Objectives of aid: The aim of the scheme is to help to ensure that young game birds released for hunting are healthy and constitute a viable stock of birds suitable for human consumption. As mortality rates among very young game birds are often high, the scheme is designed to provide information about the causes of death among the youngest groups of game birds. Based on the data collected, advice is compiled about the management of game birds (primarily pheasants) in the first three weeks of life, with a view to minimising production losses.

The final beneficiaries are game bird breeders. The scheme concerns only small and medium-sized enterprises.

The scheme comes under Article 15(2)(c) of Regulation (EC) No 1857/2006. It concerns expenditure on consultancy services

Objective of aid: Replacement is a solution that allows farmers whose activity requires on-farm presence every day of the year to have a work and life pattern comparable to other economic sectors. Nevertheless, except for cases where this option is funded (by private insurance covering maternity, accidents or illness), the cost of this service is a disincentive.

Aid is therefore being offered to farmers to encourage them to make use of these services. This aid will be granted to cover the real costs of replacing a farmer who is ill, on holiday or undergoing professional training (excluding trade union responsibilities). The aid must be granted in kind by means of subsidised services and must not involve direct payments of money to producers.

In accordance with point 4 of Article 15 of the agricultural exemption Regulation, aid will not be restricted to members of specific producer groups or other organisations. When aid is granted to a group or an organisation for a service provided to a farmer who is not a member of that group or organisation, it will be strictly limited to the costs relating to the provision of the replacement service

Legal basis: Orden de 2008, del Departamento de Agricultura, Alimentación y Acción Rural, por la cual se aprueban las bases reguladoras de las ayudas para la reposición de animales reproductores bovinos sacrificados por motivos de saneamiento oficial y se convocan las correspondientes al año 2008

Planned annual expenditure under the scheme: EUR 810 000 per year

Maximum aid intensity: Up to EUR 500 per animal slaughtered for official health reasons, to replace that animal. The maximum amount of aid per replacement animal shall be the difference between the purchase price of the new animal and the total amount received under an insurance scheme, if any, and costs not incurred because of the disease, which would otherwise have been incurred, provided that the gross aid intensity does not exceed 100 %

Date of implementation: The aid scheme will apply from the date of publication on the website of DG AGRI of the registration number of the exemption request provided for in Regulation (EC) No 1857/2006. The Order will enter into force following its publication in the Official Gazette of the Generalitat de Cataluña (DOGC), which is planned for September 2008

Duration of the aid scheme: From the publication of the scheme in 2008 until 31 December 2013

Objective of aid: The objective of the aid is to compensate farmers for losses caused by the slaughter of beef, dairy or Lidia breed cattle for official health reasons, and to facilitate the replacement of animals with the aim of restoring the breeding animals to the number before the outbreak of the disease, in accordance with Article 10 of Regulation (EC) No 1857/2006.

This aid is granted in order to combat bovine tuberculosis and/or brucellosis, and:

deals with a disease for which an outbreak has been formally recognised by the public authorities,

is part of a compulsory programme at Community, national or regional level for the prevention or erradication of the disease,

will not be granted for measures for which the cost is to be borne by the agricultural holding,

are not diseases in respect of which Community legislation provides for specific charges for control measures,

all the animals on the holding must have been slaughtered for official health reasons in 2007 and 2008. The animals to be replaced may have been lost in 2007. Therefore, the scheme meets the condition laid down in Article 10(8) of Regulation (EC) No 1857/2006 as it will be introduced within three years following the occurrence of the loss and the aid will be paid out within four years following the occurrence.

Only agricultural holdings that are considered to be micro, small or medium-sized enterprises may benefit from this aid

Objective of aid: The aid for maintaining herd books covers the cost of carrying out tests and processing the data obtained; that for carrying out genetic yield tests covers the cost of conducting tests, processing the data and disseminating the information gathered to livestock farmers.

These incentives, provided for in Article 1 of Regional Law No 36 of 4 August 2000, are granted under Article 16(1)(a) and (b) of Regulation (EC) No 1857/2006 at a rate of up to 100 % of eligible administrative costs connected with maintaining herd books and registers and of up to 70 % of the cost of tests to determine the yield of livestock, with the exception of tests undertaken by the owner of the livestock and routine tests of milk quality

Annual expenditure planned under the scheme: EUR 37 million from the National Guarantee Fund for Agricultural Disasters (FNGCA)

Maximum aid intensity: 35 %, from the FNGCA, of the premium or contribution invoiced to the insured party, net of tax, for eligible cover.

