Commission notice updating the list of parties under examination pursuant to Commission Regulation (EC) No 88/97 on the exemption from the extended anti-dumping duty on imports of certain bicycle parts originating in the People's Republic of China

(2004/C 299/04)

Commission Regulation (EC) No 88/97 (1) of 20 January 1997 authorises the exemption from the extended anti-dumping duty on imports of certain bicycle parts originating in the People's Republic of China. This duty resulted from the extension by Council Regulation (EC) No 71/97 (2) of the anti-dumping duty imposed by Council Regulation (EEC) No 2474/93 (3), and maintained by Council Regulation (EC) No 1524/2000 (4). Annex I to Commission Regulation (EC) No 88/97 comprises a list of parties whose requests for authorisation for exemption from the extended duty imposed by Regulation (EC) No 71/97 were under examination.

Interested parties are hereby informed of the receipt of further requests for exemption, pursuant to Article 3 of Commission Regulation (EC) No 88/97, and of requests which are still under examination at this stage. The suspension from the extended duty, following these requests, took effect as shown in the Annex to this notice, which constitutes an updated list of parties under examination.

1.

On 19 November 2004, the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertaking Macquarie European Infrastructure Fund LP (‘MEIF’, UK) belonging to the Macquarie group (‘Macquarie’, Australia) acquires within the meaning of Article 3(1)(b) of the Council Regulation control of the whole of the undertaking Braunschweiger Versorgungs AG (‘BVAG’, Germany) by way of purchase of shares.

2.

The business activities of the undertakings concerned are:

for MEIF: equity infrastructure investments,

for Macquarie: investment banking and financial services,

for BVAG: supply of electricity, natural gas, district heating and water.

3.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

4.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.

Observations must reach the Commission not later than 10 days following the date of this publication. Observations can be sent to the Commission by fax (No (32-2) 296 43 01 or 296 72 44) or by post, under reference number COMP/M.3650 — Macquarie/BVAG, to the following address:

On 26 November 2004 the Commission received a notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1) by which the undertakings Société Générale SA (‘SG’, France) and Otto GmbH & Co. KG (‘Otto’, Germany) acquire within the meaning of Article 3(1)(b) of the Council Regulation joint control of Hanseatic Bank GmbH & Co. KG (‘Hanseatic Bank’, Germany), by way of purchase of shares.

2.

The business activities of the undertakings concerned are:

for SG:banking and financial services,

for Otto: retailing by mail order, and

for Hanseatic Bank: banking.

3.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of Regulation (EC) No 139/2004. However, the final decision on this point is reserved. Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

Imposition by France of public service obligations in respect of scheduled air services within France

(2004/C 299/08)

1.   Pursuant to Article 4(1)(a) of Council Regulation (EEC) No 2408/92 of 23 July 1992 on access for Community air carriers to intra-Community air routes, France has decided to impose a public service obligation on scheduled air services between Annecy (Meythet) and Paris (Orly).

2.   The public service obligation is as follows:

Minimum frequency

The service must be operated throughout the year with at least three return trips a day, one in the morning and one in the evening, from Monday to Friday, excluding public holidays and one return trip on Sunday.

The service in the middle of the day may be rerouted for up to 10 weeks a year.

The service must be non-stop between Annecy and Paris (Orly).

Type of aircraft used

The service must be operated with a pressurised aircraft having a seating capacity of at least 40.

Timetables

Timetables must be such as to enable passengers on business trips during the working week to make the round trip within the day and to spend at least eight hours at their destination, whether Annecy or Paris.

Flight bookings

Seats on these flights must be marketed by at least one computerised booking system.

Continuity of service

Except in cases of force majeure, the number of flights cancelled for reasons directly attributable to the carrier must not exceed 3 % of the number of flights scheduled in any year. The carrier must give six months' notice before discontinuing the service.

Community carriers are hereby informed that the operation of air services without regard to the abovementioned public service obligation may result in administrative and/or criminal penalties.

3.   Slots have been reserved at Paris (Orly) airport for the scheduled Paris (Orly) — Annecy service pursuant to Article 9 of Council Regulation (EEC) No 95/93 of 18 January 1993 on common rules for the allocation of slots at Community airports, as amended by Regulation (EC) No 793/2004 of the European Parliament and of the Council of 21 April 2004. Air carriers interested in this route can obtain information about the allocation of these slots from the Paris airports coordinator.

2.   The public service obligation in respect of scheduled air services between Poitiers (Biard) and Lyon (Saint-Exupéry) is as follows:

Minimum frequency

The service must be operated throughout the year with at least:

two return trips a day, morning and evening, from Monday to Friday, excluding public holidays, 220 days a year,

one return trip on Sunday, 44 weeks a year

The service must be non-stop between Poitiers and Lyon.

Type of aircraft used

The service must be operated with a pressurised aircraft.

Timetables

The timetables must be such as to enable passengers on business trips during the working week to make the round trip within the day and to spend at least seven hours at their destination, whether Lyon or Poitiers.

Flight bookings

Seats on these flights must be marketed by at least one computerised booking system.

Continuity of service

Except in cases of force majeure, the number of flights cancelled for reasons directly attributable to the carrier must not exceed 3 % of the number of flights scheduled in any year. The carrier must give six months' notice before discontinuing the service.

2.   The public service obligation in respect of scheduled air services between Limoges (Bellegarde) and Paris (Orly) is as follows:

Minimum frequency

The service must be operated throughout the year, excluding public holidays and the rerouting periods in August and at the end of the year, with at least two return trips a day, one in the morning and one in the evening, from Monday to Friday and one return trip on Saturday morning and Sunday evening.

The service must be non-stop between Limoges (Bellegarde) and Paris (Orly).

Timetables

Timetables must be such as to enable passengers on business trips during the working week to make the round trip within the day and to spend at least seven hours at their destination, whether Paris (Orly) or Limoges (Bellegarde).

Flight bookings

Seats on these flights must be marketed by at least one computerised booking system.
