Notice for the attention of the persons subject to the restrictive measures provided for in Council Decision 2010/788/CFSP, as amended by Council Decision (CFSP) 2020/2033 and Council Regulation (EC) No 1183/2005, as implemented by Regulation (EU) 2020/2021 concerning restrictive measures against the Democratic Republic of the Congo

The following information is brought to the attention of the persons that appear in Annex II to Council Decision 2010/788/CFSP (1), as amended by Council Decision (CFSP) 2020/2033 (2), and in Annex Ia to Council Regulation (EC) No 1183/2005 (3), as implemented by Regulation (EU) 2020/2021 (4), concerning restrictive measures against the Democratic Republic of the Congo.

The Council of the European Union has decided that the persons that appear in the abovementioned Annexes should continue to be included in the list of persons and entities subject to restrictive measures provided for in Decision 2010/788/CFSP and in Regulation (EC) No 1183/2005 concerning restrictive measures against the Democratic Republic of the Congo. The grounds for designations of those persons appear in the relevant entries in those Annexes.

The attention of the persons concerned is drawn to the possibility of making an application to the competent authorities of the relevant Member State(s) as indicated in the websites in Annex II to Regulation (EC) No 1183/2005, in order to obtain an authorisation to use frozen funds for basic needs or specific payments (cf. Article 3 of the Regulation).

The persons concerned may submit a request to the Council before 1 September 2021, together with supporting documentation that the decision to include them on the abovementioned list should be reconsidered to the following address:

The attention of data subjects is drawn to the following information in accordance with Article 16 of Regulation (EU) 2018/1725 of the European Parliament and of the Council (1).

The legal basis for this processing operation are Council Decision 2010/788/CFSP (2), as amended by Council Decision (CFSP) 2020/2033 (3) and Council Regulation (EC) No 1183/2005 (4), as implemented by Regulation (EU) 2020/2021 (5) concerning restrictive measures against the Democratic Republic of the Congo.

The purpose of the processing operation is the establishment and updating of the list of persons subject to restrictive measures in accordance with Decision 2010/788/CFSP, as amended by Decision (CFSP) 2020/2033 and Regulation (EC) No 1183/2005, as implemented by Regulation (EU) 2020/2021.

The data subjects are the natural persons who fulfil the listing criteria as laid down in Decision 2010/788/CFSP and Regulation (EC) No 1183/2005.

The personal data collected includes data necessary for the correct identification of the person concerned, the statement of reasons and any other data related thereto.

The personal data collected may be shared as necessary with the European External Action Service and the Commission.

Without prejudice to restrictions pursuant to Article 25 of Regulation (EU) 2018/1725, the exercise of the rights of the data subjects such as the right of access, as well as the rights to rectification or to object will be answered in accordance with Regulation (EU) 2018/1725.

Personal data will be retained for 5 years from the moment the data subject has been removed from the list of persons subject to the restrictive measures or the validity of the measure has expired, or for the duration of court proceedings in the event they had been started.

Without prejudice to any judicial, administrative or non-judicial remedy, data subjects may lodge a complaint with the European Data Protection Supervisor in accordance with Regulation (EU) 2018/1725 (edps@edps.europa.eu).

Notice amending the notice of initiation of an anti-dumping proceeding concerning imports of birch plywood originating in Russia

On 14 October 2020, the Commission published a notice of initiation of an anti-dumping proceeding concerning imports of birch plywood originating in Russia (1) (the ‘Notice of 14 October 2020’) which inadvertently omitted a section concerning the procedure for the assessment of Union interest. While this omission does not affect interested parties’ right to make submissions regarding the Union interest in accordance with Article 21 of the Regulation (EU) 2016/1036 of the European Parliament and of the Council of 8 June 2016 on protection against dumped imports from countries not members of the European Union (2) (‘the basic Regulation’), the Commission nevertheless considers it appropriate to address this omission as a matter of procedural transparency. Therefore, the Notice of 14 October 2020 shall be amended as follows:

In Section 5 of the Notice of 14 October 2020, after the second paragraph the following paragraph shall be added:

‘If the conclusions are affirmative, the investigation will examine whether the imposition of measures would not be against the Union interest under Article 21 of the basic Regulation.’

After Section 5.4, the following section shall be added:

‘5.4a.   Procedure for the assessment of Union interest

Should the existence of dumping and injury caused thereby be established, a decision will be reached, pursuant to Article 21 of the basic Regulation, as to whether the adoption of anti-dumping measures would not be against the Union interest. Union producers, importers and their representative associations, users and their representative associations, trade unions and representative consumer organisations are invited to provide the Commission with information on the Union interest. In order to participate in the investigation, the representative consumer organisations have to demonstrate that there is an objective link between their activities and the product under investigation. Information concerning the assessment of Union interest must be provided within 37 days of the date of publication of this Notice unless otherwise specified. This information may be provided either in a free format or by completing a questionnaire prepared by the Commission. A copy of the questionnaires, including the questionnaire for users of the product under investigation, is available in the file for inspection by interested parties and on DG Trade’s website (https://trade.ec.europa.eu/tdi/case_details.cfm?id=2486). The information submitted pursuant to Article 21 will only be taken into account if supported by factual evidence at the time of submission.’

Other procedural issues

The time period for providing information concerning the assessment of Union interest shall end 37 days following the date of publication of the Notice amending the Notice of 14 October 2020. Given that the assessment of Union interest under Article 21 of the basic Regulation is separate from the assessment of dumping and injury caused thereby, all other procedural rules mentioned in the Notice of 14 October 2020 continue to apply to this investigation where relevant.

1.   

On 27 November 2020, the Commission received notification of a proposed concentration pursuant to Article 4 and following a referral pursuant to Article 4(5) of Council Regulation (EC) No 139/2004 (1).

This notification concerns the following undertakings:

Kingspan Holding Netherlands B.V. (the Netherlands), controlled by Kingspan Group plc,

TeraSteel SA(Romania), controlled by TeraPlast SA,

TeraSteel d.o.o. Leskovac (Serbia), controlled by TeraPlast SA,

TeraSteel Slovakia s.r.o. (Slovakia), controlled by TeraPlast SA,

Wetterbest SA (Romania), controlled by TeraPlast SA.

Kingspan Holding Netherlands B.V. acquires within the meaning of Article 3(1)(b) of the Merger Regulation sole control of the whole of TeraSteel SA, TeraSteel d.o.o. Leskovac, TeraSteel Slovakia s.r.o. (jointly ‘TeraSteel’) and Wetterbest SA.

The concentration is accomplished by way of purchase of shares.

2.   

The business activities of the undertakings concerned are:

for Kingspan Holding Netherlands B.V.: mainly active in the manufacture of sandwich panels, insulation, light & air solutions, water & energy and data & flooring technology. Kingspan Group has manufacturing and distribution operations throughout Europe, the Far East and the Americas, and is currently operating in over 70 countries,

for TeraSteel: mainly active in the production and supply of (i) foam sandwich panels, (ii) mineral fibre sandwich panels, (iii) single skin construction sheets, (iv) purlins and (v) turnkey halls. TeraSteel has two production facilities in Romania and one production facility in Serbia,

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of the Merger Regulation. However, the final decision on this point is reserved.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.
