COMMISSION OPINION

of 21 June 2007

concerning the modified plan for the disposal of radioactive waste from the SOCATRI decontamination and uranium recovery plant at the Tricastin site in France, in accordance with Article 37 of the Euratom Treaty

On 25 October 2006, the European Commission received from the French Government, in accordance with Article 37 of the Euratom Treaty, General Data relating to the modified plan for the disposal of radioactive waste from the SOCATRI decontamination and uranium recovery plant.

On the basis of the General Data, and following consultation with the Group of Experts, the Commission has drawn up the following opinion:

1.

The distance between the plant and the nearest point on the territory of another Member State, in this case Italy, is approximately 170 km.

2.

The overall result of the planned modification will be to increase the discharge authorisation of airborne radioactive effluents in respect of tritium, carbon-14 and radionuclides produced during the treatment of effluents presenting a uranium reprocessing spectrum.

3.

During normal operation, the planned modification will not cause an exposure liable to affect the health of the population in other Member States.

4.

In the event of unplanned releases of radioactive effluents resulting from an accident of the type and magnitude considered in the initial General Data, the planned modification will not give rise to doses in other Member States liable to affect the health of the population.

In conclusion, the Commission is of the opinion that the implementation of the modified plan for the disposal of radioactive waste in whatever form from the SOCATRI decontamination and uranium recovery plant at the Tricastin site in France, both in normal operation and in the event of an accident of the type and magnitude considered in the General Data, is not liable to result in the radioactive contamination of the water, soil or airspace of another Member State.

COMMISSION OPINION

of 21 June 2007

concerning the plan for the disposal of radioactive waste arising from the decommissioning of the Obrigheim nuclear power plant, located in the Federal Republic of Germany, in accordance with Article 37 of the Euratom Treaty

On 18 September 2006, the European Commission received from the Government of the Federal Republic of Germany, in accordance with Article 37 of the Euratom Treaty, General Data relating to the plan for the disposal of radioactive waste arising from the decommissioning of the Obrigheim nuclear power plant.

On the basis of these data, and following consultation with the Group of Experts, the Commission has drawn up the following opinion:

1.

The distance between the plant and the nearest point of another Member State, in this case France, is approximately 80 km.

2.

During normal decommissioning operation, discharges of liquid and gaseous effluents will not cause an exposure liable to affect the health of the population in other Member States.

3.

Solid radioactive waste produced during decommissioning will be stored in a facility on site before final disposal in an agreed storage facility. Non-radioactive solid waste and materials in compliance with clearance levels will be released from regulatory control for disposal as conventional waste or for recycling or reuse. This will be done in compliance with the criteria laid down in the Basic Safety Standards (Council Directive 96/29/Euratom).

In the event of unplanned releases of radioactive waste, which may follow an accident of the type and magnitude considered in the General Data, the doses received in other Member States would not be liable to affect the health of the population.

In conclusion, the Commission is of the opinion that the implementation of the plan for the disposal of radioactive waste in whatever form arising from the decommissioning of the Obrigheim nuclear power plant, located in the Federal Republic of Germany, both in normal operation and in the event of an accident of the type and magnitude considered in the General Data, is not liable to result in the radioactive contamination of the water, soil or airspace of another Member State.

On 6 September 2006, the European Commission received from the Government of France, in accordance with Article 37 of the Euratom Treaty, General Data relating to the plan for the disposal of radioactive waste arising from the modification of the discharge authorisations of gaseous and liquid radioactive effluents for the dismantling of INB 91 and the change of the missions of INB 141 at the Creys-Malville Nuclear Power Plant.

On the basis of these data and the additional information requested by the Commission on 15 January 2007 and provided by the French authorities on 13 February 2007, and following consultation with the Group of Experts, the Commission has drawn up the following opinion:

1.

The distance between the plant and the nearest point on the territory of another Member State, in this case Italy, is approximately 96 km.

2.

During normal operation, taking into account the requested new discharge authorisations, the discharges of gaseous and liquid effluents will not cause an exposure liable to affect the health of the population in other Member States.

3.

Solid radioactive waste arising from the operations is either stored on site or transported to specific waste treatment facilities in France. The experts recommend that checks on conventional waste, that are carried out as a precautionary measure to confirm the absence of contamination, be such that at the same time compliance with the clearance criteria laid down in the Basic Safety Standards (Directive 96/29/EURATOM) is ensured.

4.

In the event of unplanned releases of radioactive waste, resulting from an accident of the type and magnitude considered in the General Data, the planned changes will not give rise to doses in other Member States liable to affect the health of the population.

