On 13 October 2009, the Commission decided not to oppose the above notified concentration and to declare it compatible with the common market. This decision is based on Article 6(1)(b) of Council Regulation (EC) No 139/2004. Pursuant to Article 9(1)(a), second indent, of Council Regulation (EEC) No 2658/87 of 23 July 1987 on the tariff and statistical nomenclature and on the Common Customs Tariff (1), the Explanatory Notes to the Combined Nomenclature of the European Communities (2) are amended as follows:

A trademark the use of which corresponds to one of the situations referred to in Article 11(2) of the Agreement between the European Community and Canada on trade in wine and spirit drinks may continue to be used and renewed notwithstanding the protection of these geographical indications, if such trademark has been applied for, registered or established by use, if that possibility is provided for by the legislation concerned, in the territory of the Community before the date of the present publication, provided that no grounds for the trademark's invalidity or revocation exist as specified by the First Council Directive 89/104/EEC of 21 December 1988 to approximate the laws of the Member States relating to trade marks (2) or Council Regulation (EC) No 40/94 of 20 December 1993 on the Community trade mark (3).

In such cases the use of the geographical indication shall be permitted alongside the relevant trademarks.

Commission Regulations (EC) No 536/2007 (1) and (EC) No 539/2007 (2) opened tariff quotas for imports of poultrymeat, eggs and egg albumin. The applications for import licences lodged during the first seven days of September 2009 for the subperiod 1 October to 31 December 2009 do not, for quotas 09.4169, 09.4015 and 09.4402, cover the quantities available. Pursuant to the second sentence of Article 7(4) of Commission Regulation (EC) No 1301/2006 (3), the quantities that were not applied for are to be added to the quantity fixed for the following quota subperiod, from 1 January to 31 March 2010; they are set out in the Annex to this notice.

Prior notification of a concentration

On 30 October 2009, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertakings Saint Gobain Glass France (‘SGGF’, France) controlled by Compagnie de Saint Gobain (‘Saint Gobain’, France) and Trakya Cam Sanayii A.S. (‘Trakya’, Turkey) controlled by Turkiye Sis eve Cam Fabrikalari A.S. (‘Sisecam’, Turkey) acquire within the meaning of Article 3(1)(b) of the Council Regulation joint control of the whole of the undertaking Saint Gobain Glass Egypt (‘SGGE’, Egypt), by way of purchase of shares.

The business activities of the undertakings concerned are:

—	for undertaking Saint Gobain: manufacture and sale of glass, ceramics, plastics and building materials,

—	for undertaking Sisecam: manufacture and sale of glass, glassware, glass packaging and chemicals,

—	for undertaking SGGE: manufacture and sale of glass for building and automotive applications.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.
