DECISION OF THE STANDING COMMITTEE OF THE EFTA STATES No. 2/2025/SC

on the continuation of the designated Performance Review Body of the single European sky for the EFTA States [2025/1872]

THE STANDING COMMITTEE OF THE EFTA STATES,

Having regard to the Agreement on the European Economic Area, hereinafter referred to as the EEA Agreement, and in particular point 66t(d) of Annex XIII thereto,

Whereas, by Commission Implementing Decision (EU) 2016/2296 of 16 December 2016 (1), the European Commission set up an independent group of experts and designated that group of experts as the Performance Review Body of the single European sky pursuant to Article 11(2) of Regulation (EC) No 549/2004 of the European Parliament and of the Council of 10 March 2004 (2),

Whereas, by Decision of the Standing Committee of the EFTA States No. 1/2021/SC of 18 March 2021, the independent group of experts set up by Implementing Decision (EU) 2016/2296 was designated as the Performance Review Body of the single European sky with regard to the EFTA States until 31 December 2024.

Whereas appropriate working arrangements have been agreed between the EFTA Surveillance Authority and the Commission’s Directorate-General for Mobility and Transport to ensure the well-functioning of the extension of work of the Performance Review Body,

Whereas Article 11 of Regulation (EC) No 549/2004 was adapted for the purposes of the EEA Agreement with regard to Iceland, the Performance Review Body shall assist as appropriate with the implementation of the performance scheme within the framework established with regard to Iceland,

Whereas the independent group of experts has expressed no objection to continue being designated as the Performance Review Body also with regard to the EFTA States,

Whereas Regulation (EC) No 549/2004 does not apply to Liechtenstein,

Whereas, by Article 58(2) of Regulation (EU) 2024/2803 of the European Parliament and of the Council of 23 October 2024 (3), the Performance Review Body designated under Article 11(2) of Regulation (EC) No 549/2004 shall continue to exercise its functions until 2 June 2025.

HAS DECIDED AS FOLLOWS:

Article 1

Continuation of the designated Performance Review Body

The Performance Review Body designated in Decision of the Standing Committee of the EFTA States No. 1/2021/SC of 18 March 2021 shall continue to exercise its functions as laid out in that Decision until 2 June 2025.

Article 2

Advisory role

The EFTA Surveillance Authority may continue to consult the Performance Review Body on any matter relating to the performance of air navigation services and network functions in the single European sky.

Article 3

Liechtenstein

This Decision shall not apply to Liechtenstein.

Article 4

Publication

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

Article 5

Entry into force and application

This Decision shall enter into force on 6 February 2025 and shall apply from 1 January 2025 until 2 June 2025.
