Article 39 of Directive 2014/25/EU of the European Parliament and of the Council of 26 February 2014 on procurement by entities operating in the water, energy, transport and postal services sectors and repealing Directive 2004/17/EC, read in conjunction with Articles 70 and 75 of that directive,

must be interpreted as precluding national legislation on public procurement which requires that access to documents containing technical or trade secrets submitted by a tenderer be granted to another tenderer where such access is necessary in order to ensure the latter’s right to effective judicial protection in the context of proceedings relating to the award of the contract, without that legislation allowing contracting entities to weigh that right against the requirements relating to the protection of technical or trade secrets.