In conclusion, the Commission is of the opinion that the implementation of the plan for the disposal of radioactive waste relating to the modification of the discharge authorisations of gaseous and liquid radioactive effluents for the dismantling of INB 91 and the change of the missions of INB 141 at the Creys-Malville Nuclear Power Plant, both in normal operation and in the event of an accident of the type and magnitude considered in the General Data, is not liable to result in the radioactive contamination of the water, soil or airspace of another Member State.

Maximum aid intensity: Aid will amount to 70 % of the loss, calculated as follows:

Objective of aid: The aid will apply in accordance with Article 10 of the Regulation and is designed to compensate farmers for the loss of production following the death of the sheep and goats.

In view of the fact that sheep in Sardinia are raised primarily for the purpose of producing milk and given the seasonal nature of milk production amongst sheep in the region (generally between January and July), the loss of production is calculated for a period of one year, bearing in mind the difficulty with which animals can be replaced in the months following their death (because of the ban on moving animals and because no animals that could be used for production purposes will be available before the autumn of the year after the loss occurred).

The loss is calculated taking into account the value of lost production, net of intermediate costs not incurred by the farmer (purchase of forage and veterinary costs), with a distinction being made between non-purebred sheep and goats and those recorded in herd books (please refer to the explanatory table given under ‘Maximum aid intensity’).

Aid for agricultural processing and marketing and non-agricultural business activities will be provided in accordance with EC Regulation 1998/2006 which governs the granting of de minimis aid. De minimis aid is specific category of aid which does not require authorisation by the European Commission. Such support is limited to EUR 200 000 (approximately GBP 120 000) over three years for each business and can cover any type of activity.

Maximum aid intensity: The scheme consists of 3 measures: capital works and technical support. The aid intensity for the technical support measure will be 100 % in accordance with Article 15. The maximum aid intensity for the capital works will be 100 % where a grant is awarded for a the conservation of non productive heritage features. However, the maximum rate of grant will be reduced in line with the rates set out in Article 5 of Commission Regulation (EC) No 1857/2006 where the aid is productive. If aid is being paid in line with Article 4, the maximum aid intensity paid will be 40 % of the eligible investment.

Duration of scheme or individual aid award: The scheme will begin on 30 April 2007. It will close on the 1 November 2009. The last payment will be made 30 November 2009.

Objective of aid: Heritage conservation — the general aim of the scheme is to enhance and help secure Purbeck's rich diverse habitats through conservation of traditional landscapes and features mainly the Frome valley and the Purbeck Ridge.

For the capital works element of the scheme the eligible costs will be the real costs incurred as regards capital works intended for the conservation of traditional landscapes. This complies with Article 5 of Regulation (EC) No 1857/2006. For the capital works which require investment in agricultural holdings to assist in cattle handling of the conservation herd the eligible costs will be 40 % of the costs incurred as regards capital works intended to preserve and improve the natural environment. This complies with Article 4 of Regulation (EC) No 1857/2006.

For the technical support element of the scheme the eligible costs will be the training of farmers and farm workers, in particular the costs of organising the training programme, and consultancy services. The aid will be provided in the form of services on preferential terms — there will be no direct payments of money to producers this complies with Article 15 of Regulation (EC) No 1857/2006

The eligible costs will be the costs of organising training programmes and consultancy services in line with Article 15 of Regulation 1857/2006.

Notice of initiation of a partial interim review of the anti-dumping measures applicable to imports of certain seamless pipes and tubes, of iron or steel originating, inter alia, in Russia

The Commission has decided on its own initiative to initiate a partial interim review pursuant to Article 11(3) of Council Regulation (EC) No 384/96 of 22 December 1995 on protection against dumped imports from countries not members of the European Community (‘the basic Regulation’) (1). The review is limited in scope to dumping aspects as far as the exporting producers/members of the TMK Group (Volzhsky Pipe Plant, Taganrog Metallurgical Works, Sinarsky Tube Plant and Seversky Tube Works) and their related companies (‘the company’) are concerned.

1.   Product

The product under review is certain seamless pipes and tubes of iron or steel, of circular cross-section, of an external diameter not exceeding 406,4 mm with a Carbon Equivalent Value (CEV) not exceeding 0,86 according to the International Institute of Welding (IIW) formula and chemical analysis (2) originating in Russia (‘the product concerned’), currently classifiable within CN codes ex 7304 11 00, ex 7304 19 10, ex 7304 19 30, ex 7304 22 00, ex 7304 23 00, ex 7304 24 00, ex 7304 29 10, ex 7304 29 30, ex 7304 31 80, ex 7304 39 58, ex 7304 39 92, ex 7304 39 93, ex 7304 51 89, ex 7304 59 92 and ex 7304 59 93 (3). These CN codes are given only for information.

