COUNCIL IMPLEMENTING REGULATION (EU) 2026/1817

of 23 July 2026

implementing Article 8a(1) of Regulation (EC) No 765/2006 concerning restrictive measures in view of the situation in Belarus and the involvement of Belarus in the Russian aggression against Ukraine

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Regulation (EC) No 765/2006 of 18 May 2006 concerning restrictive measures in view of the situation in Belarus and the involvement of Belarus in the Russian aggression against Ukraine (1), and in particular Article 8a(1) thereof,

Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

On 18 May 2006, the Council adopted Regulation (EC) No 765/2006.

In view of the gravity of the situation in Belarus, two legal persons should be included in the list of natural and legal persons, entities and bodies subject to restrictive measures set out in Annex I to Regulation (EC) No 765/2006.

Regulation (EC) No 765/2006 should therefore be amended accordingly,

HAS ADOPTED THIS REGULATION:

Article 1

Annex I to Regulation (EC) No 765/2006 is amended in accordance with the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the date of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

European Trading Company (ETK) is a subsidiary of Belarusian Oil Company (BNK), Belarus’s leading exporter of petroleum. BNK is owned by the three largest oil production and refining enterprises in the Republic of Belarus: Belorusneft, Naftan, and Mozyr Oil Refinery. Through its ownership structure, BNK is controlled by the state of Belarus. As a subsidiary of BNK, ETK is also indirectly controlled and owned by those entities. The ETK company was created to sell petroleum products produced by Naftan and Mozyr Oil Refinery in the territory of the Russian Federation. ETK lists BNK, Naftan, Belorusneft and Mozyr Oil Refinery as its partners. Therefore, ETK is associated with, owned and controlled by, entities supporting the Lukashenka regime.

Mozyr Oil Refinery is one of the two oil refineries in Belarus. It is part of the Belneftekhim concern, which has been subject to restrictive measures by the Union since 3 August 2023, and is owned almost entirely by the state of Belarus and Slavneft. The refinery is of significant importance for the Lukashenka regime. Mozyr Oil Refinery is also a part-owner of the Belarusian Oil Company (BNK), Belarus’s leading exporter of petroleum, alongside Belorusneft and Naftan, Therefore, Mozyr Oil Refinery is controlled by and associated with entities supporting and benefitting from the Lukashenka regime. Because of its importance to the Belarusian economy, Mozyr Oil Refinery is also supporting and benefitting from the Lukashenka regime.
