Initiation of proceedings

(Case M.7758 — Hutchison 3G Italy/WIND/JV)

On 30 March 2016, the Commission decided to initiate proceedings in the abovementioned case after finding that the notified concentration raises serious doubts as to its compatibility with the internal market. The initiation of proceedings opens a second phase investigation with regard to the notified concentration, and is without prejudice to the final decision on the case. The decision is based on Article 6(1)(c) of Council Regulation (EC) No 139/2004 (1).

The Commission invites interested third parties to submit their observations on the proposed concentration to the Commission.

In order to be fully taken into account in the procedure, observations should reach the Commission not later than 15 days following the date of this publication. Observations can be sent to the Commission by fax (+32 22964301), by email to COMP-MERGER-REGISTRY@ec.europa.eu or by post, under reference M.7758 — Hutchison 3G Italy/WIND/JV, to the following address:

Notice of invitation to tender for the buying-in of skimmed milk powder by the paying agencies

(2016/C 117/04)

1.

A tendering procedure for the buying-in of skimmed milk powder by the paying agencies has been opened by Commission Implementing Regulation (EU) 2016/482 (1). The applicable provisions are laid down in Section III of Chapter I of Title II of Commission Regulation (EU) No 1272/2009 (2).

2.

The time limit for the submission of tenders for the first individual invitation to tender shall be 19 April 2016.

3.

Tenders shall be submitted to the paying agencies. The addresses of the paying agencies are available on the European Commission website: http://ec.europa.eu/agriculture/milk/policy-instruments/index_en.htm

Notice of the impending expiry of certain anti-dumping measures

1.   As provided for in Article 11(2) of Council Regulation (EC) No 1225/2009 of 30 November 2009 on protection against dumped imports from countries not members of the European Community (1), the Commission gives notice that, unless a review is initiated in accordance with the following procedure, the anti-dumping measures mentioned below will expire on the date mentioned in the table below.

2.   Procedure

Union producers may lodge a written request for a review. This request must contain sufficient evidence that the expiry of the measures would be likely to result in a continuation or recurrence of dumping and injury. Should the Commission decide to review the measures concerned, importers, exporters, representatives of the exporting country and Union producers will then be provided with the opportunity to amplify, rebut or comment on the matters set out in the review request.

3.   Time limit

Union producers may submit a written request for a review on the above basis, to reach the European Commission, Directorate-General for Trade (Unit H-1), CHAR 04/039, 1049 Brussels, Belgium (2) at any time from the date of the publication of the present notice but no later than three months before the date mentioned in the table below.

4.   This notice is published in accordance with Article 11(2) of Regulation (EC) No 1225/2009.

Prior notification of a concentration

Candidate case for simplified procedure

1.

On 23 March 2016, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking The Dow Chemical Company (‘Dow’, United States) acquires within the meaning of Article 3(1)(b) of the Merger Regulation control of the whole of Dow Corning Corporation (‘DCC’, United States), currently controlled equally by Dow and by Corning Inc. (‘Corning’, United States) by way of purchase of shares.

2.

The business activities of the undertakings concerned are:

—   For Dow: diversified chemicals with primary activities in agricultural sciences, performance plastics and chemicals, and hydrocarbon and energy products and services. Dow currently holds 50 % of the shares of DCC.

—   For DCC: silicone-based technology and innovation with primary activities in development and production of polymers and other materials based on silicone chemistry. DCC is currently a 50/50 joint venture between Dow and Corning.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of the Merger Regulation. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in this Notice.

4.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.