2.   Existing measures

The measures currently in force are a definitive anti-dumping duty imposed by Council Regulation (EC) No 954/2006.

3.   Grounds for the review

There is sufficient prima facie evidence available to the Commission that the circumstances on the basis of which the existing measures were established have changed and that these changes are of a lasting nature. Information at the Commission's disposal indicates that the company's corporate structure has changed significantly in a lasting way since the period on the basis of which the existing measures were established.

Furthermore, a comparison of normal value based on the company's domestic prices and its export prices would lead to a reduction of dumping significantly below the level of the current measure. Therefore the continued imposition of measures at the existing levels, which were based on the level of dumping previously established, would no longer be necessary to offset dumping.

4.   Procedure for the determination of dumping

Having determined, after consulting the Advisory Committee, that sufficient evidence exists to justify the initiation of a partial interim review, the Commission hereby initiates a partial interim review in accordance with Article 11 (3) of the basic Regulation.

The investigation will assess the need for the continuation, removal or amendment of the existing measures in respect of the group of companies mentioned above.

(a)   Questionnaires

In order to obtain the information it deems necessary for its investigation, the Commission will send questionnaires to the group and to the authorities of the exporting country concerned. This information and supporting evidence should reach the Commission within the time limit set in point 5(a) of this notice.

(b)   Collection of information and holding of hearings

All interested parties are hereby invited to make their views known, submit information other than questionnaire replies and to provide supporting evidence. This information and supporting evidence must reach the Commission within the time limit set in point 5(a) of this notice.

Furthermore, the Commission may hear interested parties, provided that they make a request showing that there are particular reasons why they should be heard. This request must be made within the time limit set in point 5(b) of this notice.

5.   Time limits

(a)   For parties to make themselves known, to submit questionnaire replies and any other information

All interested parties, if their representations are to be taken into account during the investigation, must make themselves known by contacting the Commission, present their views and submit questionnaire replies or any other information within 40 days of the date of publication of this notice in the Official Journal of the European Union, unless otherwise specified. Attention is drawn to the fact that the exercise of most procedural rights set out in the basic Regulation depends on the party's making itself known within the aforementioned period.

(b)   Hearings

All interested parties may also apply to be heard by the Commission within the same 40-day time limit.

6.   Written submissions, questionnaire replies and correspondence

All submissions and requests made by interested parties must be made in writing (not in electronic format, unless otherwise specified) and must indicate the name, address, e-mail address, telephone and fax numbers of the interested party. All written submissions, including the information requested in this notice, questionnaire replies and correspondence provided by interested parties on a confidential basis shall be labelled as ‘Limited (4) and, in accordance with Article 19(2) of the basic Regulation, shall be accompanied by a non-confidential version, which will be labelled ‘FOR INSPECTION BY INTERESTED PARTIES’.

7.   Non-co-operation

In cases in which any interested party refuses access to or does not provide the necessary information within the time limits, or significantly impedes the investigation, findings, affirmative or negative, may be made in accordance with Article 18 of the basic Regulation, on the basis of the facts available.

Where it is found that any interested party has supplied false or misleading information, the information shall be disregarded and use may be made, in accordance with Article 18 of the basic Regulation, of the facts available. If an interested party does not cooperate or cooperates only partially, and use of facts available is made, the result may be less favorable to that party than if it had cooperated.

8.   Schedule of the investigation

The investigation will be concluded, according to Article 11(5) of the basic Regulation within 15 months of the date of the publication of this notice in the Official Journal of the European Union.

9.   Processing of personal data

Please note that any personal data collected in this investigation will be treated in accordance with Regulation (EC) No 45/2001 of the European Parliament and the Council of 18 December 2000 on the protection of individuals with regard to the processing of personal data by the Community institutions and bodies and on the free movement of such data (5).

On 13 June 2007, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertakings Nikko Principal Investments Ltd (‘Nikko Principal Investments’, United Kingdom) and Eastmerchant GmbH (‘Eastmerchant’, Germany) acquire within the meaning of Article 3(1)(b) of the Council Regulation joint control of the undertaking Sachsenfonds Holding GmbH (‘Sachsenfonds’, Germany) by way of purchase of shares.

The business activities of the undertakings concerned are:

for undertaking Nikko Principal Investments: private equity investments firm,

for undertaking Eastmerchant: financial investments firm,

for undertaking Sachsenfonds: design, initialisation, distribution and management of closed-end funds.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.
