptance of the declaration of release for free circulation, to prove that the consignment was disposed of under conditions confirming the correctness of the prices referred to in paragraph 2. Failure to meet one or other of these deadlines shall entail the loss of the security lodged. However, the time limit of six months may be extended by the competent authorities by a maximum of three months at the request of the importer, which must be duly substantiated. The security lodged shall be released to the extent that proof of the conditions of disposal is provided to the satisfaction of the customs authorities. Otherwise, the security shall be forfeit by way of payment of the additional duties. 5. If on verification the competent authorities establish that the requirements of this Article have not been met, they shall recover the duty due in accordance with Article 220 of Regulation (EEC) No 2913/92. The amount of the duty to be recovered or remaining to be recovered shall include interest from the date the goods were released for free circulation up to the date of recovery. The interest rate applied shall be that in force for recovery operations under national law. |

Annex I is amended as follows:

Article 2
This Regulation shall enter into force on the third day following its publication in the Official Journal of European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

amending Council Regulation (EC) No 314/2004 concerning certain restrictive measures in respect of Zimbabwe

Having regard to the Treaty establishing the European Community,
Having regard to Council Regulation (EC) No 314/2004 of 19 February 2004 concerning certain restrictive measures in respect of Zimbabwe (1), and in particular Article 11(b) thereof,
Whereas:

Annex III to Regulation (EC) No 314/2004 lists the persons covered by the freezing of funds and economic resources under that Regulation. |
|
(2) |
Common Position 2008/68/CFSP of 26 January 2009 (2) amends the Annex to Common Position 2004/161/CFSP (3). Annex III to Regulation (EC) No 314/2004 should, therefore, be amended accordingly. |
|
(3) |
In order to ensure that the measures provided for in this Regulation are effective, this Regulation should enter into force immediately, |
HAS ADOPTED THIS REGULATION:
Article 1
Annex III to Regulation (EC) No 314/2004 is hereby replaced by the text set out in the Annex to this Regulation.
Article 2
This Regulation shall enter into force on the day of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

COUNCIL DECISION
of 26 January 2009
implementing Article 2(3) of Regulation (EC) No 2580/2001 on specific restrictive measures directed against certain persons and entities with a view to combating terrorism and repealing Decision 2008/583/EC

THE COUNCIL OF THE EUROPEAN UNION,
Having regard to Council Regulation (EC) No 2580/2001 of 27 December 2001 on specific restrictive measures directed against certain persons and entities with a view to combating terrorism (1), and in particular Article 2(3) thereof,
Whereas:

(1) |
On 15 July 2008 the Council adopted Decision 2008/583/EC implementing Article 2(3) of Regulation (EC) No 2580/2001 on specific restrictive measures directed against certain persons and entities with a view to combating terrorism (2), establishing an updated list of persons, groups and entities to which that Regulation applies. |

(2) |
The Council has provided all the persons, groups and entities for which it was practically possible with statements of reasons explaining why they were listed in Decision 2008/583/EC. In the case of one person an amended statement of reasons was provided in October 2008. |
|
(3) |
By way of a notice published in the Official Journal of the European Union (3) the Council informed the persons, groups and entities listed in Decision 2008/583/EC that it had decided to keep them on the list. The Council also informed the persons, groups and entities concerned that it was possible to request a statement of the Council’s reasons for putting them on the list where one had not already been communicated to them. |

The Council has carried out a complete review of the list of persons, groups and entities to which Regulation (EC) No 2580/2001 applies, as required by Article 2(3) of that Regulation. When doing so it took account of observations submitted to the Council by those concerned. |
|
(5) |
Following the judgment of the Court of First Instance of 4 December 2008 in Case T-284/08, one group has not been included in the list of persons, groups and entities to which Regulation (EC) No 2580/2001 applies. |
|
(6) |
The Council has concluded that the other persons, groups and entities listed in the Annex to Common Position 2008/586/CFSP of 15 July 2008 updating Common Position 2001/931/CFSP on the application of specific measures to combat terrorism (4) have been involved in terrorist acts within the meaning of Article 1(2) and (3) of Council Common Position 2001/931/CFSP (5), that a decision has been taken with respect to them by a competent authority within the meaning of Article 1(4) of Common Position 2001/931/CFSP, and that they should continue to be subject to the specific restrictive measures provided for in Regulation (EC) No 2580/2001. |