The extent of eligible cover is determined on the basis of a minimum excess of 25 % for single crop insurance, and 20 % for insurance covering the entire production of the farm.

For instance, for contracts with an excess higher than or equal to the minimum level, the eligible cover is the actual cover set out in the contract, and the amount of the eligible premium is the amount of the net premium invoiced to the insured party.

In the case of contracts with an excess lower than the minimum level, the amount of the eligible premium is limited to the amount of the net premium invoiced to the insured party, which relates only to the eligible cover defined above.

The FNGCA aid amounting to 35 % will be increased by 5 % for young farmers who have been established for less than five years.

Where there is a cumulation of aid from the Fund and from a regional authority, the total aid must not in any case exceed 50 % of the amount of the premium or contribution

Objective of aid: To promote the spread of insurance against various agricultural risks. The insurance premiums for which aid is granted are those referred to in Article 12 of Regulation (EC) No 1857/2006

training leading to the award of a trade qualification or certificate of competency as referred to in current legislation and for which the training element or skills updating element is of prime importance,

training to update or perfect subject-knowledge,

training with a view to acquiring sufficient ‘professional abilities’ as referred to in Community legislation and/or the certification referred to in Legislative Decree No 99/2004 (professional farmer)

The aid intensity for the disposal costs of rendering or incineration of aborted material by an approved contractor is up to 75 % in accordance with Article 16(d) of Regulation (EC) No 1857/2006

Notification by the Swiss Confederation to the European Commission pursuant to Article 34(1) of Regulation (EC) No 562/2006 of the European Parliament and of the Council establishing a Community Code on the rules governing the movement of persons across borders (Schengen Borders Code)

I.   Point (a) — List of residence permits

The Swiss Confederation issues the following permits:

category D national visas bearing the words ‘Vaut comme titre de séjour’,

identity document L for foreign nationals (short-term residence permit; L residence permit, mauve),

identity document B for foreign nationals (temporary residence permit type B; issued in three or four languages, grey),

identity document C for foreign nationals (permanent residence permit type C, green),

identity document Ci for foreign nationals (residence permit type Ci for spouses and children (up to 25 years of age) of officials of international organisations and members of foreign representations in Switzerland who pursue a gainful activity on the Swiss labour market, red),

identity cards (residence permits) issued by the Federal Department of Foreign Affairs:

identity card type B (pink stripe): heads of diplomatic, permanent or special missions, senior officials of international organisations and members of their families having the same status,

identity card type C (pink stripe): members of the diplomatic staff of diplomatic, permanent or special missions, senior officials of international organisations and members of their families having the same status,

identity card type D (blue stripe): members of the administrative and technical staff of diplomatic, permanent or special missions and members of their families having the same status,

III.   Point (c) — Reference amounts required for crossing the external borders

The Swiss Aliens Act of 16 December 2005 (RS 142.20) stipulates that foreign nationals must possess the necessary financial resources to cover the costs of residence but does not specify details. The administrative practice is as follows:

foreign nationals bearing their own costs of their stay in Switzerland must prove that they possess approx. CHF 100,00 per day. Students who can prove their identity by means of a valid student card must possess approx. CHF 30,00 per day,

foreign nationals staying with a private individual must provide proof of their means of subsistence by means of a declaration of liability signed by their host in Switzerland. The competent authority will give advance notice of the host's solvency. The declaration of liability encompasses uncovered costs borne by the public purse or private providers of medical services during the foreign national's stay, i.e. subsistence costs, accident and sickness costs, and the cost of return, and constitutes acknowledgement of an irrecoverable debt set at CHF 30 000,00. Guarantees may be provided by adults who are nationals of Switzerland or the Principality of Liechtenstein and reside in either of those two States, adult holders of a residence permit (category B only) or valid Swiss establishment permit, and legal persons registered in the commercial register.

IV.   Point (d) — National services responsible for border control

Cantonal police force in the cantons of Geneva, Zurich, Bern, Soleure, Vaud, Valais, Saint-Gall and Les Grisons,

Border Guard service: the Border Guard service carries out checks on persons at the border as part of its normal duties and pursuant to agreements between the Federal Department of Finance and the cantons (Article 23(2) of the Ordinance on the entry and visa procedure, OPEV; RS 142.204).
