COMMISSION OPINION
of 3 August 2005
concerning the modified plan for the disposal of radioactive waste at the Aube Storage Centre located in France, in accordance with Article 37 of the Euratom Treaty

On 13 December 2004, the European Commission received from the Government of France, in accordance with Article 37 of the Euratom Treaty, General Data relating to the modified plan for the disposal of radioactive waste at the Aube Storage Centre.
On the basis of the General Data and the additional information requested by the Commission on 3 March 2005 and provided by the French authorities on 5 April 2005, and following consultation with the Group of Experts, the Commission has drawn up the following opinion:
1. |
The distance between the plant and the nearest point on the territory of another Member State, in this case Belgium and Luxembourg, is approximately 150 km. |
2. |
The modification envisaged results from developments in French national law which require certain installations at the storage centre to have an authorisation for release of gaseous and liquid radioactive effluents. |
3. |
Solid radioactive waste is stored at the site or, if it is very low level waste, is transferred to an approved storage site. |
4. |
In normal operation, the modification envisaged will not cause an exposure that is significant from the point of view of health for the population of another Member State. |
5. |
In the event of unplanned releases of radioactive effluents resulting from an accident of the type and magnitude considered in the General Data, the planned modification will not give rise to any significant effect from the point of view of health on the population of another Member State. |
In conclusion, the Commission is of the opinion that the implementation of the modified plan for the disposal of radioactive waste in whatever form at the Aube Storage Centre in France, both in normal operation and in the event of an accident of the type and magnitude considered in the General Data, is not liable to result in radioactive contamination, significant from the point of view of health, of the water, soil or airspace of another Member State.

COMMISSION OPINION

concerning the modified plan for the disposal of radioactive waste at the TU5 Facility on the COGEMA Pierrelatte site in France, in accordance with Article 37 of the Euratom Treaty

On 13 December 2004, the European Commission received from the Government of France, in accordance with Article 37 of the Euratom Treaty, General Data relating to the modified plan for the disposal of radioactive waste at the TU5 Facility on the COGEMA Pierrelatte site.
On the basis of the General Data and the additional information requested by the Commission on 3 March 2005 and provided by the French authorities on 5 April 2005, and following consultation with the Group of Experts, the Commission has drawn up the following opinion:

The distance between the plant and the nearest point on the territory of another Member State, in this case Italy, is approximately 175 km. |
2. |
Among the modifications to the TU5 facility described in the General Data, it is noted that since 2002 the facility converts uranyl nitrate from the COGEMA Marcoule site causing discharges of 3H and 14C in the gaseous and liquid effluents. |
3. |
During normal operation, the gaseous and liquid effluents released from the modified TU5 installation including 3H and 14C will not cause an exposure of the population in other Member States that is significant from the point of view of health. |
4. |
In the event of unplanned releases of radioactive effluents resulting from an accident of the type and magnitude considered in the General Data, the modification will not give rise to any significant effect from the point of view of health on the population of another Member State. |
In conclusion, the Commission is of the opinion that the implementation of the modified plan for the disposal of radioactive waste in whatever form at the TU5 Facility on the COGEMA Pierrelatte site in France, both in normal operation and in the event of an accident of the type and magnitude considered in the General Data, is not liable to result in radioactive contamination, significant from the point of view of health, of the water, soil or airspace of another Member State.

The European Commission has registered a complaint, regarding the management of water in the Lago d'Idro area, with reference to a site of relevance under Council Directive 92/43/EEC of 21 May 1992 on the conservation of natural habitats and of wild fauna and flora, as number No 2005/4347 in the register of complaints. |

The Commission has received more than 35 copies of this complaint. Therefore, in order to ensure a rapid response to and information of those concerned while making the most economical use of its administrative resources, it is publishing this acknowledgment of receipt in the Official Journal of the European Communities and on the Internet at: http://europa.eu.int/comm/secretariat_general/sg1/receipt/ |

The complaint will be examined by the Commission in the light of the applicable Community legislation. The complainants will be kept informed, by any means, including eventually by publication in the Official Journal of the European Communities and/or on the Internet, of the results of this examination and of any follow-up action that the Commission may decide to take. |

The Commission will endeavour to take a decision on the substance of the case (opening of infringement proceedings or closure of the case) within 12 months from the date of registration of the complaint by the Secretariat-General. |
5. |
Should the Commission need to contact the Italian authorities, it will do so without mentioning the identity of the complainants in order to protect their rights. The complainants may, however, authorise the Commission to reveal their identity in any contacts with the Italian authorities. |

The Commission draws attention to the judgement delivered on 30 April 1996 in the ‘CIA Security’ case (C-194/94 — ECR I, p. 2201), in which the Court of Justice ruled that Articles 8 and 9 of Directive 98/34/EC (formerly 83/189/EEC) are to be interpreted as meaning that individuals may rely on them before national courts which must decline to apply a national technical regulation which has not been notified in accordance with the Directive.
This judgement confirms the Commission's communication of 1 October 1986 (OJ C 245, 1.10.1986, p. 4).
Accordingly, breach of the obligation to notify renders the technical regulations concerned inapplicable, and consequently unenforceable against individuals.