The list of the persons, groups and entities to which Regulation (EC) No 2580/2001 applies should be updated accordingly, |
HAS DECIDED AS FOLLOWS:
Article 1
The list provided for in Article 2(3) of Regulation (EC) No 2580/2001 shall be replaced by the list set out in the Annex to this Decision.
Article 2
Decision 2008/583/EC is hereby repealed.
Article 3
This Decision shall take effect on the day of its publication in the Official Journal of the European Union.

THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Regulation (EC) No 850/2004 of the European Parliament and of the Council of 29 April 2004 on persistent organic pollutants and amending Directive 79/117/EEC (1), and in particular Article 7(4)(b)(iii), 7(6) and Article 17(2) thereof,
Whereas:

Experience with the application of the derogation laid down in Article 7(4)(b) is still lacking. The notifications will contribute to its review to be carried out before 31 December 2009 pursuant to Article 7(7) and to the report on the application of the Regulation pursuant to Article 12(6). |
|
(2) |
The authorised operations shall be individually notified to the other Member States and the Commission. The notification should be efficient and focussed on the genuinely necessary information in order to avoid unnecessary burdens for the Member States and the Commission. |
|
(3) |
The notification should be clear and should aim for avoiding ambiguous information. To this end the questions under points 1, 2 and 3 are worded in a manner that only allows answers in a standardised or commonly agreed format. |
|
(4) |
The questionnaire includes a reference to the authorisation number and place, which enables a retrieval of the complete authorisation of the derogation and the justification for it, if necessary. |
|
(5) |
The measures provided for in this Decision are in accordance with the opinion of the Committee established by Article 18 of Directive 2006/12/EC of the European Parliament and of the Council of 5 April 2006 on waste (2), |
HAS ADOPTED THIS DECISION:
Article 1
The questionnaire set out in the Annex to this Decision is hereby adopted.
Article 2
The Member States shall use the questionnaire as a basis for their notification pursuant to Article 7(4)(b)(iii) of Regulation (EC) No 850/2004.
Article 3
This Decision is addressed to the Member States.

Article 1
For the purposes of Article 3(9) of Directive 2006/7/EC International Standard ISO 17994:2004(E) ‘Water quality — Criteria for establishing equivalence between microbiological methods’ shall be specified as the standard on the equivalence of microbiological methods.

COMMISSION DECISION
of 26 January 2009
concerning the non-inclusion of 2-Naphtyloxyacetic acid in Annex I to Council Directive 91/414/EEC and the withdrawal of authorisations for plant protection products containing that substance
(notified under document number C(2009) 204)

THE COMMISSION OF THE EUROPEAN COMMUNITIES,
Having regard to the Treaty establishing the European Community,
Having regard to Council Directive 91/414/EEC of 15 July 1991 concerning the placing of plant protection products on the market (1), and in particular the fourth subparagraph of Article 8(2) thereof,
Whereas:
|

Article 8(2) of Directive 91/414/EEC provides that a Member State may, during a period of 12 years following the notification of that Directive, authorise the placing on the market of plant protection products containing active substances not listed in Annex I to that Directive that are already on the market two years after the date of notification, while those substances are gradually being examined within the framework of a programme of work. |
|
(2) |
Commission Regulations (EC) No 1112/2002 (2) and (EC) No 2229/2004 (3) lay down the detailed rules for the implementation of the fourth stage of the programme of work referred to in Article 8(2) of Directive 91/414/EEC and establish a list of active substances to be assessed with a view to their possible inclusion in Annex I to Directive 91/414/EEC. That list includes 2-Naphtyloxyacetic acid. |
|
(3) |
For 2-Naphtyloxyacetic acid the effects on human health and the environment have been assessed in accordance with the provisions laid down in Regulations (EC) No 1112/2002 and (EC) No 2229/2004 for a range of uses proposed by the notifier. Moreover, those Regulations designate the rapporteur Member States which have to submit the relevant assessment reports and recommendations to the European Food Safety Authority (EFSA) in accordance with Article 20 of Regulation (EC) No 2229/2004. For 2-Naphtyloxyacetic acid the rapporteur Member State was France and all relevant information was submitted in October 2007. |
|

The Commission examined 2-Naphtyloxyacetic acid in accordance with Article 24a of Regulation (EC) No 2229/2004. A draft review report for that substance was reviewed by the Member States and the Commission within the Standing Committee on the Food Chain and Animal Health and finalised on 28 October 2008 in the format of the Commission review report. |
|

During the examination of this active substance by the Committee, it was concluded, taking into account comments received from Member States, that there are clear indications that it may be expected that it has harmful effects on human health and in particular the crucial missing data does not allow to set an ADI and such value is necessary to conduct the risk assessment. Moreover, other concerns which were identified by the rapporteur Member States in its assessment report are included in the review report for the substance. |
|

The Commission invited the notifier to submit its comments on the results of the peer review and on its intention or not to further support the substance. The notifier submitted its comments which have been carefully examined. However, despite the arguments put forwards by the notifier, the concerns identified could not be eliminated, and assessments made on the basis of the information submitted have not demonstrated that it may be expected that, under the proposed conditions of use, plant protection products containing 2-Naphtyloxyacetic acid satisfy in general the requirements laid down in Article 5(1)(a) and (b) of Directive 91/414/EEC. |
|

2-Naphtyloxyacetic acid should therefore not be included in Annex I to Directive 91/414/EEC. |
|
(8) |
Measures should be taken to ensure that authorisations granted for plant protection products containing 2-Naphtyloxyacetic acid are withdrawn within a fixed period of time and are not renewed and that no new authorisations for such products are granted. |
|
(9) |
Any period of grace granted by a Member State for the disposal, storage, placing on the market and use of existing stocks of plant protection products containing 2-Naphtyloxyacetic acid should be limited to 12 months in order to allow existing stocks to be used in one further growing season, which ensures that plant protection products containing 2-Naphtyloxyacetic acid remain available to farmers for 18 months from the adoption of this Decision. |
|

This Decision does not prejudice the submission of an application for 2-Naphtyloxyacetic acid in accordance with Article 6(2) of Directive 91/414/EEC and Commission Regulation (EC) No 33/2008 of 17 January 2008 laying down detailed rules for the application of Council Directive 91/414/EEC as regards a regular and an accelerated procedure for the assessment of active substances which were part of the programme of work referred to in Article 8(2) of that Directive but have not been included into its Annex I (4), in view of a possible inclusion in its Annex I. |
|

The measures provided for in this Decision are in accordance with the opinion of the Standing Committee on the Food Chain and Animal Health, |
HAS ADOPTED THIS DECISION:
Article 1
2-Naphtyloxyacetic acid shall not be included as active substance in Annex I to Directive 91/414/EEC.
Article 2
Member States shall ensure that:

(a) |
authorisations for plant protection products containing 2-Naphtyloxyacetic acid are withdrawn by 26 July 2009; |
|
(b) |
no authorisations for plant protection products containing 2-Naphtyloxyacetic acid are granted or renewed from the date of publication of this Decision. |
Article 3
Any period of grace granted by Member States in accordance with the provisions of Article 4(6) of Directive 91/414/EEC, shall be as short as possible and shall expire on 26 July 2010 at the latest.

This Decision is addressed to the Member States.

Following the adoption by the United Nations Security Council on 31 March 2008 of Resolution 1807 (2008) (UNSCR 1807 (2008)), the Council adopted Common Position 2008/369/CFSP on 14 May 2008 concerning restrictive measures against the Democratic Republic of the Congo (1). |
|
(2) |
On 22 December 2008, the United Nations Security Council adopted Resolution 1857 (2008) (UNSCR 1857 (2008)) providing for additional criteria for designation by the Sanctions Committee established pursuant to United Nations Security Council Resolution 1533 (2004) (UNSCR 1533 (2004)) of individuals and entities subject to an asset freeze and travel ban, and extending the measures imposed by UNSCR 1807 (2008) until 30 November 2009. |
|
(3) |
Common Position 2008/369/CFSP should therefore be amended accordingly, |
HAS ADOPTED THIS COMMON POSITION:
Article 1
Article 3 of Common Position 2008/369/CFSP shall be replaced by the following:

Restrictive measures as provided for in Articles 4(1) and 5(1) and (2) shall be imposed against the following persons and, as appropriate, entities, designated by the Sanctions Committee:

persons or entities acting in violation of the arms embargo and related measures as referred to in Article 1, |
|
— |
political and military leaders of foreign armed groups operating in the DRC who impede the disarmament and the voluntary repatriation or resettlement of combatants belonging to those groups, |
|
— |
political and military leaders of Congolese militias receiving support from outside the DRC, who impede the participation of their combatants in disarmament, demobilisation and reintegration processes, |
|
— |
political and military leaders operating in the DRC and recruiting or using children in armed conflicts in violation of applicable international law, |
|
— |
individuals operating in the DRC and committing serious violations of international law involving the targeting of children or women in situations of armed conflict, including killing and maiming, sexual violence, abduction and forced displacement, |
|
— |
individuals obstructing the access to or the distribution of humanitarian assistance in the eastern part of the DRC, |
|
— |
individuals or entities supporting the illegal armed groups in the eastern part of the DRC through illicit trade of natural resources. |

This Common Position shall take effect on the date of its adoption.

On 27 December 2001, the Council adopted Common Position 2001/931/CFSP on the application of specific measures to combat terrorism (1). |

(2) |
On 15 July 2008, the Council adopted Common Position 2008/586/CFSP updating Common Position 2001/931/CFSP (2). |
|
(3) |
In accordance with Common Position 2001/931/CFSP the Council has carried out a complete review of the list of persons, groups and entities to which Common Position 2008/586/CFSP applies. |
|
(4) |
Following the judgment of the Court of First Instance of 4 December 2008 in Case T-284/08, one group has not been included in the list of persons, groups and entities to which Common Position 2001/931/CFSP applies. |
|
(5) |
The Council has concluded that the other persons, groups and entities listed in the Annex to Common Position 2008/586/CFSP have been involved in terrorist acts within the meaning of Article 1(2) and (3) of Common Position 2001/931/CFSP, that a decision has been taken with respect to them by a competent authority within the meaning of Article 1(4) of that Common Position, and that they should continue to be subject to the specific restrictive measures provided for therein. |

The list of the persons, groups and entities to which Common Position 2001/931/CFSP applies should be updated accordingly, |

COUNCIL COMMON POSITION 2009/68/CFSP

renewing restrictive measures against Zimbabwe
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on European Union, and in particular Article 15 thereof,
Whereas:

(1) |
On 19 February 2004, the Council adopted Common Position 2004/161/CFSP (1) renewing restrictive measures against Zimbabwe. |
|
(2) |
Council Common Position 2008/135/CFSP (2), adopted on 18 February 2008, extended Common Position 2004/161/CFSP until 20 February 2009. |
|
(3) |
In view of the situation in Zimbabwe, in particular given the violence organised and committed by the Zimbabwean authorities and the continued blocking of the implementation of the political agreement signed on 15 September 2008, Common Position 2004/161/CFSP should be extended for a further period of 12 months. |
|
(4) |
Moreover, certain persons and entities associated with the Government of Zimbabwe and whose activities seriously undermine democracy, respect for human rights and the rule of law in Zimbabwe should be added to the list set out in the Annex to Common Position 2004/161/CFSP. |
|
(5) |
The list set out in the Annex to Common Position 2004/161/CFSP should also be amended to take account of changes in the functions of certain persons and to include additional identifiers for certain persons and entities, |
HAS ADOPTED THIS COMMON POSITION:
Article 1
Common Position 2004/161/CFSP shall be extended until 20 February 2010.
Article 2
The Annex to Common Position 2004/161/CFSP shall be replaced by the Annex to this Common Position.
Article 3
This Common Position shall take effect on the date of its adoption.
Article 4
This Common Position shall be published in the Official Journal of the European Union.
